14 2-A OPERATION OF THE QUESTION 1B SHALL PUEBLO TAXES BE INCREASED BY UP TO $980,000 ANNUALLY TO PAY FOR ANIMAL CONTROL SERVICES, INCLUDING BUT T LIMITED TO THE COSTS OF ANIMAL CONTROL CODE ENFORCEMENT AND THE COSTS OF OPERATING AN ANIMAL SHELTER, BY AN ADDITIONAL PROPERTY TAX LEVY AT A RATE T TO EXCEED ONE MILL; AND SHALL ALL REVENUES FROM SUCH TAXES AND EARNINGS FROM THE INVESTMENT THEREOF BE COLLECTED, RETAINED AND SPENT BY THE IN THE 2005 AND EACH SUBSEQUENT COLLECTION YEAR TWITHSTANDING THE LIMITS OF ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION AND SECTION , COLORADO REVISED STATUES, AS AMENDED? CITY OF PUEBLO QUESTION. 2A (Authorizing $17,000,000 to be received from Xcel Energy, Inc. to be used for a building for the Police Department, Municipal Court and related functions, two fire stations, and satellite police facilities) WITHOUT CREATING ANY NEW TAX OR INCREASING ANY EXISTING TAXES, SHALL THE CITY OF PUEBLO BE AUTHORIZED TO COLLECT, RETAIN AND EXPEND $17,000,000 IN THE AGGREGATE OF NEW REVENUES RECEIVED OR COLLECTED DURING FISCAL YEAR 2005 AND SUBSEQUENT YEARS FROM XCEL ENERGY, INC. AFTER ANNEXATION OF ITS FACILITIES TO THE CITY TO FINANCE THE ACQUISITION, CONSTRUCTION AND EQUIPPING OF A BUILDING FOR THE POLICE DEPARTMENT, MUNICIPAL COURT AND RELATED FUNCTIONS, TWO FIRE STATIONS, AND SATELLITE POLICE FACILITIES AS DETERMINED BY THE CITY COUNCIL, WITHOUT LIMITATION OR CONDITION AS A VOTER-APPROVED REVENUE CHANGE AND AN EXEMPTION TO THE LIMITS WHICH OTHERWISE APPLY UNDER SECTION 20, ARTICLE X OF THE COLORADO CONSTITUTION OR ANY OTHER LAW? 4 QUESTION 2B SHALL ORDINANCE (A COPY OF WHICH IS ON FILE IN THE OFFICE OF THE CITY CLERK) OF THE CITY OF PUEBLO, COLORADO BE APPROVED, WHICH ORDINANCE AMENDS CHAPTER 4 OF TITLE XIV OF THE PUEBLO MUNICIPAL CODE AND AUTHORIZES THE CITY TO USE THREE AND THREE-TENTHS PERCENT (3.30%) OF THE CITY S SALES AND USE TAX REVENUE, WHICH WAS PREVIOUSLY BEING RETAINED BY THE RETAILERS WHO COLLECT SUCH TAX ON BEHALF OF THE CITY TO COVER THEIR EXPENSES IN COLLECTING AND REMITTING SUCH TAX, FOR ONE OR MORE OF THE FOLLOWING PURPOSES, IN SUCH AMOUNTS AND PROPORTIONS AS THE CITY COUNCIL SHALL DETERMINE (1) PAYING THE PRINCIPAL OF, PREMIUM, IF ANY, AND INTEREST ON THE URBAN RENEWAL AUTHORITY OF PUEBLO, COLORADO ( AUTHORITY ) REVENUE BONDS IN THE AGGREGATE PRINCIPAL AMOUNT OF $9,500,000 ISSUED TO FINANCE INITIAL CONSTRUCTION OF THE PUEBLO CONVENTION CENTER AND HOTEL COMPLEX, OR ANY BONDS ISSUED TO REFINANCE SUCH BONDS, (2) PAYING THE NEXT OPERATING AND MAINTENANCE EXPENSES OF THE PUEBLO CONVENTION CENTER, (3) FINANCING THE ACQUISITION AND CONSTRUCTION OF PARKING FACILITIES, (4) ASSIST IN THE FINANCING, ACQUISITION, CONSTRUCTION AND EQUIPPING OF A HEALTH DEPARTMENT FACILITY, (5) PAYING THE PRINCIPAL OF, PREMIUM, IF ANY, AND INTEREST ON THE AUTHORITY S REVENUE BONDS IN A PRINCIPAL AMOUNT T TO EXCEED $12,000,000 TO BE ISSUED TO FINANCE AN EXPANSION OF THE PUEBLO CONVENTION CENTER AND RELATED IMPROVEMENTS AFTER ENCUMBERING ALL TAX ALLOCATION REVENUES OF THE AUTHORITY TO THE PAYMENT OF SUCH BONDS, OR ANY BONDS ISSUED TO REFINANCE SUCH BONDS, AND/OR (6) REIMBURSING RETAILERS FOR THEIR COSTS INCURRED IN COLLECTING AND REMITTING THE SALES AND USE TAX REVENUES TO THE CITY, AUTHORIZING THE CITY COUNCIL TO PLEDGE IRREVOCABLY ALL OR ANY PART OF THE THREE AND THREE-TENTHS PERCENT (3.30%) OF THE CITY S SALES AND USE TAX REVENUE FOR ANY OF THE FOREGOING PURPOSES AND PAYMENT THEREOF, AND SHALL THE REVENUES DERIVED FROM SUCH THREE AND THREE-TENTHS PERCENT (3.30%) OF THE CITY S SALES AND USE TAX BE COLLECTED AND SPENT NET OF ANY CONSTITUTIONALLY REQUIRED TAX CUTS, WITHOUT LIMITATION OR CONDITION, AS A VOTER APPROVED REVENUE CHANGE AND AN FOR THE ORDINANCE EXCEPTION TO THE LIMITS WHICH WOULD OTHERWISE APPLY UNDER ARTICLE X, SECTION 20 OF THE COLORADO CONSTITUTION OR ANY OTHER LAW? AGAINST THE ORDINANCE QUESTION 2C SHALL THE CITY COUNCIL OF THE CITY OF PUEBLO, COLORADO, BE AUTHORIZED TO PLEDGE THREE AND THREE-TENTHS PERCENT (3.30%) OF THE CITY S EXISTING SALES AND USE TAX REVENUE TOWARD THE PAYMENT OF BONDS TO BE ISSUED BY THE URBAN RENEWAL AUTHORITY OF PUEBLO, COLORADO ( AUTHORITY ) IN A PRINCIPAL AMOUNT OF UP TO $12,000,000 WITH A REPAYMENT COST T TO EXCEED $28,500,000 TO FINANCE THE EXPANSION OF THE PUEBLO CONVENTION CENTER AND RELATED IMPROVEMENTS AFTER ENCUMBERING ALL TAX ALLOCATION REVENUES OF THE AUTHORITY TO THE PAYMENT OF SUCH BONDS? QUESTION. 2D (Charter Amendment City Employee Residency Requirement) SHALL THE CHARTER OF THE CITY OF PUEBLO BE AMENDED BY ADDING SECTION 8-16 THERETO REQUIRING CITY EMPLOYEES APPOINTED OR EMPLOYED ON OR AFTER JANUARY 1, 2005 TO RESIDE WITHIN THE CITY? QUESTION. 2E (Charter Amendment Dates of Holding General Municipal Elections) SHALL THE CHARTER OF THE CITY OF PUEBLO RELATING TO ELECTIONS BE AMENDED BY DELETING OBSOLETE LANGUAGE AND CHANGING THE DAY FOR HOLDING GENERAL MUNICIPAL ELECTIONS FROM THE FIRST TUESDAY AFTER THE FIRST MONDAY IN VEMBER OF ODD NUMBERED YEARS TO THE FIRST TUESDAY IN VEMBER OF ODD NUMBERED YEARS? 3 QUESTION. 2F (Charter Amendment deadlines for Filing Nominating Petitions with City Clerk) SHALL THE CHARTER OF THE CITY OF PUEBLO RELATING TO ELECTIONS BE AMENDED BY AMENDING SECTION 17-5 THEREOF, CLARIFYING THAT MINATING PETITIONS ARE TO BE FILED WITH THE CITY CLERK, THAT THE CITY CLERK REVIEW SUCH PETITIONS FOR THE REQUISITE NUMBER OF SIGNATURES, THAT THE CITY CLERK RETURN SUCH PETITIONS TO THE PERSON WHO FILED IT IF FOUND INSUFFICIENT, THAT THE CITY CLERK PRESERVE SUCH PETITIONS, PROVIDING THAT SUCH PETITIONS MUST BE FILED WITH THE CITY CLERK T EARLIER THAN NINETY-ONE (91) DAYS BEFORE THE ELECTION AND T LATER THAN SEVENTY-ONE (71) DAYS BEFORE THE ELECTION, AND PROVIDING PROCEDURES FOR WITHDRAWAL OF CANDIDACY?
