32 GENERAL INFORMATION PERTINENT TO ELECTIONS AND ELECTED OFFICIALS Presidential Electors There are seven presidential electors in Colorado, one each for the five con~essmen and one each for the two United States Senators. The presidential. electors are selected b_y a majority vote of the delegates to the respective party state conventions, specifically, at the convention that is held during the presidential election year. Once the presidential electors are selected by the delegates of the state convention, their actual duties do not commence until after the general election, at which time it is determined by the vote of the electors of the state what political party will be represented at the meeting of the presidential electors. In other words, regardless of what the result may be nationally, those electors required to Ill:eet are the. electors representing the party whose candidates polled the highest vote m the state for president and vice president. The presidential electors convene at the Capitol of the State in the office of the Governor on the fi:st Monday, after the second Wednesday in December, following the elect.wn, ~t twelve noon, and proceed to take the oath required by law for presidential electors; then, once having taken the oath, cast their official ballot for president and vice president for the candidates of their party. The law in Colorado requires that each presidential elector shall vote for the pair of presidential and vice presidential candidates who received the highest number of votes in the preceding general election in Colorado. Having then cast their votes for the candidates, the duties of the presidential electors have been performed. Initiative Process for Proposed Constitutional Amendments Under the Initiative and Referendum Statute in Colorado there are provisions for electors of the State of Colorado to draft and submit to the people of Colorado proposed constitutional changes. There are a number of statutory requirements that must be followed in order for these electors to submit petitions for proposed constitutional amendments to the electors of Colorado for signatures. The following information is of a general nature and should be of help to those electors who might be considering the possibility of amending the State Constitution through the Initiative. The original drafts of all initiative petitions for proposed laws or amendments to the state constitution to be enacted by the people, before they are signed by the electors or any of them, shall be submitted by the proponents of the petition to the attorney general for his review and comment. Upon the request of the attorney general, any agency in the executive department and the legislative council and legislative drafting office in the legislative department shall render assistance to the attorney general in reviewing and preparing comments on the petition. No later than three weeks after the date of submission, at a conference scheduled by the attorney general, the attorney general shall render to the proponents of the petition his comments on any problems he has encountered concerning the format or contents of the petition. Such comments shall not be disclosed by the attorney general prior to the conference with the proponents of the petition, but at such time as the title, submission clause, and ballot title are approved. The comments shall become public documents. After the conference but before such approval, th,e proponents may amend the petition in response to some or all of the comments of the attorney general and resubmit the petition at a later date, or they may disregard the comments entirely. After the conference with the attorney general, the original or amended drafts, as the case may be, shall be submitted with a copy thereo~ to the secretary of state without any title, submission clause, or ~allot.title providing the designation by which th~ v~ters shall express th~ir ~hmce for or against said proposed law or consntutwnal amendment. W~thm.three days after such submission, the secretary of state shall call to h1s assistance the attorney general and the director of the legislative draft~ng office, th~ th:ee of whom, a majority controlling, shall designate and f1x a proper fair title for said proposed law or constitu~ional amendiii:en.t within five days thereafter, together with its ballot ntle and submisswn.clause, which shall correctly and fairly express the true intent and meamng of the proposed law or constitutional amendment, and immediately thereafter the secretary of state shall deliver the same with the original ~o the parties presenting it, keeping the. copy with a record.of t~e actwn taken thereon. Ballot titles shall be bnef and shall not conflict With those selected for any petition previously filed for the same election.... If any persons presenting such initiative retition are ~ot satisfied With the titles and submission clause thus provided and claim that they are unfair or that they do not fairly express the true meaning and intent of the proposed law or constitutional amendment, within forty-eight hours after its return, they may file a motion with the secretary of state for a rehearing, which shall be passed upon by s.aid board withi~.forty-eight hours thereafter, and, if overruled, upon their request, a certified copy of said petition with the titles and submi~sion clau~~ of such proposed la~ or constitutional amendment, together with a certified copy of such monon for rehearing and of the ruling thereon, shall be furnished them b~ t~e secretary of state and, if filed with the clerk of the supre~e cour~ Withm five days thereafter, shall be docketed as a cause there pendmg, which shall be placed at the head of the calendar and.dis~osd of ~ummarily, either affirming the action of said board or revers1?g.it, m wh1ch l~tter. case the court shall remand it with instructions, pomtmg out wherem said board is in error. No petition for proposed constitutional amend~e~ts ~hall be of any force or effect unless (iled with the secretary of state w1thm SIX months from the date that the titles have been fixed AND UNLESS FILED WITH THE SECRETARY OF STATE AT LEAST FOUR MONTHS BEFORE THE ELECTION AT WHICH IT IS TO BE VOTED UPON. The number of signatures required for a proposed amendment is deter~ined by a f~rmula set by statute, this statute requires that there shall be signatures equivalent to per cent of the total votes cast for all candidates for the office of the secretary of state at the precedi~g general el~ction. (This ~ould. ~ean that in the general election of 1, 1f anyone wis.hed to submit pennons.for a proposed constitutional amendment,,040 s1gnatur~s ~auld be reqmred.) The signers of the petitions for the proposed constitutic;>nal amendments must be qualified electors of the State of Colorado.
