1 Wednesday, December 17, 2014 A regular meeting of the Toms River Fire Commissioners, District No. 2 was called to order at 7:34 p.m. at the Pleasant Plains Firehouse. Acting Chairman Taylor made the required public statement. "Adequate notice of this meeting has been provided in accordance with the Open Public Meetings Act by the adoption of a schedule of regular meetings and notice thereof being posted in the Municipal Building, 33 Washington Street, Toms River; being filed with the Municipal Clerk and being transmitted to the Asbury Park Press and the Observer/Reporter and to all persons who have requested copies in accordance with statute." Roll call was taken; Present: Absent: Mr. Brown. Minutes of the previous meeting-a motion was offered by Mr. Solly, seconded by Mr. Geoghegan that the reading of the minutes of the previous meeting be waived and accepted as written providing that the minutes shall be made available for inspection by any member of the public during the meeting. Abstain: Mr. Solly, Mr. Geoghegan, Mr. Taylor. Mr. Heroy. Cash Receipts: Received check #5438 dated December 11, 2014 in the amount of $550 from Pleasant Plains Fire Dept. for reimbursement of insurance for December Received check #1034 dated December 10, 2014 in the amount of $34, from Toms River Fire Commissioners for Fire Prevention Bureau revenue of November Bills were presented and approved to be paid on a motion offered by Mr. Heroy, seconded by Mr. Geoghegan. Communications and Alarms - Commissioner Geoghegan reported that the phone system went down in the middle of the night and caused a delay to the Dover Woods call; the issue has been resolved. Insurance - nothing to report.
2 Wednesday, December 17, 2014 Fire Prevention Bureau - nothing to report. Fire Academy - Commissioner Heroy reported that their last meeting was brief; everything is running well up there. First Aid - nothing to report. Joint Monies - Commissioner Heroy said a letter was sent to Fire District # 1 regarding the difference in cost sharing that was billed on the HVAC system. LOSAP - nothing to report. Substation - nothing to report. Silverton report - Chief Tattersall reported that he would like to know what the status is on the new accountability tags. Commissioner Taylor reported that ifthe bulk of the accountability tags were done, the machine should go to the Board office so that the cards can be done there. A motion was offered by Mr. Heroy, seconded by Mr. Solly to approve the purchase of Silverton's request as follows: 1 White Jacket for Asst. Chief 2 Minitor V radios for repair 1 Repair Leaking Water on 2911 Pleasant Plains report - Asst. Chief Parente reported there was nothing to report at this time. Business Administrator's report - Business Administrator Gargano gave the following report: 1. OPRA requests - The Board needs to make a motion to hire a temp to fulfill Jacqueline Bramlett's OPRA request. I sent an estimate to her on how much her OPRA request will cost, but have not heard back from her yet. I sent an estimate to Ms. DiGiorgio on how much her OPRA request will cost, but have not heard back from her yet. We received a complaint from Jacqueline Bramlett stating that we did not get in touch with her. The two attorney's and Fire District #1 Administrator met and he said he would have her rescind her OPRA request; weeks went by, and we never received anything from her that she was rescinding her request, Commissioner Taylor said he was going to contact her to advise her that it was taking time to hire a temp, a letter was sent to her providing an estimate for the extraordinary time and requiring the payment of the 50% of the estimate in advance permissible by law, and the only thing received was a copy of the complaint that she filed with the State. 2. Meeting with Fire District #1 -Attorney Braslow said that he still has not heard back from Fire District #1 's attorney to set up a meeting to discuss the difficulties between the two Boards and the alternatives for the future. 3. Credit due on cost sharing of HVAC - I sent a letter to Fire District #2 on the credit due for the HV AC system - 39% vs. 35%. 4. Budget - is less than we anticipated $4.0 million vs. $4.5 million bringing the tax rate at 7.4 cents per $100 assessed valuation. 5. Air Cards - We received an from Dispatch Supervisor Sinnott that the joint board gave him an air card. This is the first that I am hearing about it; we are paying for eight air cards.
3 Wednesday, December 17, Random Drug Screening Schedule - Each fire company provided their where-abouts throughout the month of January. New Business: Resolution to Divide the Polling Places was introduced by Mr. Heroy, seconded by Mr. Solly (attached). Resolution Authorizing Budget Transfers and Encumbrances was introduced by Mr. Heroy, seconded by Mr. Solly (attached). Resolution to Appoint Acting Chairman Kenneth J. Taylor as the Custodian of Records was introduced by Mr. Geoghegan, seconded by Mr. Heroy (attached). Hiring of a Temp Employee through a Temp Agency - A motion was offered by Mr. Heroy, seconded by Mr. Geoghegan to hire a temporary employee through Joule Staffing Solutions to perform the duties to fulfill the OPRA request from Jacqueline Bramlett (contract attached). OPRA Request - Business Administrator Gargano reported that Jacqueline Bramlett reported to the State Government Records department in writing that we did not respond to the third of three OPRA requests she made to our office. Business Administrator Gargano reported that Attorney Braslow advised her that the attorneys for both Boards and Fire District # 1 Administrator Kubiel discussed this at a meeting they had, and Brian Kubiel stated that he would have her rescind the OPRA request; that was communication number one; communication number two was when Commissioner Taylor advised Business Administrator Gargano that he was going to contact Jacqueline Bramlett to tell her why it is taking so long - because we had to hire a temp to perform the duties; the third communication to Jaqueline Bramlett was when she received a certified letter from us indicating that she would have to pay 50% upfront for the extraordinary amount of time required to do this, and Business Administrator Gargano said she has not heard from her since. Commissioner Geoghegan recommended alternatives for the performance of administration/secretarial duties of the joint board. Commissioner Taylor agreed and stated action should be taken as of the first of the year. Commissioner Geoghegan, also, recommended that this Board come out in unison on this issue in support of alternatives and in support of our office and staff. Commissioner Geoghegan said that when the person making the request lives in Whiting, there is no purpose in the world for her to want this information other than to overburden our staff. Renewal of CD with Investors Savings Bank -A motion was offered by Mr. Heroy, seconded by Mr. Geoghegan to renew the CD with Investors Savings Bank. Closed Session -A resolution was introduced by Mr. Heroy, seconded by Mr. Geoghegan to go into closed session at 8:02 p.m..
4 Wednesday, December 17, 2014 WHEREAS, PL-1975 Chapter 231 allows for meetings in closed session on matters of personnel; and WHEREAS, the commissioners have matters to discuss concerning commissioners following protocol; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSIONERS OF FIRE DISTRICT NO. 2 IN THE TOWNSHIP OF TOMS RIVER, COUNTY OF OCEAN go into closed session to discuss these matters as permitted by the open public act and that the results of this closed session be available to the general public upon the completion of the acceptance of the minutes at the next regular meeting and at such time as these matters in closed session are resolved. Resume Regular Session -A motion was offered by Mr. Heroy, seconded by Mr. Solly to resume regular session at 8: 15 p.m.. 5 RESOLUTION December 1 7, 2014 WHEREAS, a petition of twenty-five (25) or more voters have been filed with the Clerk of the Board in accordance with N.J.S. 40A:l4-76 requesting the division of the district into two (2) polling places; and: WHEREAS, such a division would be in the public interest; NOW, THEREFORE, BE IT RESOLVED BY THE FIRE COMMISSIONERS OF DISTRICT NO. 2 IN THE TOWNSHIP OF TOMS RIVER, COUNTY OF OCEAN, as follows: 1. Fire District No. 2 shall be divided into two (2) polling places for the annual election on February 21, Registered voters of voting Districts 5, 15, 20, 22, 23, 29, 35, 46, 55, 56, and 61 shall vote at the Silverton Fire House, 15 Kettle Creek Road, Toms River, New Jersey. 3. Registered voters of voting Districts 6, part of 14, 21, 24, 25, 30, part of 37, 43, 44, 45, 47, 48, 49, 50, 51, 52, 58, 59, 62, and part of 63 shall vote at the Pleasant Plains Fire House, 40 Clayton Avenue, Toms River, New Jersey. 4. A copy of this resolution shall be sent to the Township Clerk and to such other officials as may be designated by the Clerk of the Board. CERTIFICATION: I, Kevin M. Geoghegan, Clerk of the Commissioners of Fire District #2 in the Township of Toms River, County of Ocean hereby certify that the foregoing resolution was duly adopted at a regular meeting of the Commissioners held on December 17, 2014.
6 PETITION We, the undersigned, hereby petition the Board of Fire Commissioners, District No. 2, Toms River, to divide the Fire District into two polling places for the annual election, to wit: Pleasant Plains Fire House and Silverton Fire House.
7 Resolution December 17, 2014 Authorization of Budget Transfers and Encumbrances WHEREAS, it has become necessary for the Commissioners of Fire District No. 2 in the Township of Toms River, County of Ocean to undertake certain transfers and encumbrances relative to the current Commissioners' budget in order to reflect monies expended or encumbered to date by the Commissioners; and WHEREAS, this resolution shall serve as authorization for said budget transfers and encumbrances as noted herein. 13 TB RMS Joule Staffing Solutions will send weekly invoices based on approved time records completed by both the assigned staff member and your representative. Standard payment terms are net 30 days from the receipt of invoice. Failure to pay and / or failure to pay in timely manner may result in suspension or termination of services. Pricing includes costs incurred by Joule, including without limitation, taxes and surcharges that may be imposed by the state or federal government. Since such costs are subject to change, Joule reserves the right to adjust all rates accordingly. In the event that Joule is not paid for services rendered, whether for temporary services or placement fee, when due, you agree to pay all collection and litigation costs, plus attorney's fees and interest at 1.5% per month. TEMPORARY PRICING Position Administrative Clerk Bill Rate $19.50 /hour TEMPOBARYTO HIRE Joule has incurred substantial recruiting, screening, training, and development costs in order to provide you with this quality talent, with the expectation that the employee will complete a minimum of 600 hours on Joule's payroll. Therefore, you must agree not to employ this candidate until he/ she has completed a minimum of 600 hours on Joule's payroll. Should you decide to transition our temporary to your payroll befare completion of the 600 hours or, you must pay our transition fee, which is outlined below. After completion 600 hours, you will not be charged any additional fees should you decide to hire the Joule employee directly. Gross compensation is defined as the candidate's earnings during the first (12) months, including and estimate of all commissions, bonuses, and incentives in addition to the salary earned by the candidate during the same period. DIBECTHIRE Our fee is 25% of the total annual compensation payable within 10 days from the start of employment. All placements will carry a 30-day replacement guarantee from the start of employment for all employees who leave voluntarily or who are terminated for unsatisfactory performance. This guarantee shall not apply when the employee is terminated due to the lack of work and/ or reduction in work force, or where the employee leaves for reasons constituting a colorable claim for constructive discharge, discrimination or any other related employment claims under applicable federal or state laws. The replacement guarantee is contingent upon receipt of the full placement fees for the candidate in question within ten (10) days from the start of the candidate's direct employment. Either you or Joule may terminate obligations under this Proposal at any time for any reason upon 30 days written notice to the other party except in the case of non-payment of invoices in accordance with these terms when the notice shall be only 24 hours. Those provisions of this Agreement, which by their terms extend beyond the termination or non-renewal of this
14 Agreement, shall survive such termination or non-renewal. Joule clients must pay for all services rendered through the effective termination date. If either you or Joule declares or becomes bankrupt or insolvent, dissolves or discontinues operations, or fails to make any payments within the time periods specified in this Proposal, the other party may terminate their obligations herein upon twenty-for (24) hours written notice. Amendments to or waivers of any terms in this Proposal must be in writing and signed by authorized representatives of Joule and your company; Any terms in this Proposal deemed by law to be unenforceable shall not affect any other provision, which can be given effect without the offending provision. This Proposal, and any Assignment Confirmations and / or,attached schedules, are the entire understanding between you and Joule and supersedes all prior. agreements. This Proposal and its terms cannot be assigned or transferred without the written consent of Joule. The terms of this Proposal are governed by the laws of the State of New Jersey, and disputes resulting in legal proceedings shall be with the federal or state courts located in the State of New Jersey.
