10 Authority Who is a Peace Officer; what does one do, and under what authority? A Peace Officer is defined as: Any employee of a police or law enforcement agency administered by the state. Any employee of a police or law enforcement agency of a federally recognized Indian tribe who has completed academy training and is deputized by a sheriff or chief of police in the state of Idaho. I.C (d). A county sheriff, constable, marshal, or police officer of a city or town. I.C Duties include prevention and detection of crime, and the enforcement of laws.

14 HISTORY Drug Enforcement Administration Created by Richard Nixon and Congress in He said that the DEA was created to combat an all-out global war on the drug menace. The DEA has an annual budget of $2.2 billion. This agency became more popular and gained notoriety when the Medellin Cartel came into power in the early 80s. The DEA was tasked with fighting the Medellin Cartel and the amount of cocaine that it was shipping into the United States

16 History Federal Bureau of Investigation In 1908, the FBI originated from a force of special agents created by the President Roosevelt and the Attorney General. These former detectives and Secret Service men were the forerunners of the FBI. In 1909, the force was named the Bureau of Investigation, primarily investigating violations of laws involving banking, bankruptcy, naturalization, antitrust, peonage and land fraud.

17 FBI In the 1920 s, the Bureau of Investigation gained stature through investigations involving Al Capone, the Ku Klux Klan (KKK), and traditional investigations of neutrality and antitrust violations. In 1924, J. Edgar Hoover was selected to head the Bureau of Investigation, which employed approximately 650 agents.

18 FBI In 1935, the Bureau of Investigation was officially named the Federal Bureau of Investigation (FBI) by the Department of Justice. Today the FBI employs 35,000 people. FBI Headquarters are located in Washington, D.C., with field offices located in 56 major cities throughout the U.S. There are more than 350 satellite offices known as resident agencies in cities and towns across the nation, and more than 60 international offices in U.S. embassies worldwide.

20 History U.S. Attorney Charged in the Constitution with ensuring that the laws be faithfully executed, the Presidents of the United States, from George Washington to Donald Trump, have been responsible for the appointment of United States Attorneys to assist them in carrying out that mandate. In Article 3, the framers of the Constitution, included a directive requiring a system of federal courts to be established just below the United States Supreme Court to deal with cases outside of State Jurisdiction.

21 U.S. Attorney Congress enacted the Judiciary Act of 1789, directing the President to appoint in each federal district a meet person learned in the law to act as an attorney for the United States. Each United States Attorney is the chief federal law enforcement officer of the United States within his or her particular jurisdiction. There are 94 United States Attorneys stationed throughout the United States, Puerto Rico, Virgin Islands, Guam, and the Northern Mariana Islands.

22 U.S. Attorney The United States Attorneys have three statutory responsibilities under Title 28, Section 547 of the United States Code, which include: 1. The prosecution of criminal cases brought by the Federal Government. 2. The prosecution and defense of civil cases in which the United States is a party. 3. The collection of debts owed the Federal Government which are administratively uncollectible.

23 U.S. Attorney The United States Attorney's Office for the District of Idaho was created in 1863 when Idaho became a territory. On March 10, 1863, Richard Williams was appointed the District's first United States Attorney by President Abraham Lincoln. Wendy J. Olson was sworn in on June 25, 2010, as United States Attorney for the District of Idaho. She joined the United States Attorney's Office in March 1997, and was serving Senior Litigation Counsel at the time of her appointment as United States Attorney

29 United States Marshal 1789 The United States Marshal is the nation s oldest Federal Law Enforcement position. Following passage of the Judiciary Act on September 24, 1789, President George Washington appointed the first 13 U.S. Marshals. U.S. Marshals have had a variety of assignments through the years. On July 1, 1870, Congress created the Department of Justice and gave it supervision of U.S. Marshals. United States Marshals (similar to United States Attorney s) are nominated for the position by the President and confirmed by the Senate.

30 Idaho Dalphus S. Payne was the first U.S. Marshal of the Idaho Territory. He began his term on March 4, 1863 appointed by President Abraham Lincoln. Idaho Historical Society records list Marshal Payne as unpopular and scandalous. He was replaced in 1865 There have been 28 U.S. Marshals for the District of Idaho since Marshal Payne.

32 Fugitive Investigations The USMS is the Federal Government s primary agency for conducting fugitive investigations. In partnership with local law enforcement in the United States, over 100,000 fugitive arrests were initiated in 2012

37 Witness Security Program

38 Sex Offenders On July 27, 2006, the Adam Walsh Child Protection and Safety Act (Public law ) was signed into law. The Act provides that the Attorney General shall use the resources of Federal Law Enforcement, including the United States Marshals Service, to assist jurisdictions in locating and apprehending sex offenders who violate sex offender registration requirements. In 2011, the District of Idaho hired a full-time Deputy U.S. Marshal as our sex offender investigation coordinator

39 Other USMS Resources USMS Behavioral analysis unit - we help with staff crisis situations and provide advice. Safeguarding for staff is important and we provide advice to agencies developing policy. We have assigned personnel at the National Center for Missing & Exploited Children National Sex Offender Targeting Center established in September 2009.
