5 Honorable Joe Enook Speaker of the Legislative Assembly of Nunavut Iqaluit, Nunavut June 5, 2018 Dear Mr. Speaker, In accordance with Section 197 of the Nunavut Elections Act, I have the privilege of submitting my report on the conduct and administration of the fifth Nunavut General Election. The mandate for Elections Nunavut encompasses more than just voting. Civic education, engagement of the public in our democratic process, and the promotion of voter participation are all crucial pillars in protecting and enhancing our form of government. This report will provide awareness of the activities of the Office of the Chief Electoral Officer to meet the 2017 General Election mandate, and offer insight into the partnerships established to ensure the integrity of the event. 7 Overview of the Fifth Nunavut General Election On June 20, 2017, the Commissioner of Nunavut Nellie Kusugak issued the proclamation that a General Election would be held on October 30, This is the first General Election in Nunavut to be held on a fixed election date, being the fourth Monday of October, four years after the fourth General Election. The Chief Electoral Officer issued writs of election to 22 Returning Officers on September 25, At the end of the declaration of candidacy period, there were 72 accepted candidates running in 21 constituencies, with the constituency of Kugluktuk being secured through acclamation. Two declarations were rejected in the constituency of Kugluktuk because the candidates filed completed declarations only after the close of candidacy. Elections Nunavut rented 24 offices to host Returning Officers and Assistant Returning Officers, 24 separate voting locations, employed 191 election officers, and shipped thousands of pounds of election material throughout Nunavut. Early voting opportunities were made available to all eligible voters during the period leading up to election day. Although 14 constituencies were hampered by inclement weather during early voting, the Chief Electoral Officer exercised his authority under the Nunavut Elections Act to delay early voting in certain communities until the weather improved. 64.7% of registered Nunavut voters cast a vote for their choice of Member of the Legislative Assembly in their constituency. After the polls closed and the counting of votes was concluded, the Returning Officer for Cambridge Bay applied to the Nunavut Court of Justice for a judicial recount, as the vote difference between Jeannie Ehaloak and Pamela Gross was within 2%. The results of the recount on November 4, 2017 confirmed Jeannie Ehaloak had received the most votes and was declared elected.

11 Report on the Conduct of the Fifth Nunavut General Election 1 Introduction of the Office of the Chief Electoral Officer The Office of the Chief Electoral Officer (Elections Nunavut) is an independent office of the Legislative Assembly of Nunavut that is overseen by the Chief Electoral Officer. Elections Nunavut is responsible for the administration of territorial elections and by-elections under the Nunavut Elections Act, as well as plebiscites under the Plebiscite Act. Under a separate agreement, Elections Nunavut also administers local option liquor plebiscites under the Liquor Act for the Department of Finance. As an independent officer, the Chief Electoral Officer is accountable directly to the Legislative Assembly through the Speaker. This ensures the Office of the Chief Electoral Officer can administer elections and plebiscites in a non-partisan manner; maintaining the integrity of the entire democratic process for all Nunavummiut. The Chief Electoral Officer is appointed by the Commissioner of Nunavut for a 7-year term. The Management and Services Board provides oversight of the budgetary and human resource requirements of Elections Nunavut. The Chief Electoral Officer is required to report annually to the Legislative Assembly, as well as to report on specific election/plebiscite events. These reports include recommendations that the Chief Electoral Officer believes will assist in improving the Nunavut Elections Act and the election/plebiscite process. Elections Nunavut provides GIS and mapping support to the Boundaries Commission. The Boundaries Commission is responsible to hold public hearings and propose boundaries and names of constituencies to the Legislative Assembly. The next electoral Boundaries Commission will be conducted in Elections Nunavut works with many public and private partners to ensure elections and plebiscites are run as effectively and efficiently as possible. Legal counsel, information technology (IT) support, geographic information system (GIS) upkeep, audit oversight, and electronic voter database management (EVDM) support are all secured through external professional contracts. The office is in Rankin Inlet and consists of four permanent employees. The year before and after an event, the casual employees and contract election officers increase the office size to over 190 people.

12 2 Report on the Conduct of the Fifth Nunavut General Election Legislative Amendments Impacting the 2017 General Election Nunavut Elections Act 1. Fixed Election Date: Assented March 19, 2014 The election day for a General Election is to be held on the last Monday in October four years after the previous General Election. The first fixed election day was October 30, This amendment also specifies that the pre-election period is the 90- day period before the writ is issued. 2. Rules for Government of Nunavut Employees: Assented November 5, 2015 Public Servants who want to be a candidate or financial agent are required to give notice, obtain approval and/or take leave in accordance with the Public Service Act. The rules were clarified to ensure public servants understand their responsibilities if they want to participate in one of these roles. 3. Publication of Notice- Financial Returns: Assented November 5, 2015 The Chief Electoral Officer will publish a notice in the newspaper advising the public on how to obtain copies of candidate s financial returns. This reduces the costs previously incurred to publish complete financial summaries. 4. Serving Liquor on Election Day: Assented November 5, 2015 Establishments can now serve liquor on Election Day. The practice of prohibiting the sale of liquor on election day was an out of date provision, and is no longer common in Canada. It is still an offence to try and influence how a person votes by offering them liquor. The Liquor Regulations were also amended to reflect this change. 5. Broadcasting during Blackout Period: Assented November 5, 2015 Anyone can now broadcast campaign material on the election day and the day before. Given the widespread use of social media, it was no longer realistic to expect or enforce the broadcast blackout. Summary Conviction Procedures Act 6. Fines for Failure to Prepare and Send in a Financial Return: Assented May 11, 2017 Candidates and their financial agents may now be issued fines for failing to prepare and send the financial return before the end of the post-election period on December 29, The specified penalty is $230.

14 4 Report on the Conduct of the Fifth Nunavut General Election Initiatives and Partnerships Secondary Student Employment Opportunity- Department of Education The Department of Education partnered with Elections Nunavut on a project to engage youth in Nunavut s electoral process. As the Nunavut Elections Act permits any individual who has not reached voting age to be employed as a Poll Clerk or a Registration Clerk, the partners saw this as an opportunity to expose youth to the democratic process. To be considered for this opportunity, students had to be at least 15 years old, enrolled in a Nunavut secondary school, be in good standing with their school (endorsed by the principal), be legally able to work in Canada and have the permission of their parents/guardians. The selection process was application-based, where students identified which role they wanted to fill and the dates during the election period they could work. The applications were available through Elections Nunavut s website, the Department of Education s website, and through requests made by or telephone. A public service announcement (PSA) was submitted by the Department of Education to ensure adequate notice of this opportunity was provided to students, school administrators and parents. Student Election Officers in Gjoa Haven 42 high school students throughout Nunavut were employed, representing approximately 23% of all election officers who worked during the General Election.

Courtesy of CIVIX Courtesy of Gjoa Haven High School During the election period, 3 school classes from Rankin Inlet conducted field trips to Elections Nunavut headquarters. During these visits, the students were instructed on how elections work in Nunavut, and participated in an imitation vote. CIVIX- Student Vote CIVIX is a non-partisan Canadian charity that builds the skills and habits of citizenship among young Canadians. They have been delivering the Student Vote program for federal, provincial, territorial and local elections across Canada since Elections Nunavut partnered with CIVIX to administer the Student Vote program to coincide with the 2017 General Election. The program combined classroom learning, family engagement, interaction with candidates, media consumption and an authentic voting experience. Students were taught about the territorial government and the process in place to elect Members of the Legislative Assembly. The students also played the roles of election officers to better understand the electoral process.

16 6 Report on the Conduct of the Fifth Nunavut General Election Enforcement Protocol During the first Nunavut Student Vote program to take place at the same time as a territorial election, students were able to cast votes for the official candidate in their respective constituencies. In total, 2161 students in 25 different schools across Nunavut participate in the voting simulation exercise. Student Vote by the Numbers Courtesy of CIVIX The Royal Canadian Mounted Police (RCMP) hosted a preelection meeting with Elections Nunavut and Public Prosecution Canada (PPC) to revisit the enforcement protocol that guides investigations during election periods. The enforcement protocol is a based on a memorandum of understanding the roles and responsibilities of each party under the Nunavut Elections Act. An enforcement manual, which is publicly available on Elections Nunavut s website, provides details of these roles. As there were amendments to the Nunavut Elections Act and Summary Conviction Procedures Regulations, the manual was updated to reflect the changes. Vital Statistics The Department of Health, Vital Statistics division provides Elections Nunavut with information on residents of Nunavut who have either left the Territory permanently or are deceased. This information sharing is guided by a memorandum of understanding and is authorized under Section 42(3)(e) of the Nunavut Elections Act. Elections Nunavut uses this information to update the voters lists for each constituency. 25 Nunavut Schools Participated 17 Constituencies Represented 2151 Students Voted Studentvote.ca/results/nu2017

17 Report on the Conduct of the Fifth Nunavut General Election 7 Human Resource and Logistics 191 election officers were employed during the 2017 General Election. Each officer was required to sign an appointment and oath form, certifying that they were eligible to work and would abide by Elections Nunavut s code of professional conduct. Election Officers were appointed in a manner that was representative of the languages spoken in the community where they would be working. Election Officer Recruitment and Training Returning Officers: In accordance with Section 198(1) of the Nunavut Elections Act, the Chief Electoral Officer appointed 22 Returning Officers (ROs) for the 22 constituencies in Nunavut. The term of their appointments ends one year after the General Election. Four, 3-day training courses were held during August and September. Assistant Returning Officers: In accordance with Section 202(1) of the Nunavut Elections Act, the Returning Officers appointed 39 Assistant Returning Officers (AROs). The term of their appointments ceased the day following the election. AROs participated with the ROs during the 3-day training sessions during August and September. Deputy Returning Officers & Poll Clerks: In accordance with Section 204 of the Nunavut Elections Act, the Returning Officers appointed 48 Deputy Returning Officers (DROs) and 48 Poll Clerks (PCs) shortly after the writs were issued. The term of their appointments ceased the day following the election. The DROs and PCs attended 1-day training sessions presented by the ROs and AROs in each constituency. Registration Clerks: In accordance with Section 46(1) of the Nunavut Elections Act, the Returning Officer appointed 30 Registration Clerks (RCs). The term of their appointments ceased the day following the election. The RCs participated in the 1-day training session with the DROs and PCs. Other Election Officers: 2 Supervisory Deputy Returning Officers (positioned in Iqaluit and Cambridge Bay), and 1 Deputy Retuning Officer- Special Ballot Coordinator and 1 Poll Clerk-Special Ballot Coordinator (both positioned in Rankin Inlet) were appointed. The term of their appointments ceased the day following the election. Elections Nunavut

18 8 Report on the Conduct of the Fifth Nunavut General Election Office and Voting Locations During the pre-election and election periods, the office of the Returning Officer is a location for the public to obtain information on the electoral process, register to vote or make changes to their registration, and vote in the advance voting opportunities. The office is also where prospective candidates, financial agents and campaign managers can obtain information on participating in the election and submitting the candidate s declaration of candidacy. An office of the returning officer was secured for every constituency. For the most part, these offices have consistently been used in previous events to establish location memory. In communities with more than one constituency, the returning officers shared the location to centralize the electoral activities. The offices are secured under a contract specifying the dates required for use and cost for the period. The contracts also stipulate certain aspects to the offices to ensure they are accessible to all Nunavummiut, including those who have mobility restrictions. During the advance vote in certain communities and on Election Day, larger voting venues were secured to accommodate the increased numbers of voters who typically vote on these days. Disaster Planning Elections Nunavut undertook an exercise to identify realistic and probable events that could impact voting during the election period. This exercise proved to be useful as the office was required to rely on the plan when early voting was delayed in some communities due to inclement weather.

19 Report on the Conduct of the Fifth Nunavut General Election 9 Information Technology Communication between the communities and Elections Nunavut headquarters is vital for ensuring an accurate and fair election. With the geographic and environmental challenges that face our territory, it is important to incorporate technology with redundant measures in the event of a communication failure. Each Returning Officer was supplied with a telecommunication device, laptop, printer, scanner, and internet modem. The election officers were also instructed on how to conduct the election and report results if the electronic technology were to fail. Example of Ground Truthing Map: Temp units represent the structures requiring identification Geographic Information Systems Geographic Information System (GIS) provides the foundation for developing constituency maps and ensuring every dwelling in Nunavut is accounted for and placed in the correct constituency. This is especially important where there are two or more constituencies in a community. Elections Nunavut contracted the services of a local company to enhance the GIS database foundation to ensure the information provided to the public in the form of detailed maps was current and accurate. This work included obtaining data sets from the Department of Community & Government Services- Lands Division, as well directly from the City of Iqaluit. Although this information was relatively current, there had been additional residential construction throughout Nunavut that was not yet identified in these data sets. The election officers in each community were provided these unknown building locations and were tasked to identify them through ground truthing. The results of the local ground truthing were then entered in to the data sets providing voters the most accurate geographic information available.

20 10 Report on the Conduct of the Fifth Nunavut General Election Outreach Save the Date Phase one of the outreach strategy commenced in June 2017 with the distribution of posters indicating when the General Election was going to take place. During this time, a social media campaign was initiated to circulate information to Nunavummiut about the election and important dates and deadlines to be aware of. Get on the Voters List Phase two commenced in the late summer of 2017 with an outreach campaign focused more towards ensuring eligible voters were registered and added to the voters list.

21 Report on the Conduct of the Fifth Nunavut General Election 11 Social Media Elections Nunavut recognizes the importance of social media in disseminating information to the public. Throughout the election, Elections Nunavut provided Facebook posts to every community news group in Nunavut. For the 2017 General Election, Elections Nunavut created #nunavote17 to provide Twitter users a platform to obtain information from many different organizations contributing to Twitter. Social Media Interactions During the Election Periods Real-time information was posted to Twitter in all of Nunavut s official languages. 22 12 Report on the Conduct of the Fifth Nunavut General Election Alternative Methods for Voting The Nunavut Elections Act recognizes that many voters in Nunavut may not be able to vote during the statutorily prescribed days for voting in the Advance Vote and on Election Day. As such, provisions were implemented to provide voters other various opportunities to vote, including voting in the office of the returning officer, vote by special mail-in ballot, vote by emergency telecommunication and vote by proxy. Elections Nunavut published information about the different voting opportunities in the newspapers, on the website and through social media. Elections Nunavut also participated in media interviews on the various voting opportunities. Special Ballot (mail-in) The Nunavut Elections Act provides the opportunity for those who will be away from their constituency on election day to vote by special ballot. Special ballot applications were made available after the writ was issued on September 25, The outreach to publicize this option was extensive and included the assistance of many organizations and agencies that support and house Nunavummiut who leave the territory temporarily (See Appendix D for distribution list). The Chief Electoral Officer attended Nunavut Sivuniksavut in Ottawa to provide an overview of the role of Elections Nunavut in our democratic process, as well as to provide in-person assistance to the students to complete voter registration forms and applications for special ballots. Special Ballot (telecommunications) The Nunavut Elections Act provides the opportunity to vote by telecommunication device under certain circumstances. This emergency voting procedure was available for voters who are located in a remote location and had no other means of voting prior to going to that remote location. The outreach for this opportunity was adjoined to the outreach for the special mail-in ballot. (See Appendix F for distribution list).

23 Report on the Conduct of the Fifth Nunavut General Election 13 Mobile Poll The Nunavut Elections Act provides the opportunity for those who are shut in and unable to attend early voting or the polling station to vote by mobile poll. The Returning Officer and Assistant Returning Officer in each constituency broadcasted information about this voting opportunity through local media and reached out to locations that house elders and others who might be physically unable to attend the poll. Elections Nunavut also communicated with the Nunavummi Disabilities Makinnasuaqtiit Society to share details to with those within their network. The mobile poll was scheduled to be conducted one week prior to the election, however, due to inclement weather, many communities were serviced by the mobile poll one day after originally scheduled. Voting in the Office of the Returning Officer An Office of the Returning Officer was set-up in every constituency, and where more than one community was within a constituency, the office was in the community where the Returning Officer was appointed. The Nunavut Elections Act provides for voting in the office of the Returning Officer as an early voting opportunity. 24 14 Report on the Conduct of the Fifth Nunavut General Election Proxy Voting The Nunavut Elections Act provides the opportunity to vote by proxy for those who cannot vote because of an unexpected absence and have no other way to vote. Proxy voting applications were made available between October 25 and October 30 at 3:00pm. The Rules for Proxy Voting: Only a Returning Officer or the Chief Electoral Officer can issue applications or certificates to vote by proxy. The voter can only qualify to vote by proxy if they could not vote on election day because of an unexpected absence from their constituency. The voter had no other opportunity to vote. The voter and the proxy voter must be registered in the same constituency. A proxy voter can only vote for one person. Voting by proxy is only allowed on Election Day. Proxy Voting Process The voter obtains an application for a proxy certificate. 2 The voter submits the application for a proxy certificate to the Returning Officer. 3 The Returning Officer confirms if the voter and proxy voter qualify. 4 If they qualify, a proxy certificate with a unique identifier is issued to the voter. 5 The proxy voter votes. 7 The proxy voter presents the completed proxy certificate to the Deputy Returning Officer. 6 The voter and proxy voter complete the proxy certificate.

The pre-election period started 90 days prior to the writ being issued. During this period, prospective candidates could actively campaign. The Nunavut Elections Act provided the following campaigning rules for this period; The prospective candidate could only use their own personal resources to campaign. This includes money and/or goods & services (S.169(1) NEA), The pre-election expenses combined with the election expenses could not exceed $30,000 (S.169(1) NEA), If the prospective candidate became a candidate in the General Election, all personal resources used during the pre-election period had to be recorded as a contribution on the financial return (S.169(2) NEA), and Anyone campaigning during the pre-election period could not knowingly make or publish any false statement of a fact in relation to the character or conduct of a prospective candidate (S.251(3) NEA)

Financial Agent Support Election officers provided support to the candidates and financial agents in preparation for the election. Guides outlining the roles and responsibilities of candidates and their teams were made available in all of Nunavut s official languages. Weekly teleconferences were offered to all candidates and financial agents during the election period to provide information and answer questions on electoral financing rules.

Candidates must have destroyed all copies of the voters lists that they received, or returned them to Elections Nunavut. Judicial Recount Disqualification from Sitting The Returning Officer for Cambridge Bay applied to the Nunavut Court of Justice for a judicial recount because the difference between the number of votes in favour of Jeannie Ehaloak was less than 2% of valid votes cast for the other candidate in that constituency. On November 4, 2017, Justice Bychok conducted the judicial recount in Cambridge Bay. All the candidates in the constituency of Cambridge Bay were served with a notice indicating the time and place of the recount, and that each candidate or their representative could attend. The recount increased the margin of win by one vote for Jeannie Ehaloak, and upheld the outcome identified in the unofficial results. Section 183(1) states that no successful candidate can sit or vote in the Legislative Assembly as a member until their financial return is sent to the Chief Electoral Officer. On November 21, 2017, the day of the first sitting of the Legislative Assembly of Nunavut, a completed financial return from Pauloosie Keyootak had not been sent to the Chief Electoral Officer. As such, Mr. Keyootak was unable to sit and vote on that day.

During the election period, the voters list is provided to each candidate for their specific constituency. The Act specifies that the candidate can only use it for the election and must destroy it after the election. The voters lists that are provided to candidates are encrypted and have a watermark that identifies each copy to a specific candidate. If a VIC was returned undelivered, the Returning Officer made a note to obtain the proper information when the voter attended the poll to vote. Concern was raised that the list contained outdated voter information. Elections Nunavut will continue to harmonize the voters list with other sources of information to improve upon its relevance and accuracy. It is noted that the coverage for registered voters in comparison to the Nunavut Bureau of Statistics population estimates is approximately 74%. This signifies that 26% of Nunavut residents who may be eligible to vote are currently not registered 1. Of particular concern is the lack of registered voters in the years age range. Registered Voters are Nunavut residents who are qualified to vote and are registered and have been added to the voters list. Eligible Voters are Nunavut residents who may be qualified to vote but are not registered and have not been added to the voters list. Coverage is the percentage of eligible voters who are registered to vote. 1 This data includes all residents of Nunavut, including a small segment that would not qualify to vote due to the one-year residency requirement.

102 92 Report on the Conduct of the Fifth Nunavut General Election Recommendations of the Chief Electoral Officer for Changes to the Nunavut Elections Act The Chief Electoral Officer proposes the following amendments to the Nunavut Elections Act: 1. Repeal Proxy Voting In addition to voting at the polls on polling day, the Nunavut Elections Act establishes alternative methods of voting. One such method is a vote by proxy. A review of Territorial/Provincial and Federal electoral legislation confirms that Nunavut is the only jurisdiction to still permit proxy voting. Proxy voting is a method by which a voter, who is unexpectedly absent from his or her constituency on election day, authorizes another voter to cast his or her ballot. Proxy voting requires the completion, review, and approval of an Application, issuance of a Certificate, and additional verification at the polling station. It is an involved process. There are other alternative methods of voting that ensure Nunavummiut who may be unexpectedly absent can have the opportunity to vote. It is recommended that the provisions allowing voting by proxy be removed and the following sections be repealed: ss. 90(4), 123, 124,125,126, 242(1)(c), 242(1)(d), 242(2). 2. Expand Emergency Voting Voters who are away from their place of residence in remote locations, and who have no other means of voting, may vote by an emergency voting procedure. This procedure allows for voting by means of a telecommunications device i.e. radio, telephone, or internet. The current Nunavut Elections Act restricts this voting opportunity to voters in remote locations. This new proposed category would capture individuals who, for example, are not able to vote on election day because of last minute medical travel, but not those who are away at school or otherwise absent and did not take the time to request a special ballot or vote in advance polls. Expanding this voting category would also capture any voters who would have likely applied to vote by proxy if such means to vote were allowed. It is recommended that the emergency voting procedure be extended to a voter who is unexpectedly absent on election day and has no other means of voting. Proposed New Wording: Emergency Voting Procedure Voting by telecommunications device 120. (1) A voter who has the right to vote in a constituency may vote by means of a telecommunications device, including a radio, telephone or Internet telephony device, if the voter

103 Report on the Conduct of the Fifth Nunavut General Election 93 (a) is able to communicate with the office of the returning officer by means of a telecommunications device; (b) requests the returning officer to provide an opportunity to vote by this method; and (c) establishes that he or she is either: (i) unable to vote by any other method because of the voter's remote location, and the voter had no other means of voting before going to this remote location; or (ii) unable to vote on election day because of an unexpected absence from the constituency and the voter had no other opportunity to vote. 3. Include a deadline to apply for a Special Mail-in Ballot All jurisdictions in Canada allow for a form of mail-in or special ballot. In Nunavut, any voter who believes that they will be unable to vote at a polling station on election day has the right to vote by means of a special ballot. In all jurisdictions voters must apply for a special ballot before a specified deadline, and ballots must be received by a specified time to be counted. The deadline to apply for a special ballot varies across the jurisdictions from weeks to days before polling day. In Nunavut, applications for special ballots can be submitted after the writ is issued but the Act does not specify a deadline for receipt of applications. Once an application is received and approved, Elections Nunavut sends out a kit to the voter via Canada Post or airline cargo. The voter is provided with instructions on how to return the special ballot to Elections Nunavut. Given the realities of postal/cargo services in Nunavut the special balloting process requires sufficient lead time to ensure that a ballot can realistically be mailed out and returned in time to be counted. In the 2017 election it is estimated that Elections Nunavut staff processed approximately 17 applications knowing that it was unlikely the ballot would get to the voter and back to Elections Nunavut in time to be counted on Election Day. In addition, staff took extraordinary measures to ensure that an additional 10 ballots would be returned on time. It is recommended that the Act be amended to limit the availability of special ballots to seven days prior to Election Day. This limit reflects a realistic assessment of the limitations of cargo/postal delivery services in Nunavut. Proposed New Wording: Exercise of right to vote 99. (1) Every voter who has reason to believe that he or she will be unable to vote at his or her polling station on election day has the right to vote by means of a special ballot issued in accordance with this Act.

104 94 Report on the Conduct of the Fifth Nunavut General Election Availability (2) Applications for special ballots shall be accepted after the writ is issued and continuing until 5 p.m. Central Standard Time on the 7 th day before election day, from the Office of the Chief Electoral Officer and in any other office in Nunavut or outside Nunavut that the Chief Electoral Officer may designate. 4. The Counting of Special Ballots To be counted, all special ballots must be received by 5:00 pm on election day. As the Act is currently drafted, however, the votes are not counted until all polls are closed at 7:00 pm. Once counted, the votes cast by special ballots are communicated to the returning officer at the polls in the relevant constituency. The votes cast by special ballot are then included in the statement of the poll prepared by the deputy returning officer. It would facilitate the counting of the votes and preparation of the statement of the poll if the results of special balloting could be available immediately at time of the closing of the polls. For this reason, it is recommended that special ballots be counted at 5:00 pm on election day. Proposed New Wording: Time of counting 131. (1) (a) On election day, immediately after the deadline for the receipt of special ballots, the counting of the votes cast by special ballots shall take place at the Office of the Chief Electoral Officer. Returning officers shall not be notified of the results until the closing of the polls on election day. (b) On election day, immediately after the close of the polls in the constituency, the counting of the votes shall take place in every polling station open that day or during the period of the advance vote. 5. Limit Anonymous Contributions The Act currently allows a financial agent to accept an anonymous contribution of $100 or less. If a single contribution exceeds this amount the contribution must be returned, or if the identify of the contributor cannot be established, the contribution must be sent to the Chief Electoral Officer. If a contribution received during an election period is more than $100 the financial agent is required to keep a record of the contribution and record the name of the contributor. There is, however, no limit on the number of anonymous contributions a financial agent may accept. In those jurisdictions in Canada that allow anonymous donations, some limit the total number of anonymous donations a campaign

By way of example, the Northwest Territories, has set the limit at $1,500 while in British Columbia the limit is set at $3,000 (or a higher amount established by regulation). The Act sets the maximum contribution from any individual, corporation, association or organization at $2,500. It is recommended that a limit on the receipt of anonymous contributions be set at $2,500. Proposed New Wording: Anonymous contribution 171. (1) A financial agent may accept an anonymous contribution not exceeding $100. Contribution exceeding $100 (2) Where a financial agent receives an anonymous contribution exceeding $100, the financial agent shall (a) if the identity of the contributor can be established, return the contribution; or (b) if the identity of the contributor cannot be established, send the whole contribution to the Chief Electoral Officer to be credited to the Consolidated Revenue Fund. Limits on total anonymous contribution (3) A financial agent may only accept a maximum of $2,500 in total anonymous contributions under subsection (1) 6. Campaign Bank Accounts The Act provides that a financial agent must open a bank account for the deposit of all campaign contributions. However, the Act does not specify when the account needs to be opened or that it must be opened before a contribution can be accepted by the financial agent. It is recommended that s. 170(4)(a) be amended to provide a deadline by which a bank account or an account at an approved institution be opened. Proposed New Wording: Bank account 170. (4) A financial agent shall (a) open an account at a bank or, where no bank exists where the financial agent resides, at an approved institution; (b) deposit in that account all contributions of money collected on behalf of the candidate; and (c) the account described in subsection 4(a) shall be opened before accepting any contributions, and no later than the 21 st day before election day. Prior to this deadline, a financial agent may apply to the Chief Electoral Officer for an extension of the time limit.

Replace the words Consolidated Revenue Fund with Government of Nunavut in subsection 176(2)(b). Correct the spelling of the constituency name in Schedule I to read Iqaluit-Niaqunnguu. Remove the definition of Liquor in subsection 2(1). Include a after The election of any person who is ineligible to be in section 13. Replace the word DVD with electronic copy in subsections 31(2), 31(2.1), 31(4).

108 98 Report on the Conduct of the Fifth Nunavut General Election Appendix A: Adaptations of the Nunavut Elections Act During the election period, the Chief Electoral Officer adapted certain provisions of the Nunavut Elections Act to accommodate unusual or unforeseen circumstances. Section 190 of the Act permits the Chief Electoral Officer to make these adaptations when the Act does not accord with the urgent needs of the situation. The Chief Electoral Officer does not however, have the authority to extend the period for filing declarations of candidacy or the time to receive a special ballot. The adaptations exercised by the CEO were necessary and appropriate to preserve the integrity of the electoral process. Result: The RCMP investigation determined that charges under the Nunavut Elections Act were not warranted. Complaint #2 A candidate in the constituency of Gjoa Haven submitted a complaint to the RCMP that another candidate was posting campaign material on Government of Nunavut property. Result: The RCMP investigation determined that charges under the Nunavut Elections Act were not warranted. Complaint #3 A candidate in the constituency of Cambridge Bay submitted a complaint to the RCMP that election officers were not providing clear instructions to voters. Result: The RCMP investigation concluded that charges under the Nunavut Elections Act were not warranted. Complaint #4 A candidate in the constituency of Cambridge Bay submitted a complaint to the RCMP that election officers in Cambridge Bay did not declare a conflict of interest due to familial ties with another candidate. Result: The RCMP investigation determined that charges under the Nunavut Elections Act were not warranted. Elections Nunavut received several complaints from the public who were directed to submit them to the RCMP for investigation.
