2 MOSES LAKE CITY COUNCIL December 11, 2018 CALL TO ORDER: The regular meeting of the Moses Lake City Council was called to order at 7:00 p.m. by Mayor Liebrecht in the Council Chambers of the Civic Center, 401 S. Balsam, Moses Lake, Washington. ROLL CALL: Present: Mayor Liebrecht, Deputy Mayor Curnel; Council Members Jackson, Myers, Leonard, Riggs, and Hankins. PLEDGE OF ALLEGIANCE: Deputy Mayor Curnel led the Council in the Pledge of Allegiance. EXECUTIVE SESSION: Mayor Liebrecht called an Executive Session at 7:03 p.m. to be held for 10 minutes pursuant to RCW (1)(i)(B) to discuss potential litigation. The Executive Session was extended for 10 minutes. The meeting reconvened at 7:23 p.m. SUMMARY REPORTS: MAYOR S REPORT Mayor Liebrecht recommended reappointment of Deputy Mayor Curnel and Fire Representative Dave Helms to continue serving on the LEOFF 1 Disability Board. Action taken: Council Member Jackson moved to affirm the reappointments of LEOFF 1 Disability Board Members, second by Council Member Myers. The motion carried 7 0. CITY MANAGER S REPORT Park Employee Recognition Parks & Recreation Director Spencer Grigg issued certification documents to Clayton Pray, Playground Safety Inspector; Thomas Moschner, Aquatics Facility Operator; and, Alberto Chavez, Aquatics Facility Operator. Nativity Scenes in Public Places Deputy City Manager Gil Alvarado reviewed the history of prior Council discussions with the former City Manager in the years 2007 and He shared an article from the State of Illinois where scenes were permitted for a variety of religions and cited the Municipal Code that prohibits private displays on public property. LTAC Application Status Contrary to discussion at the last meeting, staff advised that the Council can approve an amount that is different than the recommendation from the LTAC. Action taken: Council Member Hankins moved to approve $75k for Parks & Recreation Marketing and $65k for the Chamber Advertising applications, second by Council Member Jackson. The motion carried 6-1, Council Member Leonard opposed.

3 CITY COUNCIL MINUTES December 11, 2018 Agenda Changes Scheduled presentations from Parametrix and the Housing Authority of Grant County (HAGC) were cancelled at the last minute by each agency. CITIZEN S COMMUNICATIONS Homelessness Seven citizens provided comments to Council on the Homelessness situation in the city. Nativity Scenes on Public Property Aaron Hull, 4380 Dunn St, Moses Lake, requested a copy of the City s ordinance that prohibits private displays on public property. CONSENT AGENDA #1 a. City Council meeting minutes November 27 th b. Claims in the amount of $654,707.26; prepaid claim checks in the amounts of $9, and $6,598.62; claim checks in the amount of $695,256.77; and payroll checks in the amount of $368, c. Accept 2018 Seal Coat Project d. Accept 2018 HVAC Dunes, UV, FS2 Project e. Fee Schedule Amendment Resolution 3753 Action taken: Council Member Leonard moved to approve the Consent Agenda, second by Council Member Jackson. The motion carried 7 0. OLD BUSINESS # Budget Adjustment Ordinance 2918 First presentation of the draft ordinance occurred on November 27 th. The proposed ordinance amends revenues and expenses in nine funds. Action taken: Council Member Leonard moved to adopt Ordinance 2918 as written, second by Council Member Hankins. The motion carried 7 0. #3 Park Hours and Camping Amendment Ordinances MLMC 9.18, First presentation of the draft ordinances occurred on November 11 th and a second presentation on November 27 th. The proposed ordinances amend camping and park regulations. Council suggested amending Ordinance 2914 to include definitions of camping in subsection (B)(9). Action taken: Mayor Liebrecht moved to adopt Ordinance 2913 as presented, second by Council Member Hankins. The motion failed 2-4-1, Council Members Jackson, Myers, and Leonard were opposed. Council Member Hankins abstained. (corrected at 12/20 meeting to add Council Member Riggs as opposed) Action taken: Council Member Leonard moved to adopt Ordinance 2914 as amended, second by Council Member Hankins. The motion carried 6 1, Council Member Jackson opposed. pg. 2

4 CITY COUNCIL MINUTES December 11, 2018 NEW BUSINESS #4 Update Sanitation Fund Interfund Loan Resolution 3750 The proposed resolution extends the term of a current loan to be compliant and not overspend an enterprise fund reserve balance in Action taken: Council Member Hankins moved to adopt Resolution 3750 as written, second by Council Member Riggs. The motion carried 7 0. #5 Multi Family Project Authorization pursuant to MLMC Parkview Townhomes MLMC permits a short term exemption for qualified applicants. Following application acceptance from the Community Development Director, the Council must also approve and the applicant must sign an agreement with specific terms and conditions. Action taken: Council Member Hankins moved to authorize the City Manager to execute the agreement with Parkview Townhomes, second by Council Member Myers. The motion carried 7 0. #6 Business License Regulation Changes Title 5 Ordinance 2917 The ordinance amends business license background checks and minimum qualifications to obtain a solicitor s permit. Finance staff has requested an emergency adoption in order to meet the scheduled time that the Police Department has designated to assist with the process of business license renewals next week. Action taken: Deputy Mayor Curnel moved to adopt Ordinance 2917 as written, second by Council Member Riggs. The motion carried 7 0. ADMINISTRATIVE REPORTS Deputy City Manager Gil Alvarado met with Grant County Commissioner Cindy Carter to discuss recording fees to homelessness that are regulated under ESHB157 and currently designated to the HACG and New Hope. Action taken: Mayor Liebrecht moved to have staff draft a letter to the County Commissioners stating an intent to have a portion of the fees reallocated to the city, second by Council Member Hankins. The Planning Commission considered the Final Plat at a special meeting held on December 10, 2018 and recommended approval of the final plat as presented. Background The proposed plat is for a 29-lot residential subdivision. The property is being subdivided so that houses can be built and lots can be sold. The development is a continuation of Crossroads and Crossroads North Phases 1 through 6. Fiscal and Policy Implications None Options Option Move to approve Crossroads North Phase 5 Final Major Plat as presented. Results The Crossroads North Phase 5 Final Major Plat can be finalized in compliance with City Regulations. Parcels can be sold and homes Page 1 of 2

48 To: From: City Council STAFF REPORT John Williams, City Manager Date: December 14, 2018 Proceeding Type: Subject: Consent Agenda Police Guild Collective Bargaining Agreement Legislative History: First Presentation: December 20, 2018 Second Presentation: Action: Motion Staff Report Summary The City and the Moses Lake Police Officer s Guild have come to an agreement on a proposed Collective Bargaining Agreement. Background The current CBA is set to expire on December 31, Fiscal and Policy Implications The CBA includes a 10% wage increase over the 3-year contact period. It also includes increases to incentive items and longevity pay. Options Option Results Authorize Execution Contract will be signed and effective January 1 st. 49 To: From: STAFF REPORT John Williams, City Manager Gilbert Alvarado, Deputy City Manager Date: December 14, 2018 Proceeding Type: Subject: New Business 2018 Comprehensive Plan Amendments Legislative History: First Presentation: December 20, 2018 Action: Motion Staff Report Summary Washington State Growth Management Act (GMA) requires that most cities and counties adopt and maintain a Comprehensive Plan which addresses certain mandated elements as prescribed by the Act. The Plan may be amended no more than once per year. The City of Moses Lake adopted a GMA-compliant Comprehensive Plan in 2001 and has amended it periodically, attached are the proposed amendments for 2018, consisting of four site-specific land use designation changes requested by property owners. On December 10, 2018 at a special meeting, the Planning Commission conducted an open record public hearing and unanimously approved the proposed 2018 Comprehensive Plan amendments with a recommendation to the City Council for adoption. Background A. Dexter Property request: Change the zoning of three parcels currently zoned L-I, Light Industrial to C-2, General Commercial and Business. The parcels are 0.15, 0.99 and 3.42 acres (Comp Plan land use designation change and rezone). B. Herring Farm NWQ, LLC request: Amend UGA boundary for the addition of 19.3 acres and assign a land use designation of Low Density Residential. The Grant County zoning is currently Rural Residential C. Row Crop LLC request: Amend UGA boundary for the addition of 61.4 acres and assign a land Page 1 of 2

50 use designation of Industrial. The Grant County zoning is currently Rural Urban Reserve. D. T&M Property request: Change the zoning of two parcels currently zoned R-3, Multi-family Residential to C-2, General Commercial and Business. The parcels are.18 and.25 acres (Comp Plan land use designation change and rezone). Fiscal and Policy Implications None Options Option Review and consider the proposed Comprehensive Plan amendments. Results Adopt the 2018 Comprehensive Plan amendments as recommended by the Planning Commission. Take no action. The 2018 Comprehensive Plan amendments do not move forward which create some inconsistencies within the Plan. 51 ORDINANCE NO AN ORDINANCE ADOPTING THE 2018 COMPREHENSIVE PLAN AMENDMENTS Recitals: 1. The City of Moses Lake s Comprehensive Plan was adopted on September 11, 2001, in accordance with the Growth Management Act (GMA) and the State Environmental Policy Act (SEPA). 2. The Comprehensive Plan includes five (5) of the seven (7) mandatory elements required by GMA, except that GMA declares that the requirements for an Economic Development Element and a Park and Recreation Element are null and void until funds sufficient to cover applicable local government costs are appropriated and distributed by the state at least two (2) years before the city must update its Comprehensive Plan as required by RCW 36.70A The Washington State Growth Management Act requires the city to establish procedures and schedules whereby updates, proposed amendments, or revision of the Comprehensive Plan may be considered. 4. RCW 36.70A.130 requires cities and counties fully planning under the Growth Management Act to review and evaluate their comprehensive plans at least every eight years and update them if needed. 5. The City began a major update of the 2001 Comprehensive Plan in 2012 and continued it with updates of portions of the Comprehensive Plan in 2013 and 2014, to complete the required periodic update in 2014 per the requirements of RCW 36.70A.130. Minor updates and amendments were adopted in 2015, 2016, and The amendment to the Comprehensive Plan and zone change were submitted to the Washington State Department of Commerce on October 31, 2018, for a 60-day review and comment period as required by GMA. Comments were received on December 5, The Planning Commission held a public hearing on the Comprehensive Plan amendments and zone changes December 10, A legal notice was published in the local newspaper, and notices were posted on bulletin boards in the Civic Center and Annex and the City s website. 8. On December 20, 2018, the City Council took legislative action to accept the Planning Commission s recommendations. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOSES LAKE, WASHINGTON, ORDAINS AS FOLLOWS:

The City Council hereby adopts the following amendments to the Comprehensive Plan: A. 53 December 6, 2018 TO: SUBJECT: Planning Commission 2018 Comprehensive Plan Amendments and Rezones - Public Hearing and Recommendation to City Council The Washington State Growth Management Act (GMA) requires that most cities and counties adopt and maintain a Comprehensive Plan which addresses certain mandated elements. The Plan may be amended no more than once per year. The City of Moses Lake adopted a GMAcompliant Comprehensive Plan in 2001 and has amended it periodically. Attached are the proposed amendments for 2018, consisting of two UGA boundary changes and four site-specific land use designation changes requested by property owners. Summary: The proposed amendments are as follows: A. Redesignate 4.56 acres from Industrial to Commercial and rezone it from L-I, Light-Industrial Zone to C-2, General Commercial Zone. The owners are Kris and Theresa Dexter and the location is 1049 and 1045 E. Broadway Avenue. Parcels numbers are , , and B. Amend the UGA boundary for the addition of 19.3 acres and assign a Land Use Designation of Low Density Residential. The Grant County zoning is currently Rural Residential 1. The owner is Herring Farm NWQ LLC and the location is 6223 NE Mae Valley Road. The parcel number is C. Amend the UGA boundary for the addition of 61.4 acres and assign a Land Use Designation of Industrial. The Grant County zoning is currently Rural Urban Reserve. Staff has issued public notices, including the required 60-day notice to the State of proposed amendments. Now the Commission will hold a public hearing and make a recommendation to the City Council on each proposed amendment. The Council may not act on the amendments until the close of that 60-day period. After the close of the 60-day comment period, the Council will hold a public hearing and act on each proposed amendment. The Council public hearing is scheduled for December 11.

54 Note that in the past, land use designation changes/rezones went through a two-step process, where first the land use designation was changed, and then a rezone action followed the next year. However, since once the designation is changed, the rezone hearing is mostly just a formality, it provides better service to the applicant and the public to combine the actions into one hearing. Public Hearing: A public hearing has been scheduled. Public notices were published in the local newspaper and posted at Civic Center. Property owners and residents within 500' of the two UGA Boundary Changes and Land Use Designation Changes/Rezones were notified by mail. The Commission should open the public hearing and take testimony on the proposed Comprehensive Plan amendments and rezones. Action: The Planning Commission should consider each proposed Comprehensive Plan amendments and rezone, and make a recommendation to the City Council on each.
