MINISTERS ORDERS The Conservation and Development Act [subsection 6(2)] APPOINTMENT OF MEMBERS TO THE AREA AUTHORITY OF THE ABERNETHY CONSERVATION AND DEVELOPMENT AREA NO. 129 By virtue of the authority vested in me by subsection 6(2) of The Conservation and Development Act, being R.S.S. 1978, cc-27, I, Ron Osika, Minister Responsible for Sask Water, make the following appointments to fill vacancies on the Abernethy Conservation and Development Area Authority. The Oil and Gas Conservation Act LOUGHEED MIDALE BEDS POOL HORIZONTAL WELL PROJECT MRO 213/01. Pursuant to section 17.1 of The Oil and Gas Conservation Act, approval is granted to Caprice Resources Ltd. to drill and complete two horizontal wells in the Midale Beds underlying the north-west quarter of Section 29 and the north-east quarter of Section W2M, in accordance with plans filed with Saskatchewan Energy and Mines as Document No. H.W. 921 and subject to the following: 1 A maximum allowable rate of production shall be assigned. Pursuant to section 17 of The Oil and Gas Conservation Act, approval is granted to Husky Oil Operations Ltd. to produce oil and gas concurrently from the (11) W3M oil well, from the McLaren Sand, subject to the following: 1 The gas produced from the well must be gathered and utilized or sold pursuant to section 71 of The Oil and Gas Conservation Regulations, The well shall be produced according to good production practice as defined in clause 2(r.1) of The Oil and Gas Conservation Regulations, This approval may be withdrawn, in whole or in part, if the operator demonstrates that the gas production is no longer significant and that gathering and utilizing or selling of the gas is no longer justified. Dated at Regina, Saskatchewan, April 24, HATTON MEDICINE HAT SAND GAS POOL MRO 280/01 PO 15. Pursuant to section 17 of The Oil and Gas Conservation Act, MRO 796/00 PO 60, dated September 7, 2000, is rescinded and the provisions in the following schedule shall apply to the drilling of and production from gas wells in the Hatton Medicine Hat Sand Gas Pool, effective May 1, Dated at Regina, Saskatchewan, April 20, Schedule 1 The drainage unit for the drilling and completion of a gas well shall be four legal subdivisions in a Section, grouped as follows: legal subdivisions 1, 2, 7 and 8; 3, 4, 5 and 6; 9, 10, 15 and 16; 11, 12, 13 and 14; with the exception of the following drainage units which shall be: (a) the fractional quarter Section containing approximately 40 hectares (ha) within the area described in clause 2(a); (b) the fractional north half or fractional south half of the Section containing approximately 70 ha within the area described in clauses 2(b), (f) and (i); (c) as specified in section 7 for wells drilled within the area described in clause 2(d); (d) as specified in section 8 for wells drilled within the area described in clause 2(e); (e) for the area described in clause 2(j) the drainage unit shall be comprised of two legal subdivisions in a Section, grouped as follows: legal subdivisions 1 and 2; 3 and 4; 5 and 6; 7 and 8; 9 and 10; 11 and 12; 13 and 14; 15 and 16.

5 THE SASKATCHEWAN GAZETTE, MAY 4, Within a drainage unit, the sides of the target area shall be located 200 m from the sides of the drainage unit, with the exception of the following areas located West of the Third Meridian: (a) In Townships 12 to 14, Range 30: legal subdivisions 3 to 6 and 11 to 14 of Sections 2, 11, 14, 23, 26 and 35: (i) the east and west sides of the target area shall be located 150 m from the corresponding sides of the drainage unit; (ii) the north and south sides of the target area shall be located 200 m from the corresponding sides of the drainage unit; (b) In Township 17, Range 30: fractional Section 36: In Township 18, Range 30: fractional Sections 1, 12, 13, 24, 25 and 36: (i) the west side of the target area shall be located 609 m from the east side of the drainage unit; (ii) the east, north and south sides of the target area shall be located 200 m from the corresponding sides of the drainage unit; (c) In Township 14, Range 26: Sections 3, 4, 6 to 10, 13 to 14, the east half of Section 18, Sections 23 to 33 and 36; In Township 17, Range 28: the south half and north-west quarter of Section 26: (i) the target area shall be a 235 m square situated in the north-east corner of legal subdivisions 6, 8, 14 and 16; (ii) the approval of the Rural Municipality shall be obtained prior to drilling a well closer than 75 m to a road allowance, but no wells shall be drilled within 35 m of a road allowance; (iv) the approval of the Rural Municipality shall be obtained prior to drilling a well closer than 75 m to a road allowance, but no wells shall be drilled within 35 m of a road allowance. 3 All gas wells drilled to or completed in this pool prior to April 1, 1999, shall be considered to be drilled on-target as prescribed in section 2. 4 Unless otherwise ordered by the minister, wells producing from the Hatton Medicine Hat Sand Gas Pool shall not be subject to a production allowable. 5 Unless otherwise ordered by the minister, every well shall be flow tested within three months after commencement of production in a manner approved by the minister and any such flow tests may be made in lieu of subsections 73(1) and (2) of The Oil and Gas Conservation Regulations, The operator shall run the following logs as a minimum requirement for gas wells drilled in this pool: (a) for at least one well per Section, an approved resistivity log or standard electric log shall be run; (b) an approved pulsed neutron capture log may be substituted for the requirements of clause (a); (c) the remaining wells in a Section shall be logged with an approved radioactivity log, consisting of both natural and induced radioactivity measurements, or in accordance with clause (a) or (b); (d) all logs shall be run over the interval from surface casing shoe to total depth.

(2) The Minister shall make an order pursuant to subsection (1) if the Saskatchewan Municipal Board approves an application submitted to it pursuant to subclause 13(7)(a)(ii). 24 When making an order pursuant to this part that results in the alteration of the boundaries of an urban municipality, the minister, shall: (a) describe the actual alteration of the boundaries of the urban municipality; and (b) describe the new boundaries of the urban municipality... ; 2 The Council of the Resort Village of Katepwa Beach has submitted an application for an alteration of its boundaries to the Saskatchewan Municipal Board in the form prescribed by the Minister together with: (a) a map showing in detail the proposed alteration of boundaries which involves withdrawing territory from the Rural Municipality of Abernethy No. 186 for the purpose of including lands that are serviced by the resort village in the boundaries of the ResortVillage of Katepwa Beach; (b) a certified copy of a resolution of the Council of the Resort Village of Katepwa Beach requesting the proposed alteration. 3 The Resort Village of Katepwa Beach applied to the Saskatchewan Municipal Board, as the Council of the Rural Municipality of Abernethy No. 186 would not provide a complementary resolution. The Saskatchewan Municipal Board approved the application of the Resort Village of Katepwa Beach. 4 As a result of the above, it is desirable to alter the boundaries of the Resort Village of Katepwa Beach and the Rural Municipality of Abernethy No The undersigned, therefore, issues an Order pursuant to sections 13, 14 and 24 of The Urban Municipality Act, 1984: (a) altering the boundaries of the Resort Village of Katepwa Beach by adding to the Village and withdrawing from the Rural Municipality of Abernethy No. 186, territory adjoining the Village and described in the attached Schedule A ; (b) altering the boundaries of the Rural Municipality of Abernethy No. 186, so that they correspond to this Order; and (c) confirming that the alteration shall take effect on and from the date of this Order and that the attached Schedule B is conclusively deemed to be the legal description of the boundaries of the Resort Village of Katepwa Beach. Dated at the City of Regina in the Province of Saskatchewan, this 15th day of March, Ron Osika, Minister of Municipal Affairs, Culture and Housing. SCHEDULE A The boundaries of the Resort Village of Katepwa Beach are altered by withdrawing from the Rural Municipality of Abernethy No. 186 and adding to the Resort Village of Katepwa Beach territory lying within: Township 20, Range 12, West of the 2nd Meridian and described as: (1) all that portion of the road allowance bounded on the east by a line drawn perpendicular to the said north limit of the road allowance metres west of the northeast corner of Section 4 and on the west by the production southerly of the southwesterly limit of Block A, Plan No. 97R SCHEDULE B The boundaries of the Resort Village of Katepwa Beach shall comprise the territory in the Province of Saskatchewan lying within: Township 19, Range 12, West of the 2nd Meridian and described as: (1) that portion of the northwest quarter of Section 27 shown as Block 1, Public Reserve R1 and Poplar Drive on Plan No. 62R22841; (2) that portion of the northeast quarter of Section 33 not covered by the waters of Katepwa Lake; (3) the following portion of Section 34: (a) that portion of the southwest quarter not covered by the waters of Katepwa Lake, EXCEPTING that portion lying south of the southern boundary of Parcel C and its production westerly and lying east of the southwestern boundary of Green Street, said Parcel C and Green Street shown on Plan No. FT4734; and (b) that portion of the northwest quarter not covered by the waters of Katepwa Lake, EXCEPTING: (i) that portion lying north of the southern boundary of the surveyed road shown on Plan No. 65R12373;
