1 Judicial Procedures San Diego State University College CPA 1. According to NPC Unanimous Agreements : 1. CPA is encouraged to resolve alleged infractions as soon as possible through informal discussion with the involved parties before an infraction is filed. 2. Should informal discussions be unsuccessful, the judicial procedures will be set in motion. 3. When a CPA sorority is alleged to be in violation of the CPA Recruitment Rules and informal discussion does not resolve the issue, the following procedure shall apply: 3. The College Panhellenic Violation Report Form shall be completed and presented to the CPA Vice President of Judicial Affairs no more than 15 days after the alleged infraction has occurred. Recruitment infractions may only be reported and signed by one of these individuals: 1. Chapter President (on behalf of chapter) 2. Chapter Executive Board member (on behalf of chapter) 3. CPA Executive Board member 4. CPA Advisor 1. A copy of the College Panhellenic Violation Report Form will be sent by the CPA Vice President of Judicial Affairs to the CPA sorority facing allegations and NPC Area Advisor no more than 7 days after the report is reviewed. 2. When an infraction is believed to have occurred during a school break, the same timing and procedures as stated above must be followed. 3. The contents of the alleged infraction form is available upon request by the accused CPA sorority.

Allegations of recruitment violations not resolved through informal discussion, whether from a chapter(s) or from the CPA Executive Board, shall be designated for mediation and the following procedures shall apply: 1. A date and time convenient for the participants shall be determined within 48 hours of bid day and the mediation should be held as soon as possible. 2. The CPA Advisor or his/her designee advisor shall preside. 3. Participants shall be representatives of the chapter involved and the CPA Judicial Committee (CPA Vice President of Judicial Affairs, CPA President, and CPA Advisor). 4. At the conclusion of the mediation process, representatives of the chapter involved will be given a copy of their sanction breakdown and will have 3 days to sign and return to the CPA Vice President of Judicial Affairs, assuming no appeals are to be made. 5. If mediation is not successful, the case may be appealed to the CPA Judicial Committee, established according to the CPA Bylaws. If the decision of the CPA Judicial Committee is not acceptable, the case may be appealed to the NPC College Panhellenic Committee Appeals Chairman. 1. NPC Appeal Form ppeal%20notice.pdf 2. Written notice of intention to appeal to the NPC College Committee Appeals Chairman must be provided to the CPA President within 48 hours of conclusion of unsuccessful mediation. 6. If the NPC College Panhellenic Committee Appeals Chairman is unable to resolve the case, she shall be responsible for the further conduct of the case, and she shall submit by certified mail, return receipt requested, all data to the National Presidents of the chapters involved. 7. If the National Presidents cannot resolve the case, it may be appealed to the NPC Executive Committee by any National President involved in the case. 8. If the NPC Executive Committee cannot resolve the case, it may be appealed either by a National President or by the NPC Executive Committee to the National Panhellenic Conference, whose decision shall be final. SANCTIONS FOR INFRACTIONS OF RECRUITMENT RULES 1. Allegations for infractions may be written upon violation of any rule stated in the Standing Rules for Membership Selection. 2. CPA shall adjudicate fair and reasonable sanctions for infractions of the Standing Rules for Membership Selection.

CPA has agreed upon the following breakdown of sanctions, which shall be assessed by the CPA Recruitment Team the semester prior to formal recruitment and is to be approved with a majority council vote. MINOR INFRACTIONS AND SANCTIONS Minor infractions primarily come from recruitment procedure violations and include but are not limited to such things as: violations of budget; violations of guidelines for decorations, apparel, or food/drink; not adhering to scheduled hours of recruitment events; and not meeting the deadline for submitting invitation lists. Sanctions for minor infractions shall be assessed to fit the nature and degree of the offenses. Sanctions include, but are not limited to, community service or recruitment workshops. MAJOR INFRACTIONS AND SANCTIONS To be categorized into levels of severity, which shall include, but are not limited to: 1 pt: Giving of gifts, slander, hanging posters or marking fraternities with any sorority paraphernalia, misrepresenting a position 2 pt: Including PNMs in outings that involve men and/or alcohol, slander during recruitment parties. 3 pt: Breaking silence or any PNM contact rules, inviting PNMs over to any chapter house, whether it is of fraternity or sorority affiliated. Repeat Infractions: Automatic D sanction on Sanction Breakdown below. Class absence during formal recruitment, bid promising, encouraging women to Intentional Single Preference, extending bids early, and encouraging women to withdraw from the recruitment process or wait for a bid from another group: Automatic G sanction on Sanction Breakdown below. SANCTION BREAKDOWN 4. To be followed in this order: A. 1 4 pts. = Monetary Fine: The chapter shall be assigned to a monetary fine of $1 per member per infraction. Due date shall be determined during the Mediation Hearing to review all reported infractions. B. 5 7 pts. = Monetary Fine: The chapter shall be assigned to a monetary fine of $2 per member per infraction.

C pts. = Developmental Event for Chapter: The chapter shall be assigned to host a guest speaker within the chapter that shall be 75% mandatory for chapter members to attend who are active at the time of recruitment. It is required that the chapter collaborates with the CPA Vice President of Judicial Affairs to coordinate the event for the chapter. D pts. = Open Developmental Event for CPA + Loss of 1 Social Exchange: The chapter shall be assigned to host an event for the entire CPA community. The chapter shall have 1 social exchange taken away for the current semester. Social exchanges include, but are not limited to: Preference, Date Dance, Date Dash, Formals. E pts. = Open Developmental Event for CPA + Loss of 2 Social Exchanges: The chapter shall be assigned to host an event for the entire CPA community. The chapter shall have 2 social exchanges taken away for the current semester. F. 20+ = Developmental Event for Chapter & Open Developmental Event for CPA + Loss of all Social Exchanges: The chapter shall be assigned to host a guest speaker within the chapter that shall be 75% mandatory for chapter members to attend. The chapter shall be assigned to host an event for the entire CPA community. The chapter shall have all social exchanges taken away for the current semester. G. = Developmental Events for Chapter + Mandatory Attendance to all Open CPA Developmental Events + Loss of all Social Exchanges & Events The chapter shall be assigned to host 2 Developmental Events with a guest speaker within the chapter that shall be 75% mandatory for chapter members to attend. The chapter shall be assigned to attend all Open CPA Developmental Events, with a mandatory 75% chapter member attendance. The chapter shall not be allowed to engage in any social exchanges or events for the current semester.

5 Social events include, but not limited to: Pre parties, informal exchanges with fraternities (including satellite houses), dry exchanges with fraternities. INAPPROPRIATE SANCTIONS 5. According to NPC Unanimous Agreements, it is infringing on chapter s sovereignty, right and privilege to lower a chapter s quota as a recruitment sanction (II 1 C vii). 6. Delaying pledging or initiation infringes on the sovereignty of individual fraternities and may not be used as a recruitment sanction. 7. Deprivation of social privileges shall not infringe on the observance of national fraternity celebrations such as founders day. 8. It is strongly recommended that sanctions other than monetary be assessed. 9. If fines are utilized for specified violations, such as late invitation lists, the fine should not exceed a previously determined amount established by vote of the Panhellenic Council. DURATION OF SANCTIONS 10. The duration of any sanction imposed by CPA shall not exceed 1 semester from the time the final decision is rendered. 11. An official reprimand shall be recorded and signed by the chapter president of the accused member fraternity, the CPA Vice President of Judicial Affairs, and the CPA Advisor. The report shall be sent to the National President, NPC Delegate of the offending group, and NPC Area Advisor via the CPA Advisor and CPA Vice President of Judicial Affairs. DEVELOPMENTAL SANCTION RECOMMENDATIONS 12. Developmental sanction recommendations will coincide with the infraction, per mediation with the CPA Judicial Committee and the agreed upon Sanction Breakdown signed by the offending Chapter. Examples of a Developmental Workshop: Bid Promising Infraction: Chapter to host a developmental workshop on bid promising and what is considered a bid promise Other Developmental Workshops include (but are not limited to): Execution of properly timed parties Appropriate conversation topics to have with a Potential New Member What association CPA can have with Fraternities during Formal Recruitment/Silence/Strict Silence How to properly monitor social media of disaffiliated members

6 13. Chapters will have two weeks following their mediation to plan and contact the Vice President of Judicial Affairs to request approval of their Developmental Workshop(s) and must be in the current semester.
