Please note the following amendments to the documents: 1. Volume 1, Part I Invitation to Bid 1.1. In Clause please amend the fourth paragraph as follows: Each of the Members shall be jointly and severally liable with respect to all of the Bidder's obligations and undertakings pursuant to this ITB and to the Contract to be awarded to the Contractor. Each Member and any Related Entity thereto (as applicable), shall sign and submit as part of the Bidder's Bid an undertaking in the form attached hereto as Bidding Form E included in Volume 1, Part III. 5 2. Volume 1, Part II Threshold Requirements 2.1. In Part A, Clause 2.2, please add a new definition as follows: "Computerized Passenger Information System" shall mean a server based system that manages schedule and provides real time visual information to passengers In Part A, Clause 2.5, please amend item 2.2 as follows: Computerized ppassenger iinformation ssystem 2.3. In Part A, Clause 4, please amend the following reference: Bidding Form E G (Confirmation of Merging Company) 2.4. In Part B, Clause 3.3, please amend the Clause as follows: Authenticated copies of the Bidder/Member's and any legal entity participating in the Bid (including a Member, Related Entity, Parent Company, and Major Sub- Contractor) (and in the event of a Joint Venture each one of the Members) certificate of incorporation and minutes of incorporation, or an equivalent thereof testifying the incorporation of the Bidder legal entity in accordance with the law applicable to the Bidder it (under cover of Bidding Form Attachment C1) and declaration of Non-Payment of Commission (Bidding Form Attachment C2). Bidders Legal entities which are foreign companies and are registered in Israel shall also attach their certificate of registration as a foreign company in Israel (under cover of Bidding Form Attachment C3) In Part B, Clause 3.4, please amend the Clause as follows: A receipt or other approval of NTA, testifying the payment of the Participation Fee, under cover of Bidding Form B6. 6 3. Volume 1, Part III Bidding Forms and Price Proposal Please find attached Volume 1 Part III which is an integral part of the Bidding Documents. Please note that the Price Proposal forms will be published under a separate Addendum. 4. Volume 2 Agreement 4.1. In Clause 12A.4, please amend as follows: Payment for the Provisional Sums shall become due as follows: i. Supply, install, integrate, test and commission Construction of Stops: upon the completion of each Stop as approved by the Engineer. ii. Design, procurement, supply and installation of EARS Radio Base Stations: in accordance with Clause 11.5 in respect of payment for Nominated Subcontractor. iii. Supply, install, integrate, test and commission Tunnel Fire Main, Hydrants and Emergency Signage: according to progress of completion of installation, pro-rata to the length of the tunnels, and not less than one (1) completed kilometer per each payment.
