FY 2018 Omnibus Enacted Discretinary Funding fr DHS: $47.7 billin [FY 2017 Omnibus Enacted Discretinary Funding: $42.4 billin; 11 percent increase]. Custms and Brder Prtectin (CBP) FY 2018 Omnibus Enacted Spending Authrity: $ billin [FY 2017 Omnibus Enacted Spending Authrity: $ billin; 15 percent increase]. The enacted spending authrity fr FY 2018 includes $2.3 billin in anticipated fees and fines. U.S. Brder Patrl: $4.332 billin [FY 2017 Omnibus Enacted Discretinary Funding: $4.286 billin; 1 percent increase]. This item funds the peratins f the Brder Patrl, which in FY 2017 cnsisted f apprximately 19,437 agents, as well as its assets and supprt items. The Brder Patrl is mandated by Cngress t maintain an active duty presence f 21,370 agents but did nt meet that staffing gal in FY 2017 due t recruiting and hiring difficulties. This item des nt prvide funding fr additinal Brder Patrl agents. The bill estimates that the Brder Patrl will lse mre agents than will be gained in FY 2018, resulting in reduced payrll csts. Office f Training and Develpment: $64 millin [FY 2017 Omnibus Enacted Discretinary Funding: $54 millin; 19 percent increase]. The Office f Training and Develpment (OTD) establishes standards and plicies fr designing, delivering and evaluating training at CBP. This item funds OTD peratins fr the Brder Patrl. 1

2 Trade and Travel Operatins: $4.314 billin [FY 2017 Omnibus Enacted Discretinary Funding: $4.185 billin; 3 percent increase]. This item funds mst f CBP s peratins at U.S. prts f entry (POEs) related t brder security, as well as expediting trade and travel. Office f Field Operatins (OFO): $4.031 billin [FY 2017 Omnibus Enacted Discretinary Funding: $3.942 billin; 2 percent increase]. This item funds peratins at all 328 POEs in the U.S. and apprximately 22,810 OFO fficers, as well as agriculture specialists, wrking in the agency tday. The bill prvides funding fr an additinal 328 CBP fficers at prts f entry, bringing OFO clser t addressing its staffing shrtage f at least 2,107 additinal CBP Officers stipulated by CBP s FY 2017 Wrklad Staff Mdel. The bill prhibits the DHS Secretary frm establishing, cllecting r therwise impsing any new brder-crssing fee n individuals crssing the suthern r nrthern brder at a land prt f entry. Prcurement, Cnstructin, and Imprvements: $2.281 billin [FY 2017 Omnibus Enacted Discretinary Funding: $771 millin; 196 percent increase]. Brder Security Assets and Infrastructure: $1.742 billin [FY 2017 Omnibus Enacted Discretinary Funding: $533 millin; 227 percent increase]. This item prvides funding fr assets and infrastructure fr brder security respnsibilities between POEs. Brder Fence Cnstructin and Brder Technlgy: $1.571 billin [FY 2017 Omnibus Enacted Discretinary Funding: New Funding Item]. This item funds the cnstructin f 47 miles f new barriers and 48 miles f replacement barriers alng the U.S.-Mexic brder. This includes $251 millin fr the cnstructin f 14 miles f secndary fencing in the San Dieg Sectr, $445 millin fr 25 miles f primary pedestrian levee fencing alng the Ri Grande Valley Sectr, $445 millin fr replacement f existing primary pedestrian fencing alng the suthwest brder, and $38 millin fr brder barrier planning and design. In additin, the funding item includes $196 millin fr the acquisitin and deplyment f brder security technlgy. With the exceptin f the San Dieg Sectr, the funds apprpriated in this item t cnstruct physical barriers alng the U.S.-Mexic brder must use peratinally effective designs, such as see-thrugh steel bllard designs. Nne f the funds prvided in the bill can be used t cnstruct a brder barrier in the Santa Ana Natinal Wildlife Refuge. Trade and Travel Assets and Infrastructure: $263 millin [FY 2017 Omnibus Enacted Discretinary Funding: $71 millin; 270 percent increase]. This item supprts assets and infrastructure fr CBP OFO. Cnstructin and Facility Imprvements: $60 millin [FY 2017 Omnibus Enacted Discretinary Funding: $21 millin; 186 percent increase]. This item prvides funding fr the cnstructin and imprvements f CBP facilities, including Brder Patrl Statins and prts f entry alng the nrthern and suthern brders. 2

Office f Prfessinal Respnsibility: $182 millin [FY 2017 Omnibus Enacted Discretinary Funding: $176 millin; 3 percent increase]. The Office f Prfessinal Respnsibility (OPR) maintains versight ver all aspects prmting integrity and security at CBP, including cnducting plygraph examinatins fr law enfrcement applicants and investigating fficer miscnduct. Bdy-Wrn Cameras: $0 [FY 2017 Omnibus Enacted Discretinary Funding: $0 (n change]. The bill des nt include funding t supprt the incrpratin f bdy-wrn camera technlgy in CBP law enfrcement peratins. Integrated Operatins: $1.066 billin [FY 2017 Omnibus Enacted Discretinary Funding: $1.032 billin; 3 percent increase]. This item includes funding fr multiple CBP missin prgrams, including Air and Marine Operatins. Air and Marine Operatins: $864 millin [FY 2017 Omnibus Enacted Discretinary Funding: $838 millin; 3 percent increase]. This item funds Air and Marine Operatins 1,800 federal agents and missins supprt persnnel, 240 aircraft and 300 marine vessels tasked with interdicting unlawful carg and peple withut dcumentatin in the air and maritime envirnments. Immigratin and Custms Enfrcement (ICE) FY 2018 Omnibus Enacted Spending Authrity: $7.452 billin [FY 2017 Omnibus Enacted Spending Authrity: $6.796 billin; 10 percent increase]. The enacted spending authrity fr FY 2018 includes $376 millin in anticipated fees. Enfrcement and Remval Operatins (ERO): $4.110 billin [FY 2017 Omnibus Enacted Discretinary Funding: $3.709 billin; 11 percent increase]. ERO carries ut the apprehensin, detentin, and remval f deprtable individuals frm the U.S. This item prvides funds t place mre peple in immigratin detentin facilities r in Alternatives t Detentin (ATDs), thereby increasing the verall number f peple in custdy. Custdy Operatins: $3.076 billin [FY 2017 Omnibus Enacted Discretinary Funding: $2.705 billin; 14 percent increase]. Custdy peratins manages ICE detentin peratins and remval prgrams. The bill prvides funding t maintain 40,520 immigratin detentin beds, an increase f 1,196 beds (3 percent) ver FY ICE exceeded its annualized rate f funding fr Custdy Operatins between Octber 1, 2017 and the date f the enactment f this bill. As a result, the bill directs ICE t manage its resurces in a way that ensures it will nt exceed the annualized rate f funding fr FY The bill permits the DHS Secretary t reprgram and transfer up t 5 percent f any DHS apprpriatins made available fr FY 2018 t the U.S. Immigratin and Custms Enfrcement - Operatins and Supprt funding item as necessary t ensure the detentin f aliens priritized fr remval withut regard t the June 3

4 30, 2018 ntificatin deadline. Hwever, as required fr all DHS apprpriatins, reprgrammed r transferred funds may nt increase the receptive apprpriatin by mre than 10 percent and DHS must ntify the Senate and Huse f Representatives Cmmittees n Apprpriatins at least 30 days in advance f such a transfer. ICE is directed t cmply with requirements related t detentin facility inspectins, death-in-custdy reprting, access t facilities, detainee lcatr infrmatin and cmpliance with the 2011 Perfrmance Based Natinal Detentin Standards (PBNDS 2011) and Prisn Rape Eliminatin Act. ICE must als ensure that aliens are treated fairly while mving thrugh the immigratin adjudicatin prcess and must prvide quarterly briefings t the Huse f Representatives and Senate Apprpriatins Cmmittees. The bill prhibits DHS frm using funds t cntinue any detentin facility cntract if the tw mst recent verall perfrmance evaluatins received by the facility are less than adequate r the equivalent median scre. Fugitive Operatins: $159 millin [FY 2017 Omnibus Enacted Discretinary Funding: $152 millin; 5 percent increase]. The Natinal Fugitive Operatins Prgram (NFOP) supprts the identificatin, lcatin and arrest f undcumented immigrants in the U.S. This funding item includes $10 millin t investigate and supprt activities required t identify and remve aliens wh have verstayed their visas and requires ICE t brief the Apprpriatins Cmmittees annually n the results f these effrts. The bill directs the Fugitive Operatins Prgram t cntinue t priritize the apprehensin and remval f criminal aliens and individuals wh pse a risk t natinal security r public safety. Criminal Alien Prgram: $319 millin [FY 2017 Omnibus Enacted Discretinary Funding: $312 millin; 2 percent increase]. The Criminal Alien Prgram (CAP) supprts the bimetric and bigraphic identificatin, arrest, and remval f undcumented immigrants wh are held in federal, state and lcal prisns and jails, as well as ther undcumented immigrants in the cuntry. The bill requires ICE t ntify the Apprpriatins Cmmittees prir t implementing any significant changes t the 287(g) prgram, including any changes t training requirements, data cllectin and selectin criteria, and directs the Office f Civil Rights and Civil Liberties (OCRCL) and Office f Inspectr General (OIG) t cntinue t prvide versight f the prgram. The bill directs CAP t cntinue t priritize the apprehensin and remval f criminal aliens and individuals wh pse a risk t natinal security r public safety. Alternatives t Detentin: $187 millin [FY 2017 Omnibus Enacted Discretinary Funding: $183 millin; 2 percent increase]. The Alternatives t Detentin (ATD) prgram generally places individuals under varius frms f nn-detained, intensive supervisin thrugh a cmbinatin f hme visits, ffice visits, alert respnse, curt tracking and/r 4

5 technlgy, which may include electrnic mnitring. This increase in funding fr Alternatives t Detentin (ATD) supprts a prjected daily average f 79,000 participants in the prgram fr FY 2018, an increase f 14 percent frm FY 2017 (69,466 participants). The bill directs ICE t priritize the use f ATD and release n parle r bnd fr individuals and families wh receive psitive credible fear determinatins and d nt represent a public safety r flight risk. Transprtatin and Remval Prgram: $369 millin [FY 2017 Omnibus Enacted Discretinary Funding: $356 millin; 4 percent increase]. This prgram prvides fr secure transprtatin f individuals in ICE custdy between facilities and during remval. Hmeland Security Investigatins (HSI): $2.152 billin [FY 2017 Omnibus Enacted Discretinary Funding: $2.073 billin; 4 percent increase]. The bill prvides funding t hire an additinal 65 HSI agents. Dmestic Investigatins: $1.899 billin [FY 2017 Omnibus Enacted Discretinary Funding: $1.834 billin; 4 percent increase]. This funding item supprts criminal investigatins t prtect the U.S. against terrrism, transnatinal criminal rganizatins, and ther actrs wh threaten public safety and natinal security. Dmestic Investigatins als helps identify, lcate, and remve undcumented immigrants wh verstay their visas r ptentially pse a threat t natinal security. Internatinal Operatins: $169 millin [FY 2017 Omnibus Enacted Discretinary Funding: $159 millin; 6 percent increase]. Internatinal Operatins funding enables 67 ffices in 50 cuntries t cnduct law enfrcement activities and prvide investigative supprt t dmestic ffices in cmbating crime. Specifically, Internatinal Operatins fcuses n transnatinal criminal rganizatins that engage in human smuggling and trafficking, amng ther issues. Legal Prceedings (Office f the Principal Legal Advisr [OPLA]): $272 millin [FY 2017 Omnibus Enacted Discretinary Funding: $259 millin; 5 percent increase]. The OPLA prvides legal cunsel and representatin, persnnel training, and litigatin supprt t ICE. This prgram als serves as the exclusive DHS representative in remval prceedings befre the Department f Justice Executive Office fr Immigratin Review. This funding item supprts the hiring f 70 additinal ICE attrneys. Currently, there are apprximately 1,100 ICE attrneys in DHS. Office f Civil Rights and Civil Liberties (OCRCL) FY 2018 Omnibus Enacted Spending Authrity: $23.6 millin [FY 2017 Omnibus Enacted Discretinary Funding: $22.6 millin; 4 percent increase]. The OCRCL advises and trains DHS leadership n civil rights and civil liberties issues, investigates civil rights and civil liberties cmplaints frm the public and manages DHS equal emplyment pprtunity prgrams. It is specifically invlved in the versight f ICE s 287(g) and Pririty Enfrcement Prgrams (PEPs) by prviding plicy advice, investigatins and training. Office f the Inspectr General 5

6 FY 2018 Omnibus Enacted Spending Authrity: $168 millin [FY 2017 Omnibus Enacted Discretinary Funding: $175 millin; 4 percent decrease]. The Office f Inspectr General cnducts and supervises independent audits, inspectins, special reviews and investigatins f DHS prgrams and peratins. U.S. Citizenship and Immigratin Services (USCIS) FY 2018 Omnibus Enacted Spending Authrity: $4.483 billin [FY 2017 Omnibus Enacted Spending Authrity: $4.181 billin; 7 percent increase]. USCIS is primarily funded by user fees. The ttal spending authrity fr FY 2018 includes apprximately $4.350 billin in amunts t be cllected as fees. FY 2019 Requested Discretinary Funding: $133 millin [FY 2017 Omnibus Enacted Discretinary Funding: $121 millin; 10 percent increase]. Emplyment Status Verificatin (E-Verify): $132 millin [FY 2017 Omnibus Enacted Discretinary Funding: $119 millin; 11 percent increase]. USCIS discretinary funding predminantly funds the E-Verify prgram. This includes $109 millin in funding fr the peratins, missin supprt, and assciated management r administratin csts f E-Verify and $23 millin in funding fr the prcurement, cnstructin and imprvement csts f E-Verify. Immigratin Examinatins Fee Accunt: $4.268 billin [FY 2017 Omnibus Enacted Spending Authrity: $3.998 billin; 7 percent increase]. Almst all f USCIS funding cmes frm the Immigratin Examinatins Fee Accunt. This accunt is where the fees cllected frm immigrants applying fr immigratin status r visas are cllected and depsited. Funds are used t perate USCIS District Offices, service centers, Asylum/Refugee Operatins, recrds, infrmatin and custmer services, adjudicatin services and administratin. Asylum, Refugee and Internatinal Operatins: $345 millin [FY 2017 Omnibus Enacted Spending Authrity: $358 millin; 4 percent decrease]. This item is funded frm the Immigratin Examinatins Fee Accunt t extend humanitarian prtectin and immigratin benefits t eligible individuals. This item was the nly USCIS adjudicatin services item that saw a funding decrease, despite an verall increase in the enacted spending authrity fr the Immigratin Examinatins Fee Accunt. Systemic Alien Verificatin fr Entitlements (SAVE): $37 millin [FY 2017 Omnibus Enacted Spending Authrity: $34 millin; 9 percent increase]. This prgram assists federal, state and lcal agencies in determining eligibility fr licenses r public benefits by verifying the applicant s immigratin status. It is funded thrugh a cmbinatin f fees charged t users f the system and funds frm the Immigratin Examinatins Fee Accunt. Citizenship and Assimilatin Grants: $10 millin [FY 2017 Omnibus Enacted Spending Authrity: $10 millin; n change]. Cngress authrized USCIS t bligate $10 millin in FY 2018 frm user fee revenue t supprt the immigrant integratin grants prgram, nw knwn as the Citizenship and Assimilatin Grants prgram. These grants help prmte awareness and understanding f citizenship and assimilatin int American civic life. 6

7 H-1B and L Visa Fraud Preventin and Detectin Fee Accunt: $67 millin [FY 2017 Omnibus Enacted Spending Authrity: $47 millin; 43 percent increase]. These funds are cllected frm fees and used t prevent and detect fraud in the delivery f all immigratin benefit types t ensure the integrity f the immigratin system. H-1B Nnimmigrant Petitiner Fee Accunt: $15 millin [FY 2017 Omnibus Enacted Spending Authrity: $15 millin; n change]. Certain emplyers wh participate in the H 1B prgram must pay $1,500 in additin t the Frm I-129 base filing fee. Of the amunts depsited int the H 1B Nnimmigrant Petitiner Accunt, 55% f the fee revenue is prvided t the Department f Labr, 40% is prvided t the Natinal Science Fundatin and 5% percent is retained by USCIS. Office f Citizenship and Immigratin Services Ombudsman FY 2018 Omnibus Enacted Spending Authrity: $6.2 millin [FY 2017 Omnibus Enacted Discretinary Funding: $6 millin; 3 percent increase]. The USCIS Ombudsman assists individuals and emplyers with cases pending befre USCIS and prpses plicy changes t mitigate identified prblem. 7
