ROLL CALL Present: Absent: Also Present: Councilmembers Beattie, Fulkerson, Miller, and Mayor Gaylord Councilmember Caron Interim City Manager Johnson, City Attorney Staunton, City Planner Richards, Public Works Superintendent Wisdorf, and City Clerk Murphy 3. APPROVAL OF MINUTES a. City Council Work Session Meeting of October 7, 2013 Beattie moved, Fulkerson seconded, to approve the Minutes of the City Council Work Session Meeting of October 7, Motion carried 4/0. b. Regular of October 7, OPEN FORUM Beattie moved, Fulkerson seconded, to approve the Minutes of the Regular of October 7, Motion carried 4/0. Leigh Harrod, 220 Bell Street, addressed the Council to discuss procedures for repair of residential water meters. 5. CITY COUNCIL COMMUNICATIONS, QUESTIONS, and REPORTS Wisdorf gave an update on the 2013 Met Council Sanitary Sewer Forcemain Project. 6. AGENDA APPROVAL a. Meeting Agenda Fulkerson moved, Beattie seconded, to approve the meeting agenda. Motion carried 4/0.

PETITIONS, REQUESTS and COMMUNICATIONS a Minnetonka All Class Party - Minnetonka Alumni Association - (Continued) Gail Ofstehage, Minnetonka Alumni Association Vice President, addressed the Beattie moved, Fulkerson seconded, to approve the Special Event/Park Use Permit with the conditions outlined in the staff report and the conditions identified by the City Council: All music shall cease by 10:00 p.m. The event must end at 11:00 p.m. The area shall be cleaned up and everyone shall be out of the park by 12:00 p.m. (midnight) $1.00 per ticket paid to the City of Excelsior (if event is cancelled due to weather, the $1.00 per ticket charge will be waived) Temporary liquor license required Permit fee is non-refundable The applicant shall be responsible for any repairs that are needed to the grounds, as a result of the event. Second Reading of Ordinance No An Ordinance to Amend Chapter 32 of the Excelsior City Code, General Parking Restrictions Leigh Harrod, 220 Bell Street, addressed the Beattie moved, Fulkerson seconded, to continue the Second Reading of Ordinance No An Ordinance to Amend Chapter 32 of the Excelsior City Code, General Parking Restrictions to the November 4, 2013 Council meeting. Design Standards Review and Conditional Use Permit Amendment to Expand the Micro-Brewery Operation at 421 Third Street, P.I.D. # John Klick, Excelsior Brewing Company Mayor Gaylord opened the public hearing at 8:36 p.m. Bill Stoddard, Owner of the Rowhouses on Third Street addressed the

Design Standards Review and Conditional Use Permit Amendment to Expand the Micro-Brewery Operation at 421 Third Street, P.I.D. # John Klick, Excelsior Brewing Company - (Continued) Ann Jensen, 448 Third Street, addressed the John Klick, Excelsior Brewing Company, 421 Third Street, addressed the Hearing no further comments, Mayor Gaylord closed the public hearing at 8:54 p.m. Jon Lewin, Excelsior Brewing Company, 421 Third Street, addressed the Patrick Foss, Excelsior Brewing Company, 421 Third Street, addressed the Steve Jensen, 448 Third Street, addressed the Beattie moved, Miller seconded, to adopt Resolution No A Resolution Providing Conditional Use Permit and Design Standards/Site Plan Approval for Expansion of the Micro-Brewery at 421 Third Street, Excelsior Brewing Company, as amended to allow up to 12 seats on Third Street and 28 seats for the alley side) and delete the second sentence in Condition #8. Motion carried 4/0. 2. Site Plan Review - Revised Plan Third Street, P.I.D. # and # Mike Seifert, Excelsior 3 rd Street Station Mike Seifert, 352 Third Street, addressed the Bob Bolles, 340 Water Street, addressed the Beattie moved, Fulkerson seconded, to adopt Resolution No A Resolution Providing Site Plan Approval for the Excelsior 3 rd Street Station and Adjacent Areas Leased from the Hennepin County Regional Rail Authority at 352 Third Street, with the words subject to approval of the City Engineer added to Condition #2 and add that five (5) planter boxes be required in the parking lot area. Motion carried 4/0.

ADJOURNMENT Beattie moved, Fulkerson seconded to waive the second reading and adopt Ordinance No An Ordinance to Amend Chapter 6 of the Excelsior City Code to Adopt Uniform Animal Control Ordinance.
