The Arizona Department of Health Services will be authorized to regulate the use and sale of medical marijuana. The measure allows for the local regulation and licensing of nonprofit dispensaries, where patients can purchase medical marijuana over-the-counter. Proposition 203 not only protects qualified patients from criminal arrest and prosecution, but also protects against civil violations such as employment discrimination. 3 MICHIGAN Detroit 14th SUPPORT CONYERS Michigan Attorney General David Leyton The State Attorney General s race is shaping up to be the most important for Michigan patients this November. While David Leyton, the Democratic Genesee County prosecutor, has not come out in vocal support of the Michigan Medical Marihuana Act, he represents a far more acceptable option than his opponent. Bill Schuette, a Republican and former state appellate judge, state senator and congressman, is a vocal opponent of medical marijuana and is likely to challenge the legality of local distribution across the state. Increased raids, the threat of arrest and costly court battles will negatively impact the lives of patients in Michigan. NEVADA Las Vegas 1st SUPPORT BERKLEY NEW JERSEY Haddon Heights 1st SUPPORT ANDREWS Newark 10th SUPPORT PAYNE NEW MEXICO New Mexico Governor Diane Denish The two candidates for Governor of New Mexico couldn t be more opposed on the issue of medical marijuana. The Democratic candidate, Lieutenant Governor Diane Denish, supports the New Mexico Medical Cannabis Program passed under Governor Richardson, whereas the Republican candidate, Doña Ana County District Attorney Susana Martinez said she would work to repeal the state s medical marijuana law. Although the program has come under fire lately for failing to meet the needs of patients, the answer lies not in abolition but in improving the state s production and distribution system. Unlike Martinez, Denish wants to work with advocates to better implement state law.

Despite a need by the vast majority of patients to obtain their medication safely and over-the-counter, several states failed to implement adequate systems of distribution, which is why the voters of Oregon are going back to the polls. Oregon s Measure 74 creates a system of state-regulated, nonprofit dispensaries, much like pharmacies, which will bring greater transparency and accountability to a program that now serves approximately 40,000 ill, disabled and suffering Oregonians. Patients will still be able to cultivate their own medical marijuana, but will also have a safe supply that is subject to the strict regulations of the Oregon Health Authority, and the oversight of the Oregon Department of Justice. The new distribution system will be self-financing, costing taxpayers nothing, creating many new jobs, and generating as much as $20 million in annual revenue for Oregon s cash-strapped treasury. SOUTH DAKOTA South Dakota Measure 13 Yes The South Dakota Medical Marijuana Act, or Measure 13, provides both criminal and civil protections for patients and their caregivers. The Measure would allow for medical marijuana possession, use, distribution and cultivation by persons with a valid recommendation from a licensed physician and who are registered with the South Dakota Department of Heath. Patients may also designate a caregiver to cultivate, possess, and distribute their medical marijuana. With its civil protections, Measure 13 prevents schools, employers and landlords from refusing to enroll, employ, or lease based upon someone s patient status.
