2 Item 1.0 MINUTES OF THE MEETING OF THE LOS ANGELES HOMELESS SERVICES AUTHORITY POLICY & PLANNING COMMITTEE Held on Friday, January 17, 2014 The Los Angeles Homeless Services Authority Commission Policy and Planning Committee meeting held at 811 Wilshire Blvd, 6 th Floor, Los Angeles, California was called to order at 10:08 a.m. by Commissioner Krisiloff. Motion: Commissioner Krisiloff moved and Commissioner Neely seconded approval of the minutes with the clarification as requested by Commissioner Krisiloff. Public Speaker(s): There were no public speakers. Action: The motion passed unanimously. 2.0 Update on Federal, State, and Local Policy: Presentation on the Affordable Care Act. Leslie Clarke, United Homeless Healthcare Partners, gave the report: Ms. Clarke explained some of the points of the Affordable Care Act, how it can help individuals experiencing homelessness as shown in the provided presentation and what UHHP is doing to assist individuals get enrolled. Commissioner Neely expressed concern about outreach in South Los Angeles and asked what would be done to address the different issues of minority males as opposed to women with children. Ms. Clarke says that shifting focus from enrollment to an analysis of capacity for service provision will be necessary. Clementina Verjan, Policy & Planning Manager, and Michael Arnold, Executive Director, explained the change in the Federal chronically homeless definition, as requested by Commissioner Krisiloff. Public Speaker(s): There were no public speakers. 3.0 Report and discussion on FY 2013-FY 2014 Continuum of Care Program Competition Application Review of NOFA and HUD Priorities.

3 Policy and Planning Committee Minutes of January 17, 2014 Clementina Verjan, Policy & Planning Manager, and Josh Decell, Outcomes Unit Manager, gave the report: Commissioner Krisiloff explained that the committee is not taking action on the priority ranking today and shared that the results of the rankings adopted by the Commission are disappointing. Commissioner Neely reiterated that he disagrees with the Commission decision and wants to respect the input of the Coordinating Council. Commissioner Krisiloff believes that the Policy & Planning Committee should review HUD s priorities more closely. Staff reviewed scoring information and policy priorities for the NOFA as shown in the provided presentation. Michael Arnold explained some of the challenging scoring areas faced by the Los Angeles Continuum of Care. Commissioner Krisiloff requested that the Policy & Planning Committee work on the strategic planning for the Continuum. Josh Decell, Outcomes Unit Manager, gave an overview of the scoring criteria for permanent supportive housing (PSH) programs. Commissioner Krisiloff noted that the evaluation tool misses tracking chronically homeless individuals and planning. Mr. Arnold explained that scores come from the APR which is designed and required by HUD, but since the data comes from HMIS, chronicity level can be determined. Commissioner Krisiloff requested a list of items to review regarding chronic homelessness. Mr. Arnold suggested a matrix of the NOFA focus items and quarterly review of status on each item. Clementina Verjan provided a map of outreach and access points. Mr. Arnold suggested a future conversation and action item regarding building boundaries around elements of core infrastructure and how to apply policies. Commissioner Neely requested that the map be color coded to better indicate the difference between outreach and access. Public Speaker: Dr. Micheal Williams stated that it s critical that the commission reconsider the priorities approved at the last meeting and that the recommendation of the Coordinating Council. Public Speaker: Michael Nailat agreed that the recommendation of the Coordinating Council is the closest to the HUD priorities and hopes these issues will be taken to the Commission. Public Speaker: Mike Alvidrez commended the committee on earlier comments. He agrees with the previous speakers and the letter of the coordinating council. He offered to assist providers to improve performance. Public Speaker: David Howden expressed concern that the priorities adopted by the Commission do not reflect those shared by the Coordinating Council and HUD and hopes the decision will be reconsidered. Commissioner Neely thanked the community for participating and sharing their opinions on the priorities. 4.0 Update on status of 2014 Homeless Count. Clementina Verjan, Policy and Planning Manager, gave the report: Staff shared information on the 2014 Point in Time Homeless Count. The demographic proposal was submitted on January 2 and rejected on January 14. LAHSA was invited to submit a second proposal and will have a discussion with HUD on January 24 regarding the reasons for rejection of the proposal. Interviews for personnel will begin on January 22, so that in the event that the second application is accepted, LAHSA can move forward with hiring. There was discussion around the specifics of the proposals. Public Speaker(s): There were no public speakers. 5.0 Public Participation Public Speaker: Jessica Ahearn noted that many homeless individuals are undocumented and ineligible for services under the Affordable Care Act. 4 Policy: APR Submission Policy for Continuum of Care Program Grantees Submitted By : Josh Decell, Outcomes Unit Manager Continuum of Care Policies and Procedures Approved: Pending General: Each year, the Department of Housing and Urban Development (HUD) releases a Notice of Funding Availability (NOFA) for the Continuum of Care (CoC) Program Competition. As the Collaborative Applicant for the Los Angeles CoC, LAHSA must collect Annual Performance Reports (APRs) for each project awarded funding in the previous year, and use APR data to respond to a number of questions included in the CoC Application. Every CoC project must submit an APR to HUD within 90 days after the close of the operating year. In prior years, LAHSA has requested that CoC Program grantees submit the previous year s APRs in the 1-2 months prior to the anticipated release of the NOFA. This data collection procedure is no longer sustainable given the heightened focus on performance monitoring and evaluation (24 CFR 578.7(a)(6) and (7)). As the collaborative applicant, LAHSA needs the ability to collect and evaluate APR data throughout the year in order to (1) annually evaluate all projects funded through CoC Program, (2) provide regular and complete reports of CoC Program fiscal and programmatic performance, and (3) distribute the workload required for data collection and aggregation across the calendar year. Policy: For all CoC Program projects, grantees are required to submit a copy of the final HUD APR submission to the CoC Collaborative Applicant (LAHSA) within 90 days after the end of the operating year. This requirement may only be waived in the case that the grantee is given an extension by HUD, in which case the grantee must submit documentation that the HUD deadline has been extended prior to the 90-day deadline. In the case that an extension has been granted, the grantee will submit the report the Collaborative Applicant by the HUD extension deadline. CoC projects that do not submit an APR to the collaborative applicant within the required time frame may be subject to a decreased renewal evaluation score and/or lower prioritization in the CoC Priority Listing. 30 Federal Position Legislation Overview Status Change since last P&P Meeting Support HEARTH Act - Interim Regulation Act of 2009 (HEARTH Act), enacted into law on May 20, 2009, consolidates three of the separate homeless assistance programs administered by HUD under the McKinney-Vento Homeless Assistance Act into a single grant program, and revises the Emergency Shelter Grants program and renames it the Emergency Solutions Grants program. The HEARTH Act also codifies into law the Continuum of Care planning process, a longstanding part of HUD s application process to assist homeless persons by providing greater coordination in responding to their needs. The HEARTH Act also directs HUD to promulgate regulations for these new programs and processes. Monthly Legislative Report March 21, 2014 LAHSA and many other Continuum of Cares (CoCs), homeless service providers, and homeless persons advocates throughout the country submitted comments on the HEARTH Act - Interim Regulation on or before November 16, HUD has not responded to comments or issued any changes of the Interim Regulation to date. Given the large number of commenters, a response is not anticipated until later in 2013, perhaps the summer or fall. No Change. The interim regulation was published in the Federal Register on July 31, 2012 and became effective August 30, The public comment period closed on November 16, Federal Provided Comments Chronically Homeless Definition On March 27, 2013, HUD released revisions to the definition of "Chronically Homeless" along with the Rural Housing Assistance Program Interim Rule. Since passage of the HEARTH Act and with subsequent releases of of the interim rules for the ESG, Consolidated Plan and CoC programs. On May 30, 2012, HUD convened an informal gathering of nationally recognized experts involved in homelessness to seek individual views and suggestions on the definition. HUD reached out to USICH and to several CoC leads. Based on this feedback, along with comments received HUD is submitting for additional public comment the following revised CH definition: has been homeless and living or residing in a place not meant for human habitation, a safe haven, or in an emergency shelter continuously for at least one year or on at least four separate occasions in the last 3 years, where the cumulative total of the four occasions is at least one year. Stays in institutions of 90 days or less will not constitute a break in homelessness, but rather such stays are included in the cumulative total. Rationale: HUD believes the revised definition better targets persons with the longest histories of homelessness and therefore the highest level of need and also allows for limited resources to be more effectively targeted. The duration of one year was chosen to to be consistent with section 401(2)(A)(ii) of the HEARTH Act, which discusses a one year timeframe, and based on consensus from the participants in the expert convening. Comment letter was transmitted to HUD on May 28, Starting with the FY2013 CoC Program Competition, HUD will begin looking to CoCs and recipients of CoC Program PSH funds to move away from a first come, first served approach to filling PSH vacancies. Instead, available PSH units should first be offered to persons who are chronically homeless and who meet the other criteria required by the program. No Change Federal Support Housing and Economic Recovery Act, establishing a National Housing Trust Fund & H.R In July 2008, the Housing and Economic Recovery Act was signed into law, establishing a National Housing Trust Fund (NHTF), among other housing-related provisions. On February 1, 2011, the President announced a Housing Plan, which includes the $1 billion capitalization needed to fund the National Housing Trust Fund. The plan aims to assist homeowners and renters struggling to afford their housing. The President also included $1 billion for the NHTF in his fiscal year (FY) 2013, FY 2012, FY 2011 and FY 2010 congressional budget requests. The purposes of the NHTF are to increase and preserve the supply of rental housing that is affordable for extremely and very low-income households, including people experiencing homelessness, and increase homeownership opportunities for those households. This Act has not yet been approved for funding. In March of this year, the United for Homes Campaign achieved a major milestone when Representative Keith Ellison (D-MN) introduced H.R. 1213, the Common Sense Housing Investment Act of The bill: 1. Lowers the cap on the amount of mortgage for which interest can be deducted from $1 million to $500,000, and allow home equity loans and second homes under the $500,000 cap. 2. Converts the mortgage interest deduction to a 15% non-refundable mortgage interest tax credit. 3. Phases these changes in over five years. 4. Directs the resulting revenue of approximately $196 billion over ten years to the National Housing Trust Fund ($109 billion), the LIHTC ($14 billion), Section 8 ($54 billion), and the Public Housing Capital Fund ($18 billion). USICH has recently signed on as a supporter of this bill. President Obama included $1 billion one-time funding for the Trust Fund in his annual budget submitted to Congress on March 4. State Support AB California Interagency Council on Homelessness Assembly Bill 998 creates an Interagency Council on Homelessness, a collaborative of state agencies and community organizations to coordinate a statewide approach to address homelessness. Using existing resources, the purpose of the council is to establish California s eligibility for federal funding, streamline the administration of programs, improve efficiency, and a cohesive process. Assembly Bill (AB) 998 passed the Assembly Committee on Housing and Development with bi-partisan support on April 17, A letter of support was sent by LAHSA in May Held under submission after second hearing May 24. No change. 1

31 Monthly Legislative Report March 21, 2014 Position Legislation Overview Status Change since last P&P Meeting State Support SB California Homes and Jobs Act of 2013 Senator Mark DeSaulnier (D-Concord) introduced Senate Bill 391, the California Homes and Jobs Act of 2013 to spur job creation, boost California's business competitiveness, and build affordable homes for Californians. Principal co-authors are Assemblymembers Toni Atkins and Raul Bocanegra and co-authors are Senators Lou Correa, Jerry Hill, Mark Leno, Ted Lieu, Fran Pavley, and Assemblymembers Tom Ammiano, Richard Bloom, Susan Bonilla, Rich Gordon, Kevin Mullin, Sharon Quirk-Silva, and Norma Torres. The Bill aims to secure an estimated $500 million in annual state investment and raise billions more in federal and bank funding to build affordable homes, two-thirds of the state legislators are needed to vote YES for SB 391. A July 31, 2013, amendment states that the bill supports "homelessness prevention and rapid rehousing services; state inderdepartmental coordination of new and or existing resources to reduce homelessness" amongst other housing-related items. The amended bill also includes that an annual report to the legislature be prepared that includes the following language: "With respect to any awards made specifically to house or suport persons who are homeless or at-risk of homelessness, the report shall include an analysis of the effectiveness of the funding in allowing these households to retain permanent housing. On June 14 the bill was referred to the Assembly Housing and Community Development Committee (HCDC) and the Labor and Employment Committee. Scheduled for heaing in the HCDC on August 12, Now a 2-year bill - will remain on the Assembly Appropriations Committee s calendar while work is done to strengthen the bill and move it forward early in Housing and Homeless Advocates are actively campaigning to push the bill through Assembly Appropriations in some time in April. LAHSA Commission sent support letter in May of 2013 and signed onto petition in favor. LAHSA staff participating in campaign activities to help move bill through Assembly Approrpriations. City of LA Oppose Los Angeles City Community Care Facilities Ordinance The Community Care Facilities Ordinance requires that in a neighborhood zoned for single family homes and duplexes, a home can have only one lease. If a home has three or more leases, such as where two families are sharing or where a person with disabilities is living in shared housing, the ordinance would categorize the home as a boarding house. Under current law, boarding houses are prohibited in residential zones. Thus, by categorizing all homes with multiple leases as boarding houses, the ordinance would in effect eliminate shared housing in these residential zones. The City Council sent the proposed ordinance to a working group composed of Councilmembers Mitchell Englander, Richard Alarcon, and Ed Reyes, a City Attorney representative, Chief Legislative Analyst representative, Department of City Planning representative, Department of Building and Safety representative, and Los Angeles Housing Department representative to review the ordinance and report back to the City Council. Mayor Garcetti and some of the new City Councilmembers for the City of Los Angeles have indicated that they do not support the CCFO in its current form. LAHSA staff will follow the progress of this ordinance, an updated ordiance, or any other actions related to this item and report back to the Committee. New Ad Hoc City Council Committee began meeting in January Members include Englander, Fuentes, Bonin, Price and Huizar. The Committee is looking at what types of legislation other jurisdictions have in place to address nuisance property owners, how the City might improve its current nuisance abatement process and to determine how the current proposal can be amended to alieviate negative impacts on PSH and other types of shared housing located and operating in single family zones within the city (R1 and R2). LAHSA staff is working with LAHCID to provide data and recommendations as requested. 2
