GENERAL RULES 1.1 INTRODUCTION Armonia 2015 the 3rd National Law Fest of Madhusudan Law College shall be held from 27 th March to 29 th March, 2015 in the premises of Madhusudan Law College, Station Bazaar, Cuttack, Odisha, India. 1.2 ELIGIBILITY Bona fide students pursuing three or five year courses of the LL.B. degree in the current academic year from any recognized law school/college/university in India and officially deputed for the purpose are eligible to participate. 1.3 LANGUAGE The official language of the Event shall be English. 1.4 DRESS CODE The official Dress Code for the Events is as follows : Ladies: Black Trousers & White Shirt, or Black Salwar & White Kurta, with Black Blazer and Black Formal shoes. Gentlemen: Black Trousers, White Shirt, Black Blazer, Black neck tie and Black Formal shoes. 1.5 TEAM COMPOSITION Each law school/college/law university may enter only one team, comprising of not more than EIGHT (8) members to participate in the events of National Law Fest ARMONIA For details of the team compositions for a specific event, please refer to the Rules and Regulations of the respective Events A student cannot participate in both Moot Court and the Client Counseling A student can t participate in more than 4 events of Armonia Any additional member shall not be entitled to hospitality or certification The participation is limited to only 16 teams, on all or any of the following criteria: First come-first served basis. 2 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

4 The nature and number of events represented Any other criteria which the organizers may deem fit in the interest of maintaining and developing the standards of National Law Fest. 1.6 REGISTRATION All interested teams are required to provisionally register themselves by sending an to latest by 11:59 P.M. on 22 nd February, The subject should read as Registration for ARMONIA The mail should contain scanned copy of the duly filled registration form The registration of the team shall be confirmed by the organizers latest by 23 rd February, 2015 on the basis of criteria mentioned in rule Acceptance or non-acceptance of the registration of a team is the sole discretion of the organizers On the confirmation of the registration, the teams are required to send the hard copy of the dully filled registration form so as to reach the organizers latest by 2 nd March The hardcopy must be sent to following address and should be distinctly marked with words Armonia 2015 on the top of the envelope : Principal, Madhusudan Law College, Station Bazaar, Cuttack. Odisha. PIN PAYMENT OF REGISTRATION FEES Registration fees for Armonia-2015 is Rs.500/- per member of a team Registration fees must be sent in the form of a Demand Draft favoring The Principal, Madhusudan Law College, Cuttack, payable at Cuttack, along with the hard copy of the dully filled registration form so as to reach the Organizers latest by 2 nd March The registration fee sent shall not be refunded under any circumstances. 3 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

5 1.8 TEAM CODE After the validation of hard copy of the duly filled registration form and demand draft, the registration shall be completed and team codes and individual code shall be allotted After successful completion of registration of a team, the codes shall be communicated to the registered team The team codes and individual codes issued shall be the source of identity of teams and participants throughout the competition. 1.9 HOSPITALITY AND ACCOMMODATION Accommodation for all outstation teams shall be provided by the organizers from night of 26 th March to morning of 30 th March Teams who arrive prior to or leave after the specified time are required to make their own arrangements Participants shall be received from Cuttack Railway station or Cuttack busterminus only. Teams are required to make their own arrangements for reaching the same Teams arriving at Bhubaneswar airport or Bhubaneswar railway station can reach Cuttack railway station through regular bus, train, pre-paid auto, taxi services, etc. available from Bhubaneswar to Cuttack The college is situated adjacent to the Cuttack railway Station and at about 3 K.Ms from Cuttack Bus Stand. Cuttack is just 25 K.Ms from Bhubaneswar, the Capital of Orissa For availing the necessary arrangements, the travel and stay details/plan must be intimated to the Organizers at earliest or as and when asked for Breakfast, Lunch and Dinner shall be provided on the days of event. Teams failing to report to the place of event before the commencement of Armonia-2015 shall be disqualified Teams leaving before the completion of valedictory function shall not be entitled to any certification or awards. 4 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

RULES FOR SPECIFIC EVENTS 2.1 THE APPEAL TEAM COMPOSITION The participating team shall comprise of a minimum of TWO (2) members and a maximum of THREE (3) members In a team comprising of two members, both the members shall be designated as Speakers In a team comprising of three members, two members shall be designated as Speakers and the third member of the team shall be designated as Researcher This team composition cannot be altered once the team registration is successfully completed In case there is an odd number of participating teams, the host institution can nominate a non-competing dummy team that shall not proceed beyond preliminary rounds ROUNDS The event shall be conducted in four rounds, the preliminary round, the quarter-final round, the semi-final round and the final round. However, the Organizing Committee may reduce the number of rounds in case of exigencies The criteria and manner in which the teams shall qualify for several rounds shall be at the discretion of the Organizing Committee and the same shall be communicated to participating teams at appropriate time The sides for which teams shall be arguing shall generally be decided by draw of lots There shall be memorandum exchange before each oral round. The teams are not supposed to put any mark on the exchanged memorandum. The teams shall return back the exchanged Memorandum to the Court Officer after each oral round The teams are allowed to use a compendium of cases and other materials referred to in the memorandum in the competition, provided the materials 5 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

7 should not disclose the identity of the participating institution or the names of the participants in any manner whatsoever MEMORANDUM The memorandum shall necessarily consist of the following: Cover page Table of Contents List of Abbreviations Index of Authorities Statement of Jurisdiction Statement of Facts Points to be Decided Summary of Arguments Arguments Advanced Prayer All the teams are required to send soft copies of memorandum in.pdf format on or before 22 nd March, 2015 by 11:59 P.M. to The subject should read as Memorandum Submission for Team Code Non-compliance of the dead-line shall attract penalty of 4 marks per day of delay No amendment can be made to the memorandum after submission. Any distinction between the soft copy and the hard copy of the memorandum would attract a penalty, as determined by the Organizing Committee All the teams are also required to submit FIVE (5) hard copies of the memorandum of each side (i.e. 5 copies from the appellant s side and 5 copies from the respondent s side) which makes a total of TEN (10) memorandums, at the time of orientation The memorandums however, should not contain any kind of identification whatsoever except than the codes allotted; and if any such identification mark, text or character is found, which reveals the identity of the participant or the team, the concerned team shall face penalty and may also be subject to disqualification at the discretion of the Organizing committee. 6 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

8 The memorandum must be spiral-bound with blue cover for the appellant and red cover for the respondent respectively Team code must be given on the top right hand corner of the cover page Any argumentative statement of facts shall attract penalty All memorandums submitted must confirm inter alia to the following general rules: Memorandums must be printed on single side of white A4 size paper with black ink only The font used must be Times New Roman, size 12, line spacing The OSCOLA or any other acceptable style of uniform footnoting should be followed The font of footnotes must be Times New Roman, size 10, single line spacing Each page of the memorandum must have a margin of one inch on all sides, excluding its page number Page number must be given at the bottom right hand corner The body of written pleadings must not exceed TWENTY (20) typed pages in total. The memorandum in whole must not exceed THIRTY-FIVE (35) typed pages. 9 2.1.4 ORAL SUBMISSIONS Each team should have two speakers who shall divide the oral submission between themselves. Rebuttals are permitted. Sur-rebuttals are at the discretion of the judges For the Preliminary and Quarter-final round each team shall have a maximum of 25 minutes to present their oral submissions subject to a maximum of 15 minutes for any one speaker In the Semi-final round each team shall have a maximum of 30 minutes to present their oral submissions subject to a maximum of 18 minutes for any one speaker In the Final round each team shall have a maximum of 35 minutes to present their oral submissions subject to a maximum of 20 minutes for any one speaker The aforementioned time-limits would include the time that each team may want to reserve for their rebuttals At the commencement of each session of the oral submissions, each team shall notify the court officer as to the division of time between the 2 speakers, including time reserved for rebuttals. A maximum of 5 minutes can be reserved for the rebuttals Rebuttal can be presented by 1 speaker of the team only Any extension of the prescribed time limit shall be at the sole discretion of the judges Reference materials to the judges shall be passed through the Court Officers The participants shall not be permitted to make any audio/visual representation nor shall they be allowed to use laptops, cell phones, tablets or any other electronic device during their oral submissions Each speaker shall be marked on a total of 100 marks per judge The marking criteria for oral submissions shall be as provided herein under: 8 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

Scouting by any team in any manner shall result in instant disqualification Members of a participating team must not communicate with the judge/s or opposite counsels in private, to the detriment of the competition The Authors of the Problem are not to be contacted under any circumstances. Any attempt to do so shall lead to disqualification Students are not to disclose the identity of the team to the judges All participants shall maintain the decorum of the Court during the Competition and are expected to conduct themselves in a manner befitting legal profession. 9 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

11 2.2 THE ULTIMATE COUNSEL TEAM COMPOSITION The participating team shall comprise of TWO (2) members This team composition cannot be altered once the team registration is successfully completed ROUNDS The event shall be conducted in four rounds, the preliminary round, the quarter-final round, the semi-final round and the final round. However, the Organizing Committee may reduce the number of rounds if required The criteria and manner in which the teams shall qualify for several rounds shall be at the discretion of the Organizing Committee and the same shall be communicated to participating teams at appropriate time Each team shall be given a room for the counseling session Maximum time limit for each Client Counseling session shall be 35 minutes (30 minutes for consultation and post-consultation and 5 minutes for Critique) The participants are responsible for keeping track of their time. The participants shall be stopped after 30 minutes regardless of where they are in the consultation or post-consultation process The problems for the competition shall be set in the area of Family Law, Law of Torts, Constitutional Law or Human Rights, etc. The Competition topic shall be disclosed 10 days prior to the Event However, the participants are expected to have knowledge of any other ancillary laws and procedures The organizers shall select the clients to play the role as required by the problems During the counseling session, the team may use books, notes and other relevant materials. The team may also use office props (Files, furnishings, bookshelves etc.) or any other material to furnish their counseling room or for other relevant purposes. 12 During the session, the teams shall not be allowed to use any electronic device like laptop, LCD projectors, video camera, mobile phones, etc. and such use shall lead to disqualification COUNSELING SESSION Each Counseling Session shall be divided into three parts: Consultation Post-Consultation Critique CONSULTATION: During consultation stage, participants are expected to elicit the relevant information, outline the problem, find the clients expectations and propose a solution or other means of resolving the problem Team members are free to decide their division of work, but both the participants must consult the client as a team POST-CONSULTATION: In the post-consultation period, the participants are required to conduct a meaningful post-consultation discussion after the client has left the room The participants may talk to each other loudly so as to be audible to the judges or may indirectly address them in any other manner Participants may summarize the interview, indicate the scope of the legal work to be undertaken and state the legal issues that should be researched. Explanation of the position or attitude taken by the students may be useful If the participants feel that some documents are appropriate, like a letter to the client confirming their retention as attorneys or a letter to opposing counsel or to the party with whom the client is having their legal problems, etc. they may dictate such a document at the post consultation stage CRITIQUE: After the completion of the Post-Consultation period, the judges may question the participants on matters deliberated upon or mentioned by the participants or the client during the consultation or post-consultation period The judges may ask any question which they consider material and questions meant to test the participants understanding of the facts and/or law applicable or applied by the participants in the case. 11 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

13 Teams shall not reveal the identity of their college/university at any point of time during the counseling session Scouting or any other unethical/unprofessional conduct is strictly prohibited MARKING CRITERIA Establishing the working atmosphere and professional approach Eliciting the problem of the client and the tools used in doing so Consideration of Clients' goals, expectation and needs Analysis and formulation of the problem with precision Suggesting alternatives Allowing the client to make informed choice Effective conclusion of the counseling session Team work Management of ethical and professional relation with the client dealing with emotional and legal needs of the client and Moral issues Post interview session interaction with the judges and among themselves. 2.3 THE RIGHTEOUS PEN TEAM COMPOSITION The participating team shall comprise of only ONE (1) member This team composition cannot be altered once the team registration is successfully completed STRUCTURE The structure of the judgment shall reflect the forum / court in which the provided case is set and argued. The structure shall follow the Civil Procedural Law as the competition shall be based upon Civil Laws SUBMISSION There shall be an on spot judgment writing competition The factsheet for the competition shall be circulated a week before the competition. 12 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

14 The brief consisting of plaint/complaint/petition, written statement/reply, affidavits of parties, oral evidence or other relevant documents shall be circulated before the competition The participants shall write their judgments accordingly within the prescribed time i.e. one hour OTHER GUIDELINES Participants may refer any books, bare acts, commentaries, digest or any other appropriate material brought by them during the competition No electronic equipments are allowed during the competition Anyone found to have prepared judgment in advance shall be disqualified from the competition MARKING CRITERIA Format (All the steps of a Judgment) Language and Style (lucid expressions, brevity not at cost of clarity) Facts in brief Identification of Issues Application of Law Ratio Decidendi Justification of the Judgment Relief and Orders Obiter dicta (the Judge s mind) Creative interpretation of citations, facts, law and innovative approach 2.4 FLASHBULB TEAM COMPOSITION The participating team shall comprise of TWO (2) members This team composition cannot be altered once the team registration is successfully completed ROUNDS 13 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

15 There shall be two rounds of the Quiz Competition; preliminary round and the final round In case of compelling circumstances, Organizing Committee reserves the right to determine the overall results for Quiz on the basis of Preliminary rounds only without conducting Final Round In case of any tie in either of the rounds, the Organizing Committee/ Quiz- Master shall have the right to adopt appropriate methods for tie-breaking PRELIMINARY ROUND: The preliminary round shall be in writing Each team shall be given a set of question papers containing 30 objective type questions from areas of General Knowledge, Legal Knowledge and Current Affairs Each correct answer shall carry 1 mark and on each incorrect answer 0.5 marks shall be deducted The time limit for the Preliminary Round shall be 30 minutes Top 5 teams shall qualify for the final round on the basis of their scores in the preliminary round FINAL ROUND: The final round shall be basically consisting of various oral rounds Rules, regulations and guidelines relating to the final round shall be specified on the spot. 2.5 BRAINSTORM TEAM COMPOSITION The participating team shall comprise of only ONE (1) member This team composition cannot be altered once the team registration is successfully completed RULES The Topic for Turncoat-Debate for each participant shall be determined by draw of lots Each participant shall get around 4 minutes time for preparation and 4 minutes time for speech The first four minutes after knowing the topic shall be the preparation time. 14 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

16 In the next 2 minutes, the participant shall speak in favour of the motion given At the end of these 2 minutes, there shall be a warning bell and thereafter participant shall speak against the motion for the next 2 minutes If a participant wishes to change the motion before the completion of specified 2 minutes, he/she shall have to specify the change in motion and thereafter, he/she shall speak against the motion for next 2 minutes No time shall be given between speaking for and against the motion No speaker shall be allowed to exceed the specified time-limits and he/she shall have to change the motion or stop his speech, as the case may be at whatever stage he/she is on ringing of bell. Non-compliance shall result in penalty. 2.6 TITAN S TWIST TEAM COMPOSITION The participating team shall comprise of TWO (2) members This team composition cannot be altered once the team registration is successfully completed FORMAT Participants are challenged to speak for one minute on a given topic without repetition, hesitation or deviation Repetition means the repetition of any word, phrase, etc Hesitation is watched very strictly. It includes momentary pause before resumption of the subject, tripping over one s words, use of fillers, etc Deviation means deviating from the subject, deviating from the English language as we know it, deviation from grammar as we understand it, deviating from the truth, logic, etc The topics shall be given on the spot Other teams must listen carefully in case any of the three rules are broken. If they feel that the speaker has broken a rule they may buzz and challenge. 15 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

17 If the JAM-master accepts the challenge, the challenging team gets one point while the speaker gets one point if the challenge is deemed incorrect by the JAM-master However, if a witty interjection amuses the audience even though not being a correct challenge, both the challenger and the speaker may gain a point at the JAM-master s discretion A participant who makes a correct challenge takes over the topic for the remainder of the time or until he or she is correctly challenged. He cannot repeat what the other team's speaker has already said The opposing teams must now listen carefully to make sure that the rules are followed At any time when a team has the floor, the speaker may 'tag' a team member to take over SCORES One point for every 10 seconds a team member speaks One point for a correct challenge Five points to the team holding the floor at the end of the 60 seconds Thus, team that speaks for one minute without being challenged shall receive a total of 11 points OTHER GUIDELINES The JAM-master in his discretion can introduce any twist or add, delete or alter any rules on the spot to make the event more fascinating. 2.7 ARTISTS RENAISSANCE TEAM COMPOSITION The participating team shall comprise of ONE (1) member This team composition cannot be altered once the team registration is successfully completed RULES The theme of the event shall be Armonia. 16 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

18 Area within the College Campus shall be specified for the Event The time limit for the event shall be 1 hour The Visual Arts shall comprise of Poster Making, Painting of different kinds, Rangoli, Origami, Photography, Ceramics, Carving, Sand-Art or other related forms of Visual Arts which can be completed within the specified time and specified area Participants should keep in view the following limitations while participating in the event: They have to finish the work strictly within the time limit They have to do the Art within the specified Area They have to make their own arrangements for the props, papers, colors, instruments or other materials required for their Art Organizers won t provide any resources other than the place to work MARKING CRITERIA Concept and Creativity Visual Appeal Technique Utilization of Theme 2.8 BEYOND THE BAR TEAM COMPOSITION The participating team shall comprise of maximum EIGHT (8) members and minimum ONE (1) member This team composition cannot be altered once the team registration is successfully completed RULES This event is formatted along the lines of Got Talent genre The event shall comprise of any talent including but not limited to song, music, dance, drama, mimicry, puppetry etc., but excluding talents relating to event Visual Arts. 17 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

19 The participants are allowed to present their work both in Hindi and English The Participating team as a whole or in parts can give Two (2) presentations/performances The participants can perform solo, duet or in group The time limit is 12 minutes for each Team (For one or two performances taken together) In case of two performances from a Team, the marks of only the higher marked performance shall be considered for ranking and the participants of higher marked performance only shall be entitled to awards and certificates of merit, if otherwise entitled Participants are required to bring their own props and other materials No resources or other materials except desk and bench shall be provided by the Organizers Stunts and acts that are dangerous to human life and property are not permitted No profanity or vulgar lyrics in any vocal performance or dance music are permitted No pyrotechnics, open flames or any other dangerous additions are allowed MAKING CRITERIA Ability to connect with audience & Audience Response Concept and Creativity Competence in the Art Form Overall Entertainment and Appeal 3. 20 Best Student Advocate Best Memorandum of Arguments OTHER EVENTS Winning Team Runners-Up Team In addition to the above awards, a certificate of participation shall be given to all the teams participating in the competition. Other awards and certificates can be given at the discretion of the Organizing Committee. 3.2 SPECIAL AWARDS As is quite evident from the theme of fest, we believe in promoting a congenial and friendly ambience coupled with high level of academic excellence and never say die spirit; a perfect blend of competitiveness and comradeship is what the SPIRIT OF ARMONIA is. The recipient of SPIRIT OF ARMONIA award shall be selected by the ARMONIA participants themselves The team bagging maximum number of Prize-points (Counted as per the number and nature of Prizes won) shall be awarded as the Best Team and shall be conferred the title of TEAM ARMONIA COPYRIGHT The copyright over the memorandums or other materials submitted for the purpose of the competition shall be deemed to be assigned by the participants and the Participating Institution completely and fully with the Organizers. The participants are deemed to certify the originality of materials and shall be responsible for any claim or dispute arising out of the further use and exhibition of these materials Further use and exhibition of these materials, electronically or otherwise, shall be the exclusive right of the Organizers and they shall not be responsible for any liability to any person for any loss caused by errors or omissions in the collection of information, or for the accuracy, completeness or adequacy of the information contained in these materials. 19 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK

Maintenance of decorum during the law fest is expected within and outside the college premises Any individual or Team found attempting to unduly influence Judges, Organisers or other participants to the detriment of shall be disqualified Any action detrimental to fair Competition or against the spirit of the Event is strictly prohibited The organizers reserve the right to take appropriate action for any unethical, unprofessional and immoral conduct The participants are required to be punctual in all the events organized and any delay in appearance/ presentation shall invite deduction of marks/ disqualification (at the discretion of the organizers) in their respective event Scouting in any form or any unethical/unprofessional practice shall lead to disqualification of the Team All team members shall refrain from wearing, using or carrying in any form, any identifying items, such as badges, blazers, pins or any other identifying material(s) such as books/bags with college/university/library logo or seal during the Competition. 20 ORGANISED BY MADHUSUDAN LAW COLLEGE, CUTTACK
