3 SPRING WORKSHOP 2008 University of Texas at Austin Thompson Conference Center Speaker Biographies / Program Abstract TOM R. BARBER Tom Barber is the Director, Construction/Surety Section of Coats, Rose, Yale, Ryman & Lee, P.C. Mr. Barber has been involved in the construction industry for over 30 years. Tom began his career as an engineer and contractor prior to becoming an attorney in His practice emphasizes the representation of owners, sureties, general contractors and subcontractors, focusing on full investigation and administration of construction contract and subcontract defaults on behalf of owners, sureties and general contractors. Education: Oklahoma State University, B.S.M.E.; University of Arkansas at Little Rock, J.D. Tom has been named a Texas Super Lawyer by Texas Monthly Magazine (October 2004, 2005, 2006 and 2007). Construction T&C s this session will outline and explain the essential important and often controversial terms and conditions of a construction contract, from a public owner's perspective. Key contractual elements such as scheduling, changes, claims, surety and insurance requirements, as well as payment and termination provisions will be discussed and contrasted from the owner and contractor perspectives. Alternative Delivery Methods for Construction due to recent legislation, many public works can be delivered using one of a variety of project delivery methods, such as Design/Build, Construction Manager At Risk, Competitive Sealed Proposals, etc. This session will explain the types of delivery methods available, selection considerations and associated procurement requirements. KEVIN BAUM Kevin Baum is the Founder and President of incentergy, and Austin-based organizational and leadership development consulting group with clients around the world. Kevin is a 21-year veteran of government service, and is the former assistant fire chief and fire marshal with the Austin, Texas fire department. Kevin is a recognized leader in performance management, and his innovative ideas on organizational performance and leadership have been published in journals in the United States, Canada, the United Kingdom, South Africa, Australia, and China. CAROL COOPER, C.P.M. Carol has been in the purchasing and supply profession for twenty-nine (29) years. She has both public and private sector experience in a variety of industries. Carol is Director of Material Management for the City of Garland, Texas. She has been with Garland for twelve (12) years. Carol led her department in the receipt of the Achievement of Excellence in Procurement award for 10 consecutive years and the

4 Excellence in Innovative Supply Management award for 5 consecutive years. Carol serves on the Board of Directors of the Texas Municipal League (TML). She is the Legislative Liaison to the newly formed Texas Public Purchasing Association (TxPPA). Legislative Roundup Carol will moderate group discussion of important legislative concerns; we will break into roundtables by entity types; and convene again to come to a consensus on legislative initiatives for the 2009 Legislative Session. RICK DOLLAHAN Rick is the Gaines and Dawson County Auditor. Prior to his appointment, he retired as a Command Chief Master Sergeant after serving almost 27-years in the U.S. Air Force. He has served on the TACA Board of Directors as a member and then officer since 2003, and is currently the President Elect and Law Study Chair. He also recently completed the year long and by invitation only 2007 TAC Leadership Foundation Leadership Class. Mr. Dollahan has three Associate Degrees and a Bachelor of Business Administration Degree, Accounting major, from Texas Tech University. Legislative Objectives - To begin a dialogue, effectively collaborate and work closely with the TxPPA, County Treasurer s, Judges and Commissioners and any other affected parties to provide the Legislature with relevant information to facilitate a review and update of the county procurement statutes. (The HOUSE COMMITTEE ON COUNTY AFFAIRS has included Item number two (2). Examine county procurement statutes to identify areas for increasing efficiency without sacrificing internal controls. on its Interim Study Charges). MARILYN GETTINGER Marilyn Gettinger owns and manages the consulting firm, New Directions Consulting Group. Marilyn created the organization in 1993 with the mission to assist companies in making the most of their precious resources. She designs customized training programs and consulting services to support organizations that must change to meet the demands of the 21st century. She has consulted with organizations to improve purchasing, inventory, and supply chain processes. Marilyn helps promote other businesses through her involvement at both Bergen Community College and Kean University s Small Business Development Center s small business workshops. She holds a C.P.M., an MBA in Business, and is certified in Materials Management from Bloomfield College. Project Management - This session will provide an overview of the project planning process; discuss resource management; cover the goal setting process; introduce motivational ideas to keep the project alive; show steps in managing the project to completion; offer tools to stay on target; explain project planning charts; and discuss the many software management options for project management. Contract Administration This session will differentiate between contract administration vs. contract management; discuss strategic issues and risks in the public arena; provide steps in taking ownership of the contract developed and written by other departments; goals and objectives of contract management; the 21 st century business and work environment; the mechanics of successful relationships; contract performance management; renewals; communication channels; managing multiple contracts; effective feedback to contract writers; and the debriefing process. SHANNA IGO Shanna is the Director of Legislative Services for the Texas Municipal League where she coordinates and implements the legislative policy program for the 1,167 member cities and their mayors and council members. She has been with TML for 19 years. She has worked in the Texas Senate as a legislative aide and as the Committee Director for the Senate State Affairs Committee. Shanna is a graduate of Texas A&M University where was named as Distinguished Student and to the Dean s Honor Roll. Legislative Timeline and Process It is NOT too soon to start planning and preparing for the 2009 Legislative Session. This session will give you an overview of the legislative process and provide the timeline for getting resolutions presented, approved and endorsed by your legislators and governing boards.
