For example, Chapter 199 may be subdivided into sections as 199.1, 199.2, 199.3, etc., and each section subdivided by means of decimals (199.2, , etc.) creating subsections as necessary. 6 100.3 There shall be an official book of codification of all Statutes compiled, maintained, and kept up to date by the Statutes Committee, and the Senate President. There shall also be as many copies of the official codification as is necessary for Student Government use The codification shall include all Statutes, with the exception of Constitutional amendments, passed by the Senate and approved by the Student Body President dating from August 1, All Statutes, except for funding Statutes, passed before that date shall become null and void upon passage of this Statute, unless such Statutes are passed by the Senate again Any Statutes passed before the Constitution is approved by the student body, that conflict with the Constitution, will become null and void after the passing of the Constitution. No Statute may conflict with the United States Constitution or laws, the State of Florida Constitution or laws, or the Student Government Constitution. 7 101 Construction of the Student Government Statutes Any bill amending statutes will automatically result in the adjustment to the Table of Contents, by the Statutes Committee, where necessary, without the need for a second bill to be passed A proposed statute amendment shall be termed a regular amendment if it involves only one title and one chapter of that title, except in the matter of a name change, then it may concern all appropriate titles Regular amendments shall require two readings as defined by statute A proposed statute amendment shall be termed a special amendment if it involves more than one title and/or more than one chapter of one title Special amendments shall require three readings and suspension of this rule shall not be in order at any time without unanimous consent of the Senate Each chapter shall be defined and identified as an Act. There shall be an index of all Acts to be included with these statutes Each section or subsection in the statutes shall have printed after it, a history giving the Senate session and bill number in which it was amended. 8 102 Compliance with the Statutes All Student Government officers shall comply with the Student Government Statutes. Any willful or deliberate disregard of any Statute may be considered as cause for impeachment in accordance with the Student Government Constitution All students serving in any capacity with Student Government must comply with the Student Government Statutes. Any willful or deliberate disregard of any Statute may subject that student to removal from the position When a conflict between statutes is encountered, the most recently amended statute shall take precedence. 9 103 Definitions of Terms in the Student Government Statutes Student Government officers shall be defined as "any person serving in an elected position within Student Government." Abstentions - Abstain shall be the response by a Senator in a vote to refrain from voting because of direct personal or pecuniary interests Ad-Hoc Committee - A Senate committee, created by either the Senate President or by a majority vote of the Senate for a specific task, after which it is dissolved, and on which any student is eligible to serve Agency - An organization that receives its operating revenue directly from allocations in the Activity and Service Fee Budget and whose duties, composition, and responsibilities are outlined in Statute Select Committee - A Senate committee, created by either the Senate President or by a majority vote of the Senate for a specific task, after which it is dissolved, and on which any Senator is eligible to serve Standing Committee - A Senate committee established by Senate ROP that has perpetual life. 11 200 Method of Impeachment All appointed and elected Student Government officers (i.e. Senators, President, Vice president) and the Supreme Court Justices can be subject to impeachment The following impeachment procedure shall be adhered to for the impeachment of all appointed and elected Student Government officials (for constitutional, statutory, rules of procedure violations): A. The accusing party brings a complaint to the attention of any Student Government Senator. B. The Senator then submits a memo to the Senate President Pro-Tempore with wording similar to "name" holding the office of " " has been accused of " ". C. The Senate President shall be held responsible for bringing to the floor of the Senate the creation of an unbiased/impartial ad-hoc committee that will be composed of five members from the Senate elected by the Senate. The author/sponsor of the charges, the Senate President and the Senate Vice-President cannot sit on the ad-hoc committee. D. The committee shall give notice to the accused of the proceedings at least five school days before the hearing. That notification must be written via certified mail or verbal. E. The speaking rights of the accused must be comparable to that of a member of the investigative committee. The accused has a right to procedural objections and to speak in turn. The accused does not have a right to make a motion, except for a motion to quash. F. The committee shall give a report to the Senate within ten school days. The committee can find the charges groundless or valid. The committee, by majority vote, may recommend that charges be dropped, or that Articles of Impeachment, in the form of a resolution, be drawn up. If the committee finds that the charges are groundless then the impeachment/charges process stops. G. In the Senate, the accused must be allowed speaking time after the author/sponsor of the resolution. The accused must have been given advance notice of Senate consideration. Either the accused or the counsel, but not both, will have speaking rights as a Senator with the exception that the accused is also afforded first place on the speaking list after the author/sponsor of the impeachment resolution then is given the last word after the question has been called. H. A two-thirds vote of all Senators present and voting shall be needed to recommend impeachment of the individual. From that point on the individual shall be tried by the SG Supreme Court (if the individual is a SG Supreme Court Justice, then he/she shall be tried by the Judicial Review Committee) which shall determine if that individual shall be impeached Any Senator who is impeached and subsequently removed can never hold the position of Senator again. 13 201 Removal of Senate officers, Cabinet officers, and other executive appointees, excluding Supreme Court Justices and those executive appointees mandated by the school or state For purposes of the chapter, agency directors shall not be considered executive appointees. All such members shall be exempt from this chapter The Student Body President may remove any executive appointee except Supreme Court Justices Any senator who feels that a cabinet officer, or any other executive appointee is delinquent of their duties, may call to remove that person from office. A. The President Pro-Tempore shall immediately call for the election of a five person Senate committee to investigate the charges. B. The committee shall meet at least on that next Friday and Monday after the election. The committee shall notify the accused by either written or verbal notice before that Friday's meeting. The committee shall meet on a mutually acceptable time on those two days. C. The speaking rights of the accused must be comparable of that of the members of the investigative committee. The accused shall not have the right to make a motion, except for a motion to quash. Procedural objectives shall be allowed. The committee shall make its findings known by either verbal or written notice that Monday. D. During the next Senate meeting, the committee shall announce its recommendation to the Senate to remove the subject, or to drop charges. If the committee's recommendation is to drop the charges, then the issue shall die. E. If substantial evidence is found to warrant removal from office, then the accused shall have the right to speak first after the committee, and last after the vote has been called. F. By majority vote, the Senate shall send the issue to the Student Government Supreme Court. G. That following Friday, the Court shall be authorized to hold a mandatory meeting. The removal of office shall be placed first on the agenda. H. The Court shall have seven school days to deliberate. The Court's decision shall be binding All Senate officers, including Senate appointed ARB members, shall be subject to a vote of confidence as outlined in the Senate's ROP. 14 202 Removal of SG Supreme Court Justices Any justice may be impeached by the Senate as outlined in Title II Chapter As stipulated in the Constitution, no justice may be tried by a fellow justice Upon impeachment by the Senate, the Student Body President and the Senate shall be required to appoint a nine person Judicial Review Committee. The Committee shall be composed of five members of the Executive Branch, appointed by the Student Body President, and four senators appointed by the Senate. The committee must be approved by the Senate The Judicial Review Committee shall hold a hearing to determine if the justice shall be removed. The Committee shall operate according to the rules of procedure and statutes of the Court. This shall ensure due process It shall take, as specified in the SG Constitution, a 2/3 vote to remove a justice from his or her position. Printed on Monday, October 16, 2000 Chapter 202

15 203 General Regulations The President of the Student Body shall provide, when asked, a list of all persons paid with A&S funds All meetings of the USF Student Government shall be open to the public except SG Court deliberations, Judicial Review Committee deliberations, Impeachment Committee deliberations and New Legislation Committee Supreme Court Justice Nominee deliberations All USF Student Government meetings shall be held on campus The Student Government may own vehicles for the use of Student Government and/or student organizations The Chief Accountable Officer and/or Agency Director for each respective organization will be responsible for their own vehicles The Chief Accountable Officer and/or Agency Director shall set rules and guidelines for use of these vehicles with the approval of the Senate and the President of the Student Body. 16 Legislative intent and declaration of policy: Student Government Code of Ethics A. It is essential to the proper conduct of Student Government that its officials be independent and impartial. Student Government officers, appointees, and employees hold their positions for the benefit of the Student Body. Such officers and employees are bound to observe in their official acts, the highest standards of ethics consistent with Statutes. B. It is the intent of this chapter to protect the integrity of Student Government by prescribing restrictions against conflicts of interest and unethical practices No member of Student Government shall: A. Take advantage of the official capacity of their office for their own personal gain or advantage, including any act beneficial to any person in whose welfare he/she is interested. B. Participate in any private business or professional activity in which they have any direct or indirect financial interest which would place that person in conflict between that interest and the public interests of the Student Body. C. Participate in any activity done with a wrongful intent and for the purpose of obtaining, or receiving compensation for, any benefit resulting from some act or omission of a public servant which is inconsistent with his or her duties. D. Participate in any malicious act. E. Misuse Student Government Property: No officer or employee shall use or allow the use of Student Government property, facilities, vehicles, or personnel of any kind for other than University Business. F. No Student Government Officer shall offer or agree to accept a bribe. G. Inducing to Act: No officer or employee of Student Government shall aid, advise, procure, or in any way induce another to act in violation of Chapter Printed on Monday, October 16, 2000 Chapter 204

17 204.3 Violations of Criminal Law or Liability under Civil Law. A. No elected member of Student Government shall be convicted by a court of competent jurisdiction of a felony of misdemeanor related to the duties of his or her office. B. No member of Student Government shall be found civilly liable for an act of moral turpitude in relation to their office. C. For the purposes of this chapter a conviction or civil finding of liability must be for an act occurring during the Student Government member s current term of office or during the official campaign period for that member s office as defined by Student Government Statutes. D. Any Student Government member may be immediately suspended from office if he or she is convicted or found civilly liable. 1. Suspension of a member of the Executive Branch, other than the President, is dependent on the Student Government President. Suspension of a member of either the court or the legislature, with the exception of the Senate President or Chief Justice, will be dependent on the agreement of two of the three branch heads. 2. Suspension of a branch head will be dependent on the agreement of the two remaining branch heads. 3. During the period of suspension, the vacated seat, if required, will be filled on an interim basis by the general rules of succession set forward in the Student Government Statutes and Constitution. E. During the period of suspension, the suspended officer will not perform any official act, duty, or function or receive any pay, allowance, emolument, or privileges of office. F. If the suspended member of Student Government is subsequently cleared the charges that were the reason for their suspension, the individual will be immediately reinstated and be entitled to back pay. G. If the member in question is cleared of guilt or liability in relation to the charges in question, the individual will be immediately returned to their previous position unless during the suspension the term of office for their position expired. H. All actions of Student Government in pursuance of may be appealed to the University President A violation under this chapter may be cause for impeachment, suspension, or removal from office, suspension or dismissal from employement, or public censure reprimand All individuals accused of violation of this chapter shall have the right to demand suppression of the accusatory report before the Student Government Supreme Court If at any time before the duration in which investigation, suspension, and/or removal from office is sought, the member in question resigns, all procedures will cease and the position will be filled according to Statutes and the University of South Florida Student Government Constitution. 19 205 Public Records Act All Student Government records shall be open for a personal inspection of any person and those in charge of such records shall not refuse this privilege to any person Student Government Records shall refer to all material, regardless of physical form or characteristics, made or received pursuant to law or in connection with the transaction of official business by any committee, division, or similar structure of any branch of Student Government Every person having custody of Student Government Records shall permit them to be inspected and examined at reasonable times during normal operating hours and be monitored by that person by any person, and allowed to be copied thereof on payment of any appropriate fees, if any. These fees shall not exceed the actual cost of duplication and/or printing of the material requested The SG Supreme Court shall have the power to issue injunctions to enforce the purposes of this chapter upon the application of any individual. 20 206 South Florida Anti-Discrimination Act Unlawful discrimination shall be defined as the differential treatment of a student solely on the basis of race, creed, color, religion, sex, age, sexual orientation, national origin, marital status, parental status, disability, personal wealth, or any combination thereof. Discrimination shall further be defined as the denial of due process or the infringement of the substantive rights of any student No SG officer, employee, branch, agency, affiliated group, or A&S funded Student Organization shall practice unlawful discrimination as defined in Statute Upon finding a violation of this chapter, the Supreme Court shall be empowered to issue the following remedies: suspension/loss of SG status, freezing/loss of SG funding, removal from office, and/or probation as stipulated by Statutes Any person or entity found in violation of this Statute may appeal the decision to the Vice President for Student Affairs. 21 207 Oath of Office Act Except as provided in Statute, all SG officers shall be required to take the oath of office as outlined in Statute No SG officer shall be required to take any oath that would violate any personally held moral intent The oath shall be as follows: "As a member of the Student Government of the University of South Florida, I [name] do hereby affirm to uphold the office of [office], to abide by the Student Body Constitution, to uphold the Statutes incorporated thereto, and to represent the Student Body to the best of my ability." 22 208 SG Employment Act All persons employed by the Student Government Association Agencies and Branches, must be USF students, exceptions shall be made in Statute All employees of Student Government shall be responsible for all information contained in the SG Employment Handbook Failure to act in accordance with the handbook shall be grounds for immediate and unconditional termination SG Employment Handbook No SG official elected or appointed shall be remunerated unless so established in the current operating budget and all employment paperwork has been approved prior to commencing work. This is not intended to prohibit the hiring of personnel through the office of student employment and financial aid In case a position s duties cannot be fulfilled, any elected or appointed paid position may split his/her hours and hire a substitute to assume some of his/her duties as long as the total amount paid does not exceed the amount in the current operating budget As the single exception of Statutes, the following officials shall be remunerated: A. President of the Student Body. B. Vice President of the Student Body. C. President of the Student Senate. D. Vice President of the Student Senate. E. Chief Justice of the Supreme Court. F. Directors and Assistant Directors of Administrative Support Offices. G. Chairpersons of Senate Standing Committees, including FSA Liaison. H. Executive Cabinet Officials as appointed by the Student Body President and confirmed by the Senate. I. Director, Assistant Directors, and Committee Chairs of the Campus Activities Board All staff secretarial positions including clerks, typists, stenographers, and such, shall be defined as OPS positions. Salaries for these positions shall be set in the current operating budget No elected or appointed official, nor staff positions outside of Agencies, shall receive salary adjustments without the approval of the Senate Interim Funding and Transfers Committee and the Student Body President. 24 300 Executive Branch Act The Executive Branch shall be composed of all offices outline in Titles III and IX of these Statutes. The power of the Executive Branch shall be vested in the Student Body President The Executive Branch shall be responsible for the enforcement and execution of these Statutes Printed on Monday, October 16, 2000 Chapter 300

25 301 The Executive Office (Cabinet) Act The Executive Office shall be comprised of the President, the Vice President, and all Cabinet level positions. These positions shall be the Directors of Administrative Support Offices, Executive Assistant, and any and all Administrative Assistants appointed by the President The Executive Office shall be the vehicle through which the President and Vice President execute their constitutional power and carry out their administrations programs, projects, and agenda Administrative Assistants shall be appointed by the President and, if the position receives remuneration, must be approved by the Senate. This person shall assist the Executive Office as deemed necessary by the President and in a manner that benefits the Student Body The Executive Office shall derive its authority from the Student Body President and Vice President, and has no authorization, power, or authority to act unless specifically granted by the President and/or Vice President The President has sole power over the appointment within the Executive Office and may dismiss at his/her discretion any individual serving under him/her, except as outlined by Statute. 26 301.6 The following is a list of the Administrative Support Offices as defined elsewhere in statute: A. Office of Academic Affairs [OAA] B. Office of Administration & Communication [OAC] C. Office of Cultural Diversity [OCD] D. Office of Government and Political Affairs [GPA] E. Office of Internal Affairs [OIA] F. Office of Legal Affairs [OLA] G. Office of Management and Budget [OMB] H. Office of Graduate and Non-traditional Student Affairs [GNA] I. Office of Resident Affairs [ORA] J. Office of Student Affairs [OSA] K. Florida Student Association Intern [FSAI] L. Office of Athletic Affairs A member of the Executive Office shall have debating privileges with 2/3 consent of the Senate The Executive Office shall meet once a week during the fall & spring semesters and bi-weekly during the summer semester at times set by the Vice President. Minutes of these meetings will be kept and recorded The Vice President serves as chair of the Executive Office, if he/she is unable to do so, the President shall assume responsibility. As Chair, the Vice President may establish the structure for reporting techniques that are deemed appropriate for the efficient operation of the Executive Office. 301;10 The Vice President will ensure that Executive Office Directors are available and hold their office hours. Directors not holding their office hours may be removed from office. 301;11 Each Director may appoint eligible students to serve as staff members of all offices as deemed necessary, with the approval of the Vice President. Additional appointments of staff persons may be made by the President or Vice President. These positions will not be eligible for remuneration. 301;12 Each Director, with the advice and consent of the Vice President, may establish any formal chains of command within his/her own Office. The titles of Director and Assistant Director are paid positions and approval is required before appointing students to those positions as detailed in Statute. 301;13 Any and all eligible students desiring the opportunity to become involved in SG shall be given the opportunity to do so, and will work with the elected leadership of the Student Body to insure the overall success of the organization. 27 302 Administrative Support Office (Cabinet Offices) All Directors and Assistant Directors of Administrative Support Offices shall be subject to the advice and consent of the Senate as outline in Statute and shall serve on the Executive Office and shall conduct their Offices as determined by the Vice President While the following are a suggested list of Administrative Support Offices, they are in no way binding to the Student Body President, but rather a model of the support offices which he/she may decide to create Office of Academic Affairs (OAA) The OAA shall be responsible for providing the Executive Office information and program options on academic issues that affect the students of USF The duties of the Director of the OAA include, but are not limited to: A. Advising the President on the activities and proceedings of the Faculty Senate and relevant academic committees of USF. B. Research and development of academic initiatives and programs for the President. C. Advising the President on all academic issues. D. Representing the interests of the Student Body, as expressed through the President, to the faculty and administration on all major academic related programs or initiatives of the University. E. To assist students and/or serve as a de facto ombudsman of student academic concerns by directing students and/or student concerns to the appropriate University official, and ensure that they are addressed tenaciously. F. Work with the Senate Academic Affairs Committee. G. Perform other related functions as directed by the President Office of Administration and Communication (OAC) The OAC is responsible for the effective operation of the Executive Office, insuring that appropriate communication exists between the Executive Office and other entities within and without SG, execution of discretionary programs or projects for the Executive Office, and maintenance of all Executive accounts and property. 28 The duties of the Director of the OAC, referred to as Chief of Staff shall include, but are not limited to: A. Oversight of other Administrative Support Offices, under the direction of the Vice President. B. Development of policy on the operation of Student Government. C. Screen and make preliminary recommendations of candidates for Presidential appointment as outlined in Statute. D. Maintain strong lines of communication between the Executive Office and other entities within Student Government. E. Use the media resources to inform and educate the Student Body of Student Government's activities. F. Inform the press of the actions of Student Government. G. Design all printed materials, placing all advertisements, and overseeing all public relations activities for the Executive Office. H. Work with Administrative Support Office Directors and Agency Directors to develop publicity campaigns for programs and activities. I. Execution of any discretionary task for the President or Vice President Office of Government and Political Affairs (OGPA) The duties of the Director of the OGPA, also referred to as Director of Student Lobbying, shall include, but not be limited to: A. Advising the Student Body President on all legislation pertaining to higher education in the State and Federal Government. B. Directing the lobbying activities of Student Government in conjunction with the Senate Legislative Concerns Committee. C. Representing the interests of the Student Body, as articulated by the President, to the State University System Board of Regents, the State and Federal Government when appropriate. D. Using the resources of the Executive Office to enhance student awareness of legislative activity and issues. E. Conduct systematic, continuous, and tenacious study of the Student Body Statutes for the purpose of reducing inconsistencies and improving clarity. B. Submit a report to the Senate President, twice a semester, detailing any inconsistencies within the Student Body Statutes, for the purpose of revision. C. Shall present and elaborate upon, in an unbiased manner, to the SG Supreme Court, all cases heard by the Court involving persons accused of violating the Student Body Constitution, Statutes, in accordance with SG Statutes. D. Representing the Student Body and Student Government and all affiliated agencies or student organizations in all cases in which the Student Body, Student Government, affiliated agencies or student organizations are a party. E. Provide opinions on the Constitution or Statutes to any student who shall, in writing, request such an opinion. F. Be thoroughly familiar with the Rules of Procedure of the Supreme Court The duties of the Student Counselor shall include, but are not limited to: A. Providing representation to students or student organizations who request it in all cases before the Supreme Court. B. Be thoroughly familiar with the Rules of Procedure of the Supreme Court Office of Cultural Diversity (OCD) The duties of the Director of the OCD shall include, but not be limited to: A. Advising the President on issues of race, ethnicity, gender, sexual orientation, and religion. B. Research and development of programs for the President that are designed to enhance the quality of life for affected students. C. Using the resources of the Executive Office to develop multi-cultural awareness. D. Chair the Cultural Student Council as outlined in statute. E. Advise the University on issues concerning recruitment and retention of affected students. F. Develop and maintain a dialogue with groups at other State institutions concerning the affairs of affected students. G. Non-traditional students shall be defined by the Non-traditional Student Association The duties of the Director of the OGNSA shall include, but are not limited to: A. Advising the President on all issues pertaining to graduate and non-traditional students at USF. B. Research and development of programs for the President that are designed to enhance the quality of life for graduate and non-traditional students. C. Serving as liaison between Student Government and all graduate and non-traditional student organizations, including but not limited to: Non-traditional Student Association and the Graduate Student Association. D. Perform other related functions as directed by the President Office of Resident Affairs (ORA) The ORA shall be responsible for providing information and program options on all matters concerning students' needs, issues, or concerns about student housing The duties of the Director of the ORA shall include, but are not limited to: A. Advising the President on all issues pertaining to social and living conditions of the students at USF. B. Chair the Resident Student Council. C. Publish, in conjunction with Student Information Services, an off-campus living handbook. D. Work in conjunction with fraternal organizations, residence halls, and apartment complexes to promote better relationships between these groups and the students of USF. E. Perform other related functions as directed by the President Office of Student Affairs (OSA) The OSA shall be responsible for providing information and program options to the Executive Office regards any non-academic aspect of Student Life. Advise the President of all issues pertaining to non-academic student activities, especially those not under the direct jurisdiction of another Administrative Support Office. B. Research and development of programs for the President that are designed to enhance the quality of life for students by improving the campus, its facilities, programs, and environment. C. Actively participate in the programs that address such social concerns that are not under the jurisdiction of another Administrative Support Office. D. Chair the Greek Council as outlined in statute. E. Work in conjunction with the Senate Student Affairs Committee. F. Perform other related functions as directed by the President. 302;10 Executive Assistant 302;10.1 The Executive Assistant shall assist the Executive Branch in fulfilling the duties of the offices therein. 302;10.2 The duties of the Executive Assistant shall include, but not be limited to: A. Research and prepare reports on various projects and/or issues for Student Government that will benefit the students of the University. B. Design and produce various management tools for Student Government. C. Design, modify, and manage a filing system for the Student Government Association. D. Prepare workbooks, reference guides, and handbooks on various subjects or projects for Student Government. E. Serve as an ex-officio member of the Executive Office. F. 32 304.0 President of the Student Body Chapter Number 304 Presidential & Vice Presidential Powers Act The powers of the President shall be enumerated herein and shall not be limited to those only listed Constitutionally granted powers are those powers delineated in the Student Body Constitution. These powers, duties, and responsibilities, subject to statutory limitations and provisions are: A. Be responsible for all agencies of Student Government. Thereby granted the power to nominate, and by and with the advice and consent of the ARB, appoint and remove all agency heads. B. Nominate, with the advice and consent of the Senate, judges to the Supreme Court. C. Nominate, with the advice and consent of the University President, student representatives to University-wide Councils, committees, and boards. D. Represent the student body on the State Council of Student Body Presidents, the Florida Student Association, or other similar representative bodies. E. Sign or veto within 10 schools days all legislation passed by the Senate, with exceptions on changes of the Rules of Procedure of the Senate. Failure to act within this time period shall be deemed as approval of such legislation. F. Address the Senate at least once each semester. G. Call for a referendum of the Student Body, subject to approval of 2/3 of the Senate. H. Initiate the budget process by providing a proposed A&S Fee budget to the Senate. I. 33 Statutorily granted powers are those powers granted to the President by these Statutes. These powers, duties, and responsibilities are: A. Nominate, with the advice and consent of the Senate, Director and Assistant Directors of the Administrative Support Offices, Executive Assistants should the need arise, Administrative Assistants as needed, and staff advisor for the ARB. B. Call for the formation of a screening committee for the hiring and/or firing of the Comptroller, Internal Auditor, and/or Fiscal Assistant as provided for in Statute. C. Nominate an Executive Representative to the University Center Board of Associates, subject to the approval of the University President. D. Draft Executive Orders as provided in Statute. E. Call for Student Body Town Meetings as necessary, no less than one per semester. F. Administer and enforce all Statutes and Senate legislation. G. Initiate legislation, for consideration by the Student Government Senate. H. Call, at will, special sessions of the Student Senate, providing at least 72 hours notice to all members both by voice and in writing. Such notice may take the form of an advertisement in the Oracle. I. Be empowered to represent the Student Body officially within the University, to state and national Student Associations that the SG of USF is a member of, the Board of Regents, the State and national legislative bodies, and at all other appropriate forums extended to the University. J. To assign job related duties to any member of the Student Government, and to any person, or persons therein as deemed necessary. Appeal of this duty may be approved by a majority vote of the Senate. K. Dismiss any appointee to the Executive Office as his/her discretion. L. Any and all other actions necessary and proper to carry out the duties of this office; such action may be appealed to the Senate by a majority vote Special powers are those powers granted to the President by authorities other than Student Government. These powers include: A. Call for a Super Fee Committee to be established to analyze the Student Fees as set forth in Florida Statute. B. Be given the power to line item veto the Activity and Service Fee budget as contained in Florida Statute The President shall select, from applications received, any eligible student for any position deemed necessary. 34 No position requiring Senate approval may be filled until the position has been advertised in the Oracle for at least three consecutive days, or for four non-consecutive days All positions granted remuneration shall require Senate confirmation. All other positions can be filled as deemed necessary and are not subject to statutory controls The term of office for all Presidential appointed persons shall end with the term of office of the President who nominated them Executive Orders shall be the form that all orders of the President shall take, when acting in the official capacity, and shall apply to all students All Executive Orders are subject to the Constitutionality and Statutory requirements of legislation, excepting that the Senate may not substantively debate Executive Orders can be amended and/or retracted only by the President or by Supreme Court decision Any appeal of Executive Orders shall be subject to the due process contained in Statute Executive Orders shall only last until the end of the term of the President giving such orders The Student Body President or his designee will chair the Agency Review Board. This board will be responsible for the following: A. To advise and reprove the SG Agencies in accordance with their Rules of Procedure. B. To report Bi-Monthly to the Student Body Executive Branch as a whole. C. Approving the payroll schedule of all agencies fiscal budgets. D. Pay rates and hours for all agency employees (including Directors) will be set by the Agency Review Board and will no be under the jurisdiction of the ASRC board. E. All other fiscal budget schedules will remain under the jurisdiction of ASRC. F. In order for a payroll schedule to be passed by ARB a majority of 3/4 is required. G. An agency director may not vote on his or her own agency's payroll at the Agency Review Board. H. Each Agency s payroll schedule must be passed independently. H. To hire, with the approval of the SG Senate, for the position of Agency Director from a panel of nominees presented by the Student Body President, panel equaling more than one person. I. To terminate, with sufficient reason and agreement from the Student Body President, and Agency Director. J. 35 The Agency Review Board shall be composed of the following individuals: A. The Student Body President or their designee. B. All Agency Directors or their designees. C. Three Senators appointed by the SG Senate. D. One faculty/staff advisor appointed by the SG President and approved by the SG Senate. E. The SG Comptroller or their designee In the event of the formation of an additional SG Agency, the number of SG Senators on the board will automatically be raised by one Any and all appeals of the Director s authority will first go to the Agency Review Board before going to any other SG entities The voting procedures for the Agency Review Board will be as follows: A. All Senators, Agency Directors, and the Comptroller or their designee will vote on all issues brought before the board. B. The Student Body President will vote only in the event of a tie vote by the Agency Review Board. C. The faculty/staff advisor will not vote on any issue but may speak as an advisor. D. A Director may not vote in their own hiring, firing, or payroll A nominee shall be empowered to work as an acting member of the entity, such that no compensation is given and the time period is no more than six weeks, until Senate approval Should a vacancy exist for any reason, the President shall fill the position as required by statute, if deemed necessary Statutorily granted powers are those powers granted to the President by these Statutes. 37 305 University-wide Committees Act Membership on all committees governing the University shall be determined by the University President unless otherwise specified in the University Charter, Policy & Procedures Manual, Governance Constitutions, By-laws, or Statutes SG reserves the right to select all nominees for student membership on committees to the University President. Such nominees shall not be made in conflict with the University Charter, Policy and Procedures Manual, the Student Body Constitution, the Student Body Statutes, and/or the committee's own charter Unless otherwise specified, the term of office for a student membership shall be one year The University President may remove any student member of a University or Presidential Committee The Student Body President may, upon approval of the University President, nominate through the same process, student alternates to each committee It is recognized that the University President is ultimately responsible for the University, its institutions, governance and administration, with the aid of the governance groups on campus each representing their own constituency. 38 306 General Requirements Executive appointed-non-senate approved positions (i.e. assistant cabinet officers, executive appointed ARB members) and other such positions as outlined in the Constitution of the Student Body, may be compensated for their duties. Approval of the majority of Senators present and voting shall be needed for such compensation Such executive appointed positions shall assist in fulfilling the duties of the Executive Branch The President shall submit to the Senate a tentative schedule of all Executive Office travel for each semester by the second regular meeting of the Senate. Such schedule may be altered by either the President or the Senate Budget and Finance Committee. Once passed by the Senate, the schedule can only be changed by dates and not by amounts, without approval of the Budget and Finance Committee Each Office Director shall submit to the President a tentative budget for that semester. Any transactions requiring expenditure must be approved by the President The Student Body President shall present all signed bills to the Student Government Business Manager and Senate Clerk the next working day after being signed Bills vetoed by the Student Body President shall be presented to the Student Government Senate President the next working day after being vetoed The FSA Intern appointee shall be appointed by the Student Body President and approved by the Senate as outlined in The FSA Internshall not be compensated under any circumstances No additional funds shall be transferred to or from the FSA Intern budget under any circumstances USF shall fund for only one FSA Intern per semester The FSA Intern Budget shall not exceed $2,000 per year as outlined in statute Any additional FSA Interns shall be the sole responsibility of FSA Any increase in the FSA Intern budget shall be allocated through the ASRC budgetary process Statutes shall expire at the end of the fiscal year Statutes can be renewed at the discretion of the Senate by the end of the fiscal year 2001 Printed on Monday, October 16, 2000 Chapter 306
