1 MINUTES OF THE REGULAR MEETING OF THE LITTLE SILVER BOROUGH COUNCIL October 21, 2013 The meeting was called to order and the Statement of Compliance with the Open Public Meetings Act given by Mayor Neff at 8:43 p.m. "Adequate notice of this meeting has been provided by the mailing of a notice to the Asbury Park Press and The Two River Times on January 7, 2013, and by filing same with the Clerk of the Borough of Little Silver and by prominently posting said notice on the bulletin board of the Borough Hall." The salute to the flag was led by Mrs. Jungfer and followed by a moment of silence. Roll Call: Present: Absent: Mayor Neff, Mr. Galante, Mr. Gilmour, Mr. Mihlon, Mr. O Hern, Dr. Scott, Mr. VanWinkle, Attorney Ackerman, Mrs. Jungfer, Acting Administrator/Clerk None. Communications: None Ian Nussbaum and Kevin Campi of Woodbine Avenue stated that the overnight parking prohibition is a concern as Mr. Nussbaum received a ticket but has no choice but to park in the street as the driveway is not large enough to accommodate his car as his parents cars are in the driveway. The Mayor explained that the police were asked to use discretion in issuing summonses while the Governing Body reviews the issue. REPORTS OF COUNCIL MEMBERS: FIRE, FIRST AID AND NEWSLETTER (Recreation, Property Maintenance and Parker Homestead Liaison): Mr. O Hern reported that the Fire Department is making some interior modifications to the Fire House to accommodate the new truck. POLICE AND EMERGENCY PREPAREDNESS (Board of Health, Library Trustees and Local Emergency Planning Council): Mr. Gilmour had no report. BUILDINGS, GROUNDS, EQUIPMENT, STREET LIGHTS (Planning Board, Americans With Disabilities Act Committee, Recycling and Little Silver Cross Acceptance Liaison): Dr. Scott reported that the new sign is up and working. Fire safety improvements and the police locker room are being worked on at Borough Hall.

2 PERSONNEL (Traffic Safety Committee and Drug Alliance) Mr. Mihlon reported that there will be a Special meeting of the Mayor and Council on December 9 th at Markham Place regarding the traffic signals on Branch Ave. PUBLIC WORKS (Environmental Commission, Shade Tree Commission, Open Space, Capital Fund Projects Liaison and Recycling): Mr. Galante had no report. FINANCE AND BUDGET AND INSURANCE (Business and Professional Association, Waterfront Committee): Mr. Van Winkle had no report. Council and Public Discussion: None Mayor's Report: Mayor Neff reported that the Professional Association was having a Book Fair at the Woman s Club on October 26 th. Mayor Neff stated that the sent letters to the 195 homes affected by Sandy and in that letter advised them of the Governor s Cabinet Toolkit that would be held at the Woman s Club on October 23 rd from 3 to 7 p.m. Mayor Neff reported that he was considering an Ad Hoc Committee of local professionals and Borough officials to help market the vacant commercial properties in town. 3 BOROUGH OF LITTLE SILVER VOUCHERS PAYABLE October 21, 2013 I offer this Resolution in favor of the payment of the following vouchers which have been authenticated and presented for payment. These payments represent expenditures for which an appropriation was duly made in the budget adopted by the governing body, including any emergency expenditures. The Chief Financial Officer has certified that sufficient funds are available to pay the same from each designated appropriation. 4 Chief Financial Officer R E S O L U T I O N Authorizing Disposal of Surplus Property WHEREAS, the Borough of Little Silver is the owner of certain surplus property which is no longer needed for public use; and WHEREAS, the Borough of Little Silver is desirous of selling said surplus property in an as is condition without express or implied warranties; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Little Silver, County of Monmouth, as follows: 1. The sale of the surplus property shall be conducted through GovDeals pursuant to State Contract A-70967/T2581 in accordance with the terms and conditions of the State Contract. The terms and conditions of the agreement entered into with GovDeals are available online at govdeals.com. 2. The sale will be conducted online and the address of the auction site is govdeals.com. 3. The sale is being conducted pursuant to Local Finance Notice A list of surplus property to be sold is as follows: a. Rescue One 1600 Connector Boat - IN# LWC01236H112. Galvanized Boat Trailer VIN# 4J2BDMR16D Mercury 4-Stroke 40 HP engine with 20 shaft. b Ford Crown Victoria, Vin #2FAHP71W14X The surplus property as identified shall be sold in an as is condition without express or implied warranties with the successful bidder required to execute a Hold Harmless and Indemnification Agreement concerning use of said surplus property. 6. The minimum bid accepted for consideration for the Rescue One Boat, trailer and engine shall be $15, The Mayor and Council reserves the right to accept or reject any bid submitted.

5 R E S O L U T I O N WHEREAS, Jeffrey Matthew Francis Villapiano, as a member of the Boy Scouts of America, Troop 126 in the Borough of Little Silver, has achieved the rank of Eagle Scout, the highest rank in Scouting; and

6 WHEREAS, Jeffrey Matthew Francis Villapiano, for his Eagle Scout Project, searched a portion of Mount Calvary Cemetery for graves of victims of the Influenza Epidemic; and WHEREAS, Jeffrey Matthew Francis Villapiano chose this project hoping to uncover the graves of Italian American influenza victims whose grave markers had been covered by years of soil deposits; and WHEREAS, Jeffrey Matthew Francis Villapiano used metal detectors and trash pickers and, with a group of volunteers, located a handful of grave markers, including five large white granite crosses and two markers showing family names and dates of birth and death; NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Little Silver hereby recognizes the achievement of Jeffrey Matthew Francis Villapiano in attaining the rank of Eagle Scout, and further congratulates and commends him for his service to the Boy Scouts of America and to his community. R E S O L U T I O N WHEREAS, the Little Silver Department of Public Works is in need of a Kubota Tractor with front loader and snow blower; and WHEREAS, the Department of Public Works Director has solicited the following quote: Cherry Valley Tractor Sales Inc. Cherry Valley, NJ $31,292.80; and WHEREAS, the Kubota Tractor with front loader and snow blower is listed under the National Joint Powers Alliance (NJPA), New Jersey State Approved #65MCESCCPS ; and WHEREAS, the Department of Public Works has a Bobcat Skid-Steer Loader with snow blower and the Director of the Department of Public Works has determined this piece of equipment to be non-essential and eligible for trade-in with Cherry Valley Tractor Sales Inc.; and WHEREAS, Cherry Valley Tractor Sales Inc. has agreed to accept the Bobcat Skid-Steer Loader with snow blower as a trade-in and offered reasonable trade-in value, thus reducing the cost to $16,292.80; and WHEREAS, adequate funding for this purchase exists in Ordinance #723-12; and

7 WHEREAS, the Borough Administrator/Clerk has reviewed the quote and finds the quote submitted by Cherry Valley Tractor Sales Inc. in the amount of $16, to be in order and recommends the quote submitted by Cherry Valley Tractor Sales Inc.; NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Little Silver that the quote submitted by Cherry Valley Tractor Sales Inc. in the amount of $16, for the purchase of a Kubota Tractor with front loader and snow blower be and is hereby accepted.
