1 RESOLUTION NO. 171 A RESOLUTION OF THE CITY OF NEWCASTLE, WASHINGTON, APPROVING THE PRELIMINARY PLAT OF THE SUBDIVISION OF TRAVOR~, AND ADOPTING THE HEARING EXAMINER'S FINDINGS OF FACT, CONCLUSIONS, AND RECOMMENDATIONS. WHEREAS, an application for preliminary plat approval for the subdivision of Travore, consisting of 14 single-family residential lots on approximately 3.42 acres, was submitted by Richard F. Loman of Oakhurst Development to the City of Newcastle; and WHEREAS, the City has issued a SEPA Mitigated Determination of Nonsignificance for the proposed subdivision; and WHEREAS, the Hearing Examiner conducted a public hearing on the preliminary plat application on December 9, 1998; and WHEREAS, the Hearing Examiner entered his Findings, Conclusions, and Recommendation on the Travore preliminary plat on December 14, 1998; and WHEREAS on January 19, 1999, the City Council passed a motion, setting February 1, 1999 as the date for Council consideration of the Hearing Examiner's recommendation; and WHEREAS on February 1, 1999, the City Council tabled consideration of the Hearing Examiner's recommendation until such time as staff has considered the road standards variance requests associated with the Travori, Preliminary Plat; and WHEREAS on February 11, 1999, staff submitted a staff report to the City Council presenting the staff findings and conclusions regarding the road standards variance requests associated with the Travore Preliminary Plat; and WHEREAS on March 2, 1999 the City Council considered the Hearing Examiner's recommendations; NOW, THEREFORE, THE ClTY COUNCIL OF THE ClTY OF NEWCASTLE DOES RESOLVE AS FOLLOWS: Section 1. Adoption. The Findings, Conclusions, and Recommendation of the Hearing Examiner are hereby adopted as the final decision of the City Council on the preliminary plat of the subdivision of Travore. Section 2. Conformance with Requirements. The approved subdivision is in conformance with the requirements of Chapter RCW; other applicable State laws; the City of Newcastle's Comprehensive Plan; the City of Newcastle's subdivision and zoning ordinances; and all other applicable ordinances. \\NEWCASTLE\VOLI\DATA\CLERK\Resolutions\Travore Prelim Platdoc

A description of any changes to development regulations, modifications to capital improvement programs, subarea, neighborhood, and functional plans required for implementation so that regulations will be consistent with the Plan. Review and Plan Amendment Process The Annual Review and Plan Amendment Process (hereafter called Process) provides an opportunity to refine and update the Comprehensive Plan and to monitor and evaluate the progress of the implementation strategies and policies incorporated therein. The Process is also developed to meet the requirements of ESHB 1724 and the revisions to RCW 36.70A contained therein. RCW 36.70A.130 (as amended by 1724) addresses comprehensive plan amendments. The GMA requires that comprehensive plans be amended only once a year, except for certain exemptions and "emergencies." Under 1724, the following amendments may be considered more frequently than once every year: * initial adoption of a subarea or neighborhood plan 0 adoption or amendment to a shoreline management program when an emergency exists ("emergency" is not defined) 0 to resolve an appeal of a comprehensive plan filed with a Growth Management Hearings Board or with the court The major changes to the GMA regarding plan amendments are described below: 0 Establish a means by which cities and counties will "docket" (i.e., compile and maintain a list) suggested plan or development regulation amendments and consider them during the annual amendment process. Cities and counties must include in their development regulations a procedure for any interested person to suggest plan or development regulation amendments. * Public participation programs must be developed for proposed amendments or revisions to the comprehensive plan. City of Newcastle Draft Comprehensive Plan Adopted 6/17/97 This process is the vehicle by which the City, and private property owners, developers, community groups or individual citizens request changes to the planned land uses on property or propose changes to the goals and polices of the Plan. The process includes the review of proposed expansions to the Urban Growth Area thus allowing the City to evaluate the necessity for further urban expansion and growth. The

6 Process affords the opportunity to refine the Plan based on changing conditions and community needs. In the Annual Review and Amendment Process, the Planning Commission and City Council shall consider current development trends to determine the City's progress in achieving the economic, land use and housing goals established in the Plan. Information which shall be considered includes vacant land absorption, residential versus economic development, amounts and values of non-residential construction, number and types of housing units authorized by building permit, affect of changes to adopted functional plans in the community, as well as activity levels in such processes as subdivision approvals, annexations, and building permits. Other information which shall be considered includes the current capacity status of major infrastructure systems for which levels of service have been adopted in the Plan (transportation, water, sewer) and the levels of police, fire and park and recreational services being provided by the City. The process shall also include monitoring of overall population growth and relative comparison with the forecast growth projections contained in the Plan (and the inclusion of updated projections where appropriate)." The Annual Review and Amendment Process includes public participation, both through community meetings to familiarize the general public with the amendment proposals as well as at the formal public hearings before the Planning Commission and City Council. A permanent agenda item should be added regarding suggestion of plan amendments from the public at city council and planning commission meetings. The Process should be adopted as a part of the City's development regulations, including selection and review criteria for the Planning Commission. City of Newcastle Druj? 7 In choosing an amendment date, the City must consider the timeline requirements for joint planning agencies and other city-related fiscal year cycles (e.g., amendments to the capital facilities element may require adjustments to the budget). Proposed plan amendments must also be submitted to the State Department of Community, Trade and Economic Development (CTED) for their review and comment at least 60 days prior to final City Council adoption. Policies The following policies are recommended to reflect the annual plan review and amendment process: U-PI - The City of Newcastle's Community Development Department shall schedule annual review of the Comprehensive Plan, to consider the need for amendments. At that time, both City-initiated and private party or developer-initiated amendment requests will be considered." IA-P2 - All Comprehensive Plan amendments shall be processed together with any necessary zoning, subdivision or other ordinance amendment, to ensure consistency. U-P3 - Amendment procedures shall be fblly outlined in the City of Newcastle's land development regulations. Conceptual Plan Review and Amendment Schedule* The plan amendment process is designated to be flexible to accommodate unique conditions such as the nature, complexity, or amount of plan amendment requests in a single year. The annual "window" of plan amendment submittals *om the public will be open throughout the year, (i.e., the public can submit requests for amendments at any time) however, they will only be "processed" in accordance with the adopted regulations. The timing of the process is intended to conform to the following generalized schedule: November 15th City solicits public requests for comprehensive plan amendments. February 1st Deadline for submitting proposed amendments to the Department of Community Development. 8 MarcWAuril: MavIJune: August: City Council decides which proposed amendments should be considered and establishes a plan amendment schedule. Planning Commission public hearing(s) and final recommendation to City Council. City Council review and adoption of Annual Amendments. All amendment proposals shall be considered concurrently (in a package) by the Planning Commission and the City Council so that their cumulative impacts can be ascertained. Provisions for the joint CityICounty consideration of a plan amendments of mutual concern within the UGA shall be included in the appropriate interlocal planning agreement (as established in the countywide planning policies), or other appropriate agreement. Emergency Plan Amendment Consideration The Comprehensive Plan may be amended outside the normal schedule if findings are adopted (by City Council resolution) to show that the amendment was necessary, due to an emergency situation of a neighborhood or city-wide significance. Plan and zoning amendments related to annexations may be considered during the normal annexation process and need not necessarily be coordinated with the annual plan amendment schedule. The nature of the emergency shall be explained to the City Council, which shall decide whether or not to allow the proposal to proceed ahead of the normal amendment schedule.
