2 RESOLUTION NO. 2012/ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, APPROVING A FIRST AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING (MOU) WITH BROWARD COUNTY FOR THE ADMINISTRATION OF HOME FUNDNG FOR THE REPROGRAMMING OF FUNDS IN THE AMOUNT OF $23, FROM FY07 TO FY11 WHEREAS, the City of Deerfield Beach are members of the Broward County HOME Consortium and entered into a Memorandum of Understanding (MOU) for the administration of HOME funding for fiscal year ; and WHEREAS, the parties thereto wish to reprogram funds in the amount of $23, from fy07 to fy11 for a total of $262,385.04; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DEERFIELD BEACH, FLORIDA, AS FOLLOWS: Section 1. The above referenced Whereas clauses are true and correct and made a part hereof. Section 2. The City Commission of the City of Deerfield Beach does hereby approve the attached First Amendment to the MOU between the Broward County and the City of Deerfield Beach to reprogram funds in the amount of $23, from fy07 to fy11 for a total of $262, The Mayor and/or the City Manager is authorized to execute same and the City administration is authorized to implement said Amendment. 5 FIRST AMENDMENT TO INTERLOCAL AGREEMENT Between BROWARD COUNTY and CITY OF DEERFIELD BEACH for ADMINISTRATION OF HOME FUNDING PROGRAM This is a First Amendment to the Interlocal Agreement ("First Amendment to Agreement") entered into by and between BROWARD COUNTY, FLORIDA, a political subdivision of the State of Florida ("COUNTY"), and CITY OF DEERFIELD BEACH, FLORIDA, a municipal corporation of the State of Florida ("CITY"), collectively referred to as the "Parties." WITNESSETH WHEREAS, the Parties entered into an agreement ("Agreement") dated January 27, 2012, pursuant to Section , Florida Statutes, as may be amended from time to time, also known as the Florida Interlocal Cooperation Act of 1969; for the administration by COUNTY of HOME Funds from the U.S. Department of Housing and Urban Development ("HUD") allocated to CITY; and WHEREAS, pursuant to a substantial change resolution adopted by the Board of County Commissioners on February 28, 2012, reallocating funding to CITY from its fiscal year allocation, the Parties desires to enter into this First Amendment to Agreement increasing the funding under the Agreement and Exhibit "A," Project Description by $23, in accordance with the terms set forth herein; and WHEREAS, the Parties have determined that it is mutually beneficial to enter into this First Amendment to Agreement; NOW, THEREFORE, IN CONSIDERATION of the mutual covenants set forth herein, the Parties agree as follows: 1. The above recitals are true and correct and are incorporated herein as if set forth in full hereunder. 1

6 2. Section 3, Funding, of the Agreement is amended as follows: 3. Funding. COUNTY shall allocate Two Hundred Thirty-eight Thousand Seven Hundred Forty-six Dollars ($238,746.00) Two Hundred Sixty-two Thousand Three Hundred Eighty-five Dollars and Four Cents ($262,385.04) in HOME funds to CITY for FY 2011/2012. COUNTY agrees to administer CITY s allocation of HOME funds for the HOME Program Project(s) described in Exhibit "A," Project Description. 3. Exhibit "A," Project Description, is amended as provided for in revised Exhibit "A," attached hereto, to reflect the increase in funding. Upon the effective date of this First Amendment to Agreement, the references in the Agreement to Exhibit "A" shall refer to the revised Exhibit "A" attached to this First Amendment to Agreement. 4. This First Amendment to Agreement shall be effective upon full execution by the Parties. 5. Except as provided for herein this First Amendment to Agreement, the terms of the original Agreement not inconsistent herewith shall remain in effect. 6. This First Amendment to Agreement may be fully executed in multiple copies by all parties, each of which, bearing original signatures, shall have the force and effect of an original document. 9 EXHIBIT "A" PROJECT DESCRIPTION Fiscal Year Project City of Deerfield Beach Housing Rehabilitation Program Allocation: HOME Funds $238, $ 262, CITY shall provide minor home repair assistance of up to Thirty Thousand Dollars ($30,000.00) per home to assist approximately Seven (7) Eight (8) Income Eligible Households ("Clients") in accordance with the terms of the Agreement and specifically Exhibit "B," Costs/Budget for Project. The assistance includes all rehabilitation and allocable soft costs defined in the Agreement for HOME Eligible Activities. Applicants shall be referred by CITY to the Contractor. The Contractor shall process applicants on a first come, first served basis. CITY's Program shall be administered in accordance with CITY s Local Housing Assistance Plan (LHAP). COUNTY, CITY and the Contractor shall comply with HOME Rules and Regulations governing the Project and CITY's Program including, but not limited to, the following: o Maximum value of a property after rehabilitation work is limited to Section 203 (b) of 24 CFR Part 92. o Lead based paint testing and abatement, as needed 24 CFR Part o Income Eligible Households shall refer to households whose maximum income shall be less than 80% of the County median COUNTY income based on 2011/12 income limits established by HUD and adjusted for family size. o Federal procurement procedures set forth in 24 CFR Part are applicable to the selection of the Contractor. The Contractor may use the CITY's list of contractors for bidding o Ensure that the recapture and affordability restrictions set forth in the Agreement are followed. The Contractor shall provide COUNTY with an individual scope of work and a tax assessment for each property to be assisted prior to committing any HOME funds. The Contractor will review tax assessed value and scope of work to determine if the value of the property after rehabilitation work is completed meets HOME guidelines.
