BACKGROUND, PURPOSE AND EFFECT On June 5, 2015, Chairman Phil Mendelson, at the request of the Mayor, introduced PR , the "Real Property Tax Appeals Commission Eric Jenkins Confirmation Resolution of 2015" which would confirm the appointment of Eric Jenkins as a part time member to the Com mission fo r a term to end April, As noted in correspondence from the Executive, and included as Attachment D, Mr. Jen kins is filling a scat that is currently vacant, and is not replacing anyone currently. 2 Mr. Jenkins is currently a law partner with Graves, Horton, Askew & Johns, a managing principal at Evergreen Urban, holds a!.d. from The George Washington University, is a licensed attorney in the District of Columbia and Maryland and is a Real Estate Broker in the District of Columbia and Maryland. The Real Property Tax Appeals Commission (RPTAC) is the second-level real property assessment and appeals process 2, and was created in 2012 to restructure and professionalize what was the Board of Real Property Assessments and Appeals (BRP AA). The mission of the Real Property Tax Appeals Commission is to conduct fair and impartial real property assessment appeal hearings for the citizens of the District of Columbia. RPTAC is comprised of 14 real estate professionals with a full-time Chairperson and full-time vice-chairperson, four full time commissioners and eight part-time commissioners. II. Notice of public roundtable on PR , the "Real Property Tax Appeals Commission Eric Jenkins Confirmation Resolution of 2015" was published in the D.C. POSITION OF THE EXECUTIVE The Committee did not receive any additional comments from the Executive. IV. SUMMARY OF TESTIMONY The Committee on Finance and Revenue held a public roundtable on PR on Friday, June 26, at 10:00 a.m. Committee Chair Jack Evans made an opening statement: Then we have, PR , the "Real Property Tax Appeals Commission Eric Jenkins Confirmation Resolution of 2Q 15" would confirm the appointment of Eric Jenkins as a part time member to the Commission for a term to end April, A video recording of the round table can be viewed at oct.dc.gov. The following witnesses testified before the Committee, and copies of written testimony can be found in Attachment C: Eric D. Jenkins spoke in support of his' nomination. Mr. Jenkins has lived in DC over 18 years and is enthusiastic about his appointment. Mr. Jenkins has experience in real estate as a principal, as a developer and a advising lawyer or real estate broker. Mr. Jenkins has planned, managed and advised clients on over 6 million square feet and 2 billion dollars of development and projects. The public roundtable adjourned at 10:55 a.m. VI. IMPACT ON EXISTING LAW PR does not amend existing law. VII. FISCAL IMPACT STATEMENT There are no expenditures necessary in conjunction with the approval of this Resolution. VIII. SECTION BY SECTION ANALYSIS Section 1 contains the long and short titles of the legislation. Section 2 contains the nominee information and confirmed appointment period. Section 3 provides, upon resolution adoption, _for transmittal to the Mayor. Section 4 contains the effective date. IX. COMMITTEE ACTION The Committee on Finance and Revenue convened at 9:49 a.m., on July 9, 2015, to consider and vote on PR Pursuant to Committee on Finance and Revenue Rule 301, acting Chairman Grosso recognized the presence of a quorum, consisting of himself, Chairman Mendelson Councilmembers Orange and Silverman. 3

4 Acting Chairman Grosso moved PR and other measures on the agenda en bloc opened the floor for discussion. Discussion having ended, Acting Chairman Grosso then moved the proposed committee print and report for resolution PR , with leave for the Committee staff to make technical and conforming amendments. 14 TESTIMONY OF ERIC D. JENKINS, JD/MBA DISTRICT OF COLUMBIA REAL PROPERTY TAX APPEALS COMMISSION Chairman Evans and members of the Committee, thank you for the opportunity to testify before you today. First I would like to thank Mayor Muriel Bowser for her support of my nomination to the Real Property Tax Appeals Commission. I am deeply grateful for the trust and keenly aware of the responsibility that the Mayor has placed in me to serve our city. I would also like to thank Joe Carrol for his kind words in support of my nomination. Joe has proven himself to be a budding giant in real estate in the District of Columbia and his endorsement means a lot to me. And finally please allow me to take this opportunity to thank my lovely wife and three amazing daughters for joining me here today. I am especially thankful for their enduring my endless discussions around all things real estate, as I admit, at times I can be a bit obsessed on the topic. Good morning, my name is Eric Jenkins and it is an honor and a privilege to be here this morning to be in such distinguished company as one of Mayor Bowser's nominees for Commissioner on the Real Property Tax Appeals Commission. If I have the honor of being confirmed today I will bring the perspective gained through 18 years as a resident of the District of Columbia, 15 years as a lawyer in the District of Columbia, 12 years as a DC licensed residential and commercial broker, and 15 years as a private and public-private real estate developer in the District. Through this experience I learned real estate from the ground up. But I learned the value of hard work and the impact owning property can have much earlier in life. My first "paying" job was working at my grandfather's automotive shop in the summers to earn money for school clothes. As I worked my way up summer to summer from cleaning oil spills and organizing the tools to changing the oil and making the daily run for parts I came to appreciate and even love the dusty 12,000 square foot lot where my grandfather earned his living for what it meant to my family. I look back now and know that it was these summers at the shop that sparked my early passion for real estate. This interest in real estate manifested itself in the District where I used my first check from my job as a first year law associate as an earnest money

15 deposit to purchased my first home in the year 2000 in the Ward 5 neighborhood of Bloomigdale. Naturally, this is also when I began to pay real property taxes for the first time and became more interested in city services such clean streets, timely trash pick up and better schools. And it is also where I became a husband, a father and ran for ANC Commissioner. And while my campaign was not successful that experience remains one of my most memorable life events as I learned so much more about my neighbors and my neighborhood, which has only strengthened my resolve to find ways to serve. As I am sure the three Ward 5 members of this committee can attest, over the last 15 years Ward 5 has been a strong contributor to the District's tax base through the addition of new development welcoming new retail and new residents. It has been during this time where my capabilities as a real estate lawyer, real estate broker and real estate developer were honed. Over this time I have been privileged to have planned, managed and advised on over 6 million square feet and 2 billion dollars of development projects including: Leading the District's planning for the 3.1 million square foot Walter Reed Project as the Director of Local Redevelopment Authority; Advising and representing the team selected by the District to develop the 67 acre Walter Reed site as developer counsel; Developing numerous affordable housing projects; Brokering multi-family and commercial property transactions; and Developing many residential for sale condominium and rental multifamily projects. Whether my participation in a real estate project was as a principal, as a developer, or advising as a lawyer or real estate broker, central to every decision is always the proper valuation of the asset. If confirmed, I will first and foremost accept the duties of the post with gratitude, humility and firm determination to uphold the Commission's objective to ensure that real properties are fairly assessed at market value so that an equitable tax burden is shared. Additionally, if called upon, I will take advantage of opportunities to engage in a dialogue with property owners, real estate developers and neighborhood representatives to explain the property tax appeals process to District residents and commercial

16 property owners. As an owner and developer of multiple properties in the District myself, I know all too well that an accurate tax assessment is critical to a decision on whether to locate, improve or develop real estate projects. The real property tax assessment value and corresponding tax burden can often be determinative as to whether many of these projects are feasible. Many of which would produce permanent and temporary jobs to DC residents, improve neighborhoods and make housing more affordable. I look forward to working with the leadership of the Commission and my Commission colleagues to ensure the Commission conducts fair and impartial real property assessment appeal hearings for the citizens of the District of Columbia.
