1 Resolution No KH RESOLUTON OF THE GOVERNNG BODY OF THE THREE AFFLATED TRBES OF THE FORT BERTHOLD NDAN RESERVATON A Resolution Entitled: "Approval of sale of ndividual Residential Lots in the Northern Lights Subdivision in accordance with Title X, Chapter of the Three Affiliated Tribes Code of Laws" This Nation having accepted the ndian Reorganization Act of June 18, 1934, and the authority under said Act and having adopted a Constitution and By-Laws pursuant to said Act; and The Constitution of the Three Affiliatea Tribe generally authorizes and empowers the Tribal Business Council to engage in activities on behalf of and in the interest of the welfare and benefit of the Tribes and of the enrolled members thereof; and Article ill of the Constitution of the Three Affiliated Tribes provides that the Tribal Business Council is the governing body of the Tribes; and Article V, Section f () of the Constitution of the Three Affiliated Tribes provides the Tribal Business Council has the power to adopt resolutions regulating the procedure of the Tribal Business Council and other Tribal Agencies and Tribal officials on the Reservation; and Article X, Section of the Constitution of the Three Affiliated Tribes provides that the Tribal Business Council shall have the authority to manage, lease and otherwise deal with Tribal lands and resources in accordance with law; and n accordance with Article X, Section of the Constitution, the Tribal Business Council adopted an ordinance entitled Title X, Chapter to create a statutory mechanism in conformance with Article X, Section 2 of the Constitution which authorizes the acquisition, sale and encumbrance of tribal fee lands for public purposes including residential housing development; and The Tribal Business Council created the Tribal Housing Division of the Three Affiliated Tribes with the goal of developing new homes on the Reservation and creating homeownership opportunities for tribal members; and Title X, Chapter, Section 1.4 authorizes the sale of the lots in the Dreamcatcher project to tribal members provided that a resolution authorizing such lots to be sold has been adopted by the Tribal Business Council. 2 Resolution No KH THEREFORE BE T RESOLVED, The Tribal Business Council of the Three Affiliated Tribes in accordance with Title X, Chapter, Section 1.4 of the Three Affiliated Tribes Code of Laws hereby authorizes the sale of the following fee property to the tribal members identified: 1. Block 5, Lot 6 Northern Lights Subdivision, City of New Town, County of Mountrail, North Dakota to: Damon and Rae Ann Williams BE T FNALLY RESOLVED, that said transactions shall be accomplished through real estate purchase agreements and warranty deeds by the Tribes' Legal Department and executed by the Tribe in accordance with Title X, Chapter 1, Section 1.4 and all other tribal resolutions/policies in effect. 4 Resolution No KH RESOLUTON OF THE GOVERNNG BODY OF THE THREE AFFLATED TRBES OF THE FORT BERTHOLD NDAN RESERVATON A Resolution Entitled: "Approval of 32 Applicants for Enrollment into the Three Affiliated Tribes" This Nation having accepted ilie diati Reerganization Act of June 18, 1934, and the authority under said Act and having adopted a Constitution and By-laws pursuant to said Act; and Article of the Constitution of the Three Affiliated Tribes provides that the Tribal Business Council is the governing body of the Tribes; and The Constitution ot: the Three Affiliated Tribes authorizes and empowers the Tribal Business Council to engage in activities on behalf of and in the interest of the welfare and benefit of the '{ribes and of the enrolled members thereof; and Article V, Section 5 () of the Constitution of the Three Affiliated Tribes provides that the Tribal Business Council has the power to adopt resolutions regulating the procedure of the Tribal Business Council and other Tribal agencies and Tribal officials on the Reservation; and According to the Article, Section 1: Membership of the Three Affiliated Tribes Constitution, the membership of the Three Affiliated Tribes shall consist of: A. All persons whose names appear on the membership of the Tribe as of October 2, B. Any person born before the effective date of this amendment and to any member of the Tribe who was a resident of the reservation at the time of birth of said person. C. All persons of at least 11t h ndian Blood of the Hidatsa, Mandan and lor Arikara Tribe. 1
5 Resolution No KH AMENDMENT V, DUAL ENROLLMENT:.. A. Persons enrolled with another tribe and who have received benefits from another tri5e in t e form of land or payments shall not be eligible for enrollment with the Three 4\ffiliated Tribes of the Fort Berthold Reservation, provided that inherited interests shall not be considered as being such benefits. B. Persons eligible for enrollment with the Three Affiliated Tribes of the Fort Berthold Reservation and another tribe shall relinquish whatever rights of enrollment they may hold in the other tribe as a condition to their enrollment with the Three Affiliated Tribes of the Fort Berthold Reservation. on November 2,2010 a secretarial election was held to amend Article of the Tribes' Constitution and a 118th Mandan, Hidatsa and/or Arikara blood quantum requirement was adopted for membership eligibility; on November 13th, 2014 the Tribal Business Council reviewed the applications of 30 individuals who are determined eligible for membership into the Three Affiliated Tribes under the amended provisions of Article of the Constitution and; NOW THEREFORE BE T RESOLVED, that the Tribal Business Council of the Three Affiliated Tribes hereby approves the enrollment of the attached list of30 applicants for enrollment into the Three Affiliated Tribes. 9 Resolution No KH RESOLUTON OF THE GOVERNNG BODY OF THE THREE AFFLATED TRBES OF THE FORT BERTHOLD NDAN RESERVATON A Resolution Entitled: "Request for the North Segment Community Development Corporation to be appropriated $850,000 from the Land Purchases fund for Land Acquisition for the purchase of the Golden Manor trailer park in the northwest part of New Town, ND with the intention of constructing and maintaining affordable housing for Tribal Members" This Nation having accepted the ndian Reorganization Act of June 8, 1934, and the authority under said Act and having adopted a Constitution and By-Laws pursuant to said Act; and \ The Constitution of the Three Affiliated Tribes generally authorizes and empowers the Tribal Business Council to engage in activities on behalf of and in the interest of the welfare and benefit of the Tribes and of the enrolled members thereof; and Article, Section 1 of the Constitution of the Three Affiliated Tribes provides that the Tribal Business Council is the governing body ofthe Tribes; and Article V, Section S(c) of the Constitution ofthe Three Affiliated Tribes provides that the Tribal Business Council has the power to adopt resolutions regulating the procedure of the Tribal Business Council and other Tribal agencies; and The Tribal Business Council passed Resolution No DSB, establishing a charter for the North Segment Community Development Corporation, a non-profit corporation, as attached hereto; and Article of the Corporate Charter states as follows: Section A) The general purpose of this Corporation is to promote economic development activities in six primary areas offocus: Community Planning, Commercial Development, Business/Technology Training, CommunitylY outh Development, Health Care and Housing Development for members of the North Segment Community of the Three Affiliated Tribes who reside within the exterior boundaries of the Fort Berthold Reservation; C) The Corporation will create an economically viable community by expanding opportunities for low income persons and families. Article V, Section A of the Corporate Charter states: To purchase, take, receive, take by gift, devise, or bequest, or otherwise acquire, own, hold, improve, use and otherwise deal in and with real or personal property, or any interest therein, wherever situated; and Page of3
10 Resolution No KH Article V, Section B of the Corporate Charter states: to sell, convey, mortgage, pledge, lease, exchange, transfer, or otherwise dispose of all or any part of its property or assets; and Due to the recent oil and gas development boom within the confines of the Fort Berthold Reservation, the North Segment community has been burdened with a lack of adequate and affordable housing for its Segment members. Therefore, the North Segment and its members would benefit immensely by receiving an $850,000 appropriation for the proposed land acquisition... NOW THEREFORE BE T RESOLVED, that the Tribal Business Council of the Three Affiliated Tribes acknowledges and recognizes that housing is needed for all tribal members and in particular the North Segment community and the inherent benefit in supporting housing development; and BE T FURTHER FNALLY RESOLVED, the Tribal Business Council hereby appropriates to the North Segment Community Developme t Corporation $850,000 and management authority of said appropriation for the proposed land acquisition of the Golden Manor trailer park, located in the northwest part of New Town, ND. This Nation having accepted the ndian Reorganization Act of June 18, 1934, and the authority under said ct ancl having adopted a Constitution and By-laws pursuant to said Act; and, Article Tl of the Constitution of the Three Affiliated Tribes provides that the Tribal Business Council is the governing body of the Tribes; and The Constitution of the Three Affiliated Tribes authorizes and empowers the Tribal Business Council to engage in activities on behalf of and in the interest of the welfare and benefit of the Tribes and of the enrolled members thereof; and Article V, Section 5 () of the Constitution of the Three Affiliated Tribes provides that the Tribal Business Council has the power to adopt resolutions regulating the procedure of the Tribal Business Council and other Tribal agencies and Tribal officials on the Reservation; and The Tribal Business Council has established the Mandan, Hidatsa, and Arikara Nation mortgage loan program to assist tribal members in acquiring homes, whereby said program purchases homes for the applicant and resells said home to the applicant through a loan and mortgage as applicable; and Some of the real estate agencies and other companies that the mortgage loan program is acquiring homes from have requested specific authorization from the Tribal Business Council establishing who has authority to sign purchase agreements other legal documents for the acquisition of these homes; and The Tribal Business Council believes the authority should be granted to the Tribal Chairman and in his absence to the Vice Chairman. NOW, THEREFORE BE T RESOLVED, the Tribal Business Council of the Three Affiliated Tribes hereby authorizes the Tribal Chairman to sign and execute any and all purchase agreements or other legal documents necessary for the acquisition of homes by the mortgage loan program of the MHA Nation; and Page 1 of3
