3 CHAPTER I PRELIMINARY PRINCIPLES The Church of Jesus Christ is the provisional demonstration of what God intends for all of humanity. As such, the church is called to be a sign in and for the world of the new reality, which God has made available to people in Jesus Christ. (G ) The Miami Presbytery of the Presbyterian Church (U.S.A.) is a governing body including churches in Butler, Champaign, Clark, Clinton, Darke, Greene, Logan, Miami, Montgomery, Preble, Shelby, and Warren Counties. Scripture and our confessions help us define presbytery. Presbytery is a collective group of ministers of Word and Sacrament and members of congregations unified in our commitment to Jesus Christ as Lord, joined by our reformed heritage and form of government. Presbytery is a community of people who combine their efforts to increase the quality of their leadership, to inspire each other and congregations to engage in Christ s mission, to enhance the efficient operation of congregations, and to provide theological and ethical integrity. This understanding challenges the notion that presbytery is a professional staff or a location containing records or a series of meetings held throughout the year. The Miami Presbytery seeks to serve its member congregations and leaders to fulfill Christ s mission in the world today. Higher governing bodies, such as The Miami Presbytery, serve local congregations and those who lead them by providing theological integrity, governmental guidance, and discipline (including both accountability and instruction). Three significant principles are as follows: o The essential mission of The Miami Presbytery is to prepare, disciple, and equip church leaders. o The relationship between presbytery and church leaders is one of edification, instruction, support and inspiration to carry out Christ s mission in the world. o Mission in The Miami Presbytery is primarily carried out by individuals and local congregations working together. This design of The Miami Presbytery focuses on equipping and empowering individuals and congregations to engage actively in Christ's mission and emphasizes the common contributions of each one s gifts instead of placing that emphasis upon committees or staff. Similarly, the structure is formed by the community's mission and vision and implemented by presbyters, not staff. Now to each one the manifestation of the spirit is given for the common good. [I Corinthians 12:7 NIV] 1. Neighborhoods The Presbytery is organized into four (4) geographic regions called Neighborhoods. Just as various neighborhoods are present within a single community; our Neighborhoods comprise the community of our Presbytery. Each Neighborhood gathers together urban, suburban and rural congregations, both large and small including a variety of theological perspectives. 3

4 An essential purpose of Neighborhoods is to provide opportunities for individuals and local congregations to receive the services of Presbytery and to interact on a more intimate level. Neighborhoods can provide greater opportunities for presbyters and congregations to disciple and equip Church leaders; helping them to deepen their relationship with Jesus Christ, reliance upon the Holy Spirit, knowledge of the Scriptures and Confessions, and to continue their training in ministry. 2. Networks Networks are vocational associations or groups of individuals, gathered by a sense of passion, call and giftedness for a particular ministry. In those times when a particular mission effort is larger than one person or organization, congregations, members, or presbyters may combine their energies in partnership with the Presbytery as a Network to accomplish that mission. At times there are individuals within different congregations who have been given particular passions by God for particular ministries. These individuals can form a Network to respond to God s call for that ministry. Networks may emerge within a single Neighborhood; they may transcend a number of Neighborhoods; or they may even include participation by those beyond the jurisdiction of our Presbytery. As a Network, the group is free to organize itself in a manner that allows it to operate most effectively. A Network is not required to be of a particular size or composition, provided that it consists of at least two members from different congregations. Networks are not required to implement a particular structure or to elect particular officers. Indeed, Networks offer the Presbytery an opportunity to focus on ministry and mission instead of structure. Within The Miami Presbytery there are two types of Networks: formal and informal. Informal Networks are gatherings of individuals or congregations. Formal Networks are those that enter into a covenantal relationship with The Miami Presbytery for one or more of the following reasons: (1) to receive assistance in distributing information through Presbytery communication channels; (2) to provide services to the Presbytery; (3) to use the Presbytery s name as an implied endorsement of the ministry; (4) to request funds from The Miami Presbytery or from entities beyond the Presbytery; (5) and to acquire the services of consultants to assist a Network s ministry or mission. The Networks Support Committee (NSC) shepherds formal Networks. The NSC has the responsibility of stewardship of funds allocated by the Presbytery for Network ministry and mission. Each Network receiving funds shall be asked to describe its work and how this work assists the Presbytery in accomplishing its mission and goals. Formal Networks shall submit an annual report including a self-evaluation of their accomplishments and stewardship of funds. 4

5 CHAPTER II GENERAL ADMINISTRATIVE PRINCIPLES 1. Rules of Order The Standing Rules of The Miami Presbytery and the government of this Presbytery shall at all times be in consonance with the Constitution of The Presbyterian Church (U.S.A.). The most recent edition of Robert's Rules of Order shall govern the proceedings of this Presbytery, except in those cases where these Standing Rules or the Constitution provide otherwise (G ). 2. Amendments The Standing Rules of The Miami Presbytery may be amended by a majority vote of the members present and voting at any stated meeting of the Presbytery, after due notice has been given and the proposed amendment has been read in full at the immediately previous Stated Meeting of the Presbytery. The Standing Rules may be temporarily suspended without such notice when two-thirds of the members present vote in favor of such suspension. 3. Operations Manual The Standing Rules of Miami Presbytery shall include an attachment hereafter referred to as the Manual of Operations. The purpose of the Manual of Operations shall be to describe the structure, purpose and duties of the individual committees of the Presbytery. Changes in the Manual of Operations shall be by majority vote of Presbytery with at least ten (10) days prior notice of such change(s). 4. Nominations and Committees a. Annually, at the May meeting of Presbytery, the Committee on Nominations shall present nominations to the Presbytery for each position in which there is or will be a vacancy, including Moderator, Vice-Moderator, Stated Clerk, Treasurer and the chairperson of each committee. Ordinarily, the Vice-Moderator shall be nominated for Moderator and the outgoing Moderator as chair of Council. b. Chairpersons of each committee shall be elected each year and ordinarily, no one person shall serve as committee chair for more than three consecutive years. c. Ordinarily, the elected committee chair will be an elder or minister of the Word and Sacrament. If the elected chair is not ordained, he/she may appoint an elder member of the committee to represent the committee on the floor of Presbytery with voice and vote. This appointment must be filed with the Stated Clerk of the Presbytery. d. Except as set forth otherwise in these Standing Rules, no one elected to an office or position in the Presbytery shall be elected for a term of more than three years, nor shall any such person serve for consecutive terms, either full or partial, aggregating more than six years. Any person having served a total of six consecutive years shall be ineligible for election to the same position or committee for at least one year. Unless otherwise specified herein, committees shall be comprised of three classes as nearly equal in number as possible, of which only one class shall expire each year. 5

6 Presbytery may elect persons under twenty-five years of age to Presbytery committees for terms of one, two or three years. e. A majority of the votes cast shall be necessary for election to all offices and positions in the Presbytery. Nominations may be made from the floor following the report of the Committee on Nominations. When there is more than one nomination for an office or position, election shall be made by paper ballot. f. In case of a vacancy in any elective office or position before the term has expired, a person shall be elected to complete the unexpired term. Nomination and election shall follow the same procedure as set forth in these Standing Rules for a regular term. g. All committee terms shall begin at the close of the Presbytery meeting at which elections are held. Officers shall be installed during a service of worship at the same meeting at which elections are held. h. Nominations from the Committee on Nominations shall not include any of its own members. i. Each committee shall perform services directed by the Presbytery or the Council. Each committee shall hold regular meetings and be responsible for its own organization and performance of its responsibilities. j. Each committee shall be empowered to appoint additional ministers and/or laypersons to their elected number as dictated by their special workload or the need for some particular talent or expertise. Such persons shall have no vote. k. If a member of any committee needs to resign for good cause, s/he shall notify the chair of the particular committee who will then make a written request for replacement. This statement shall be filed with the Stated Clerk who shall forward the request to the Committee on Nominations. l. Each committee is responsible for encouraging full participation of its members. Should a member of a committee fail to attend or participate in the work of the committee, the committee may, after conferring with the member, make a written request for replacement, which shall include the reason for requesting the replacement and the nature of the discussion with the member to be replaced. The request shall be filed with the Stated Clerk who shall forward it to the Committee on Nominations. The Committee on Nominations may recommend to Presbytery that the position of the nonparticipating member be declared vacant and nominate a person to fulfill the unexpired term. 5. Financial Principles a. Ordinarily, no new business with financial and/or constitutional implications shall be brought before Presbytery for action without prior review by the Council or their designee. 6

7 b. Committees and/or Formal Networks wishing to solicit funds directly from member churches shall seek approval from the Council in consultation with the Board of Trustees and the Networks Support Committee prior to solicitation. c. Committees and/or Formal Networks applying for grants outside of the Presbytery shall have advance approval of the grant application by the Networks Support Committee. All grants shall be monitored by the Board of Trustees. d. Between stated meetings of the Presbytery, the Board of Trustees, with communication with the Council, may approve loans up to $100,000 and/or sales of property by member churches as guided by the Book of Order (G-8.000). Such action shall be reported to the Presbytery at the next stated meeting. CHAPTER III MEMBERS 1. Minister Members Ministers of Word and Sacrament shall be enrolled and maintain their membership in the Presbytery as provided in G of the most recent Book of Order and Committee on Ministry policy, Continuing Membership and Validation of Ministries. 2. Elder Members a. Representatives of Churches: It is the duty of each session to be represented at each stated meeting of the Presbytery by the number of elders authorized in the Book of Order (G a). In order that the Presbytery may have continuity to fulfill its responsibilities, sessions should elect commissioners from their membership for a period of at least one year to represent them in the Presbytery. When requested, commissioners are required to present credentials satisfactory to the Stated Clerk regarding their commission as delegates, before they are seated as members. b. Additional Elder Members (G c): When elders are elected to serve as Vice- Moderator, Past Moderator/Council Chair, a member of the Council, chairperson of a standing committee, Executive Presbyter, Stated Clerk, and/or Treasurer, such persons shall be enrolled as elder members of the Presbytery for the duration of service in these positions, whether or not commissioned by their sessions. c. The Presbytery shall redress any imbalance of ministers and elders as provided in G (b) of the most recent Book of Order. The Stated Clerk shall nominate those sessions that are to be invited to name additional elders each year, with special attention to the concerns of G Such additional elders shall serve for one-year terms, beginning at the close of the May meeting of Presbytery. 7

8 3. Corresponding Members a. Former moderators of the Presbytery who are elders shall be enrolled as corresponding members of the Presbytery with voice but no vote as long as they maintain active membership with a member church. b. Visiting ministers of Word and Sacrament and ministers seeking membership in the Presbytery may be seated as corresponding members by majority vote of the Presbytery. Such persons shall have voice but no vote. 4. Duties and Attendance of Members a. Ministers: It shall be the duty of each minister who is an active member or a member-at-large to attend all stated meetings of the Presbytery. All ministers of the Presbytery shall make themselves available to the Presbytery for election and/or appointment to any office or committee, limited only by personal health. Ministers who are Honorably Retired or permanently disabled shall be granted the option of attendance at all meetings of the Presbytery. If an active minister member or member-at-large is absent from all meetings for a period of one year and shall neglect to report to the Presbytery concerning residence and work, the Presbytery, after making an effort to locate and counsel with the minister, shall then without prejudice to the minister, place that minister's name on the inactive roll (G ). b. Elders: It shall be the duty of each elder commissioner to attend all stated meetings of the Presbytery. Whenever a session is not represented by a regularly elected elder delegate at four consecutive Stated Meetings without excuses satisfactory to the Presbytery, the session shall be notified in writing by the Stated Clerk and shall be requested to render satisfactory reason for this absence or be liable to censure as determined appropriate by the Presbytery. CHAPTER IV MEETINGS 1. Stated Meetings Unless modified by action of Presbytery there shall be four (4) Stated Meetings each year. a. Dates and Times: The dates and times of the Stated Meetings shall be: February The second Saturday 9:00 am to 1:00 pm May The second Tuesday 4:00 pm to 9:00 pm September The second Tuesday 4:00 pm to 9:00 pm November The second Saturday 9:00 am to 1:00 pm b. Location: The Council shall establish the location of each stated meeting of the Presbytery. Through the Stated Clerk, the Council shall solicit and receive invitations from the sessions that wish to host the stated meetings of the Presbytery. 8

9 c. Docket: The Docket Work Group of the Council shall prepare a proposed docket for each meeting of the Presbytery. The Stated Clerk shall forward a copy of the proposed docket to each pastor and clerk of session ten (10) days in advance of each meeting. 2. Special Meetings Special meetings of the Presbytery shall be called in accordance with G of the Book of Order. CHAPTER V ADMINISTRATIVE ORGANIZATION 1. Officers The officers of the Presbytery shall be: Moderator, Vice-Moderator, Past Moderator, Stated Clerk, Recording Clerk, Enrolling Clerk, and Treasurer. All positions will be held by a minister member of Presbytery or an elder on the active membership roll of a member church. a. The Moderator: The Moderator shall serve for a term of one year. The authority and duties of the Moderator are set forth in G , and include those of presiding officers outlined in Robert's Rules of Order. The Moderator will plan worship services at stated meetings of the Presbytery during his/her year of service. The Moderator shall perform these duties and such other duties as may be assigned by the Presbytery. b. The Vice-Moderator: The Vice-Moderator shall serve for a term of one year and will ordinarily be nominated for Moderator the following year. Under the direction of the Council, the Vice-Moderator shall nominate the chairperson and the members of the Committee on Nominations to the Presbytery. The Vice Moderator shall perform such duties as may be assigned by the Moderator and by the Presbytery. c. The Past Moderator: The Past Moderator shall be the person who has most recently completed a term as Moderator. Ordinarily, the Past Moderator will serve as the chairperson of the Council and to make the reports of the Council to the Presbytery. d. The Stated Clerk: The Stated Clerk of the Presbytery shall be elected at a May meeting of the Presbytery for a term of three years and may be reelected for an indefinite number of terms. The Stated Clerk is the chief ecclesiastical officer of the Presbytery. The Stated Clerk shall receive compensation for services in an amount set by the Presbytery. The Stated Clerk is responsible to the Presbytery through the Council and Staff Services Committee. In accordance with the Book of Order, the duties of the Stated Clerk shall be: 1) To record the transactions of the governing body, keep its rolls of membership and attendance, preserve its records carefully, and furnish 9

10 extracts from them when required by another governing body of the church. (G a); 2) To assist the Council in making all necessary arrangements for each meeting of the Presbytery, including the preparation of a docket, maintaining accurate minutes, compilation of floor papers, and proper notification of all meetings with ministers, elder commissioners and elder members of Presbytery; 3) To serve as parliamentarian of the Presbytery; 4) To maintain the rolls of Ministers of Word and Sacrament, Certified Christian Educators, and Inquirers and Candidates; 5) To secure annual statistical reports from member congregations and to report such information to the Office of the General Assembly; 6) To act as secretary of the Council as ex officio without vote; 7) To act as the official correspondent of the Presbytery by receiving and transmitting appropriate information with governing bodies and other entities; 8) To attend General Assemblies, the annual OGA Fall Polity Conference and annual synod clerk s training; 9) To conduct the annual review of session minutes; 10) To maintain the Standing Rules and Manual of Operations under the direction of the Council; 11) To provide administrative support to Investigating Committees, Committees of Counsel and the Permanent Judicial Commission in matters of judicial process; 12) To provide resource support to the Committee on Nominations, the Committee on Representation and Administrative Commissions; 13) To assist in the preparation of an annual directory of the Presbytery; 14) To oversee the work of the Recording Clerk, Enrolling Clerk, and Historian of the Presbytery; 15) To act as the Secretary of the Corporation; 16) To perform other duties as directed by the Presbytery or by the Council. e. The Recording Clerk: The Recording Clerk shall be elected at the same time as the Stated Clerk for a term of three years and may be reelected for an indefinite number of terms. The Recording Clerk shall serve as assistant to the Stated Clerk and shall perform the latter's duties whenever the Stated Clerk is unable to act. The Recording Clerk shall be assigned the specific task of taking such notes as may be necessary to provide information from which the Stated Clerk can prepare the minutes of the Presbytery meetings. f. The Enrolling Clerk: The Enrolling Clerk shall be elected at the same time as the Stated Clerk for a term of three years and may be reelected for an indefinite number of terms. The Enrolling Clerk shall also serve as an assistant to the Stated Clerk. The enrolling clerk shall be responsible for obtaining the signatures for the roll of the Presbytery at each meeting. g. The Treasurer: The Treasurer shall serve for a term of three years and may be reelected for an indefinite number of terms. The Treasurer may receive compensation for services in an amount set by the Presbytery. It shall be the duty 10

11 of the Treasurer to receive and hold all funds committed to the Presbytery and to disburse such funds upon approval of the Council, committee or commission chairpersons, or the Executive Presbyter for items covered in an official budget approved by the Presbytery. The Treasurer shall provide regular reports to the Presbytery on the financial status, including income and disbursements. With the Board of Trustees, the Treasurer shall arrange for annual financial review of the books and report the results to the Presbytery. The Treasurer shall be bonded in an amount to be determined by the Council, and the bonding fee shall be paid from the treasury. The Treasurer is responsible to the Presbytery through the Council and Staff Services Committee. h. Stated Clerk and Treasurer: At the time of an expired term for either the Stated Clerk and/or Treasurer, there shall be an open search for nominees. Position descriptions shall be available for all applicants. All applicants shall be an elder or minister of Word and Sacrament in the Presbyterian Church (USA). Search committees will bring their nominee before the Presbytery for election and installation. Search Committee composition for the Stated Clerk: one member of the nominating committee, one member of the Council, and one member of Staff Services. Search Committee composition for the Treasurer: one member of the nominating committee, one member of the Board of Trustees, and one member of Staff Services Committee. The Executive Presbyter will be ex officio member of each committee and will do the necessary reference checks and criminal background check. 2. The Staff Members of the staff are servants of the Presbytery and of the church-at-large who are given the responsibility of helping the Presbytery--its churches, its members, and all its structural units--to accomplish its purpose. They will seek to promote the mission of the church in and through The Miami Presbytery as they assist the individual ministries of its members, the corporate ministries of churches within its bounds, and cooperative ministries of denominational, ecumenical, and interfaith agencies. a. Job and Person Descriptions: Detailed job and person descriptions shall be kept up to date by the Council according to the changing needs and shall be available at all times in the files of the Presbytery. b. Staff Members: i. The Executive Presbyter: (G and ): The Executive Presbyter shall be a minister or elder elected by the Presbytery, shall serve for a term of five years and may be reelected for an indefinite number of terms. S/he is the chief administrative officer of the Presbytery and supervisor of the staff of the Presbytery. The EP is to assist the Presbytery in the implementation of strategy and program, to be a resource to the Presbytery, and to provide staff services as necessary. ii. Organizing Pastors Ministers of Word and Sacrament called to be organizing pastors for New Church Developments. iii. Office Manager 11

12 iv. Bookkeeper c. Transitional Staff i. Executive Director for Kirkmont Center: A minister or lay person may be elected to serve as the Executive Director Kirkmont Center and shall serve for an indefinite term. S/he is a member of the administrative staff of the Presbytery under the direct supervision of the Executive Presbyter and is to assist the Presbytery in the implementation of strategy and program. In addition to the regular operational duties of Kirkmont Center, the Executive Director will work with the Board of Trustees to develop a viable plan for the future of camp and conference ministries in this Presbytery. This plan will be presented to the Presbytery for action no later than January ii. Resource Center Staff: These part-time positions will remain in place until a new plan for the Resource Center is developed and presented to the Presbytery for action no later than January During the transition, these persons will report to the Executive Presbyter. 3. Consultants From time to time, the Presbytery will need flexible professional assistance to meet goals and objectives. Consultants provide leadership in the Presbytery to meet continuing and changing needs as they arise. Networks may request consultants through the Network Support Committee (NSC) which will forward such requests to Staff Services Committee. Standing committees may request consultants through Staff Services Committee. Consultants are approved by Council on recommendation of the Staff Services Committee and may serve for no more than two years. Employment of consultants will be done in full compliance with the church s ethical standards and government regulations. Their work will be reviewed regularly by the Staff Services Committee. CHAPTER VI COMMITTEES & OTHER ENTITIES 1. Constitutional Committees (G a) Committee descriptions are located in the Manual of Operations a. Council a. The Committee on Ministry b. Administrative Commissions The use of Administrative Commissions will comply with the guidelines provided in the Book of Order (G- G ). Once authorized by the Presbytery at a duly called meeting, the Moderator shall appoint ministers and elders to the commission in accordance with the action of the Presbytery. 4. Committees for Judicial Process a. Investigating Committees: The Moderator of the Presbytery may appoint an Investigating Committee between stated meetings of the Presbytery as authorized by D b upon receipt by the Stated Clerk of a written statement of an offense as defined in D and D If the Moderator disqualifies her/himself in a particular case, the Moderator may delegate to the Vice Moderator the authority to appoint an Investigating Committee. In making the appointment, the Moderator or Vice Moderator shall consult with the Executive Presbyter and Stated Clerk of the Presbytery or their designees. The appointment of Investigating Committees shall be reported as information to the next stated meeting of the Presbytery. b. Committees of Counsel: In the event the Presbytery becomes a complainant or respondent in a remedial case (D ), the Moderator of the Presbytery may appoint a Committee of Counsel between stated meetings of the Presbytery as authorized by D a. If the Moderator disqualifies her/himself in a particular case, the Moderator may delegate to the Vice Moderator the authority to appoint a Committee of Counsel. In making the appointment, the Moderator or Vice Moderator shall consult with the Executive Presbyter and Stated Clerk of the Presbytery or their designees. Appointment of Committees of Council shall be reported as information at the next stated meeting of Presbytery. 5. Other Organizations Members of particular churches may partner to conduct special tasks of witness, service, nurture, or other appropriate endeavors, being at all times responsible to the Presbytery. If such organizations are local chapters of a national organizations recognized by the denomination, they may use the name of The Miami Presbytery without becoming formal Networks. They may report to the Presbytery through the Council. These organizations may include, but are not limited to, the following: c. Presbyterian Women in Miami Presbytery d. Presbyterian Men e.
