1 PITTSGROVE TOWNSHIP COMMITTEE MEETING MINUTES SEPTEMBER 28, 2016 At 7:30pm The Pittsgrove Township Committee was called to order by Dr. Fiore J. Copare, Mayor. It was advertised in the Daily Journal on January 9, 2016, in accordance with Public Law 1975, Chapter 231. The flag salute was led by Mayor Copare. ROLL CALL Present: Absent: Conover, Craver, DuBois, Spinelli, Copare Solicitor Carr, Administrator DiGiorgio and Municipal Clerk Marlor were also in attendance. APPROVAL OF THE MINUTES On a motion by DuBois and seconded by Craver, the minutes from September 14, 2016 were approved as submitted. APPROVAL OF 08/2016 TOWNSHIP DEPARTMENTAL/ACTIVITY REPORTS On a motion by Craver and seconded by Conover, the departmental reports from August 2016 were approved as submitted. Committeewoman Spinelli asked Administrator DiGiorgio if the issues discussed last week were being addressed with the Public Works Forman. Administrator DiGiorgio answered that it is on the front burner. APPROVAL - USE OF FACILITY REQUEST FORMS 1. Sue Batchelder Holly Tree Acres Community Watch- Senior Center/ September 25, 2016/ 5:30pm-8:30pm 2. Shannon Morgan-Leonen Girl Scout Troop Senior Center/Every 1st and 3rd Wednesday / 6:00pm-7:00pm On a motion by Spinelli and seconded by Craver, the Facility Use Requests # 1&2 were approved as submitted. Committeewoman DuBois commented that we appear to have a few neighborhood watch groups now in Pittsgrove. Mayor Copare answered that presently we do; but Tom Hayes is trying to combine the efforts of the different groups and get them to work together.

2 TOWNSHIP ENGINEER S REPORT Mayor Copare stated that Engineer s Report was included in their agenda packets and asked if anyone had any questions. Hearing no questions the Mayor moved on. TOWNSHIP SOLICITOR S REPORT Solicitor John G. Carr reviewed his report synopsis that was submitted for distribution and review by the Township Committee. The contents of the report included: Sway Golf v. Pittsgrove Twp.: I did participate in a telephone conference with the Court, Plaintiff s counsel and counsel from the DEP. This matter is currently scheduled before the Court for oral argument in October and the State s brief is due in late September. I will share that with the Committee when it arrives however bear in mind that this matter is at the stage of Cross Motions for Summary Judgment having been filed by Plaintiff and Defendant and then the Court having interpled the New Jersey Department of Environmental Protection based upon their ownership of the land. I think the DEP position will be crucial as to whether or not DEP feels it appropriate that taxes be paid to the Township based upon the for profit activities ongoing on the golf course property. I will keep you up-to-date as this develops. Halter v. Pittsgrove Twp.: I had opportunity to review a Notice of Claim filed in the matter of an arrest which took place emanating based upon a claim by Pittsgrove Township. Initial insurance has been denied however the Township Police Professional Liability coverage provided through National Casualty Insurance Company has yet to state a position. You will find information relative to this matter attached. Spending Plan Pursuant to Mt. Laurel Decision: The Spending Plan approved at the last Township Committee meeting is appropriate for submission to the Court via a Motion. Either I or Special COAH counsel will undertake that filing in the near term. I stepped in for the last hearing based upon a perceived potential for a conflict with Township COAH counsel in the Township s Motion. I will keep you up-to-date as this develops. TOWNSHIP ADMINISTRATOR S REPORT Administrator DiGiorgio stated he had nothing to report this evening. They concluded their discussion and the Mayor moved on to Committee reports. TOWNSHIP COMMITTEE REPORTS Mayor Copare called on each committee member as follows: Committeewoman Spinelli stated that she had attended the Environmental Commission meeting on the 26 th of September and reported they discussed the upcoming shredding event. Additionally, she shared that Ron McBride and Tom Figlio had attended a meeting regarding groundwater and they shared disturbing news that South Jersey is not keeping up with groundwater replenishment. 2

3 She also reported that she was in attendance at the collective bargaining meeting on the 27 th. She concluded her report. Deputy Mayor Craver stated he had attended the Ag Advisory meeting and there were a couple of applications for farmland preservation in the pipeline. He also noted that he was in attendance at the September 27 Planning Board meeting where the main topic was the re-exam report for the Master Plan. Sally Birdsall was in attendance. He concluded his report. Committeewoman DuBois stated that she too had attended the Ag Advisory meeting and had nothing further to report. Committeewoman Conover reported that she had nothing else to add but she too was in attendance at the collective bargaining meeting. She concluded her report. MAYOR S REPORT Mayor Copare announced the following items: Announcements: Free Flu Clinic Schalick HS Oct 5, 2016 from 4-7pm. Check our website for the complete schedule. Trunk or Treat October 29 th 5:30-6:30 and Fireworks at 7 at the High School Municipal Offices are closed on October 10 th for Columbus Day He additionally noted that several residents are seemingly confused by the percentage of their taxes that are local. He asked that we create a pie chart that shows the breakdown of the percentages and asked that it be posted on our website and TV screen in the lobby. Administrator DiGiorgio stated he would take care of that and try to have it completed by September 30 th. Mayor Copare thanked him and concluded his report. PUBLIC SESSION - AUDIENCE PARTICIPATION Mayor Copare announced that anyone wishing to speak should please stand, approach the microphone, state their name and the municipality in which you live for the record, and in five (5) minutes or less briefly state your comments to the Township Committee. On a motion by Craver and seconded by Spinelli, the meeting was opened to the Public. Mayor Copare seeing no one wishing to speak asked for a motion to close the Public Session. On a motion by Craver and seconded by Spinelli, the meeting was closed to the Public. 3

4 RESOLUTIONS/CONSENT AGENDA Mayor Copare stated that all matters listed under the Consent Agenda are considered to be routine in nature, and having been reviewed by the Township Committee, will be enacted by one motion. Any item may be removed from the Consent Agenda at the request of any Committee Member and if so removed, will be treated as a separate matter. Any items requiring expenditure are supported by a Certification of Availability of Funds Resolution for the Payment of Bills (bill list attached) Resolution to Authorize a Raffle License for Schalick Track Booster Club Resolution Authorizing Approval of Change Order No. 1, Final Payment Authorization and Acceptance of the Maintenance Bond from Asphalt Industries, Inc. for 2016 Oil and Stone Restoration Program Resolution to Promote Josh Briggs a Public Works Employee from Laborer II to Laborer I A Resolution to Terminate all Participation Under the State Health Benefits Program (Including Prescription Drug Plan and/or Dental Plan Coverage) Resolution to Join the Southern Coastal Regional Employee Benefits Fund Resolution Authorizing the Appointment of Southern Coastal Regional Employee Fund Commissioner and Alternate Fund Commissioner Mayor Copare asked if anyone wished to pull any resolution or have any questions. Committeeman Craver motioned and Committeewoman Spinelli seconded to vote by Consent Agenda on Resolutions through Roll Call: Conover - yes, Craver yes, DuBois -yes, Spinelli yes, Copare yes; motion carries Committeeman Craver motioned and Committeewoman DuBois seconded to adopt by Consent Agenda on Resolutions through Roll Call: Conover yes, Craver - yes, DuBois yes, Spinelli - yes, Copare yes; motion carries OLD BUSINESS Mayor Copare asked if there was any old business. No one responded. NEW BUSINESS Committeewoman DuBois stated that she is excited that they will be sharing Centerton s 50 th Anniversary celebration with them and will be presenting a Certificate of Recognition to the Fire District. Hearing no one else comment the Mayor asked for a motion to adjourn. 4
