ADMINISTRATION OF DAMAN & DIU MRrqTM Arty unit PUBLISHED BY AUTHORITY No.l/1241ELEC-LB/03-04NP/ 31 y Administration of Daman & Diu, Office of the Director of Panchayat Election, Daman & Diu, Daman Dated :- 7/03/2011 THE DAMAN AND DIU (PANCHAYATS) (ELECTION OF CHAIRMAN, VICE CHAIRMAN, PRESIDENT-CUM-CHIEF- COUNSELLOR AND VICE-PRESIDENT-CUM-COUNSELLOR) RULES In exercise of the powers conferred by clause (b) of Sub Section 2 of the Section 65 read with Section 19 of the Daman and Diu Village Panchayats(Amended) Regulation, 1994, the Administrator of Daman & Diu is hereby pleased to make following amendments in the existing the Daman & Diu (Panchavats) (Election of Chairman, Vice Chairman, President-cum Chief Counsellor and Vice-President-cum Counsellor) Rules, 1995.

2 -2- DATED : 7T" MARCH, Short title and Commencement:- (.) These Rules may be called the Daman & Diu (Panchayats) (Election of Chairman, Vice Chairman, President-cum Chief Counsellor and Vice-President-cum Counsellor) (Second Amendment) Rules, (ii) They shall come into force at once. 2. Amendment of Rule - 9-E(2) In place of the existing Rule 9-E(2), following rules shall be substituted. 9-E(2) - if there are two or more such candidates, an Election shall be held by raising of hand of the members present in the meeting. 3. Deletion of Rule 9-E-(3) The existing Rule 9-E(3) shall be deleted. 4. Amendment of Rule 9-F In place of existing Rule 9-F, the following Rule shall be substituted. Voting:- 9-F - (1) Votes shall be taken by raising of hand of the members present in the meeting. (2) The presiding authority shall put the motion of election of President-cum- Chief Counsellor or the Vice President-cum-Counsellor, as the case may be, before the house and record the votes by raising of hands in favour of motion. (3) In the event of there being an equality of votes between the candidates, the result shall be obtained by lots as provided in Sub-section (4) of Section 19 of the Regulation. For this purpose, the presiding officer shall draw lots in the presence of the members and the candidate whose name is first drawn shall be declared to have been duly elected, as if the candidate on whom the lot falls received an additional vote. 5. 3 -3 EXTRAORDINARY No.: 09 DATED : 7Th MARCH, No.1/124/ELEC-LB/03-04NP/ 3 'Administration of Daman & Diu, Office of the Director of Panchayat Election, Daman & Diu, Daman Dated :- 07/03/2011 THE DAMAN AND DIU DISTRICT PANCHAYAT (MOTION OF NO CONFIDENCE AGAISNT PRESIDENT CUM -CHIEF- COUNSELLOR AND VICE PRESIDENT-CUM COUNSELLOR ), (FIRST AMENDMENT) RULES, 2011 In exercise of the powers conferred by clause (r) of Sub Section 2 of the Section 65 read with Section 24 of the Daman and Diu Village Panchayats(Amended) Regulation, 1994, the Administrator of Daman & Diu is hereby pleased to make following amendments in the existing the Daman & Diu District Panchayat (Motion of No Confidence against President-cum-Chief Counsellor and Vice-President-cum Counsellor) Rules, 1997: 1.Short title and Commencement:- (i) These Rules may be called the Daman & Diu District Panchayat (Motion of No Confidence against President-cum-Chief Counsellor and Vice-President-cum Counsellor) Rules, (ii) They shall come into force at once. 2. Amendment of Rule - 7:- in place of the existing Rule 7, the following rules shall be substituted as under:- 7 - Manner of voting (i) Votes shall be taken by raising of hands of the members present in the meeting. cam... Section 18 of the Daman & Diu Municipalities (Amendment) Regulation, 1994 and all other powers enabling in this behalf, the Administrator of Daman & Diu proposed to makes the following amendment to "the Daman & Diu Municipalities (President & Vice President Elections) Rules, 1995 published in official gazette Extraordinary No. 4 dated " Any person having any objection/s or suggestion/s to the said draft, the same may be sent to the Deputy Secretary UD, Urban Development Department, within 15 (Fifteen) days of its publication in the Official Gazette of Daman and Diu so that they may be taken into consideration at the time of finalization of the proposed amendment after expiry of said period of 15 days. Amendment to Rule 7 - In place of existing Rule - 7, the following rule shall be substituted : Page 4 of 6

5 -5- DATED : 7T" MARCH, Procedure for election:- (1) If, after withdrawal of candidature, if any, there is only one candidate duly nominated, he shall be declared to have been duly elected as the President. (2) The voting shall be taken by raising of hands of the Councillors present in the meeting, where there are more than one candidate duly nominated. (3) The Presiding Authority shall put the Motion of Election of President or the Vice President as the case may be before the house and record the votes by raising of hands in favour of Motion. (4) Where two or more candidates are contesting, the candidate to whom majority of votes are given by raising of hand, shall be declared elected. If there is any equality of votes, the result shall be declared by lots as provided in sub-section (4) of Section 52 of Regulation, By order andj I n the name of the Administrator of Daman & Diu. Amendment to Rule 4 For the existing rule - 4, the following rule shall be substituted: 4 - Procedure for meetin g :- In the case, No Confidence Motion against President & Vice President is to be considered, the same is to be decided by raising of hand. (2) The Presiding Authority shall put the Motion of No Confidence, before the house and record votes of members by raising of hands, in favour of Motion. (3) The President or the Vice President shall cease to be a President or Vice-President, as the case may be. if the Council passed a resolution by a majority of total number of Councilors at the special meeting.
