1 CONSTITUTION OF THE DURBAN RUGBY SUB UNION YOUTH CLUB ASSOCIATION 1. NAME The name of the Association shall be the Durban Rugby Sub Union Youth Club Association (hereinafter referred to as the DRSUYCA). 2. AFFILIATION The DRSUYCA affiliates to the Durban Rugby Sub Union (DRSU) which in turn affiliates to the KZN Rugby Union (KZNRU). 3. AREA The area of jurisdiction of the Association shall be the area as recognised and defined by the KZNRU as applicable to the DRSU as being the district of Durban and its headquarters shall be at Kings Park, Durban. 4. COLOURS DRSUYCA colours are Yellow and Blue (as laid down by the DRSU). All affiliated teams to the DRSUYCA shall participate in their respective club colours. 5. OBJECTIVES The main objectives for which the DRSUYCA is established: 5.1 To promote the basic skills, laws, ethos, sportsmanship and general enjoyment of the game of rugby under its jurisdiction and for the furtherance and better attainment thereof. 5.2 To promote amongst the youth of its membership a basic love and knowledge of the game of rugby union. 5.3 To enforce safe play and foster skills amongst the players. 5.4 To promote the growth of the game of rugby union and to encourage active family involvement. 5.5 To arrange, sanction, regulate, facilitate and control activities including the playing of matches and tournaments in age categories up to Under 18.

2 5.6 To promote and qualify Coaches of all age groups. 5.7 To promote and qualify Referees. 5.8 To work in conjunction with schools to enhance and improve the quality of rugby. 6. MEMBERSHIP All registered DRSU Rugby Clubs, in turn duly registered with the KZNRU, that cater for ages up to and including under 18, might seek membership of the association. 7. REQUIREMENTS FOR MEMBERSHIP 7.1 Any member club or part of an affiliated Rugby Club of the DRSU that accommodates age groups up to and including under All member clubs of the DRSUYCA shall have a properly elected Committee drawn from its club membership or the parent body of its club members. 7.3 The committee of member clubs shall consist of a Chairperson, Treasurer and Secretary and others as required and elected from the current members. 7.4 Membership to be approved by a minimum of half the affiliated member clubs. 7.5 An ongoing commitment to the Objectives as laid out in Clause Adherence and support for the Rules, Regulations and Code of Conduct as approved by the DRSUYCA Committee, which may be ammended from time to time. 7.7 Membership of the DRSUYCA may be revoked: Should a member club be in contravention of the requirements for membership, such membership may be revoked at an Extraordinary or Annual General Meeting called in terms of the Constitution, where the motion to revoke is proposed and voted upon Any member club whose membership has been revoked in terms clause may apply for reinstatement at the beginning of the following calendar year. 8. COMMITTEE OF THE ASSOCIATION 8.1 The Committee of DRSUYCA shall comprise of: Chairperson Vice Chairperson Secretary Treasurer Chairperson of each affiliated club or youth rugby club that meets the requirements for membership of DRSUYCA.

3 8.2 The executive committee comprising elected Chairperson, Vice Chairperson, Secretary and Treasurer are empowered to make the day-to-day decisions in the interest of the association. 9. ELECTION OF OFFICE BEARERS 9.1 Affiliated rugby clubs or youth rugby clubs that meet the requirements of membership (per Clause 7), and that are not in arrears with annual affiliation fees, are entitled to submit in writing, nominations for Chairperson, Vice Chairperson, Secretary and Treasurer. 9.2 The name of nominees must reach the secretary in writing 7 (seven) days before the Annual General Meeting. 9.3 The name of all nominees for the position of Chairperson shall, if he/she is unable to gain election to the position, be added to the list of nominees for Vice Chairperson, Secretary or Treasurer. 9.4 The name of all nominees for the post of Vice Chairperson, shall if he/she is unable to gain election to the position, be added to the list of nominees for the post of Secretary or Treasurer. 9.5 The Chairperson shall upon election not be required to vacate his/her respective portfolio at club level. 9.6 The DRSUYCA duly elected committee shall have the power to fill any casual vacancies, should they occur during the year, in the post of Chairperson, Vice Chairperson, Secretary and Treasurer. 9.7 The Committee may co-opt any individual or group of individuals or anybody for any length of time it may determine if it deems that such co-option shall expedite the execution of its duties individuals so co-opted have no vote. 9.8 The Committee may recommend to members at an Annual General Meeting persons who they consider deserving and worthy of life or honorary membership of the association. These recommendations must be approved at an Annual General Meeting to come into effect. 10. COMMITTEE MEETINGS 10.1 The Chairperson, or in his/her absence the Vice Chairperson shall act as Chairperson at all meetings of the Committee The quorum necessary for the transaction of business shall be half of the membership of the committee Each affiliated club may appoint an alternate, in writing, should its representative on the Committee not be available for Committee meetings. Such alternates will be entitled to vote thereat.

4 10.4 The number of votes per affiliated club stands in direct relation to the number of teams represented within a specific segment of the youth spectrum with a minimum of two teams per segment to equal one vote 2 Teams in the age group U6 to U9 = 1 vote; 2 Teams in the age group U10 to U13 = 1 vote; 2 Teams in the age group U14 to U18 = 1 vote 10.5 Each segment is limited to a maximum of 1 vote, irrespective of the number of teams over and above two per segment that any one club might cultivate 10.4 Unless otherwise decided at an Annual General Meeting or Extraordinary General meeting, there shall be a minimum of four (4) committee meetings per annum. 11. GENERAL MEETINGS 11.1 All affiliated clubs to have their Annual General Meetings once every year before or by the end of October The DRSUYCA Annual General Meeting shall be held once every year before the end of November and will have placed before it for approval the Chairpersons report and financial statements for the previous financial year The Annual General meeting shall be called by giving at least 14 days (fourteen days) written notice Upon a resolution passed at a meeting of the Committee and/or upon a requisition signed by at least half of the affiliated Youth Clubs, the Chairperson shall be compelled to convene an Extraordinary General Meeting with 7 days (seven) written notice A quorum at an Annual or Extraordinary General meeting shall be half of the members entitled to attend. 12. ATTENDANCE AT GENERAL MEETINGS Entitled to attend with voting rights at an Annual or Extraordinary General meeting shall be the following: 12.1 The current Chairperson, Vice Chairperson, Secretary and Treasurer; 12.2 The Chairperson of each affiliated rugby club or youth rugby club that accommodates for the ages as per Clause 7 and that are not in arrears with annual affiliation fees; 12.3 Two nominated representatives of each affiliated rugby club or youth rugby club with membership of DRSUYCA that are not in arrears with annual affiliation fees; 12.5 Voting will be decided by means of a simple majority - the Chairperson shall have a casting vote in the event of a tie

5 12.6 Voting by proxy shall only be accepted if presented in writing by the club Chairperson or in his/her absence, instead by a representative, at the AGM; 12.7 Voting shall be by a show of hands unless otherwise decided by the majority of members at the meeting. 13. DUTIES OF OFFICE BEARERS The duty of office bearers is to uphold the constitution of DRSUYCA, and the general interest of Youth Rugby. 14. FINANCE All funds of DRSUYCA shall be deposited in an account opened for that purpose by the Committee with a registered commercial bank and shall be used at the discretion of the Committee in the furtherance of the objectives of the DRSUYCA. Note: This Constitution was approved at a DRSUYCA Annual General meeting held on 12 th November 2011.
