1 Voting Papers for the Forty-Sixth Annual General Meeting to be held on 26 April March 2018 I am writing to provide our members with the Voting Papers for the election of five Branch Committee Members. Five existing Branch Committee Members will retire from the Branch Committee and four of them have offered themselves for re-election. A further four nominations have been received from members after the invitation to nominate for the Branch Committee was sent on 12 February There are 5 vacancies with 8 candidates seeking election or re-election. Accordingly, it is necessary to hold an election. I attach a list of retiring members of the Branch Committee who are willing and eligible to be reelected and a list of the new nominees, together with their brief CVs. Pursuant to Rule 10.1 of the Branch Rules, members of the Branch Committee will be elected by Voting Papers at the Annual General Meeting. I enclose the Voting Papers. Pursuant to Rule 10.6 of the Branch Rules, the Voting Papers must be delivered or returned to the Scrutineers and as stated on the Voting Papers at least seven clear days before the date fixed for the Branch Annual General Meeting. Accordingly, the Voting Papers must reach the Scrutineers on or before Wednesday 18 April The Report of the Scrutineers will be distributed and read out at the Annual General Meeting which will be held on Thursday 26 April This letter and the Voting Papers are being sent to members by post and by . This year, there are two ways members can vote. The first way is by the postal voting system. The Voting Papers must be sent by pre-paid post to the Scrutineers as set out in the Voting Papers. 2 second way is by fax. The Voting Papers must be faxed to the Scrutineers as set out in the Voting Papers. We ask that members use only one form of voting, as only one vote will count per member. 3 Candidates for members to cast their votes in the election 1. Helen Au Fellow. Helen first started to serve CIArb as the Honorary Secretary of the Young Members Group in year 2012, and later as the vice-chairperson, and chairperson of the Young Members Group. In year 2015, she was elected as a member of the main committee, and has been actively serving at the main committee since. In the past 12 months, Helen attended 9 of the 11 Branch Committee meetings. Helen is a barrister. She has been appointed to serve as Chairman of Appeal Tribunals constituted under section 48 of the Buildings Ordinance (Cap 123), a Member of the Board of Review constituted under section 65 of the Inland Revenue Ordinance (Cap 112), an Adjudicator of the Registration of Persons Tribunal under section 3C of the Registration of Persons Ordinance (Cap 177), a Member of the Emergency Relief Fund Committee under the Emergency Relief Fund Ordinance (Cap 1103). She is also a Visiting Lecturer at the Department of Building and Real Estate at the Hong Kong Polytechnic University. 2. Paul Barrett Associate Member since 1985 and currently a Fellow and Chartered Arbitrator. Committee member 1999 to Branch Chairman 2002 to 2004, Hon Treasurer 2000 to 2002 and 2017 to 2018, Chair of Professional Development and Training 2006 to 2008 and 2012 to Member of various CIArb sub-committees, AFL member, Course Director and regular teacher/examiner and organiser to all CIArb courses 1995 to Regional Pathways Leader (RPL) 2017 to present. Supervisory Board/Editorial Member for Asian Dispute Review Journal 2006 to In the past 12 months, Paul attended 9 of the 11 Branch Committee meetings. Barrister at Pacific Chambers with a quantity surveying background practising in arbitration, adjudication, mediation and commercial litigation. Has 35 years experience in domestic and international arbitration and mediation. Accredited mediator and adjudicator. Panel listed arbitrator in various jurisdictions. Frequently sits as arbitrator and regularly teaches and speaks on all aspects of ADR. 3

4 3. David Fong Associate Member since 2003 and currently a Fellow. David was first admitted as an Associate in 2003, became a Member in 2005 and a Fellow in He has joined the Branch as a committee member in During his offices at the EAB, he had served the Branch as the Chair of the Mediation Subcommittee, Vice-Chair of the Program Sub-committee, Chair of the Approved Faculty List Sub-committee, Vice-Chair and then Chair of the Regional Sub-committee (China). David has been a Vice-Chairman of the Branch since During the term 2017/ 2018, he has served the Branch as the Chair of External Communications cum Public Relation Officer, Vice Chair of the Approved Faculty List Sub-committee and Vice-Chair of the Regional (China). In the past 12 months, David attended 6 of the 11 Branch Committee meetings. David is a member of the Harcourt Chambers and was called to the Hong Kong Bar in He was awarded the Diploma in International Commercial Arbitration by the Chartered Institute of Arbitrators in 2006 and the Master of Laws degree with distinction by the City University of Hong Kong in He is also a CPA (Non- Practicing). David has been an Approved Faculty for around a decade. He had represented the EAB in serving as a Director of the Joint Mediation Helpline Office in 2011 to Nicholas Turner Member since 2000 and currently a Fellow. Committee member from 2015 to 2018, deputy Hon Secretary 2015 to 2016, Chair of the Programme and events sub-committee from 2016 to 2018 and Co-deputy Chairman from 2017 to In the past 12 months, Nicholas attended 7 of the 11 Branch Committee meetings. Partner at Pinsent Masons, specialising in construction and engineering law. Nicholas has experience in domestic Hong Kong and international commercial arbitration, litigation and mediation proceedings in relation to major infrastructure projects. He has lived and worked in Hong Kong for over 22 years, previously as a quantity surveyor and for over 16 years as a solicitor. He is a member of the Royal Institution of Chartered Surveyors and the Society of Construction Law Hong Kong (SCLHK). For over 10 years he was actively involved on the committee of the SCLHK and held various roles including Chairman, Secretary and Treasurer. 4

5 5. Vincent Li Associate. Proposed by Harrison Cheung, supported by Ronald Pang. Mr Vincent Li is a practising barrister, arbitrator, accredited mediator and a chartered engineer. He is included in the list of mediators and arbitrators of various local and international institutions. Before joining the legal profession, Vincent had been working in the construction and commercial field for more than 20 years. Vincent has also been engaged in teaching tasks at the Hong Kong Polytechnic University, the City University of Hong Kong, and other academic instructions, teaching subjects in development control law, construction law, contract law, arbitration, mediation, and dispute resolution. He is one of the co-authors of the book Arbitration in Hong Kong: A Practical Guide (2 nd edition) published by Sweet & Maxwell in 2011, and also the book Construction Contact Essentials in Hong Kong published by HKU Press in Vincent has acted as helper in courses organized by the East Asia Branch of CIArb. 6. Jagmeet Makkar Member. Proposed by Mary Thomson, supported by Paul Barrett. A Shipping Expert, Maritime Arbitrator and an Educator with nearly 35 years of shipping experience in wide ranging senior roles including commercial and technical. A member of the Education and Training Committee of the Institute of Chartered Shipbrokers, regular speaker at various international conferences and a contributor of papers and articles in a number of publications. A member of the Zubin Foundation Diversity List 2017 for the Ethnic Minorities. A 3 day Masterclass comprising of Shipping Contracts Management and Introduction to International Arbitration, tailored to attract maritime industry students and professionals, has been jointly organised by SkillsPlus and CIArb EAB. The program has been included under the Maritime and Aviation Training Fund for 80% refund for eligible candidates by the Hong Kong Government. This is expected to appeal to a larger audience to become students and subsequently members of the Institute. First program in January 2018 was a success and has paved the way for future ones. 5

6 7. Anny Wong Fellow. Proposed by Christopher To, supported by David Fong. Anny has been working with the ICT industry for over 25 years. She has held leadership and senior management positions at Microsoft, IBM and Cisco Systems in China and Hong Kong. She has ample of experience in leading sales and marketing organisation, government relations, strategy planning and operations, channel management, geographic expansion as well as compliance programs. Over the years, she has worked on in-house copyright infringement cases, software licensing disputes resolutions, as well as hardware brand protection cases in the Greater China region. She works closely with the Ministry of Science and Technology and the Liaison office of the Central People s Government in the Hong Kong SAR. In the past 3 years, Anny has been instrumental in helping the Hong Kong Science and Technology Parks Corporation, a statutory body, to earn the National Incubator and joint Mainland and Hong Kong Co-working Space status under the Mass Entrepreneurship and Innovation initiative, in addition to the attainment of National Bases through working with strategy partners in Mainland China. 8. Albert Yeu Fellow. Proposed by David Fong, supported by Richard Leung. Chartered civil engineer and chartered project management surveyor with 20 years experience in design and construction of tunnel, bridge, highway, waterworks and flood prevention schemes in Hong Kong. Projects involved the Hong Kong-Zhuhai-Macao Bridge, urban trunk sewerage system, major flood prevention projects, strategic new town development infrastructure projects, urban drainage improvement works. Albert is a Fellow of the Chartered Institute of Arbitrators, Member of the Institute of Civil Engineers and Member of the Royal Institute of Chartered Surveyors. He is currently the Hon Secretary of the CIArb (EAB) Young Members Group and a committee member of the Society of Construction Law Hong Kong. He is a HKIAC arbitrator and a practicing construction adjudicator and mediator in the East Asia region. 6
