1 City of Camarillo AGENDA REPORT Date: February 14, 2018 To: From: Subject: Honorable Mayor and Councilmembers Dave Norman, City Manager Request of Council Member Trembley: City Council Term Limits SUMMARY Staff asks that Council discuss and provide direction on Council Member Tony Trembley s request to place a City Council term limit ordinance on the November 6, 2018 General Municipal Election ballot. DISCUSSION At the City Council meeting of January 24, 2018, Council Member Trembley requested that an item be placed on the City Council Agenda to discuss and consider placing a Council term limit ordinance on the November 6, 2018 General Municipal Election ballot. Council Member Trembley s proposed term limit ordinance was distributed to the City Council at that Meeting; this is Attachment A. California Government Code Section 36502(b) provides that, Any proposal to limit the number of terms a member of the city council may serve on the city council, or the number of terms an elected mayor may serve, shall apply prospectively only and shall not become operative unless it is submitted to the electors of the city at a regularly scheduled election and a majority of the votes cast on the question favor the adoption of the proposal. There are two primary paths a local ballot measure can take to qualify for placement on an election ballot: 1) citizens can propose an initiative and circulate a petition for signatures to qualify the initiative for the ballot, or 2) a City Council may pass a resolution to place its own measure on the ballot, thereby bypassing the need to petition for signatures. If a qualified citizen petition is signed by 10% or more of the voters of the city, the City Council may adopt the proposed ordinance without alteration, thereby bypassing the need to place the initiative on the ballot. The deadline to file petitions for an initiative is May 18, The deadline to submit an approved resolution to the Clerk-Recorder to place an ordinance on the ballot is July 3, CC IV B 1

The Clerk-Recorder s timeline is Attachment B. The County of Ventura and the Cities of Thousand Oaks and San Buenaventura all have term limit ordinances, and these are found under Attachment C. On January 31, 2018, Camarillo Citizens for Term Limits submitted a Notice of Intent to Circulate a Petition for the placement of a City Council term limits ordinance on the November 6, 2018 General Municipal Election ballot. The ordinance was further revised and resubmitted on February 5, 2018 to correct minor technical errors identified by the City Attorney. This corrected ordinance and its Notice of Intent are Attachment D. If the Camarillo Citizens initiative qualifies for the ballot, and the Council either places its own ordinance on the ballot, or Council Member Trembley s proposed ordinance qualifies for the ballot after the required number of signatures have been gathered, then the competing initiative receiving the highest number of affirmative votes would prevail and become the City s term limit ordinance. BUDGET IMPACT The cost to place a measure on the November 6, 2018 General Municipal Election ballot is estimated to be approximately $13,700. SUGGESTED ACTION Provide one of the following directions to Staff: 1. Prepare a resolution to place a City Council term limits ordinance on the November 6, 2018 General Municipal Election ballot. 2.
