1 SCRANTON, PENNSYLVANIA The Scranton School Board of Directors held a Special Meeting for General Purposes on Monday, December 16, 2013 following the Public Hearing in the Board Room of the Administration Building, 425 N. Washington Ave., Scranton, PA President McGuigan called the meeting to order at 8:24pm. Roll Call: By the Secretary Present: Absent: Directors Casey, Donahue, Douaihy, McAndrew, Oleski, Ruane, Sheridan, Shrive and President McGuigan. All Present. President McGuigan announced for Visiting Delegations that the resolution for an RFQ for Solicitor has been pulled from the agenda. Visiting Delegations: Rosemary Boland, SFT, addressed the board regarding the process for handling harassment charges. Robert Needham, Scranton, wanted to address the board regarding his son. President McGuigan consulted with Attorney Minora regarding speaking in public about a child. Attorney Minora offered to meet with Mr. Needham at another time with the Special Education director. Director Ruane questioned if it is okay if it is his own child. Mr. Needham did not mind speaking in public regarding his son s circumstances and needs. Mrs. Colarossi addressed his concerns and a discussion took place between administration and the directors regarding the child s IEP, services and available staff. Michele Devine, Little Tykes, spoke to the board regarding transportation concerns and a personnel issue at Whittier Elementary School. Mrs. Jessica Leitzel-Aquilina responded and will schedule a meeting with Ms. Devine to address her concerns. Resolution Of The Board Of School Directors Of The Scranton School District, Adopting The Pennsylvania School Boards Association Standards For Effective School Governance And Code Of Conduct For Members Of Pennsylvania School Boards Page 1 of 9

2 WHEREAS, the Board of School Directors of the Scranton School District, having been entrusted by our fellow residents with stewardship of the education of the youth of this community, is deeply committed to the highest ideals of excellence in student achievement and in school governance; and WHEREAS, the Board acknowledges the immense responsibility it bears for fostering the development of citizens with the intellectual, social and ethical skills necessary to contribute successfully to the advancement of our representative democracy; and WHEREAS, the Board recognizes the direct relationship between high student achievement and the effectiveness of a school entity s governing board of directors; and WHEREAS, the Board believes that success requires it not only to set and enforce high expectations and standards for students and school staff, but also to set and enforce high expectations and standards for the Board of School Directors; NOW THEREFORE BE IT RESOLVED, that the Board of School Directors does hereby adopt the Pennsylvania School Boards Association s Standards for Effective School Governance and Code of Conduct for Members of Pennsylvania School Boards, attached hereto as the standards and expectations for the conduct of the business and fulfillment of the public responsibilities of this Board of School Directors, effective immediately. THE BOARD MAY, from time to time, take specific action to reaffirm its commitment to these standards and code of conduct as means of communicating its ongoing commitment to excellence in school governance DULY ENACTED this 16th_day of December, SEE ATTACHMENT The resolution was seconded by Director Ruane and passed unanimously on a roll call vote. The resolution was seconded by Director Shrive and passed unanimously on a roll call vote. EDUCATION COMMITTEE The following resolution was submitted by Director Douaihy. It is the recommendation of the Education Committee that the following resolution be approved: WHEREAS, the Scranton School Board recognizes the importance of providing appropriate instructional Materials for the students of the Scranton School District, and Page 3 of 9

4 WHEREAS, the Scranton School District s Reading Curriculum Committee has reviewed and unanimously selected Pearson Reading Street for implementation in kindergarten through fifth grade, and WHEREAS, the total cost of the kindergarten through fifth grade adoption is $819,033.50, and WHEREAS, Pearson Publishers has offered three-year extended financing terms, with one-third of the total, $273, due on February 28, 2014, THERFORE, BE IT RESOLVED that the Board authorizes the purchase and adoption of Pearson Reading Street for implementation during the school year. The resolution was seconded by Director Sheridan and passed unanimously on a roll call vote. ON THE QUESTION: President McGuigan asked the SFT union president, Ms. Boland if she is satisfied with this choice. Ms. Boland confirmed that the Textbook Committee selected. PERSONNEL COMMITTEE 10-J-1 The Personnel Committee presents the following resolution for your consideration: WHEREAS, the Board, in an effort to reduce costs and in order to ensure that the Chain of Command is followed, wishes to approve a protocol that permits only the Superintendent of Schools, Deputy Superintendent/Finance & Manager of Personnel Services to interact directly with the Board Solicitor. All other Administrators that require the professional services of the District Solicitor must obtain approval from either the Superintendent of Schools or the Deputy Superintendent/Finance before contacting and/or meeting with the Solicitor. The resolution was seconded by Director Donahue. ON THE QUESTION: Director Douaihy made a motion, seconded by Director Sheridan to table the resolution. Director Oleski confirmed that her affirmative answer would be to table the resolution for further discussion. President McGuigan noted that according to PSBA as best practice that a lot of school districts do this as a way to control costs and fees and comes directly from PSBA and further it does not forbid folks from contacting the solicitor but just making one of the three people aware. (Comments made from out of order audience members caused President McGuigan to restore order to the meeting) The motion to table passed with five (5) affirmative and four (4) negative votes. The negative votes were cast by Directors Donahue, McAndrew, Shrive and President McGuigan. ALSO Page 4 of 9

5 10-J-2 The Personnel Committee presents the following resolution for your consideration: WHEREAS, the Scranton School Board agrees to adopt the amended Scranton School District Organizational Chart, as per attached, and WHEREAS, be it further resolved that all District Administrators are required to follow the Chain of Command, as listed on the attached Organizational Chart. SEE ATTACHMENT The resolution was seconded by Director McAndrew. ON THE QUESTION: Director Douaihy made a motion to table the resolution, seconded by Director Ruane. The motion to table failed with four (4) affirmative and five (5) negative votes. The negative votes were cast by Directors Donahue, McAndrew, Oleski, Shrive and President McGuigan. Director Oleski questioned the order of the organizational charges changes and the order should be the Board of School Directors, the Superintendent then the Supervisor of Special Education falling in line with the other supervisors. It was confirmed that that is correct. Director Douaihy pointed out that the PIMS Administrator will report to the Director of Special Education. The resolution passed with six (6) affirmative and three (3) negative votes. The negative votes were cast by Directors Douaihy, Ruane and Sheridan. PERSONNEL COMMITTEE 10-J-4 SUPERINTENDENT S REPORT NO APPOINTMENTS/ASSIGNMENTS It is the recommendation of the Superintendent of Schools that the individuals as listed below be appointed to professional positions in the Scranton School District. ON THE QUESTION: Director Shrive commended everyone retiring for their years of service. NEW BUSINESS: At this time Director Shrive announced he would be resigning from the Scranton School Board effective Tuesday, December 17, 2013 as he will be serving as the Solicitor for the City of Scranton. Mr. Shrive further added that while it is not prohibited for him to service in both capacities he believes that the potential for conflicts of interest could arise. Page 8 of 9

9 Mr. Shrive thanked his fellow directors, the administration, faculty and staff, the students of the Scranton School District and the taxpayers for the opportunity to serve as it has been a wonderful experience for him as well as his wife and family. Mr. Shrive indicated for the record that his official resignation will be given to President McGuigan, the Superintendent and the Board Secretary. President McGuigan said that although Director Shrive s time was short she thanked him and he will be greatly missed. President McGuigan asked Solicitor Minora if it would be appropriate to vote on the resignation now. Attorney Minora said that it could be accepted at a regular meeting.
