MOTION CARRIED 3 REMIT TO LGNZ PROHIBITION ON SMOKING OUTSIDE CAFES, RESTAURANTS AND BARS The Committee considered a report by the Group Manager Regulatory Services on a remit to LGNZ requesting central government develop legislation prohibiting smoking outside cafes, restaurants and bars. Proposed Clr Wills Seconded Clr Brien That Council supports the remit to Local Government New Zealand on the prohibition on smoking outside cafes, restaurants and bars. MOTION CARRIED # July 2015

6 4 DELEGATED AUTHORITY TO STAFF HEALTH PROTECTION BYLAW The Committee considered a report by the Environmental Health Manager on the legislative ability to provide delegated authority to staff in relation to Council Bylaws. Proposed Clr Mulvey Seconded Clr Earnshaw 1 That appropriate officers of the local authority have warrants issued stating: An Authorised Officer pursuant to the Bylaws of the. An Enforcement Officer under section 177 of the Local Government Act 2002 in respect of offences and breaches of the Act and the Council Bylaws that require remedial action. Power of Entry - this warrant is evidence under section 174(1) of the Local Government Act 2002 in respect of Power of Entry Empowered on this Officer by any of the above enactments. 2 That this authority be entered into the Council s delegation register. MOTION CARRIED 5 SIGNIFICANT NATURAL AREAS FUND APPLICATION The Committee considered a report by the District Planning Manager on an application by the Upper Rangitata Gorge Landcare Group (Inc) for funding from the Significant Natural Areas fund. The Committee was advised that the group is a successful committed group which has carried out valuable work in the area. 1. That the report be received. Proposed Clr Stevens Seconded Clr Tierney 2. That the application be approved and $5,000 be granted to the applicant. 3. That the Council sends the applicant a letter of commendation for its weed control work in the Upper Rangitata Gorge. MOTION CARRIED 6 FIRE SERVICE REVIEW SUBMISSION The Committee considered a report by the Group Manager Regulatory Services on the Fire Service Review. Proposed Clr Tierney Seconded Clr Mulvey That Council drafts a submission on the Fire Service review document and that due to timing issues the Chairperson of the Resource Planning and Regulation Committee be given authority to approve the submission. 8 RESOURCE PLANNING AND REGULATORY COMMITTEE FOR THE MEETING OF 28 JULY 2015 Report for Agenda Item No 6 Prepared by - Mark Geddes District Planning Manager Road Name Proposal (File P5/2/0) Purpose of Report To refer a road naming proposal to the Committee. Background Subdivision consent no was recently granted to Old North Road Properties Ltd for a 16 lot subdivision at 217 Old North Road. The location of the site is illustrated in Figure 1, while the layout of the subdivision is illustrated in Figure 2. Figure 1 Location of the site to which the subdivision relates. 9 Figure 2 General layout of subdivision consent no The applicant suggests the names Mueller Drive or Mueller Street for the new road. The road is likely to be extended to the east in the future. The application states the name Mueller is consistent with other roads in the neighbourhood that are named after South Canterbury alpine features e.g. Cook Street, Godley Place, Tasman Street. The Mueller Glacier is located in Aoraki / Mount Cook National Park. Statutory Matters Council has power under Section 319 of the Local Government Act 1974 (LGA) to name roads. Section 319A LGA requires Council to send the Registrar-General of Land and the Surveyor-General a copy of its resolution of any road it names for the first time. Road Naming Policy Council s policy on the naming of streets, roads and private ways is attached as Appendix 1. In respect of naming a new road, the policy invites the subdivider to submit three names (in order of preference) with reasons for the suggestions, along with details of any consultation undertaken. The Planning and Regulatory Committee will then consider the submission and recommend to Council a ranked list of new road names with reference to the Approval Criteria and Style Guide contained within the policy. Assessment I consider the name Mueller has geographical and historical significance and therefore complies with Council s Road Naming Policy. In terms of the latter, Mueller Glacier was named by Julius Haast in 1862, after Ferdinand von Mueller. Mueller was a Danish-born scientist and explorer, who came to Australia in Mueller became a great botanical collector and writer. As stated by the applicant, the Mueller Glacier is located in Aoraki/Mount Cook National Park. # July 2015

10 I agree with the applicant that the name Mueller continues an established theme in the neighbourhood. I can confirm that the proposed road type drive/street complies with Council s road name policy. The proposed road name and road type name also complies with Australian/New Zealand Standard - Rural and Urban addressing (AS/NZS 4819:2011). LINZ has given their informal approval to the fact that the road is currently a cul-de-sac, but will have a road type name of Drive/Street. A search of Council s roading database has been conducted to confirm that the proposed road name does not already occur in the district. There are also no similar names. The applicant s first preference is for Mueller Drive. I see no issue with that and prefer the sound of Mueller Drive to Mueller Street. Options 1. Accept one of the proposed names. 2. Amend one of the proposed names. 3. Ask the applicant(s) for revised names. Identification of Relevant Legislation, Council Policy and Plans Policy on the Naming of Streets, Roads and Private Ways. (Attached) Australian/New Zealand Standard - Rural and Urban addressing. AS/NZS 4819:2011. (Not attached). Assessment of Significance This matter is not deemed significant under the Council s Significance and Engagement Policy. Consultation I am not aware that the applicant has conducted any consultation on this matter. Other Considerations There are no other relevant considerations. Funding Implications The road naming policy states that the developer shall pay Council for the required sign and installation. Therefore, the road naming proposal should not affect Council funding. Conclusion In conclusion, I consider that Mueller Drive is acceptable. Recommendations 1 That the report be received. 2 That the Committee resolves to accept the name Mueller Drive and subsequently recommends this name to. 3 That the subdivider shall pay Council for the required road name sign and its installation. # July 2015

11 Appendix 1 Council Road Naming Policy POLICY ON THE NAMING OF STREETS, ROADS AND PRIVATE WAYS Council has the authority under section 319(j) and 319A of the Local Government Act 1974 to name roads. New names are usually needed for new roads in subdivisions, or when a previously unformed road is constructed. New Roads The subdivider is invited to submit three names (in order of preference) with reasons for the suggestions, along with details of any consultation undertaken. The Resource Planning and Regulation Committee will consider the submission and recommend to Council a ranked list of new road names with reference to the Approval Criteria and Style Guide. Private Ways It is the Council policy not to directly name private ways, however if names are to be allocated to private ways then the names shall be in accordance with the Approval Criteria and Style Guide. Renaming Roads and Naming of Existing Legal but Previously Unformed Roads The request to alter existing road names or to name existing but previously unformed legal roads will be forwarded to the Regulatory Services Manager to determine whether the request is appropriate. If agreed then it will be recommended to the Resource Planning and Regulation Committee to decide on the road name. The Resource Planning and Regulation Committee may decide that the Council should undertake the Special Consultative Procedures as outlined in the Local Government Act The Local Government Act 1974 does not require that special consultation procedures have to be undertaken for the naming roads. Note that the where a road is requested to be renamed, a minimum of 85% of residents/property owners must approve of the change. Approval Criteria The following factors shall be taken into account when selecting street and road names: a b c d e Historical or geographical significance. Well known, or previously well known, names of farms or properties. Maori names of local significance. Appropriate consultation and advice from Arowhenua may be required. Names of local residents who have achieved prominence in their chosen fields such as arts, sport, commerce, politics, local government, military, etc. Naming after persons living is generally avoided. Permission of surviving relatives should be obtained where appropriate. Continuing an established theme in a neighbourhood. # July 2015

12 f g h i j k l Where more than one road is being created in a subdivision, a common theme is recommended for the names. A significant feature in the area (for example, geographical feature, landscape, flora, fauna). Naming after features which do not exist in the area should be avoided (for example, naming after native trees or plants that are not evident in the area, or views that can not be identified). Where an existing street is being extended, the street extension will be the same as that of the existing street. Names cannot be offensive, insensitive or commercially based. All road signs for private ways shall be annotated Private at the applicants expense. The Council may not necessarily accept the marketing name for a development as a road name for any road within a development. A new road shall not be named the same, or similar to a road already in existence within the District. Note that the proposed road names will be checked against Council s RAMMS database to avoid duplication. Style Guide for Names To ensure a consistent standard of road naming, the following style guide should be applied: a In general the road type of a road/private way will reflect the public/private nature of a road, or the geography of the area and in accordance with the naming guide below: Type of Road Relatively short, dead-end Roads, Culde-sacs Loop Road to same Street Rural Road Long cul-de-sacs, Through Roads Narrow Road, Service Lane Wide spacious roads Street in Commercial areas Short Road leading to water Rural State Highway Road Name Place, Court, Close, Grove, Way, Courtyard, Rise Crescent, Loop, Circle Road Road, Street, Drive, Ridge, Terrace Lane Avenue, Boulevard, Parade Arcade, Mall, Plaza, Square, Street, Road Landing Highway The above is a guide only and people are welcome to make other suggestions. However, it is Council s prerogative to name streets and the Council may refuse to approve names considered unsuitable for any reason. b Individuals full names will only be used where the name is of reasonable length and the first name needs to be used to correctly identify the individual being commemorated. Full names longer than 15 letters will not usually be # July 2015

13 considered. In these instances, consideration will be given to using only the surname. c d Short names for short streets are suggested for practical reasons. Diacritical marks such as macrons should not be used, to ensure the clarity of signs is maximised. Additional Notes When the new name is confirmed, the standard format Council name sign shall be erected. For new roads in subdivisions the developer shall pay Council for the required sign(s) and installation. For existing legal but previously unformed roads and roads being renamed the Council shall meet the cost of sign(s) and installation. If a developer erects its own ornamental name sign(s) and/or post, in addition to the Council name sign, and that ornamental name sign is damaged or stolen, then the Council shall not be responsible for the repair or replacement of that name sign. These sign types should ordinarily be positioned on private property (or the property boundary). If a developer requires a sign to be positioned within the road reserve, an application must be submitted to Council s Land Transport Unit for consideration. The same Council Unit may, or may not approve the application. In accordance with section 319A of the Local Government Act 1974, if the Council names any road for the first time, or alters the name of a road, the Council will as soon as practicable send a copy of the relevant resolution to the Registrar-General of Land and the Surveyor-General. Note: Reference is also made to the Road Name Signs Specification document (#102907) which details the design and installation of road name signs. # July 2015

14 RESOURCE PLANNING AND REGULATORY COMMITTEE FOR THE MEETING OF 28 JULY 2015 Report for Agenda Item No 7 Prepared by - Chris English Group Manager Regulatory Services Eco Design Advisor Service Purpose of Report As a result of a submission to the Long Term Plan, Council has requested a report on the Eco Design Advisor Service that seven Councils in New Zealand provide to their residents. Background BRANZ, an independent research, testing, consulting and information company, believed there was a lack of factual, independent advice for homeowners, consumers and industry about sustainable building and how to improve house performance. They initiated the Eco Design Advisor service to meet that perceived need. There are currently seven Councils offering the Eco Design Service in New Zealand and these are a mix of part-time and full-time roles and usually sit within the Building Unit. The Eco Design Advisor service provides people with a number of services: Undertake free or low cost in-home consultations with homeowners, this is the primary role of the service; Provide free phone advice and short consultations at Council offices for homeowners regarding their new home or renovations; Undertake presentations and networking with industry and community groups. Council staff involved in the service, in addition to actually providing the service to customers, have to: Participate fortnightly in conference calls across the advisor network; Participate in twice yearly training conferences, usually one in Wellington and one in another location; Collect information about consultations and changes to houses as a result, to enable researchers to identify ways to optimise the service and the advice offered. 15 Assessment of Significance This issue is not deemed significant in relation to Council s overall activities or within the terms of our Significance Policy. Consultation N/A Funding Implications No provision for this role was provided for in the Long Term Plan budget and it would not be possible to provide the service without additional resources due to current workloads and statutory timeframes needing to be met. Until the service was offered Council would not know the level of interest in the Eco Design Advisor Service or staff resource required to meet that interest. Kapiti Coast employ 1 FTE in the role, Hutt Valley started with a 0.5 FTE but went to a 1 FTE after a year of offering the service. A 0.5 staff person would cost approximately $40 - $50k with overheads and a 1 FTE $80 - $100k. Conclusion While the service appears to be a worthwhile initiative and does provide benefits for residents and positivity for Council in being pro-active in an increasingly sustainability driven environment, it is not a core Council activity, however no other entity offers such a free service. Also the Building Unit, under current staffing resources, and with significant training commitments to meet Building Act Regulation 18 (Building Diploma) requirements and staff resources allocated to developing the on-line consenting framework is simply unable to allocate any resource to the provision of an Eco Design Advisory Service. Recommendation That Council, while acknowledging the merits of such a service, does not proceed to employ additional staff and offer an Eco Design Advisor Service. # July 2015

16 RESOURCE PLANNING AND REGULATION COMMITTEE FOR THE MEETING OF 28 JULY 2015 Report for Agenda Item No 8 Prepared by - Grant Hyde Building Control Manager Amendment to the Delegations Register Purpose of Report To advise the Committee of an amendment to the Delegations Register. Background The delegations register is a Territorial Authority (TA) function under section 232 of the Building Act 2004 and clause 32 of schedule 7 of the Local Government Act 2002 (see attached). Identification of Relevant Legislation, Council Policy and Plans Local Government Act 2002 Assessment of Significance This matter is deemed significant under the Council s Significance Policy. Other Considerations Attached are copies of the current and amended delegations register showing changes in red font. Page 1 - shows job titles which have altered, and two additional columns have been included for delegations for the Building Warrant of Fitness (BWOF) support officer and the Quality Assurance Coordinator, following some advice from the IANZ auditors, and also to keep in line with actual practices in the BCA, in order to make the delegations register more robust. Page 2 - shows the delegation given to the BWOF Support Officer for purposes of carrying out audits to buildings that have BWOF s. Page 3 - o Two delegations have been inserted under the heading Quality Assurance Coordinator, following some advice from the IANZ auditors. o Relevant changes and additions of Acts, Regulations, and By-laws have been inserted. Funding Implications N/A Conclusion Due to the recent legal issues faced by a number of other Councils around delegations, the proposed amendments to Council s Delegation Register have been reviewed and approved by Council s legal representative in Timaru. # July 2015
