6 June 26, 2017 A Regular Meeting and Public Hearing of the Council of the City of Manassas, Virginia was held in Council Chambers, City Hall, on the above date with the following present on roll call: Mayor Harry J. Parrish II, Vice Mayor Marc T. Aveni, Council Members Sheryl L. Bass, Ken D. Elston, Ian T. Lovejoy, and Pamela J. Sebesky; City Manager W. Patrick Pate, Deputy City Manager Bryan Foster, Assistant to the City Manager/City Clerk Andrea P. Madden, City Attorney Martin R. Crim, Chief of Police Douglas W. Keen, Community Development Director Elizabeth S. Via-Gossman, Planning and Zoning Manager Matthew Arcieri, Public Works Director Steve Burke, and Communications Manager Patty Prince. Absent from the meeting was Council Member Mark D. Wolfe. Mayor Parrish called the meeting to order at 5:30 p.m. giving the invocation and leading those present in the Pledge of Allegiance to the flag. City Attorney Report Mr. Crim reported on two delinquent tax cases involving the properties located at 9023 and 9025 Centreville Road. City Manager Report Mr. Pate reminded everyone that the City will host a Community Conversation regarding the new public safety building on Tuesday, June 27 at 7:00 p.m. at the Manassas City Police Station. The public is invited to attend and learn more about the project and speak with staff about the plans. Mr. Pate stated that last week, Community Development staff spent a morning at the Farmer s Market speaking with citizens and asking them to share their favorite thing about the City of Manassas; this was the first in a series of questions that will be posed in the City s community engagement effort. Mr. Pate commented that demolition of the Journal Messenger building on Center Street has begun. Upscale apartments with first floor retail space is planned for that property, which will be perfectly suited for VRE riders or those who wish to walk to all the downtown events, shops, and restaurants. Mr. Pate announced that Center Street is scheduled to be paved this week and thanked motorists for their patience; the work will be completed before the July 4th holiday. Mr. Pate reported that Dr. Thomas Grizzard, a long-time resident of the City and member of the Utility Commission, passed away after sustaining injuries he received in a bicycle accident. On behalf of City staff, Mr. Pate offered his condolences to the Grizzard family. 6 1

7 June 26, 2017 Mr. Pate wished the community a safe and happy 4th of July and said he looks forward to seeing everyone in downtown to Celebrate America! Chief of Police Report Chief Keen invited residents to the Community Conversation on Tuesday, June 27, 2017 at 7:00 p.m. to learn more about the public safety building. The public meeting will be held at the Police Station, located at 9518 Fairview Avenue. Chief Keen emphasized that this is the first of many meetings regarding this project and stated that he looks forward to hearing from the community. Chief Keen stated that the Police Department is working to prepare for the 4th of July celebration and noted that the Sheriff s Department and State Police will offer assistance with traffic and crowd control. Council Time Council Member Bass reported on a meeting of the Economic Development Authority (EDA) and recognized the contributions of John Gregory to the EDA and the entire community. Council Member Bass thanked the Economic Development staff for providing a great newsletter and actively working with the business community to promote all the great things happening in the City. Council Member Elston encouraged the public to thank a veteran for their service this 4th of July and offered his condolences to the Grizzard family. Council Member Sebesky also offered her condolences to the family of Dr. Thomas Grizzard and recognized his service to the community. Council Member Sebesky noted that applications for the newly formed Parks and Recreation Committee will be accepted through the summer and encouraged those interested in serving to apply online. Council Member Sebesky wished everyone a very happy 4th of July. Mayor Time In response to requests for City Council to meet at community centers throughout the City, Mayor Parrish briefly discussed the necessary considerations and legal requirements that must be adhered to in order for the Council to conduct a meeting. 1) Consent Agenda 1.1 City Council Minutes: May 22 and June 19, Resolution R: $ of Insurance Reimbursements in the General Fund 1.3 Policy #P : Revisions to the City of Manassas Financial Policies 7 2

Seconded by Vice Mayor Aveni. Roll call vote: AYES Aveni, Bass, Elston, Lovejoy, and Sebesky. ABSENT Wolfe. MOTION CARRIED. 2) Ordinances and Resolutions 2.1 Resolution #R : Weems Elementary School Matthew Arcieri, Planning and Zoning Manager, stated that Weems Elementary School has requested an extension to allow the use of existing modular classrooms through July 1, 2023, to coincide with the opening of the proposed Dean Elementary School replacement facility. The City Council held a public hearing regarding the Special Use Permit on June 19, 2017 with no speakers in favor of or in opposition to the request. Mr. Arcieri noted that the Planning Commission and staff recommend approval of the SUP as conditioned. VICE MAYOR AVENI MOVED that Resolution #R , Special Use Permit # : Weems Elementary School, 8750 Weems Road, be approved. Seconded by Council Member Sebesky. Roll call vote: AYES Aveni, Bass, Elston, Lovejoy, and Sebesky. ABSENT Wolfe. MOTION CARRIED. 2.3 Resolution #R : Metz Middle School Telecommunication Tower Matthew Arcieri, Planning and Zoning Manager, stated that Milestone Communications has requested a Special Use Permit to place a 106-foot tall wireless telecommunication tower on a replacement athletic field light at Metz Middle School. The City Council held a public hearing regarding the Special Use Permit on June 19, 2017 with no speakers in favor of or in 8 3

9 June 26, 2017 opposition to the request. Mr. Arcieri noted that the Planning Commission and staff recommend approval of the SUP as conditioned. COUNCIL MEMBER BASS MOVED that Resolution #R , Special Use Permit # : Metz Middle School Telecommunication Tower, 9950 Wellington Road, be approved. Seconded by Council Member Lovejoy. Roll call vote: AYES Aveni, Bass, Elston, Lovejoy, and Sebesky. ABSENT Wolfe. MOTION CARRIED. 3) New Business 3.1 Approve: Revisions to the Covenants, Conditions and Restrictions for Cannon Ridge Matthew Arcieri, Planning and Zoning Manager, explained that the covenants for the Cannon Ridge Homes Association adopted in 1973 gave the Town of Manassas the ability to review any future changes to the covenants as well as the right to enforce the covenants. The City does not typically enforce private covenants and has never exercised this authority for Cannon Ridge. The homeowner s association approached the City and requested the revisions and removal of the language. VICE MAYOR AVENI MOVED that the revised covenants, conditions and restrictions for the Cannon Ridge Homes Association be approved. Seconded by Council Member Elston and CARRIED UNANIMOUSLY. 4) Awards, Acknowledgments and Presentations 4.1 Presentation of Commendation Honoring Richard, Shirley and Allan Guy Mayor Parrish, joined by Elizabeth S. Via-Gossman and Mary Helen Dellinger, presented the Commendation honoring Richard, Shirley, and Allan Guy to Marianne Pendlebury, daughter of Richard and Shirley Guy, and Laura Delaney, Richard and Shirley s granddaughter. 4.2 Presentation of Commendation Honoring Planning Commission Vice Chairman Bruce Wood Mayor Parrish, joined by Matthew Arcieri, presented the Commendation honoring Planning Commission Vice Chairman Bruce Wood to Mr. Wood and members of his family. 5) Citizens Time There were no speakers at Citizens Time. 9 4

10 June 26, ) Public Hearing Mayor Parrish read an affidavit of publication that was before him signed by an authorized agent of the Prince William Times newspaper certifying that the public hearing listed on the evening s agenda was published in conformance with Virginia law and City ordinances. 6.1 SUP # : Mathis Investments LLC (Trucks Unlimited) Continued from June 19, 2017 Matthew Arcieri, Planning and Zoning Manager, explained that the applicant, Mathis Investments LLC, has requested a special use permit to allow motor vehicle repair use at 9107 Mathis Avenue. The repair use will allow for the installation of bolt-on motor vehicle parts sold at the Trucks Unlimited retail store located onsite and will be located within an existing loading bay area. Mr. Arcieri presented the project overview to the City Council and discussed the conditions that would accompany the special use permit. John E. Carter, an attorney representing the applicant, and Rick Krial, owner of Mathis Investments LLC, appeared before the Council and offered to answer any questions regarding the special use permit request. Mayor Parrish opened the public hearing and invited anyone wishing to speak in favor of or in opposition to the special use permit to come forward and address the City Council. There were no speakers in favor of or in opposition to the special use permit. Mr. Arcieri recommended that the City Council close the public hearing and schedule action for Monday, July 10, VICE MAYOR AVENI MOVED that the public hearing be closed and action scheduled for July 10, Seconded by Council Member Lovejoy and CARRIED UNANIMOUSLY. The public hearing was closed at 7:46 p.m. 7) Authorize a Closed Meeting 7.1 Authorization of a Closed Meeting VICE MAYOR AVENI MOVED that the Council convene in a closed meeting for consultation with legal counsel or briefing by staff members or consultants pertaining to probable litigation involving property located at 9787 Bragg Lane, where such consultation or briefing in open meeting would adversely affect the negotiating or litigating posture of the City and to discuss or consider the acquisition of real property for a public purpose, specifically the location of a fire station, since discussion in an open meeting would adversely affect the bargaining position or negotiating strategy of the City, as permitted by Virginia Code

11 June 26, 2017 Paragraphs A (7) and A (3), for which the Virginia Freedom of Information Act permits discussion in a closed meeting. Seconded by Council Member Bass. No. R RE: RESOLUTION IN SUPPORT OF EARLY CHILDHOOD EDUCATION WHEREAS, children s experiences in the earliest years have a large and lasting effect on their entire lives; and WHEREAS, early childhood education can particularly help children who are born with risk factors, whether economic, psychological, or physical; and WHEREAS, children who have access to high quality early childhood education programs are better prepared for kindergarten and for success in school; and WHEREAS, school readiness has economic and social benefits not only for the children who attend these programs, but for all Virginians; and WHEREAS, a successful kindergarten experience is the ideal start to the eventual completion of high school and prepares students for a successful career. NOW, THEREFORE, BE IT RESOLVED that the Manassas City Council, meeting in regular session on July 10, 2017, recognizes the importance of early childhood education to children s future success in school and in life and commends the teachers, volunteers, parents, community leaders, and students involved in early childhood education for their valuable contributions. 16 PROCLAMATION WHEREAS, parks, culture and recreation are an integral part of communities throughout this country, including the City of Manassas; and WHEREAS, parks, culture and recreation are vitally important to establishing and maintaining the quality of life in our communities, improving the health of all citizens, and contributing to the environmental well-being of a community; and WHEREAS, parks, culture and recreation, in conjunction with public-private partnerships through the Boys & Girls Club and the Freedom Aquatic & Fitness Center, build healthy, active communities that aid in the health of all citizens; and WHEREAS, parks, culture and recreation are fundamental to active sports leagues, such as the Greater Manassas Baseball League and the Stonewall Park Swim Team, develop City youth team spirit, healthy habits, and social responsibility; and WHEREAS, parks, culture and recreation, through Keep Manassas Beautiful initiatives, improve water and air quality, protect and preserve green space, provide vegetative buffers to development, produce habitat for wildlife, and ensure the ecological beauty of the City of Manassas; and WHEREAS, parks, culture and recreation support the Manassas Museum and the Center for the Arts programs to ensure a place for children and adults to learn, engage, celebrate, and foster innovation, collaboration and communication through fine arts and history; and WHEREAS, parks, culture and recreation strive to maintain safe and healthy park amenities to explore and connect with nature and to recreate outdoors, and the City of Manassas recognizes the benefits derived from parks and recreation resources; and WHEREAS, the United States House of Representatives has designated July as Parks and Recreation Month. NOW, THEREFORE, I, Harry J. Parrish II, Mayor of the City of Manassas, Virginia and on behalf of the Manassas City Council, hereby proclaim the month of July 2017 as Parks and Recreation Month in the City of Manassas and take great pride and pleasure in drawing special public attention to parks, culture and recreation that serve to provide quality of life for the local community and in communities across the nation. City Council Special Meeting May 10, 2017 (Original Adoption) City Council Meeting May 22, 2017 (Directed staff to place on the agenda for reconsideration after a public hearing) City Council Meeting June 19, 2017 (Held public hearing on increases to personal property tax rates) Summary and/or Comments: At the May 10 th special meeting, City Council adopted Ordinance # O setting the personal property tax rates for tax year 2017, which are incorporated in the FY 2018 Budget. At the May 22 nd meeting, City Council directed staff to advertise and hold a public hearing on the increases to the personal property tax rates and to place Ordinance # O on the agenda for reconsideration after a public hearing is held. The advertisement for the public hearing was published in a newspaper on May 31 st. At the June 19 th meeting, City Council held a public hearing on the increase to the personal property tax rates. The tangible personal property tax rate is proposed to increase from $3.25 to $3.60 per $100 of assessed value. The business personal property tax rate is proposed to decrease from $3.70 to $3.60 per $100 of assessed value. 24 SUP # , Mathis Investments LLC 9107 Mathis Avenue June 30, 2016 In addition to compliance with all applicable zoning, subdivision, and Design & Construction Standards Manual (DCSM) requirements, the development and use of the designated property shall be subject to the following conditions: 1. This special use permit (SUP) is for Motor Vehicle Repair, Minor, subject to the performance standards under Section of the Zoning Ordinance (Attachment A) and limited to bolt-on installation of motor vehicle parts and accessories sold onsite at the associated Motor Vehicle Parts/Supply Establishment. The site, subject to minor modifications in connection with final site plan review or final engineering, shall be developed and operated in substantial conformance with the SUP Plan and Parking Tabulation titled Mathis Investments LLC, prepared by Schools and Townsend, dated May 22, At such time as the existing freestanding sign is replaced, the sign shall be limited to a monument-style sign not to exceed ten (10) feet in height and conforming with the requirements of the Zoning Ordinance. 6. All hazardous materials shall be recycled or disposed of according to federal, state and local laws. 7. A spill kit shall be maintained on site per the Virginia Department of Environmental Quality requirements. Hazardous fluid spills shall be cleaned up immediately with the proper absorbent materials and disposed of in accordance with federal, state and local regulations. 8. Material Safety Data Sheets for any hazardous materials stored or used shall be available on site for review by public safety personnel. 9. The applicant shall be responsible for obtaining Fire Prevention Code Permits as required by the Virginia Statewide Fire Prevention Code for hazardous materials storage or operations. 10. There shall be no use of an exterior public address or loudspeaker system. 11. A copy of the conditions for this special use permit shall be included with any lease agreements and with any permit application submitted to the City of Manassas.
