All electoral areas Application received: N/A Electoral Areas Services April 18, 2016 Committee: Recommendation: THAT the board consider first and second readings of Bylaw No. 369, being the Comox Valley Regional District Development Approval Information Bylaw No. 369, 2015 (PJ 1CV 15), which establishes the procedures and policies of development approval information for zoning bylaw amendments, development permit applications and temporary use permit applications; FURTHER THAT the board consider first and second readings of Bylaw No. 370, being the Comox Valley Regional District Planning Procedures and Fees Bylaw No. 328, 2014, Amendment No. 1 (PJ 1CV 15), which amends the planning application procedures to account for the development approval information bylaw; AND FINALLY THAT the communication plan attached as Appendix D of this staff report dated March 21, 2016, be followed to publicize the proposed bylaws to the development community.

3 COMOX VALLEY REGIONAL DISTRICT BYLAW NO. 370 A bylaw to amend the Comox Valley Regional District Planning Procedures and Fees Bylaw No. 328, 2014 in order to reference the development approval information bylaw. WHEREAS the board of the Comox Valley Regional District adopted Bylaw No. 328 being the Comox Valley Regional District Planning Procedures and Fees Bylaw No. 328, 2014 on July 29, 2014 to establish procedures to amend an official community plan or zoning bylaw or issue a permit under part 14 of the Local Government Act (RSBC, 2015, c. 1); AND WHEREAS the board intends to amend the planning procedures and fees bylaw to reflect the establishment of a development approval information (DAI) bylaw; NOW THEREFORE the board of the Comox Valley Regional District in open meeting assembled enacts as follows: Amendment 1. Bylaw No. 328 being the Comox Valley Regional District Planning Procedures and Fees Bylaw No. 328, 2014 is hereby amended by: (a) replacing subsections (i) to (viii) of section 1(c) of schedule A which read: (i) (ii) Development approval information (DAI) applies to any area that has been designated in the OCP as a DAI area. Where DAI is applicable, the procedures and policies for reports and studies are set out in this section as follows. The CVRD officer may request detailed assessment in support of an application, including, but not limited to, the following: (1) assessment of archaeological significance; (2) assessment of soil suitability for agricultural uses; (3) land use impacts, such as noise, vibration, glare and electrical interference; (4) visual impacts; (5) transportation demand management strategies and transit feasibility assessments; (6) assessment of terrestrial, aquatic and atmospheric ecology; (7) assessment of market conditions and real property absorption rates in areas relevant to the project; (8) economic impact assessment; (9) geotechnical conditions;
4 Bylaw No. 370 Comox Valley Regional District Planning Procedures and Fees Bylaw No. 328, 2014, Amendment No. 1 Page 2 (iii) (iv) (v) (vi) (vii) (viii) (10) rainwater management, including downstream flood mitigation and surface water quality and quantity; (11) erosion and sediment control; (12) local infrastructure impacts; (13) public facilities, including schools and parks, impacts; (14) community services impacts; and (15) other assessments as deemed necessary. Where DAI is required, the reports and studies, prepared at the applicant s expense, must: (1) be prepared and certified by a qualified professional; (2) address all of the terms of reference that are provided by the CVRD officer; (3) identify anticipated impacts of the proposed development activity, including any cumulative impacts; (4) provide recommendations for conditions or requirements to mitigate any anticipated impacts; and (5) provide detailed cost estimates for the recommended mitigation measures. Where DAI is deemed required, the CVRD will provide the applicant with a written request of DAI details within 30 days of receipt of the initial application. An application that requires DAI is not considered complete until the receipt and written confirmation of acceptance of any DAI information from the CVRD officer. If it is deemed by the CVRD officer that a report containing DAI is incomplete or deficient, the applicant will be notified in writing of the nature of deficiencies and the timeframe to resubmit the corrected report. The CVRD officer or the board may request, at the applicant s expense, the presentation of any DAI report to the EASC, the board, the public and staff by the qualified professional who prepared the assessment. The CVRD may distribute and publicize a report containing DAI requested under this bylaw.

Where DAI is applicable, the procedures and policies for reports and studies are set out in Comox Valley Regional District Development Approval Information Bylaw No. 369, 2015 and amendments thereto. Replacing the references in schedule C, sections 1(a), 1(b), 1(c) and 1(d) to Review (e.g., site visit and internal referrals), Review (e.g., site visit, referrals and advisory planning commission and Review (e.g., site visit and referrals) with Review (e.g., DAI process, site visit and internal referrals). This Bylaw No. 370 may be cited as the Comox Valley Regional District Planning Procedures and Fees Bylaw No. 328, 2014, Amendment No. 1.
