Proposal Request The San Diego Local Agency Formation Commission (LAFCO) is in receipt of a jurisdictional change proposal filed by the Julian-Cuyamaca FPD. The proposal seeks dissolution of Julian-Cuyamaca FPD and conditioned by the Board on a concurrent approval by LAFCO to expand County Service Area (CSA) No. 135's latent power to assume fire protection and related emergency medical services within affected territory. Concurrent sphere amendments will be required for Julian-Cuyamaca FPD and expand the designation for CSA No The affected territory spans approximately 52, 100 acres with an estimated resident population of 3,562 with the majority located with the unincorporated community of Julian. It is anticipated CSA No. 135 will formally consider the referenced latent power expansion request for submittal to LAFCO on May 15, A copy of the key proposal materials is attached. II. Proposal Purpose I The purpose of the proposal is to transfer all fire \protection and related emergency medical services within the affected territory from Julian-Cuyamaca FPD to the County Fire Authority through its administrative surrogate, CSA No Julian-Cuyamaca FPD has self-conditioned the proposal to dissolve on CSA No. 135 concurrently requesting and receiving LAFCO approval to expand its latent power authority to provide fire prote'ctlon s~rvices within the affected territory. In adopting the resolution of application, Julian-Cuyama~D listed three specific justifications for the proposal: --- 1) Ensure continuity of fire protection and emergency medical service in the affected territory;

Ill. LAFCO Considerations An initial review of the proposal identifies the following pertinent item(s) germane to LAFCO staff's review and ahead of the Commission's deliberations: 8pplicabili.ty of Government Code Section 5688~Uerms; Successor Agency~_s_) This code section is specific to LAFCO's authority and duty to establish approval terms as appropriate. This includes - and among other germane items - designating one or more successor agencies to assume services as well as other related functions, such as receiving any remaining assets and liabilities of a dissolved special district. If applicable, LAFCO may waive this determination if it concurrently approves a condition requiring the establishment of new and/or expanded revenues - such as a tax or fee. IV. WHEREAS, the proposed dissolution of JCFPD is contingent upon the designation of CSA No. 135 as successor to JCFPD to deliver at least all of the JCFPD services at levels no less than those provided by JCFPD on the day immediately prior to the effective date of the proposed dissolution; and NOW, THEREFORE, BE IT RESOLVED, that this Resolution of Application is hereby approved and adopted by the Board of Directors of the Julian-Cuyamaca Fire Protection District. BE IT FURTHER RESOLVED, that the Local Agency Formation Commission of San Diego County is hereby requested to undertake such proceedings for the proposed change of organization of the JCFPD that includes the territory as described in Attachment A according to the terms and

6 APPLICATION FOR EXPANSION OF LATENT POWERS IN ASSOCIATION WITH SPECIAL DISTRICT DISSOLUTION Application is hereby jointly made to San Diego Local Agency Formation Commission (LAFCO} to: 1. Amend the sphere of influence for the JCFPD to a transitional (zero) designation. 2. Amend the sphere of influence for the fire and EMS latent powers area of CSA No. 135 to include the territory within the former JCFPD. 3. Dissolve JCFPD. (Note: JCFPD is responsible for adopting the resolution of application for this jurisdictional change). 4. Expansion of the fire and EMS latent powers area within CSA No (Note: The County of San Diego is responsible for adopting the resolution of application for this jurisdictional change). As a part of this application for EXPANSION OF CSA No. 135's LATENT POWERS IN ASSOCIATION WITH DISSOLUTION OF THE JULIAN/CUYAMACA FIRE PROTECTION DISTRICT (JCFPD} as applicants, agree to defend, indemnify, hold harmless, and release the San Diego LAFCO, its agents, officers, attorneys, and employees from any claim, action, or proceeding brought against any of them, the purpose of which is to attack, set aside, void, or annul the approval of this application or adoption of the environmental document which accompanies it. Respond with NA to items that do not apply. GENERAL INFORMATION 1. Why is EXPANSION OF LATENT POWERS IN ASSOCIATION WITH SPECIAL DISTRICT DISSOLUTION proposed? (1) To ensure continuity of fire protection and emergency medical service for the territory of the former JCFPD; (2) To ensure the long-term security of fire protection service to the communities within the territory of JCFPD; and (3) To eliminate duplication of management, administration, and oversight associated with the operation of multiple Special Districts providing the same service. 2. Identify existing dispatch.providers and discuss all changes in providers or-amendments to - existing communications agreements that would be required to accommodate the proposal. CAL FIRE San Diego dispatches JCFPD and CSA 135. There will be no change with the latent powers area expansion and district dissolution, and therefore no changes to communications agreements. Monte Vista lnteragency Communications Center 2249 Jamacha Rd, El Cajon, CA Describe any proposed changes to paramedic service, which would be required as a result of the proposal. Currently, Paramedic (ALS) Service is provided out of fourteen CSA 135 Career Stations. Within the next year, Paramedic Service will be added at Julian Station 56 (bringing the total ALS stations in CSA 135 to fifteen). This service will be in place by July 30, Thus, there will be an increase in the level of paramedic service resulting from the LAFCO process. 8 4. How would the proposal affect exclusive operating areas (EOA) for the subject districts? There will be no change to the exclusive operating areas for the subject districts resulting from the LAFCO process. The Ambulance Contract between the County and JCFPD expires June 30, JCFPD may exercise an early termination or initiate a subcontract, whereby the County EMS/County Fire would contract with another service provider for the existing EOA until the Unified Service Area is put into place. 5. Please identify current and proposed staffing: Currently, JCFPD Volunteer Firefighters staff the Julian Station as available. Within the next year, Paramedic Service is proposed for Julian Station 56. List specific position classifications for all additional personnel that would be hired as a result of consolidation or reorganization. No additional personnel will be hired as a result of the latent powers expansion and district dissolution. Admin personnel currently employed by JCFPD will be offered the opportunity of employment by the County, CAL FIRE, or a contract agency/service provider. Ambulance personnel currently employed by JCFPD will be offered employment by a contract agency/service provider. San Diego County, through the CAL FIRE agreement, will add 6 personnel to staff the paramedic engine in Julian. 7. Describe if there are any retirement liabilities that would result from the proposal and how liabilities would be addressed. There are no retirement liabilities resulting from the latent powers expansion and district dissolution. 8. List services currently provided and services that the reorganized agency would provide: An overall Basic Life Support {BLS) level of service is currently provided by the volunteers staffing the stations within the district. 9 proposed for Julian Station 56, should the reorganization occur. This added service will be in place by July 30, Fire prevention services are currently provided by the County and will continue after dissolution. The ALS EMS Ambulance Contract between the County and JCFPD expires June 30, JCFPD may exercise an early termination or initiate a subcontract, whereby the County EMS/County Fire would contract with another service provider for the existing EOA until the Unified Service Area is put into place. 9. Briefly discuss any new service that would be provided within the reorganized district. CSA 135 will add a first-response paramedic fire engine in Julian and a basic life support career-staffed fire engine in Cuyamaca. 10. List existing automatic and mutual agreements and indicate which agreements may need to be amended to facilitate reorganization. County Service Area 135 surrounds the JCFPD. There will be no need for new or amended automatic or mutual aid agreements. 11. Describe the governance structure of each district; include number of directors, whether elected or appointed, and terms of office. Discuss whether former FPD board members will have any formal advisory role after reorganization. Discuss how the proposal will affect opportunities for furthering efficiencies, such as usage of joint powers agreements, joint powers authorities, regional planning opportunities, etc. List current shared activities with other service providers, including shared facilities and staff and the reorganized district is planning to provide. Discuss how the proposal will further these efforts. The proposal will provide opportunities for organizational efficiencies. The reorganization will combine administrative and operational resources from JCFPD and CSA 135. In addition, fleet services and equipment management will be consolidated through a logistical support unit. 11 17. Briefly discuss the anticipated ISO rating for the reorganized agency and the ISO process for reevaluating the consolidated service area. ISO ratings help establish appropriate fire insurance premiums for residential and commercial properties. ISO assigns classifications ranging from 1 to 10. Class 1 generally represents superior property fire protection, and Class 10 indicates that the area's fire-suppression program doesn't meet ISO's minimum criteria. See Table One - It is anticipated that the ISO rating will improve from a 5/9 to a 3/X. 18. Describe prevalent land uses in each district; list predominant General Plan designations: See Table One. 19. Briefly discuss all development or change in land-use that the proposal would allow. There is no change in development or land-use proposed that would occur as a result of the reorganization. 20. What sphere of influence is proposed for the reorganized agency? The Structural Fire I EMS Sphere of Influence will generally be coterminous with the boundary of the CSA 135 latent powers area. Because CSA 135 surrounds the district, no changes 1:0 the current sphere ottnfluenc e-ofthe.. dfai.iolve d-disfrlct boundades are anticipated as a result of the reorganization. 21. Discuss the ability of the reorganized district to provide services to all territory within the district's sphere of influence. Include a discussion of the cost to extend services. CAL FIRE MVU dispatches JCFPD, and the latent powers area of CSA 135. There will be no change with the reorganized district. CAL FIRE uses the closest resource concept for dispatch which would extend to any areas within the sphere of influence. There will be no additional cost to extend services to these areas beyond the addition of the ALS Engine currently proposed. 22. Briefly explain how each districts' operations have been financed; list major revenue sources and identify the percent of operational funding which each source represents. JCFPD: Property tax 50%, Voter-Approved Assessments (50%); CSA No. 135: Property tax (50%), General Purpose Revenue (50%); SDCFA: General Purpose Revenue {90%), Grants {10%). 12 23. List special taxes approved by voters within each district. If the reorganized agency will continue to levy voter-approved taxes, explain restrictions and processes concerning collection and expenditure of special tax revenue. There are currently two voter approved special tax assessments collected by the district. The County will pay this fire station debt and the fund will be discontinued. Fund is used to pay for structural fire protection and will continue after dissolution. The special tax levies collected will be used to serve the residents within the geographic areas from which they are collected. Discrete funds will be created for each tax to allow differentiation and use of the taxes to provide services to the residents within the respective voter approved assessment areas. 24. 13 SUPPLEMENTAL FISCAL AND GENERAL INFORMATION For the questions in this section, please submit answers on additional pages, indicate who provided the information, and attach the pages to this form. 1. Per requirements in Government Code Section 56653, submit with this application a plan for providing services within the affected territory. At a minimum the plan for services must include: (1) An enumeration and description of the services to be provided; (2) The level and range of services to be provided; {3} An indication of when services can be feasibly extended to the reorganization territory; (4) An indication of any improvements or upgrades of facilities that the reorganized agency will make or require; and (5) Information with respect to how services will be financed. A plan for service is included in Attachment A. 2. Provide a copy of each district's: adopted budgets and staffing schedules for the current and previous fiscal-year and the most recent audits, Capital Improvement Programs, Master Service Plans, and a copy of a five-year proposed budget and staffing schedule for the consolidated/reorganized agency detailing expenditures, anticipated revenues, and reserves. 3. Explain how operations for each district have been financed and include a narrative summary of all sources of revenues and expenditures. Cite the fiscal year for the data and indicate how the --sources of revenue and associated expenditures will -change with consolidation/reorganization. If new opportunities for additional revenue will result from the proposal (e.g., joint agency grant applications, etc.) please elaborate. See response to Application for Special District Dissolution # Describe any voter-approved charges or taxes that each district currently levies, and indicate if the successor district would continue to levy them after this change of organization. See response to Application for Special District Dissolution # Discuss the opportunities for improved service delivery associated with proposed changes in government organization through merging staff, staff reduction/attrition, phasing out of positions, etc. See response to Application for Special District Dissolution # What will be the major source(s) of funding for the successor district? The Board of Supervisors provides General Purpose Revenue to fund the Fire Authority. In addition, a small portion of the fire and emergency medical services are funded through property taxes. 14 7. Indicate if the successor district plans to establish improvement districts as a mechanism to continue the collection of fees and taxes in each former district's territory. If the proposed improvement district has different boundaries than the former district, provide a map and legal description. If improvement districts or tax zones are proposed to be formed, explain the rationale used to determine the boundaries and associated benefit fees, taxes, or assessments. There are no plans to establish new improvement districts as a result of the proposed consolidation/ reorganization. Within Julian/Cuyamaca Fire Protection District (JCFPD), there are two voter-approved fixed charge special assessments/ tax levies. The special tax levies collected will be used to serve the residents within the geographic areas from which they are collected. Discrete funds will be created for each tax to allow differentiation and use of the taxes only within the respective voter approved assessment areas. The existing boundaries will remain the same and there are no sunset provisions for these taxes. 8. If the successor district proposes to levy additional fees or taxes as a result of this proposal, indicate how those costs will be levied, and what the cost will be for each resident/service user. San Diego County Fire has adopted response time goals for fire and emergency medical services that utilize four regional categories identified by land use designation and population density: Urban, Rural, Outlying, and some hard to serve or extreme outlying areas defined as Desert. These regional categories are consistent with the San Diego County General Plan for Safety definition for travel time standards for fire protection services. These same standards will be applied to the area currently served by JCFPD, with the expectation that the Department meet these performance standards on 80% of all code 3 emergency incidents. The adopted standards are defined below. Call Processing Time: The San Diego County Fire and EMS Dispatch Center has established a call processing time standard of 1 minute 20 seconds (01:20). This time standard begins at the time the call is received at the Secondary Public Safety Answer Point (PSAP) and includes the call taking, call processing, and queue time. This time standard ends when the incident is ready to be dispatched. Station Alerting and Turn Out Time: San Diego County Fire has established a station alerting and turn out time standard of 1 minute and 40 seconds (01:40) for all code 3 incidents. This time standard begins at the time of dispatch and includes station alerting, fire station acknowledgment, and personnel preparation for response. This time standard ends when the personnel and apparatus are responding.! Travel Time: San Diego County Fire has established a travel time standard for all code 3 : incidents dependent on the regional category. For Urban area incidents, the standard is S minutes (05:00), Rural area incidents is 10 minutes {10:00), Outlying area incidents is 20 minutes {20:00), and Desert area incidents is 45 minutes {45:00). This time standard begins when the personnel and apparatus are responding and includes the travel time to the scene of the emergency incident. This time standard ends when the unit arrives on scene at the emergency. Total Response Time: Total Response Time is the sum of each of the above parts. A key element of this system is having resources allocated in such a way that they are capable of arriving on scene, ready to mitigate an emergency within established performance standards. To achieve this San Diego County Fire always dispatches the closest available resource, regardless of jurisdiction or boundaries, to an emergency incident. The closest available resource is determined through the use of an Automatic Vehicle Locator (AVL) and is supported through Mutual and Automatic Aid agreements with surrounding agencies ffts.importanito note.tha(the exis.1:ing Jci=f56servlce a rea.fs aimost exduslve.ivliordered by County Fire service area; County Fire staffs two 24/7 ALS engines capable of reaching the JCFPD service area within 10 minutes and three 24/7 ALS engines capable of reaching the JCFPD service area within 20 minutes. Additionally, through its partnership with the State of California, County Fire makes use of three BLS engines within the JCFPD service area and two BLS engines capable of reaching the JCFPD service area within 20 minutes. In total, there are twelve fire stations within 30 minutes of the JCFPD service area capable of offering support on a major emergency incident or to ensure that "move up and cover" service area coverage is available during an extended incident. Julian has been identified by San Diego County Fire as a must cover station. This means that when the primary engine is predicted to be committed to an incident for 30 minutes or longer, a second engine is "moved up" from a surrounding community to provide service area coverage and respond to the next emergency incident. During major incidents, all engines within the Cooperative Regional Fire Protection System are strategically located to provide the greatest level of service possible. The County/ latent powers area of CSA 135 shall be the successor to all assets, liabilities and service responsibilities of the dissolved districts, including land, equipment, vehicles, contractual rights and obligations, materials, supplies and all monies, including cash on hand, monies due but not collected, and other obligations. 17 ATTACHMENT A Plan for Service (1) An enumeration and description of the services to be provided; Structural Fire Protection and Emergency Medical Services: Staffing will increase over the levels today: Paramedic Service will begin on July 30, 2018 at Julian Fire Station 56, where the County will place a full time, year-round staffed Paramedic Fire Engine. The County will also provide winter funding to maintain an Expanded Scope Basic Life Support Fire Engine at CAL FIRE Cuyamaca Fire Station 51 year-round. As of the effective date, equipment will be housed at CAL FIRE Cuyamaca Station 51. Fire Prevention Services: Fire prevention services are currently provided under contract by the County and will continue after dissolution. (2) The level and range of services to be provided; County Fire will implement ALS service for Julian Station 56, bringing the total number of County Fire ALS stations up to fifteen. Staffing is 24-hour coverage, seven days per week, 365 days per year. The County will ensure a Battalion Chief is on duty in Battalion 5 (Julian) 24 hours per day. The County will ensure that an ambulance is stationed in Julian. (3) An indication of when services can be feasibly extended to the reorganization territory; Services within the affected territory are provided today through the JCFPD volunteer firefighters. No change to the services is anticipated. Paramedic Service will begin on July 30, 2018 at Julian Fire Station 56. Fire prevention services are currently provided under contract by the County and will continue after dissolution. (4) An indication of any improvements or upgrades of facilities that the reorganized agency will make or require; The Julian Fire Station is newly constructed. No significant improvements will be needed as a result ofthe LAFCO process. 18 The services will be financed using District and the CSA No. 135 Latent Powers Subarea existing funding (Property Tax Revenue, County General Purpose Revenue, and Special Benefit Fees). It is anticipated that the funding will continue to be budgeted within the same categories of services after the reorganization is complete. (6) The total estimated cost to provide the new or different function or class of services within the special district's jurisdictional boundaries. Tables 1 and 2 below provide the five-year budgets of CSA 135 and the County Fire Authority. (7) An identification of existing providers, if any, of the new or different function or class of services proposed to be provided and the potential fiscal impact to the customers of those existing providers. Fire and emergency medical services are currently provided within the Julian/Cuyamaca Fire Protection District by volunteer firefighters. Under this proposal, these services will be provided by CAL FIRE employees under contract with the County of San Diego and County Reserve firefighters. (8) The plan for service involves the activation of latent powers as exercised in the following resolutions: [TITLE OFtOUNTY BOARD-OF SUPERVISORS RESOLUTION] (9) A plan for financing the establishment of the new or different function or class of services within the special district's jurisdictional boundaries. See question (6) above. Financing will be provided through property tax assessment revenue allocated through the County's annual budgeting process. (10) Alternatives for the establishment of the new or different functions or class of services within the special district's' jurisdictional boundaries. An alternative to the proposal could be for the Fire Protection District to remain. This will result in a loss of the County funding provided to the District, with a resulting reduction in fire and emergency medical services to the area. 19 EXHIBIT B Terms and Conditions RECOMMENDED TERMS AND CONDITIONS Dissolution of Julian/Cuyamaca Fire Protection District and Expansion of Latent Powers of County Service Area 135 (San Diego County Regional Communications System/ Fire Protection) to Provide Structural Fire Protection and Emergency Medical Services within the Service-Specific Area 1. Prohibition on Dissolved Agency. Upon the Commission's order giving approval to the dissolution of the Julian/Cuyamaca Fire Protection District {hereafter referred to as JCFPD), the FPO is prohibited from taking any of the actions contained in Government Code Section , including: (a) Approving any increase in compensation or benefits for members of the governing board, its officers, or the executive officer of the agency. (b) Appropriating, encumbering, expending, or otherwise obligating, any revenue of the agency beyond that provided in the current budget at the time the dissolution is approved by the commission. 2. Successor Agency. Upon and after the Effective Date, CSA No. 135 shall be the successor to JCFPD for purpose of providing structural fire protection and emergency medical services, and succeeding to all of the rights, duties, and obligations of the extinguished district with respect to enforcement, performance, or payment of any outstanding bonds, including revenue bonds, or other contracts and o61igati0ns witnin thederrifory prevfousl{irieluded within the extin.ifliished disfriet(governmenf Code Sections et seq., and 56886(m). 3. Employees. As of the effective date, the District Secretary shall be offered equivalent employment as determined by the County with the County, CSA No. 135, or through a contract with another agency/service provider. (Government Code Section 56886(1). 4. Organization and Governance. The dissolved fire protection district will become part of the fire protection and emergency medical services subarea of CSA No CSA No. 135 is governed by the five-member Board of Supervisors and the Deputy County Administrative Officer for the Public Safety Group will serve as the Fire Warden. Operationally, the County of San Diego will continue to contract with CAL FIRE to provide services. A seven-member fire advisory board has been created in accordance with County Board Policy A-74. [Government Code Section 56886{k)] 5. Transfer by Operation of Law. If the proposed jurisdictional changes are approved by LAFCO, then as of the effective date, CSA No. 135 shall have ownership, possession, and control of all books, records, papers, offices, equipment, supplies, moneys, funds, appropriations, licenses, permits, entitlements, agreements, contracts, claims, judgments, land, and other assets and property, real or personal, owned or leased by, connected with the administration of, or held for the benefit or use of, JCFPD. Refer to Exhibit B containing a list of assets, property ownership, leases, and contractual obligations. The County of San Diego, on behalf of CSA No. 135, shall be the successor to all assets, liabilities, and service responsibilities of the dissolved district, including but not limited to, land, equipment, vehicles, contractual rights and obligations, materials, and supplies. 20 the successor to all monies, including cash on hand, monies due but not collected and other obligations. The County of San Diego, on behalf of CSA No. 135, shall be the successor to all liabilities and service responsibilities of the dissolved district, including, but limited to land, equipment, vehicles, contractual rights and obligations, materials, supplies and all accounts payable and other obligations. Exhibit B on file in the LAFCO office lists improved and unimproved land owned by JCFPD prior to the Effective Date and to be owned by CSA No.135 on and after the Effective Date. Exhibit B also lists Real Property Lease (Easement) to which JCFPD is bound as landlord or tenant prior to the Effective Date and which bind CSA No.135 on and after the Effective Date. Exhibit B lists contracts binding upon JCFPD prior to Effective Date and to be binding upon CSA No. 135 after the Effective Date. 6. Tax Revenues. Upon the Effective Date, the legal existence of JCFPD shall cease, except as otherwise required by law and the Resolution of the Board of JCFPD's governing board adopting these terms and conditions to the Matter. All property tax revenues and voter-approved special tax or special assessment revenues (if any), received or receivable by JCFPD as of the Effective Date shall be collected or collectible by CSA No. 135 for the exclusive use of funding the Services within the Territory. CSA No. 135 property taxes, special taxes, and special assessments shall not be available for other CSA No. 135 or County purposes. 7. Plan for Service. CSA No. 135 shall provide the services within the territory provided by JCFPD per the Plan for Services adopted by the County of San Diego. CSA No. 135 will provide a Paramedic Fire Engine in Julian at Fire Station #56. CSA No. 135 will fund the year-round staffing of CAL FIRE Cuyamaca Fire Station #51 with an expanded scope BLS Fire Engine. Julian Fire Station #56 will be considered a must-cover priority #1 station subject to the 30-minute move up. Levels of Services may improve or increase prior to the day immediately preceding the Effective Date. 8. Transfer in "As-ls" Condition. CSA No. 135 shall accept all real and personal property, books, records, papers, offices, equipment, supplies, moneys, funds, appropriations, licenses, permits, entitlements, agreements, contracts, claims, judgments, and all other assets and obligations transferred from JCFPD in "as-is" condition, without any payment or repair obligation from JCFPD [Government Code Section 56886(h)]. All incidental liabilities, such as accounts payable, contract obligations and consumer deposits, shall be transferred to CSA No.135's appropriate, respective, isolated accounts. Alf assets including, but not limited to cash reserves, land, structures, appurtenances, rolling stock, personal property including tools, office furniture, fixtures and equipment, and held by JCFPD, shall be transferred to the appropriate services zone of CSA No.135 as of the Effective Date. 9. Property Tax Transfer. Prior to issuance of the Certificate of Filing for the Matter, the County Board of Supervisors, as the governing body for CSA No. 135, shall commence and complete a property tax transfer process, as outlined in Revenue and Taxation Code Section et seq , to transfer the fire related ad valorem property tax revenues to CSA No [Government Code Section 56886(s)] 10. Transfer of Facilities. Upon the Effective Date, the facilities located at the real properties identified on Exhibit B of Julian-Cuyamaca Application shall be transferred to CSA No.135 for use in providing the Services. The facility in the community of Cuyamaca will not be transferred and will be disposed of by the JCFPD prior to the effective date of dissolution. 11. Insurance Service Office (ISO) Ratings. CSA No. 135 will petition the ISO to update Julian's former 5/9 rating of properties within the Territory to the County's 3/3x ISO rating. Julian/Cuyamaca Fire Protection District maintains a class 5/9 ISO Fire Department rating. 21 12. Explorer Program. CSA No. 135 shall assume and continue support for Julian/Cuyamaca Explorer Program in place on the day immediately preceding the Effective Date. 13. Community Events. County and/or state firefighters stationed in Julian will participate in community events as requested. 14. District Firefighters. Upon successful completion of medical and background screening, JCFPD volunteer firefighters shall be offered reserve positions/transitioned into the San Diego County Volunteer Reserve Firefighter Program. Personnel unable to meet these requirements may be offered positions as Support Reserves 15. Benefit Fees. The County will pay the remaining balance on the Fire Station loan using the collected Fire Station benefit fee and additional County funds. The Fire Station benefit fee will then be discontinued. 16. Effective Date. Dissolution of Julian/Cuyamaca Fire Protection District shall become effective upon recordation. Both front line Medic 56 and backup Medic 256 mechanically in service at Station Month of March M56 ran a total of 52 calls with 1 call as mutual aid to Borrego Springs outside of Julian Service Area and a 94% time compliance rating. Time exceptions due to distance were submitted to the County, if approved we will have a 100% time compliance for March. 3. Competitive testing of 11 candidates for Part Time Firefighter/Paramedic's was held on March 26 h resulting in 7 new FF/PM's successfully passing testing and joining the Part Time List. 4. Field training of new Part Time Firefighter Paramedics will be held during months of April and fvlay. 5. Anticipate a competitive process for Part Time Firefighter/EMT's to be held during month of April

40 'RESOLUTION NO Page 1 of 3 RESOLUTION OF THE BOARD OF DIRECTORS OF THE JULIAN CUYAMACA FIRE PROTECTION DISTRICT MAKING THE ANNUAL REQUIRED CONTINUED PARTICIPATION OF THE SAN DIEGO COUNTY FIRE MITIGATION FEE ORDINANCE FOR FISCAL YEAR 2018/2019. WHEREAS, the Julian Cuyamaca Fire Protection District is anticipating that further new development will occur within the District which will cause the further need for the expansion of existing fire protection facilities; and WHEREAS, the Julian Cuyamaca Fire Protection District is currently participating in the San Diego County Fire Mitigation Fee Program; and WHEREAS, the County of San Diego is empowered to collect mitigation fees from applicants for new development for the purpose of the expansion of fire protection and firefighting facilities and equipment; and WHEREAS, the County of San Diego has established fee ceilings for types of constructions by Chapter 3 of Division 10 of Title 8, (commencing with Section ) of the San Diego County Code; and WHEREAS, the County of San Diego has amended Chapter 3, Division 10 of Title 8 of the San Diego County Code of Regulatory Ordinances relating to fire mitigation fees; and WHEREAS, the Julian Cuyamaca Fire Protection District intends hereby to comply with said amendments to continue to participate in the fire mitigation fee program. IT IS HEREBY FOUND THAT: a) The Julian Cuyamaca Fire Protection District does not have existing facilities which could be used to provide an adequate level of services to new development within the District's boundaries; and b) The Julian Cuyamaca Fire Protection District does not have sufficient funds available to construct additional facilities from fund balances, capital facility funds, property tax sources, or any other appropriate sources; and c) The lack of fire protection facilities and equipment to serve new development would create a situation perilous to the public health and safety if fire mitigation fees are not levied within the district; and d) The annexation fees and plan check fees, if charged by the Julian Cuyamaca Fire Protection District, do not include a payment toward costs of the capital facility and equipment expansion as a component of the fee; and e) Refunds shall be required when all or a portion of fees remain unexpended or uncommitted in the district's account for more than five years after it's collection date. The monies shall be refunded to the current owner or owners on a prorated basis including any interest

41 accrued thereon. RESOLUTION NO Page 2 of 3 IT IS HEREBY RESOLVED THAT: f) The. Julian Cuyamaca Fire Protection District requests the County to collect 100% of the ceiling amount of the fire mitigation fee on the District's behalf from applicants for building permits. This percent of the ceiling is equal to or less than the capital facility expansion needs caused by new development. g) The fee amounts do not exceed the ceiling for fire mitigation fees established by the San Diego County Board of Supervisors. h) The District shall place all funds received by the County under this program, and all interest subsequently accrued by the District on these funds, in a separate budget accounting category to be known as the "San Diego County Fire Mitigation Fee". i) The District shall expend funds from said "San Diego County Fire Mitigation Fee" budget accounting category only for the purposes of providing capital facilities and equipment to serve new development. j) The District shall submit eight copies of the fire mitigation fee annual report to the County of San Diego no later than October 31 of each year to the Director of the Mitigation Fee Program, Department of Planning.and Land Use. Said report shall include, but not be limited to, the balance in the account at the end of the previous f i seal year, the revenue received in fees and interest, the amount and type of expenditures made, and the ending balance in the fund. The report shall further specify the actions the District plans to take to alleviate the facility in equipment needs caused by new development. The District shall make available, upon request by the Director, a copy of its annual audit report. k) The District shall make its records available to the public on request which justify the basis for the fee amount. l) The District shall hold San Diego County harmless for any errors made by the County in collecting and/or transmitting these fees to the District. m) The District agrees to a review of revenues and expenditures each fiscal year by a committee established by the County Board of Supervisors. n) By April 16 of each year following the year of original adoption of this District's resolution, the Julian Cuyamaca Fire Protection District shall submit a copy of a new resolution adopted by the Board of Directors making the required findings and setting the percentage of the fire mitigation ceiling requested by the District.

45 Resolution No A RESOLUTION OF APPLICATION BY THE JULIAN/CUY AMA CA FIRE PROTECTION DISTRICT REQUESTING THE LOCAL AGENCY FORMATION CO:MMISSION TO TAKE PROCEEDINGS TO DISSOLVE THE JULIAN-CUY AMACA FIRE PROTECTION DISTRICT RESOLVED, by the Board of Directors of the Julian-Cuyamaca Fire Protection District, that WHEREAS, the Board of Directors of the Julian:Cuyamaca Fire Protection District (JCFPD) desires to initiate proceedings pursuant to the Cortese/Knox/Hertzberg Local Government Reorganization Act of 2000, Division 3, commencing with section of the California Government Code, for Dissolution of the District; and 'WHEREAS, the proposed change of organization includes the following jurisdictional change: Dissolution of the JCFPD; and WHEREAS, the reason(s) for the proposed change(s) of organization is/are as follows: (1) Ensure continuity of fire protection and emergency medical service for the territory of the former JCFPD; (2) Ensure the long-term security of fire protection service to the communities within the territory of JCFPD; and (3) Eliminate duplication of management, administration, and oversight associated with the operation of multiple Special Districts providing the same service; and WHEREAS, the map of the current JCFPD territory is attached hereto as Attachment A and by this reference is incorporated herein; and WHEREAS, terms and conditions for the proposed dissolution of JCFPD are set forth in Attachment B. 48 ATTACHMENT B Terms and Conditions RECOMMENDED TERMS AND CONDITIONS Dissolution of Julian/Cuyamaca Fire Protection District and Expansion of Latent Powers of County Service Area 135 (San Diego County Regional Communications System I Fire Protection) to Provide Structural Fire Protection and Emergency Medical Services within the Service-Specific Area 1. Prohibition on Dissolved A!!ency. Upon the Commission's order giving approval to the dissolution of the Julian/Cuyamaca Fire Protection District (hereafter referred to as JCFPD), the JCFPD is prohibited from taking any of the actions contained in Government Code section , including: (a) Approving any increase in compensation or benefits for members of the governing board, its officers, or the executive officer of the agency. (b) Appropriating, encumbering, expending, or otherwise obligating, any revenue of the agency beyond that provided in the current budget at the time the dissolution is approved by the commission. 2. Successor A!2:encv. Upon and after effective date of dissolution (the "Effective Date"), CSA No. 135 shall be the successor to JCFPD for purpose of providing structural fire protection and emergency medical services, and succeeding to all of the rights, duties, and obligations of the extinguished district with respect to enforcement, performance, or payment of any outstanding bonds, including revenue bonds,. or other contracts and obligations within the territory. previously included within the extinguished district (Government Code sections et seq., 56700, and 56886(m). 3. Employees. As of the effective date, the JCFPD Secretary shall be offered equivalent employment as determined by the County with the County, CSA No. 135, or through a contract with another agency/service provider. (Government Code section 56886(1). 4. Ornanization and Governance. The dissolved fire protection district will become part of the frre protection and emergency medical services subarea of CSA No CSA No. 135 is governed by the five-member Board of Supervisors and the Deputy County Administrative Officer for the Public Safety Group will serve as the Fire Warden. Operationally, the County of San Diego will continue to contract with CAL FlRE to provide services. A seven-member fire advisory board has been created in accordance with County Board Policy A-74 (Government Code section 56886(k)). 5. Transfer by Operation of Law. If the proposed jurisdictional changes are approved by LAFCO, then as of the effective date, CSA No. 135 shall have ownership, possession, and control of all books, records, papers, offices, equipment, supplies, moneys, funds, appropriations, licenses, permits, entitlements, agreements, contracts, claims, judgments, land, and other assets and property, real or personal, owned or leased by, connected with the administration of, or held for the benefit or use of, JCFPD. Refer to Exhibit B containing a list of assets, property ownership, leases, and contractual obligations. The County of San Diego, on behalf of CSA No. 135, shall be the successor to all assets, liabilities, and service responsibilities of the dissolved district, including but not limited to, land, equipment, vehicles,

The County of San Diego, on behalf of CSA No. 135, shall be the successor to all liabilities and service responsibilities of the dissolved district, including, but limited to land, equipment, vehicles, contractual rights and obligations, materials, supplies and all accounts payable and other obligations. Exhibit B on :file in the LAFCO office lists improved and unimproved land ovvned by Julian-Cuyamaca prior to the Effective Date and to be owned by CSA No.135 on and after the Effective Date. Exhibit B also lists Real Property Lease (Easement) to which JCFPD is bound as landlord or tenant prior to the Effective Date and which bind CSA No.135 on and after the Effective Date. Exhibit B lists contracts binding upon JCFPD prior to Effective Date and to be binding upon CSA No. 135 after the Effective Date. 6. Tax Revenues. Upon the Effective Date, the legal existence of JCFPD shall cease, except as otherwise required by law and the Resolution of the Board of JCFPD's governing board adopting these terms and conditions to the Matter. All property tax revenues and voter-approved special ta,"'{ or special assessment revenues (if any), received or receivable by JCFPD as of the Effective Date shall be collected or collectible by CSA No. 135 for the exclusive use of funding th~ Services within the Territory. CSA No. 135 property taxes, special taxes, and special assessments shall not be available for other CSA No. 135 or County purposes. :;J(~ 7. /\\. Plan for Service. CSA No. 135 shall provide the services within the territory provided by JCFPD per the Plan for Services adopted by the County of San Diego. CSA No. 135 will provide a Paramedic Fire Engine in Julian at Fire Station #56. CSA No. 135 will fund the year-round staffing of CAL FIRE Cuyamaca Fire Station #51 with an expanded scope BLS Fire Engine. Julian Fire Station #56 will be considered a must-cover priority #1 station subject to the 30-minute move up. Levels of Services may improve or increase prior to the day immediately preceding the Effective Date. 8. Transfer in "As-Is" Condition. CSA No. 135 shall accept all real and personal property, books, records, papers, offices, equipment, supplies, moneys, funds, appropriations, licenses, permits, entitlements, agreements, contracts, claims, judgments, and all other assets and obligations transferred from JCFPD in "as-is" condition, without any payment or repair obligation from JCFPD [Government Code Section 56886(h)]. All incidental liabilities, such as accounts payable, contract obligations and consumer deposits, shall be transferred to CSA No. 135's appropriate, respective, isolated accounts. All assets including, but not limited to cash teserves, land, structures, appurtenances, rolling stock, personal property including tools, office furniture, :fixtures and equipment, and held by JCFPD, shall be transferred to the appropriate services zone of CSA No. 135 as of the Effective Date. 9. Property Tax Transfer. Prior to issuance of the Certificate of Filing for the Matter, the County Board of Supervisors, as the governing body for CSA No. 135, shall commence and complete a property ta'{ transfer process, as outlined in Revenue and Ta'{ation Code Section et seq , to transfer the fire related ad valorem property tax revenues to CSA No. 135 [Government Code Section 56886(s)]. 10. Transfer of Facilities. Upon the Effective Date, the facilities located at the real properties identified on Exhibit B of Julian-Cuyamaca Application shall be transferred to CSA No.13 5 for use in providing the Services. The facility in the community of Cuyamaca will not be transferred and will be disposed of by the JCFPD prior to the effective date of dissolution.

50 11. Insurance Service Office QSO) Ratimts. CSA No. 135 will petition the ISO to update JCFPD's fonner 519 rating of properties with.in the Territory to the County's 3/3x ISO rating. JCFPD maintains a class 5/9 ISO Fire Department rating. 12. Exulorer Prorrram. CSA No. 135 shall assume and continue support for JCFPD Explorer Program in place on the day immediately preceding the Effective Date. 13. Community Events. County and/or state :firefighters stationed in Julian will participate in community events as requested. 14. District Fireforbters. Upon successful completion of medical and background screening, JCFPD volunteer :firefighters shall be offered reserve positions/transitioned into the San Diego County ~ Volunteer Reserve Firefighter Program. Personnel unable to meet these requirements may be offered positions as Support Reserves 15. Benefit Fees. The County will pay the remaining balance on the Fire Station loan using the collected Fire Station benefit fee and additional County funds, The Fire Station benefit fee will then be discontinued Effective Date. Dissolution of JCFPD shall become effective upon recordation.

ISO ratings help establish appropriate fire insurance premiums for residential and commercial properties. ISO assigns classifications ranging from 1to10. Class 1 generally represents superior property fire protection, and Class 10 indicates that the area 1 s firesuppression program doesn't meet ISO's minimum criteria. See Table One - It is anticipated that the ISO rating will improve from a 5/9 to a 3/X. 18. Per requirements in Government Code Section 56653, submit with this application a plan for providing services within the affected territory. At a minimum the plan for services must include: {1) An enumeration and description of the services to be provided; (2) The level and range of services to be provided; {3} An indication of when services can be feasibly extended to the reorganization territory; (4) An indication of any improvements or upgrades of facilities that the reorganized agency will make or require; and (5) Information with respect to how services will be financed. There are no plans to establish new improvement districts as a result of the proposed consolidation/ reorganization. Within Julian/Cuyamaca Fire Protection District (JCFPD), there are two voter-approved fixed charge special assessments/ tax levies. The special tax levies collected will be used to serve the residents within the geographic areas from which they are collected. Discrete funds will be created for each tax to allow differentiation and use of the taxes only within the respective voter approved assessment areas. The existing boundaries will remain the same and there are no sunset provisions for these taxes. 8. If the successor district proposes to levy additional fees or taxes as a result of this proposal, indicate how those costs will be levied, and what the cost will be for each resident/service user. There are no new fees or taxes as a result of th~prop~sed consolidation/ reorganization. 9. Discuss any opportunities for cost-savings or cost-avoidance. Include in the response any proposed actions to decrease or charges/fees; whether employee salaries and benefits will be increased or decreased; effects on equipment purchases, facility planning, shared facility usage, insurance costs, overall service costs, etc. Note that any associated costsavings/increases needs to be reflected in the proposed budgets submitted with the LAFCO application. San Diego County Fire has adopted response time goalsfor fire and emergency medical services that utilize four regional categories identified by land use designation and population density: Urban, Rural, Outlying, and some hard to serve or extreme outlying areas defined as Desert. A key element of this system is having resources allocated in such a way that they are capable of arriving on scene, ready to mitigate an emergency within established performance standards. To achieve this San Diego County Fire always dispatches the closest available resource, regardless of jurisdiction or boundaries, to an emergency incident. The closest available resource is determined through the use of an Automatic Vehicle Locator (AVL) and is supported through Mutual and Automatic Aid agreements with surrounding agencies. It is important to note that the existing JCFPD service area is almost exclusively bordered by County Fire service are~; County Fire staffs two 24/7 ALS engines capable of reaching the JCFPD service. area within 10 minutes and three 24/7 ALS engines capable of reaching the JCFPD service area within 20 minutes. Additionally, through its partnership with the State of California, County Fire makes use of three BLS engines within the JCFPD service area and two BLS engi~es~apable'qf re~ching the JCFPD service area within 20 minutes. In total, there are twelve ffrestations within.30 minutes of the JCFPD service area capable of offering support on a mafor~mergencyincident or to ensure that "move up and cover" service area coverage is available during an extended incident. Julian has been identified by San Diego County Fire as a must cover station. This means that when the primary engine is predicted to be committed to an incident for 30 minutes or longer, a second engine is "moved up" from a surrounding community to provide service area coverage and respond to the next emergency incident. During major incidents, all engines within the Cooperative Regional Fire Protection System are strategically located to provide the greatest level of service possible. The County/ latent powers area of CSA 135 shall be the successor to all assets, liabilities and service responsibilities of the dissolved districts, including land, equipment, vehicles, contractual rights and obligations, materials, supplies and all monies, including cash on hand, monies due but not collected, and other obligations. 63 ATTACHMENT A Plan for Service (1) An enumeration and description of the services to be provided; Structural Fire Protection and Emergency Medical Services: Staffing will increase over the levels today: Paramedic Service will begin on July 30, 2018 at Julian Fire Station 56, where the County will place a full time, year-round staffed Paramedic Fire Engine. The County will also provide winter funding to maintain an Expanded Scope Basic Life Support Fire Engine at CAL FIRE Cuyamaca Fire Station 51 year-round. As of the effective date, equipment will be housed at CAL FIRE Cuyamaca Station 51. Fire Prevention Services: Fire prevention services are currently provided under contract by the County and will continue after dissolution. (2) The level and range of services to be provided; County Fire will implement ALS service for Julian Station 56, bringing the total number of County Fire ALS stations up to fifteen. (7) An identification of existing providers, if any, of the new or different function or class of services proposed to be provided and the potential fiscal impact to the customers of those existing providers. Fire and emergency medical services are currently providedwithin the Julian/Cuyamaca Fire Protection District by volunteer firefighters. Under this proposal, these services will be provided by CAL FIRE employees under contract with the County of San Diego and County Reserve firefighters. 65 EXHIBIT B Terms and Conditions RECOMMENDED TERMS AND CONDITIONS Dissolution of Julian/Cuyamaca Fire Protection District and Expansion of Latent Powers of County Service Area 135 (San Diego County Regional Communications System I Fire Protection) to Provide Structural Fire Protection and Emergency Medical Services within the Service-Specific Area 1. Prohibition on Dissolved Agency. Upon the Commission's order giving approval to the dissolution of the Julian/Cuyamaca Fire Protection District (hereafter referred to as JCFPD), the FPD is prohibited from taking any of the actions contained in Government Code Section , including: (a} Approving any increase in compensation or benefits for members of the governing board, its officers, or the executive officer of the agency. (b} Appropriating, encumbering, expending, or otherwise obligating, any revenue of the agency beyond that provided in the current budget at the time the dissolution is approved by the commission. 2. Successor Agency. Upon and after the Effective Date, CSA No. 135 shall be the successor to JCFPD for purpose of providing structural fire protection and emergency medical services, and succeeding to all of the rights, duties, and obligations of the extinguished district with respect to enforcement, performance, or payment of any outstanding bonds, including revenue bonds, or other contracts and obligations within the territory pr~viously included within the extinguished district (Government Code Sections et seq., and 56886(m}. 3. Employees. As of the effective d~te, the Oistrict Secretary shall be offered equivalent employment as determined by the County with the County, CSA No. 135, or through a contract with another agency/service provider. (Government Code Section 56886(1). 4. Organization and Governance. The dissolved fire protection district will become part of the fire protection and emergency medical services subarea of CSA No CSA No. 135 is governed by the five-member Board of Supervisors and the Deputy County Administrative Officer for the Public Safety Group will serve as the Fire Warden. Operationally, the County of San Diego will continue to contract with CAL FIRE to provide services. A seven-member fire advisory board has been created in accordance with County Board Policy A-74. [Government Code Section 56886(k}] 5. Transfer by Operation of Law. If the proposed jurisdictional changes are approved by LAFCO, then as of the effective date, CSA No. 135 shall have ownership, possession, and control of all books, records, papers, offices, equipment, supplies, moneys, funds, appropriations, licenses, permits, entitlements, agreements, contracts, claims, judgments, land, and other assets and property, real or personal, owned or leased by, connected with the administration of, or held for the benefit or use of, JCFPD. Refer to Exhibit B containing a list of assets, property ownership, leases, and contractual obligations. The County of San Diego, on behalf of CSA No. 135, shall be the successor to all assets, liabilities, and service responsibilities of the dissolved district, including but not limited to, land, equipment, vehicles, contractual rights and obligations, materials, and supplies. 66 monies, including cash on hand, monies due but not collected and other obligations. The County of San Diego, on behalf of CSA No. 135, shall be the successor to all liabilities and service responsibilities of the dissolved district, including, but limited to land, equipment, vehicles, contractual rights and obligations, materials, supplies and all accounts payable and other obligations. Exhibit Bon file in the LAFCO office lists improved and unimproved land owned by JCFPD prior to the Effective Date and to be owned by CSA No.135 on and after the Effective Date. Exhibit B also lists Real Property Lease (Easement) to which JCFPD is bound as landlord or tenant prior to the Effective Date and which bind CSA No.135 on and after the Effective Date. Exhibit B lists contracts binding upon JCFPD prior to Effective Date and to be binding upon CSA No. 135 after the Effective Date. 6. Tax Revenues. Upon the Effective Date, the legal existence of JCFPD shall cease, except as otherwise required by law and the Resolution of the Board of JCFPD's governing board adopting these terms and conditions to the Matter. All property tax revenues and voter-approved special tax or special assessment revenues (if any), received or receivable by JCFPD as of the Effective Date shall be collected or collectible by CSA No. 135 for the exclusive use of funding the Services within the Territory. CSA No. 135 property taxes, special taxes, and special assessments shall not be available for other CSA No. 135 or County purposes. 7. Plan for Service. CSA No. 135 shall provide the services within the territory provided by JCFPD per the Plan for Services adopted by the County of San Diego. CSA No.135 will provide a Paramedic Fire Engine in Julian at Fire Station #56. CSA No. 13S will fund the year-round staffing of CAL FIRE Cuyamaca Fire Station #51 with an expanded scope BLS Fire Engine. Julian Fire Station #56 will be considered a mustcover priority #1 station subject to the 30-miilute move up. Levels of Services may improve or increase prior to the day immediately preceding the Effective Date. 8. Transfer in "As-ls" Condition. CSA No. 135 shall accept all real an.d personal property, books, records, papers, offices, equipment, supplies, moneys, funds; appropriations, licenses, permits, entitlements, agreements, contracts, claims, judgments, and all other assets and obligations transferred from JCFPD in "as-is... cpnclition, without any payment or repairopligation from JCFPD [Government Code Section 56886(h)).. All incidental liabilities, such as account~ payable, contract obligations and consumer deposits; shall be transferred to CSA No.135's appropriate, respective, isolated accounts. All assets inclu~ing, but not limited to cash reserves, land, structures, appurtenances, rolling stock, personal property including tools, office furniture, fixtures and equipment, and held by JCFPD, shall be transferredto t~e appropriate services zone of CSA No.135 as of the Effective Date. 9. Property Tax Transfer. Prior toj~suance of the Certificate of Filing for the Matter, the County Board of Supervisors, as the goyerning,body for CSA No. 135, shall commence and complete a property tax transfer process, as C>utJined in Revenue and Taxation Code Section et seq , to transfer the fire related ad valorem property tax revenues to CSA No [Government Code Section 56886(s)] 10. Transfer of Facilities. Upon the Effective Date, the facilities located at the real properties identified on Exhibit B of Julian-Cuyamaca Application shall be transferred to CSA No.135 for use in providing the Services. The facility in the community of Cuyamaca will not be transferred and will be disposed of by the JCFPD prior to the effective date of dissolution. 11. Insurance Service Office (ISO) Ratings. CSA No. 135 will petition the ISO to update Julian's former 5/9 rating of properties within the Territory to the County's 3/3x ISO rating. Julian/Cuyamaca Fire Protection District maintains a class 5/9 ISO Fire Department rating. 67 12. Explorer Program. CSA No. 135 shall assume and continue support for Julian/Cuyamaca Explorer Program in place on the day immediately preceding the Effective Date. 13. Community Events. County and/or state firefighters stationed in Julian will participate in community events as requested. 14. District Firefighters. Upon successful completion of medical and background screening, JCFPD volunteer firefighters shall be offered reserve positions/transitioned into the San Diego County Volunteer Reserve Firefighter Program. Personnel unable to meet these requirements may be offered positions as Support Reserves 15. Benefit Fees. The County will pay the remaining balance on thejfre Station loan using the collected Fire Station benefit fee and additional County funds. The, f(re Station benefit fee will then be discontinued. 16. Effective Date. Dissolution of Julian/Cuyamaca Fire Protection District shall become effective upon recordation.
