He stated he has been employed in this position for the past 32 years. He disagrees with the findings of the Personnel Department. He provided several examples of the discrepancies/inaccuracies. Abel Hernandez, Interim Supervising Chief Public Defender, testified on behalf of Mr. Richardson. He provided a brief description of his current job description, which he stated contained many of the same duties as Mr. Richardson s. Debbie Rodriguez, Sr. Personnel Analyst, stated she does not dispute the fact Mr. Richardson is a tenured, experienced employee. She stated her audit showed Mr. Richardson does not work independently and does not work in a lead capacity or assign work. Jackie Denney, Kern County Treasurer and Tax Collector, explained that upon Mr. Richardson announcing his impending retirement, she went before the Board and requested an additional position so that training could be done. She stated the thought was to have the second position deleted upon Mr. Richardson s retirement. She relayed that hierarchy in the department dictates this is the correct classification.

4 Page 4 PERSONNEL MATTERS All appeals will be heard in open session unless requested to be heard in closed session. Any person whose matter is on this agenda and would like that matter heard in closed session, is to notify the Commission when your matter is called. 6. Request from William J. Hadden, Attorney for (name redacted), to schedule dates for an appeal hearing in the matter of his client s termination from his position of Deputy Sheriff with the Kern County Sheriff s Office. Request from John Ramirez, Attorney for (name redacted), to schedule dates for an appeal hearing in the matter of his client s termination from his position of Detention Deputy with the Kern County Sheriff s Office. Request from the Kern County Personnel Department to remove MARK FLORES from the eligible and layoff reemployment lists for Building Services Worker I/II/III, Certification List No and impose penalties upon him for falsification of his application for Building Services Worker I/II/III. In accordance with Civil Service Rules , it is requested to impose the penalties as outlined in the memorandum to the Civil Service Commission. APPROVED WITH MODIFICATON TO REDUCE PENALTY TO ONE YEAR EFFECTIVE AUGUST 13, ayes/1 nay (Pr) Mr. Flores requested this matter be heard in closed session.

5 Page Second Reading of proposed revision to Civil Service Rule (CSR) APPROVED; Rh/Pa All ayes 13. Second Reading of proposed revision to Civil Service Rules (CSR) and APPROVED; Pa/Rh All ayes Chuck Waide, SEIU Local 521, expressed a concern regarding the protection of active duty employees being made at the expense of tenured employees. He felt it was not appropriate to pass this rule change prior to a plan being developed. Mark Quinn, Director of Personnel, explained that the change in the Civil Service Rule would remain the same; however, an administrative process will be established to mitigate the impact on more senior employees. Susan Wells, Employee Relations Officer, stated the CAO is committed to working with County Counsel and the Director of Personnel to develop the policy. John Nilon, CAO, voiced that this is an important issue to the Board of Supervisors. There is a proposed procedure in the works that will mitigate the impact to senior employees. He stated this is a win-win situation. 14. Findings of Fact, Decision and Order, in the matter of the disciplinary action by Kern County Aging & Adult Services of (name redacted), last hearing date April 21, 2009, with deliberation on April 22, APPROVED; AUTHORIZED SECRETARY TO MAKE PROPER DISTRIBUTION; Pa/Rh All ayes 15.
