2 B.1 DIRECTOR S REPORT TO THE BOARD DATE: SUBJECT: APPROVAL OF TRUSTEE HONORARIUM POLICY Background & Information Ontario Regulation 357/06 sets out the method for calculating the limits on honoraria paid under section 191 of the Education Act. The calculations have been reviewed with the Audit Committee Amendments to Ontario Regulation 357/06: 1. Boards are no longer required to establish and consult with a citizen s advisory committee with respect to establishing the honorarium policy; 2. Boards must establish their policy by October 15, 2014 which is a change from October 31, This change is due to the advancement of election day which is October 27, This policy will set out the limits for: 1. Trustee remuneration for Chair remuneration for Vice Chair remuneration for Remuneration relating to distance in accordance with eligibility criteria The Board did not recommend payment of the meeting attendance remuneration.
3 B.1 DIRECTOR S REPORT TO THE BOARD DATE: SUBJECT: APPROVAL OF TRUSTEE HONORARIUM POLICY Background & Information (cont d) The Board is required by Ontario Regulation 357/06 to establish by policy the maximum honorarium that will be paid to a member of the board, the Chair of the Board and the Vice-Chair of the Board for the term of office commencing December 1, 2014 and ending on November 30, The ADSB policy attachment relating to the above and honoraria calculations is attached. (See Attachment B.1 #1) Algoma District School Board recognizes the importance and value of providing fair levels of honoraria for its members as set out in Ontario Regulation 357/ Recommendation It is recommended that trustee honorarium amounts be approved as described in the Director s report to the Board dated It is recommended that the Board approve policy number 2.11 on Trustee Honoraria as described in the Director s report to the Board dated Proposed Resolution That the recommendations be approved as described in the Director s report to the Board dated relating to trustee honoraria That the Board approve policy number 2.11 on Trustee Honoraria as described in the Director s report to the Board dated
4 Algoma District School Board Policy Manual SECTION 2: BYLAWS/TRUSTEES/COMMITTEES Policy 2.11: Trustee Honorarium Policy Amended See Appendix 1 to Policy Supporting Policies 2.10 Student Trustee Supporting Procedures Supporting Protocols and Guidelines Supporting Templates and Forms: Other Resources Ontario Regulation 357/06: Honoraria for Board Members Ontario Regulation 412/00: Elections to and Representation on District School Boards Consumer Price Index Public Sector Restraint Act 2010 Memos from the Minister of Education March 28,2014 and September 23, 2014 Approved by Board Resolution # Revised by Resolution # Amended by Resolution # BACKGROUND The Board is required pursuant to Ontario Regulation 357/06 September 23, 2014, to adopt a policy establishing the honoraria for its Board members, on or before October 31, of the calendar year in which the term of office for Board members begins; Ontario Regulation 357/06 sets out the method for calculating the limits on honoraria paid under section 191 of the Education Act and deals with public consultation requirements for district school boards; The Board is required by Ontario Regulation 357/06 to establish by policy the maximum honorarium that will be paid to a member of the board, the Chair of the Board and the Vice-Chair of the Board for the term of office commencing December 1, 2010 and ending on November 30, 2014; Algoma District School Board recognizes the importance and value of providing fair levels of honoraria for its members as set out in Ontario Regulation 357/06; Policy 2.11: Trustee Honorarium Policy Page 1 of 6
5 Algoma District School Board Policy Manual Amendments to the regulation a) Boards are no longer required to establish a Citizens Advisory Committee for recommendations to the Board in accordance with Ontario Regulation 357/06. b) Boards must establish their honorarium policy by October 15 th which is a change from October 31 st. This change is due to the advancement of Election Day which is October 27, c) For each year of a term of office beginning on or after December 1, 2006, the amount calculated for a year of the previous term of office, increased by the percentage increase in the Ontario Consumer Price Index as published by Statistics Canada for the period between (July 1, 2010 to June 30, 2014), i. July 1 of the calendar year in which the previous term of office started, and ii. June 30 of the calendar year in which the term of office starts. Bill 16 (Public Sector Restraint Act, 2010) states that the honorarium paid to a trustee cannot be greater than the amount of honorarium paid to him/her on March 24, 2010 during the period March 25, 2010 and March 31, In a Memorandum on March 28, 2014, the Minister of Education extended the restraint period to Nov 30, 2014 to cover the 4-Year term of office. A further Memo from the Minister of Education on September 23, 2014 extended the restraint period for the term of office for the base amount calculation. 2.0 DEFINITIONS 2.1 ADE The Board s average daily enrolment number for the Board s fiscal year that ends in the calendar year in which the year of the term of office commences. 2.2 Year of a term of office the year of office commencing on December 1 and ending on the following November 30, as described within the Education Act or its Regulations. 2.3 Member of the Board a member of the Board duly elected in accordance with the Education Act or its Regulations 3.0 COMPONENTS OF THE MAXIMUM LEVEL OF HONORARIUM The maximum honorarium for a member of the Board, the Chair of the Board and the Vice-Chair of the Board, in respect of a year of a term of office, shall consist of the following components: 3.1 The base amount for the period December 1, 2014 to November 30, 2018 is $5,900. When applying the Consumer Price Index the base amount would increase to $6, NOTE: for a term of office subsequent to the term of office beginning December 1, 2014, the base amount calculated for the first year of the previous term of office shall be increased by the percentage increase 9.4% in the Ontario Consumer Price Index as published by Statistics Canada for the Period: i. July 1, 2010 = 116 ii. June 30, 2014 = Note: Due to the Public Sector Restraint Act, 2010 and the Minister of Education s Policy 2.11: Trustee Honorarium Policy Page 2 of 6
6 Algoma District School Board Policy Manual Amendment to Ontario Regulation 357/06 an increase to the base amount cannot occur until after Nov 30, The enrolment amount for the year. 3.3 The attendance amounts payable to a member for the year. 3.4 The distance amount payable to a member for the year. 4.0 The maximum level of honorarium for a year of the term of office commencing December 1, 2014 and ending Nov 30, 2018 for a member of the Board who is not the Chair of the Board or the Vice-Chair of the Board shall be the amount determined in 4.2 as calculated in accordance with Ontario Ontario Regulation 357/06: 4.1 Multiply the Board s average daily enrolment (ADE) from the Original Estimates by $1.75, divide that number by the number of members of the Board excluding the member of the Board representing the First Nations, and add $5, Given, the Board s ADE is 9,538.18, the multiplier is $1.75, the number of members of the Board is 10, the enrolment amount is $1,669.18, the base amount is $5,900, and therefore the maximum level of honorarium is $7, The maximum level of honorarium for a year of the term of office commencing December 1, 2014 and ending Nov 30, 2018 for the Chair of the Board and the Vice-Chair of the Board shall be the amounts determined in 5.3 in the case of the Chair of the board and 5.4 in the case of the Vice-Chair of the Board, as calculated in accordance with Ontario Regulation 357/06: 5.1 To the amount determined in 4.2 add $5,000 for the Chair of the Board and $2,500 for the Vice-Chair of the Board. 5.2 To the amount determined in 5.1 add for the Chair of the Board, the Board s ADE multiplied by five cents with a minimum of $500 and a maximum of $5,000; and for the Vice-Chair, the Board s ADE multiplied by two and one-half cents to a minimum of $250 and a maximum of $2, Given the Board s ADE is 9,538, the multiplier is $.05 in the case of the Chair of the Board the resultant amount is $ less than the minimum amount of $500, and less than the maximum amount of $5,000. The amount is $ and therefore, the maximum level of honorarium for the Chair of the Board is 13, Given the Board s ADE is , the multiplier is $.025 in the case of the Vice-Chair of the Board the resultant amount is $ less than the minimum amount of $250, and less than the maximum amount of $2500. The amount is $ and therefore the maximum level of honorarium for the Vice-Chair of the Board is $10, ATTENDANCE AMOUNT Policy 2.11: Trustee Honorarium Policy Page 3 of 6
7 Algoma District School Board Policy Manual 6.1 The Chair of the Board, the Vice-Chair of the Board or a member of the Board who is a member of the Special Education Advisory Committee (SEAC) or a Supervised Alternative Learning for Excused Pupils Committee (SALEP) may receive a maximum of $50 for each meeting of these committees they attend. The Board did not approve an attendance amount. 7.0 DISTANCE AMOUNT 7.1 Given that the Board s jurisdiction as noted in Ontario Regulation 412/00 is 9,069 square kilometres and the Chair of the Board, the Vice-Chair of the Board or a member of the Board may travel one way more than 200 kilometres from their residence to attend a meeting of the Board, a meeting of the Special Education Advisory Committee (SEAC) or a meeting of a Supervised Alternative Learning for Excused Pupils Committee (SALEP), the Board shall pay to the Chair of the Board, the Vice-Chair of the Board or a member of the Board who so qualifies a distance amount in accordance with Ontario Regulation 357/06 of $50. The Chair of the Board, the Vice-Chair of the Board or a member of the Board shall receive the distance amount only once in respect of any day. Policy 2.11: Trustee Honorarium Policy Page 4 of 6
8 Algoma District School Board Policy Manual Appendix 1: Amendment for Period December 1, 2014 to Nov 30, 2018 BACKGROUND Pursuant to Ministry Ontario Regulation 357/06, the Trustee Honorarium Policy 2.11 was revised October 5, Within the regulation, it indicated that the Honorarium was eligible for increases based on the Consumer Price Index (i.e. inflation), as of April 1, In a memo dated April 1, 2012, the Minister of Education, Laurel Broten announced a further amendment in light of the original expiration of restraint provisions on March 31, This amendment extended the restraint period of Honoraria for Board members until March 31, A further amendment on March 27, 2014 from Minister of Education, Liz Sandals extended the restraint period to November 30, 2014 for Trustees. A further amendment on September 23, 2014 extended the restraint period until November 30, This amendment by the Minister extended the pay freeze for elected provincial politicians with the intent to set an example that everyone is being asked to do their part to resolve the provincial deficit. Also, the regulation requires that Trustee Honorarium (Chair, Vice Chair and Trustees) be calculated annually based on four components: 1. Base amount 2. Enrolment amount 3. Attendance amount 4. Distance amount The new amounts result in a small decrease in the maximum amounts of Trustee Honorarium due to declining enrolment. Policy 2.11: Trustee Honorarium Policy Page 5 of 6
9 Algoma District School Board Policy Manual Attachment #1: Policy Appendix 1 ALGOMA DISTRICT SCHOOL BOARD TRUSTEE HONORARIA REGULATION 2014 December 1, 2014 to November 30, Description Base amount for a trustee: Based on enrolment the maximum level of honorarium for the term of office from Dec. 1, 2014 to November 30, 2018 is $7, Total base and enrolment amount for Chair: Based on enrolment the maximum level of honorarium for the term of office from Dec. 1, 2014 to November 30, 2018 is $13, Total base and enrolment amount for Vice Chair: Based on enrolment the maximum level of honorarium for the term of office from Dec. 1, 2014 to November 30, 2018 is $10, Attendance amount per meeting attended: A trustee, Chair or Vice-Chair who is a member of the Special Advisory Committee (SEAC) or a Supervised Alternative Learning for Excused Pupils Committee (SALEP) may receive a maximum of $50 for each meeting of these committees that they attend. Distance amount: ADSB qualifies as a Board that may pay trustee a distance amount if the trustee travels more than 200 kilometers one way from their residence to attend a meeting of the Board or its committees.
