1 European Parliament Committee on Employment and Social Affairs EMPL_PV(2015)0712 MINUTES Meeting of 7 December 2015, BRUSSELS The meeting opened at on Monday, 7 December 2015, with Thomas Händel, (Chair) in the chair. 1. Adoption of agenda EMPL_OJ (2015)0712_1 The agenda was adopted as shown in these minutes. 2. Chair s announcements 2.1. All the languages were available except Finnish, Maltese, Croatian and Gaelic The EMPL delegation to The Netherlands, The Hague, took place on Wednesday 4 and Thursday 5 November 2015: NL Minister Lodewijk Asscher had informed Members that fair mobility: Equal pay for equal work in the same workplace would be a main priority for the Dutch Presidency. For NL State Secretary Jetta Klijnsma combating poverty and social inclusion and the need of Member States and Europe s big cities to exchange knowledge for it would be the prime theme. A third priority would be decent work at decent working conditions, offering workers legislation for more protection from carcinogenic substances. A special feature would be a strong institutional drive for evidence based policy making in the Social Economic Council and in independent government advisory bodies The EMPL delegation to the ILO, Geneva on 6 November 2015 composed by the Chair, A. Jongerius, J. Steinruck and G. Bach met the ILO Director General Guy Ryder who had been interested in strengthening the cooperation with the EP and other representatives. The topics discussed were the integration of refugees in the labour market, the ILO work in Greece, the application of labour standards in trade agreements, digitalisation and the future of work among others The EMPL Delegation to Lisbon took place from 4 to 6 November. The purpose of the visit was to review recent social and employment-related developments in Portugal as a post-programme country. PV\ doc PE v01-00 United in diversity

2 Members of the Delegation met the Secretary of State for Labour and Social Security, Members of the Portuguese Parliament, social partners, representatives from the National Council of Education, from the Institute for Rehabilitation, from the Authority for Working Conditions and from the Institute for vocational training. Their field visits to two associations of social assistance allowed them to have a better grasp of the situation. 3. Chair's announcements 1.1 Interpretation Interpretation was available in German, English, Italian, French and Danish. 1.2 Unused interpretation at meetings At the Shadow rapporteurs' meeting on Microfinance implementation report on Monday 26 October 2015, French was not used. 1.3 State of play related to conflicts of competence Agreement between EMPL and ITRE on "How best to harness the job creation potential of small and medium sized enterprises (SMEs)?" (LS) ITRE Committee objected the EMPL request for an INI report on "How best to harness the potential of small and medium sized enterprises (SMEs), which are an important contributor to growth and employment in the EU?" and asked for a modification of the title, content and scope of this report to reflect only the areas of competence of the EMPL Committee. ITRE and EMPL Committees have agreed upon the formulation of a new title, "How best to harness the job creation potential of small and medium sized enterprises (SMEs)?", and revised scope that reflect the understanding between both Committees that the main goal of this report should be to identify and discuss specific obstacles and burdens SMEs are facing when creating jobs Refugees: Social inclusion and integration into the labour market - EMPL/CULT (PR) At their meeting of 28 September 2015 Coordinators decided to seek authorisation for a nonlegislative own-initiative report on Refugees: Social inclusion and integration into the labour market. The CULT committee has submitted a request to the CCC to be associated under Rule 54 for parts of the report falling under its competence, notably education, lifelong learning, and "integration through culture". During the CCC meeting on 27 October it was decided to grant the CULT Committee Rule 54 and to mandate the two secretariats to -- in consultation with the rapporteur -- draw-up a letter specifying the arrangement. 1.4 EMPL Working Group on Labour market impacts of digitalisation and robotics (LS/RS) Decision: Coordinators decided to maintain the Working Group, and took note of the constitutive meeting date of 19 November (the ECR group informed the other groups that it would unfortunately not be present due to political group activities). 1.5 Invitation to Minister Pier Carlo Padoan to EMPL meeting (MA) The Italian Minister of Economy and Finance, Pier Carlo Padoan, will be invited to present its initiative on a European unemployment insurance scheme at one of next EMPL Committee meetings. Decision: Coordinators took note of the invitation of Minister Padoan and agreed also that representatives from Member States' governments should be invited to present good practices in employment matters at forthcoming EMPL meetings, starting with Austria. 1.6 Joint ECON/EMPL hearing on "Reasons, repercussions and remedies of economic inequality in the EU" (AC) At the CCC meeting of 27 October 2015 the EMPL Chair expressed the wish to be associated to the PV\ doc 7/28 PE v01-00

8 ECON hearing on "Reasons, repercussions and remedies of economic inequalities in the EU" as the topic falls under the remit of both the EMPL and ECON Committees. The two Chairs agreed on the following arrangements: The hearing is held during a mutually agreeable time-slot of the ECON Committee The hearing will be co-chaired One half of the total number of experts will be determined by ECON, the other half by EMPL Experts whose expenses are in want of reimbursement will be reimbursed by the budgetary appropriations of the committee which nominated the expert in question. 1.7 Other items Coordinators agreed that compromise amendments could be discussed in EMPL Committee, taking consideration of timing and organisational constraints. 2. 9 2.5 Communication from the Commission to the European Parliament, the Council and the European Central Bank on steps towards completing Economic and Monetary Union COM (2015)600 Recommendation for a Council recommendation on the establishment of National Competitiveness Boards within the Euro Area COM (2015)601 (MM/AC) Responsible: ECON Opinions: EMPL, BUDG, REGI, AFCO, ITRE Decision: Coordinators decided not to draw up an oral question on the European pillar of social rights to postpone their decision on the course of action on the euro area recommendations Coordinators also instructed the Secretariat to closely monitor the impact of the package and of the forthcoming euro area recommendations on the scope and calendar of the EMPL INI on the AGS, also with a view to ensure the appropriate involvement of the EMPL Committee within the EP. 3. Monitoring group on the implementation of labour market and social reforms in Greece (GB/LS) Decision: Coordinators established the Monitoring Group on the implementation of labour market and social reforms in Greece under the Memorandum of Understanding, with the proposed mandate. Coordinators decided to request authorisation to send a Delegation composed of 6 Members and the Chair to Athens on 30 November and 1 December Possible follow-up on the Ryanair reaction of the public hearing organised by EMPL (AC/RS) Decision: Coordinators instructed the Chair to write to the President informing him of their decision not to follow up on the issue, emphasising the importance of forthcoming discussions on a proposed new IIA on a mandatory Transparency Register. A separate point regarding Ryanair was raised regarding (Court) cases involving Ryanair on national level and how to deal with it on Committee level. Coordinators agreed on the sensitivity of the issue, such as the need to avoid political interference in ongoing Court cases, so that the issues concerned could be dealt with in the framework of current/ upcoming files, such as the own-initiative report on social dumping, the labour mobility package (includes the EMPL hearing in March 2016) or the aviation package. 5. Exchange of views with stakeholders - Implementation of the UN Convention on the Rights of Persons with Disabilities with special regard to the Concluding Observations of the UN CPRD Committee (MM) Decision: The Coordinators decided that they would invite five experts: Yannis Vardakastanis (European Disability Forum), Michael O'Flaherty (FRA), Emily O'Reilly (European Ombudsman), a representative of UNCRPD Committee and Jan Jařab (Office of the High Commissioner for Human Rights). 10 claim travel expense. 6. Tripartite Social Summit (MA) Decision: The Chair is mandated to send a letter to President Schulz asking him to write to President Juncker, President Tusk and the Luxembourg Presidency to thank for the invitation received and express once again the wish that the EMPL Chair be invited on a permanent basis and in good time ahead of each meeting. 7. EMPL Committee work programme for Studies & Workshops (LS/ZP) Decision: Coordinators approved the overall principles of grouping proposals by subject and aligning the programme of studies and workshops on planned EMPL and Commission work. Coordinators also agreed to decide on the work programme for 2016 at their next meeting. 8. Discussions with relevant European organisations on concrete realisations in the EMPL field (AC) Decision: this item has been postponed 9. Motion for Resolution 1 - decision on procedure (MA) 9.1 B8-0974/ Motion for a European Parliament resolution on Italy's dangerously low birth rate (8.5 children per 1000 head of population) by Gianluca Buonanno The Motion for Resolution can be found annexed to these notes. 1 Rule 133 : Motions for resolutions 1. Any Member may table a motion for a resolution on a matter falling within the spheres of activity of the European Union. The motion may not comprise more than 200 words. 2. The committee responsible shall decide what procedure is to be adopted. It may combine the motion for a resolution with other motions for resolutions or reports. It may adopt an opinion, which may take the form of a letter. It may decide to draw up a report under Rule The authors of a motion for a resolution shall be informed of the decisions of the committee and of the Conference of Presidents. 4. The report shall contain the text of the motion for a resolution. 5. Opinions in the form of a letter addressed to other institutions of the European Union shall be forwarded by the President. 6. The author or authors of a motion for a resolution tabled under Rule 123(2), 128(5) or 135(2) shall be entitled to withdraw it before the final vote. 7. A motion for a resolution tabled in accordance with paragraph 1 may be withdrawn by its author, authors or first signatory before the committee responsible has decided, in accordance with paragraph 2, to draw up a report on it. Once the motion has been thus taken over by the committee, only the committee shall be empowered to withdraw it up until the opening of the final vote. 8. A withdrawn motion for a resolution may be taken over and retabled immediately by a group, a committee or the same number of Members as is entitled to table it. Committees have a duty to ensure that motions for resolutions tabled under this Rule which meet the requirements laid down are followed up and duly referred to in the resulting documents. Decision: Not to follow up this matter; the issues connected with the implementation of the 'posted workers directive' (96/71/EC) have been discussed in the EMPL Committee several times and Directive 2014/67/EU on the enforcement of Directive 96/71/EC has been adopted on 15 May 2014 by ordinary legislative procedure; in addition, the issues raised in the motion may be covered by the EMPL Committee in the framework of future discussions on the planned revision of the 'posted workers directive' as well as of the own-initiative report on 'Social dumping' whose adoption is scheduled for March B8-0993/ Motion for a European Parliament resolution on the accessibility of services for people with disabilities by Aldo Patriciello The Motion for Resolution can be found annexed to these notes. Decision: Not to follow up this matter; the Union has no competence to rule on the right to strike (Article 153 TFEU) although it is bound to respect it as it is a right recognised by all Member States which is also enshrined in the Charter of Fundamental Rights: issues related to the exercise of the right to take collective action, including strike, in the internal market were raised by the so-called "Laval-Viking" case law by the Court of Justice in , following which the European Parliament called several times on the Commission to take initiatives aimed to clarify that economic freedoms cannot undermine fundamental social rights; however in 2012 the proposed 'Monti II' regulation on the exercise of the right to take collective action within the context of the freedom of establishment and the freedom to provide services had to be withdrawn by the Commission because of subsidiarity concerns voiced by several national Parliaments based on the Protocol on the application of the principles of subsidiarity and proportionality; it shall also be noted that the EMPL Committee has more recently commissioned a study on "EU social and labour rights and EU internal market law" which was published last September 9.5 B8-1033/ Motion for a European Parliament resolution on support for pensioners by Gianluca Buonanno The Motion for Resolution can be found annexed to these notes. Chair's announcements 14.1 Interpretation Interpretation was available in German, English, Italian, French, Hungarian, Danish and Portuguese State of play related to conflicts of competence Refugees: Social inclusion and integration into the labour market - EMPL/CULT (PR) At their meeting of 28 September 2015 Coordinators decided to seek authorisation for a nonlegislative own-initiative report on Refugees: Social inclusion and integration into the labour market. The CULT committee has submitted a request to the CCC to be associated under Rule 54 for parts of the report falling under its competence, notably education, lifelong learning, and "integration through culture". During the CCC meeting on 27 October it was decided to grant the CULT Committee Rule 54. A letter specifying the arrangement has been agreed on by both Committee Chairs on 24 November and has subsequently been sent to the CCC Feedback from the Chair on the Delegation to Greece (MK) On and a delegation by EMPL composed of the Chair and the members Miareta Kumpula-Natri (S&D), Amjud Bashir (ECR), Laura Agea (EFDD) and the local member Kostandinka Kuneva (GUE) visited Athens following an invitation by Mr Katrougalos, Minister of Labour, Social Security and Social Solidarity. The delegation had meetings with the Minister and the Alternate Ministers Antonopoulou, Fotiou and Petropoulos, and with the Heads of Unit of the ministry. The delegation also met the social partners, the President of the Hellenic Republic, Mr Pavlopoulos, the Vice President of the Government, Mr Dragasakis and had a meeting in the Greek Parliament with representatives of the Committee on Social Affairs of the Greek Parliament, in which was also assisted Mr Nicolas Schmidt, Minister of Labour, Luxembourg Presidency. The delegation was informed about the forthcoming reforms to the Greek insurance and pension system, the impact on the labour market and the social situation of measures taken in the framework of the financial assistance programmes granted to Greece following the Memoranda of Understanding, the current needs to be met to cope with high unemployment rates and also the terms for assuring the sustainability of the Greek pension and insurance systems. For the sake of transparency of measures to be taken to ensure the effectiveness of the necessary Greek reforms, the Greek authorities expressed the wish that the EMPL committee would follow in the framework of its competence the forthcoming review of the Greek labour law, the labour market situation -including collective dismissal, industrial action and collective bargaining, taking into account best practices internationally and in Europe -, labour market policies to be established which should be compatible with sustainable and inclusive growth. The Greek authorities also stressed the need for an increased funding from the ESF, the adaptation to the Greek particularities of the Youth Employment Initiative or of the FEAD so as to allow the Greek government to continue to run the distribution of in kind benefits Feedback from Chair from the CCC - Implementation reports The draft recommendation can be found in the annexes Decision: The Chair invited Coordinators to send him comments in writing on the draft recommendation in view of the upcoming CCC meeting. Accessibility Act (MM/MA) Decision: Coordinators took note of the proposal for a Directive on the approximation of the law, regulations and administrative provisions of the Member States as regards accessibility requirements for products and services. Coordinators consider the proposal as falling within the EMPL remit and expect the text to be referred to EMPL as lead Committee. Coordinators decided that if this weren't the case, the procedure for joint committee meetings (Rule 55) should apply. 18. EMPL Committee work programme for Studies & Workshops (LS/ZP) Annex: table prepared by Policy Department A with assessment of opportunity of launching expertise on the topics proposed, and the format and price estimate of possible expertise, and note concerning the budget.
