3 C/106/L/23 22 October 2015 COUNCIL 106th Session DRAFT RESOLUTION ON IOM UN RELATIONS (Submitted by the Standing Committee on Programmes and Finance to the Council for consideration and adoption under item 9 of the revised provisional agenda) The Council, Reaffirming the purposes and functions of the Organization as set out in the IOM Constitution and other relevant documents and decisions of the Council, Bearing in mind the long-standing relationship and collaboration between IOM and the United Nations, Recalling the Cooperation Agreement between IOM and the United Nations, dated 25 June 1996, Considering the report submitted to the Council by the Standing Committee on Programmes and Finance, document S/17/14, reflecting the work of the Working Group on IOM UN Relations and the IOM Strategy, Considering also the requirement affirmed by Member States that the Organization be able to continue to fulfil its mandate while it stays coordinated with the international agenda, 1. Expresses its appreciation to the Chairperson of the Working Group on IOM UN Relations and the IOM Strategy for the way in which he has guided its work in 2015, building on the good work of the Chairperson of the Working Group in 2014; 2. Requests the Director General of IOM to formally approach the United Nations to convey to it the views of IOM Member States as set out in subparagraphs (a) to (c) below and develop with it a way in which the legal basis of the relationship between IOM and the United Nations could be improved, based on the following essential elements and under the explicit condition that these essential elements as contained below in subparagraphs (a) and (b) be preserved in fulfilling the requirements of subparagraph (c):

4 C/106/L/23 Page 2 (a) IOM is the global lead agency on migration and is an intergovernmental, nonnormative organization with its own constitution and governance system, featuring a predominantly projectized budgetary model and a decentralized organizational structure. The Organization must, in addition to these features, also retain the following attributes to which its Member States attach importance: responsiveness, efficiency, cost-effectiveness and independence; (b) IOM is an essential contributor in the field of migration and human mobility, in the protection of migrants rights, and in operational activities related to migrants, displaced people and migration-affected communities, including in the areas of resettlement and returns. It has, over time, accumulated a wide and unique range of real world experiences. IOM must be in a position to continue to play this essential and experience-based role; (c) In order for IOM to continue to play such leading and essential roles and also for IOM s practical experience to be counted in and to be recognized at the level of United Nations decision-making bodies, the Organization should seek to become a member of key coordination mechanisms, including, but not limited to, the United Nations Chief Executives Board for Coordination and its three pillars, the High-level Committee on Programmes, the High-level Committee on Management and the United Nations Development Group; the Regional UNDG Teams and the United Nations country teams; the Inter- Agency Standing Committee; and the Executive Committee on Humanitarian Affairs. The Organization should also continue its membership in the Inter- Agency Security Management Network and in country-level security management teams; 3. Also requests that the Director General report back on his discussions on a continuous basis to the Member States through the Working Group on IOM UN Relations and the IOM Strategy, including on the cost implications that the envisaged improved legal arrangements would entail; 4. Further requests that, in light of his discussions, the Director General develop proposals for improved legal arrangements with the United Nations which the Council could evaluate and upon which it could act at one of its future sessions.

5 C/106/L/25 18 November 2015 COUNCIL 106th Session DRAFT RESOLUTION ON THE ADMISSION OF THE DEMOCRATIC REPUBLIC OF SAO TOME AND PRINCIPE AS A MEMBER OF THE ORGANIZATION (Submitted by the Secretariat to the Council for consideration under item 6 of the revised provisional agenda) The Council, Having received the request of the Democratic Republic of Sao Tome and Principe for admission as a Member of the Organization (C/106/18), Having been informed that the Democratic Republic of Sao Tome and Principe accepts the Constitution of the Organization, has completed all the required internal procedures according to its constitution and applicable rules and has undertaken to make a financial contribution to the administrative requirements of the Organization, Considering that the Democratic Republic of Sao Tome and Principe has demonstrated its interest in the principle of the free movement of persons as stated in Article 2(b) of the Constitution, Convinced that the Democratic Republic of Sao Tome and Principe could give valuable assistance towards furthering the purposes of the Organization, 1. Decides to admit the Democratic Republic of Sao Tome and Principe as a Member of the International Organization for Migration, in accordance with the provisions of Article 2(b) of the Constitution, as from the date of the present resolution; 2. Also decides to determine its contribution to the Administrative Part of the Budget at per cent thereof.

7 C/106/L/26 18 November 2015 COUNCIL 106th Session DRAFT RESOLUTION ON THE ADMISSION OF SAINT KITTS AND NEVIS AS A MEMBER OF THE ORGANIZATION (Submitted by the Secretariat to the Council for consideration under item 6 of the revised provisional agenda) The Council, Having received the request of Saint Kitts and Nevis for admission as a Member of the Organization (C/106/19), Having been informed that Saint Kitts and Nevis accepts the Constitution of the Organization, has completed all the required internal procedures according to its constitution and applicable rules and has undertaken to make a financial contribution to the administrative requirements of the Organization, Considering that Saint Kitts and Nevis has demonstrated its interest in the principle of the free movement of persons as stated in Article 2(b) of the Constitution, Convinced that Saint Kitts and Nevis could give valuable assistance towards furthering the purposes of the Organization, 1. 23 C/106/L/34 18 November 2015 COUNCIL 106th Session DRAFT RESOLUTION ON THE MIGRATION GOVERNANCE FRAMEWORK (Submitted by the Secretariat to the Council for consideration under item 9 of the revised provisional agenda) The Council, Considering the IOM Constitution and in particular Article 1.1(c) regarding, inter alia, the Organization s purpose and function to provide advisory services on migration questions and other assistance, as well as Article 1.1(e) regarding the Organization s purpose and function to provide a forum for the exchange of views and experiences, and the promotion of cooperation and coordination of efforts on international migration issues, Considering also the IOM Strategy (Council Resolution No of 7 June 2007) and other relevant Council resolutions, including Council Resolution No of 27 November 2012 affirming the support of Member States for the recognition of the current and future role of IOM as the global lead agency on migration, Confirming IOM s commitment to the principle that humane and orderly migration benefits migrants and society, Considering IOM s mandate to act with its partners in the international community in order to assist in meeting the growing operational challenges of migration management, including in response to migration crises, to advance understanding of migration issues, to encourage social and economic development through migration and to uphold the human dignity and well-being of migrants, Confirming the sovereignty and territorial integrity of States, including the right of each State to determine who enters and stays in its territory and under which conditions, within the framework of international law, Recalling the body of international migration law that encompasses, inter alia, obligations under human rights, refugee, labour, humanitarian, maritime and transnational criminal law,

24 C/106/L/34 Page 2 Aware of the Declaration of the High-level Dialogue on International Migration and Development (A/RES/68/4) and in particular paragraph 1 recognizing that international migration is a multidimensional reality and a cross-cutting phenomenon that should be addressed in a coherent, comprehensive and balanced manner, Taking note of the Making migration work: an eight-point agenda for action contained in the Report of the Secretary-General on international migration and development (A/68/190), and The 5-year Action Plan for Collaboration, civil society s proposal for an outcome and follow-up to the United Nations 2013 High-level Dialogue on International Migration and Development, Recalling the Berne Initiative process and its International Agenda for Migration Management (published in 2005), containing a set of common understandings for the management of international migration, Recalling IOM s comparative advantage in addressing the migration dimensions of crises based on its migration management mandate and expertise and the IOM Migration Crisis Operational Framework (Council Resolution No of 27 November 2012), Appreciating IOM s role and experience as the lead international organization in the field of migration and its comparative advantage in addressing migration and mobility governance, and in particular position papers issued in the lead-up to the World Humanitarian Summit and the 2013 High-level Dialogue on International Migration and Development (including the paper IOM activities and possible high-road scenarios for the four roundtable themes ), Recognizing that this is an era of unprecedented mobility and that the need to support coherent, comprehensive and balanced approaches to migration is becoming increasingly relevant, Aware of the adoption by the United Nations General Assembly of the 2030 Agenda for Sustainable Development (A/69/L.85) and in particular Sustainable Development Target 10.7 to facilitate orderly, safe, regular and responsible migration and mobility of people, including through the implementation of planned and well-managed migration policies, Recalling Council Resolution No of 29 November 2013 affirming the support of Member States for IOM s role in the discussions on the post-2015 development agenda, in particular discussions related to migration and development, Mindful of the requests that IOM has received for advice on governing all aspects of migration, Acknowledging IOM s commitment to using results-based approaches in its projects, and its desire to continue to improve how it plans and reports on the results achieved by the Organization, Aware that there is no single convention or framework presenting a coherent, comprehensive and balanced approach to migration governance which is also practical, concrete and concise,

25 C/106/L/34 Page 3 Mindful of the differences in the needs, interests and priorities of Member States, which will affect how they choose to apply a coherent, comprehensive and balanced approach to migration, Reaffirming the importance of IOM s partnerships with other international and regional actors and the continued complementarity of IOM activities to their mandates, IOM s ongoing commitment and support to existing legal and institutional frameworks, IOM s role in the Global Migration Group, and the Organization s expertise in issues related to migration and mobility, 1. Expresses its gratitude to the Director General for this initiative; 2. Welcomes the IOM Migration Governance Framework; 3. Requests the Director General to use and apply the Migration Governance Framework to guide the Organization s activities on the basis of available resources, in cooperation with its partners, including in supporting capacity-building and training, project development, and planning and reporting at IOM; 4. Further requests the Director General to report to the IOM Council on a regular basis on how the Migration Governance Framework is being applied and on any other relevant updates or developments; 5. Encourages Member States to use the Migration Governance Framework to enhance their own governance of migration and mobility, with support from IOM.

31 C/106/L/37 18 November 2015 COUNCIL 106th Session DRAFT RESOLUTION ON THE PROGRAMME AND BUDGET FOR 2016 (Submitted by the Secretariat to the Council for consideration under item 9 of the revised provisional agenda) The Council, Having received and examined the Programme and Budget for 2016 (C/106/7), Having taken into account the comments and recommendations of the Standing Committee on Programmes and Finance (S/17/14), Conscious of the core budgetary needs for the administration of the Organization, Recognizing the funding constraints of Member States as a result of the global economic crisis, Mindful of the decisions taken by the Member States in consultation with the Administration for the implementation of the budget-strengthening model, with a view to finding solutions to address, inter alia, the coverage of the core structure, 1. Approves the Programme for 2016; 2. Adopts the Budget for 2016 in the amounts of 44,164,770 Swiss francs for the Administrative Part and 820,281,000 United States dollars for the Operational Part of the Budget; 3. Authorizes the Director General to incur obligations and make expenditures arising from any increase in activities in the Operational Part of the Budget, within the limits of available income, notwithstanding the provisions of operative paragraph 2;

Requests the Director General to report to the Standing Committee on Programmes and Finance at its next session in 2016 any necessary revision of the estimates contained in the Budget for 2016 taking into account any additional measures that may be necessary in order to achieve a balanced budget by the end of 2016; 5. Authorizes the Standing Committee on Programmes and Finance, at its spring session in 2016, to adopt a scale of assessment for the year 2017, on the basis of an IOM assessment scale fully equated to that of the United Nations, as set forth in document SCPF/4 and updated with the addition of new Member States; 6. Reaffirms the desirability of universal participation in the financing of the operational activities, and appeals to Member States, other interested States and other donors to provide additional funds.

33 C/106/L/38 18 November 2015 COUNCIL 106th Session DRAFT RESOLUTION ON THE REPORTS ON THE SIXTEENTH SESSION AND THE SEVENTEENTH SESSION OF THE STANDING COMMITTEE ON PROGRAMMES AND FINANCE (Submitted by the Secretariat to the Council for consideration under item 9 of the revised provisional agenda) The Council, Recalling that pursuant to Resolution No of 28 November 2014, the Standing Committee on Programmes and Finance was invited to meet during the month of July 2015 for the purpose of taking, on behalf of the Council, such action as it deemed necessary in connection with the Financial Report for the year ended 31 December 2014, the Report of the Director General on the work of the Organization for 2014, a revision of the Budget for 2015, the scale of assessment for 2016 and matters related thereto, Bearing in mind that pursuant to Resolution No. 1292, the Standing Committee on Programmes and Finance was invited to meet again in October 2015 to consider matters under its remit in accordance with its terms of reference, Having received and reviewed the reports on the Sixteenth Session (S/16/18) and the Seventeenth Session (S/17/14) of the Standing Committee on Programmes and Finance, 1. Takes note of the reports; 2. Approves the decisions taken by the Standing Committee on Programmes and Finance at its Sixteenth Session.

35 C/106/L/39 18 November 2015 COUNCIL 106th Session DRAFT RESOLUTION ON CONVENING THE NEXT REGULAR SESSION (Submitted by the Secretariat to the Council for consideration under item 18 of the revised provisional agenda) The Council, Bearing in mind Articles 6 and 9 of the Constitution, 1. Decides to hold its next regular session in November or December 2016 in Geneva, at the call of the Director General; 2. Invites the Standing Committee on Programmes and Finance to meet in June 2016 for the purpose of taking, on behalf of the Council, such action as it may deem necessary in connection with the Financial Report for the year ended 31 December 2015, the Report of the Director General on the work of the Organization for 2015, a revision of the Budget for 2016, the scale of assessment for 2017 and matters related thereto; 3. Also invites the Standing Committee on Programmes and Finance to meet again in October 2016 to consider matters under its remit in accordance with its terms of reference.
