ADMINISTRATIVE PROCEDURES a) Review minutes of the Nov 14, 2018 Planning Commission meeting. III. CITIZEN COMMENT The planning commission will allocate 15 minutes for citizen comments regarding items not related to the current agenda. IV. OLD BUSINESS - NONE V. NEW BUSINESS a) A Public Hearing on expansion to the Pangborn and Baker Flats Industrial Service Areas. Douglas County has initiated a comprehensive plan amendment and rezone to expand the industrial zoning districts at both Pangborn and Baker Flats. The proposal at Baker Flats includes three parcels of land totaling approximately 26 acres in size, these parcels are located west of the highway and at the intersection of NW Cascade and US 2. The proposal at Pangborn includes two different areas. The first area is located just north of the current industrial service area and totals approximately 55 acres in size. The second area lies just east of S Van Well Ave and totals approximately 76 acres in size. VI. Adjourn Planning Commission meeting materials available at:

CALL MEETING TO ORDER The meeting was called to order by Chair Molly Linville at 5:30 P.M. Douglas County Planning Commission Members Present: Molly Linville, Michael Machado, Robert Knowles, Dan Beardslee, David Andrews, and Tanya Davis Douglas County Staff Present: Curtis Lillquist, Principle Planner Tanner Ackley, Associate Planner II. ADMINISTRATIVE PROCEDURES a) Planning Commission member Robert Knowles made a motion to approve the August 8, 2018 minutes. The motion was seconded by Planning Commission member Dan Beardslee. III. IV. Citizen Comment No citizens present at this meeting chose to comment. Old Business None V. New Business a) A Public Hearing on City of East Wenatchee CPA/ZC : An application by Paul Bondo for Equilus Partners, LLC, proposing an amendment to the Greater East Wenatchee Area Comprehensive plan land use map and the East Wenatchee Official Zoning Map that would 1

3 change the land use designation and zoning of approximately 3.7 acres from Residential Low Density (R-L) to Residential Medium Density (R-M). Planner Curtis Lillquist provided an overview of the application including information about how Douglas County and East Wenatchee keep their Comprehensive Plans consistent with each other. Planning Commission member Michael Machado moved to forward a recommendation of approval to the Douglas County Board of Commissioners. The following findings and conclusions were entered into record: Findings 1. The proposal is a request to amend the Greater East Wenatchee Area Comprehensive plan land use map and the East Wenatchee Official Zoning Map that would change the land use designation and zoning of the subject property from Residential Low Density (R-L) to Residential Medium Density (R-M). 2. The subject property is located at 50 14th St. NE, East Wenatchee, WA and is legally described as Lot 1, Jennings Short Plat, all within Section 2, Township 22 N. Range 20 EWM Douglas County, Washington. 3. The subject property is identified as Douglas County Assessor Parcel number The fee owner is listed as Jennings Trust with Daniel & Tennye Jennings, Trustees. 4. The City of East Wenatchee and Douglas County have adopted the Greater East Wenatchee Area Comprehensive Plan in accordance with the provisions of the Growth Management Act and RCW Chapter 36.70A which covers the City and Douglas County unincorporated areas within the East Wenatchee Urban Growth Area Boundary. 5. The subject property is within the study area of the Greater East Wenatchee Area Comprehensive Plan (2017) and is designated as suitable for low density residential development. 6. The GMA requires comprehensive plans and development regulations to be consistent. 7. RCW Chapter 36.70A authorizes cities and counties to adopt and amend comprehensive plans and development regulations. 8. The City of East Wenatchee and Douglas County provide opportunities to the public, local and state jurisdictions and agencies for early and continuous public participation in the drafting of amendments to comprehensive plans and development regulations. The City adopted Resolution on June 8, 2010 establishing a Public Involvement Plan for adoption and amendments of comprehensive plan and development regulations. 9. Douglas County and East Wenatchee coordinate in long-range planning within the Greater East Wenatchee Area. The Douglas County Regional 2

4 Policy Plan established the protocol for comprehensive plan and development regulation amendments. 10. The planning commission is responsible for long-range planning matters and providing implementation recommendations to assure compliance with the GMA. Staff Report CPA/ZC Page The change from Residential Low Density to Residential Medium Density will provide a transition between the higher intensity General Commercial and Waterfront Mixed Use designation to the west and the low intensity Residential Low Density designation to the east. 12. The proposal is an extension of an adjacent residential medium density land use designation. 13. Copies of the application materials and environmental documents were sent to agencies with jurisdiction and commenting agencies requesting their review and comment on the proposed project. Agencies consulted include: Douglas County PUD; Douglas County Transportation and Land Services; Douglas County Fire District; Douglas County Sewer District; East Wenatchee Water District; City of Wenatchee Community Development Department, Chelan County Community Development Department, the Washington State Department of Transportation; and the Washington State Department of Ecology. No comments were received from those agencies. 14. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed and a Determination of Nonsignificance and Adoption of Existing Environmental Document was issued on November 13, 2017 with a 14-day comment period. No comments were received indicating that the proposed project would have a probable significant adverse impact on the environment. 15. Copies of the proposal and environmental documents were sent to the Washington State Department of Commerce on September 29, 2017 requesting their review and comment on the proposal and initiating the 60- day review process required by RCW 36.70A.106. No comments were received from any state agency. 16. The East Wenatchee Planning Commission has reviewed the entire record including the goals and policies of the comprehensive plans, and public testimony (both written and oral) as it relates to the proposed comprehensive plan map and zoning map amendments. 17. The East Wenatchee Planning Commission conducted a duly advertised public hearing on December 5, The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 18. Public testimony was taken at the hearing. The main concerns expressed were: 3

5 Conclusions 1. The proposed change in the zoning and comprehensive plan land use designation for the subject properties is consistent with and implements the goals and policies in the Greater East Wenatchee Area Comprehensive for designating property for medium density residential use. 2. The proposal is being process in accordance with provisions of the Douglas County Regional Policy Plan. Staff Report CPA/ZC Page The public involvement process for the proposed amendments meets the standards anticipated by RCW Chapter 36.70A.140 and Resolution The public involvement component included the opportunity for oral and written comment, and testimony at public hearings advertised by legal notice, the city web page and the news media. 4. It is the determination of the lead agency that no more than a moderate effect on the environment is a reasonable probability as a result of the proposed action. The proper exercise of the threshold determination process as required by WAC is than an environmental impact statement is not required to be prepared for this project. 5. Proper legal requirements of RCW 36.70A.106, title 19 EWMC, and Chapter EWMC were met and the community was given the opportunity to comment on the proposal at a duly noticed open record public hearing. 6. The proposed amendment has been processed in a manner consistent with the requirements of the Revised Code of Washington and the Washington Administrative Code. 7. Any Finding of Fact that is more correctly a Conclusion of Law is hereby incorporated by this reference. The recommendation was seconded by Planning Commission member Robert Knowles. The motion was passed unanimously. b) CPRZ : A public hearing on a Douglas County initiated comprehensive plan/rezone amendment from Office High Residential (R- H) to General Commercial (G-C) involving 3 parcels totaling approximately 6.7 acres. The proposal is located on SR 28, within the SW Quarter of Section 13, Township 22 N., Range 20 EWM, Douglas County. Principle Planner Lillquist gave an overview of the project including information provided within the staff report and photographs of the property. Planning Commission member Robert Knowles moved to forward a recommendation of approval to the Douglas County Board of 4

6 Commissioners. The following findings and conclusions were entered into record: Findings: 1. Douglas County has adopted a Countywide Comprehensive Plan pursuant to the Growth Management Act (GMA) and RCW Chapter 36.70A, and a series of subarea plans for each municipality in the county. These plans have been found to be consistent with each other. 2. RCW Chapters and 36.70A authorize the adoption of development regulations. 3. Amendments to the development regulations, SEPA threshold determination and supporting documentation were sent to the Washington State Department of Commerce on September 11, On September 10, 2018 Douglas County issued a Determination of Non-Significance pursuant to WAC for amendments to the Douglas County Code. 5. No written comments from agencies or the public were submitted during the review period. 6. The Notice of Public Hearing before the Planning Commission was published on September 13, 2018 in the Wenatchee World and Empire Press. 7. The Planning Commission conducted an advertised public hearing on November 14, The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 8. The proposal is located within the shoreline residential shoreline environment. 9. The proposal is located within geologically hazardous critical areas. Conclusions: 1. The procedural and substantive requirements of the State Environmental Policy Act have been complied with. 2. The procedural requirements of RCW 36.70A have been complied with. 3. The proposed amendments are consistent with the Douglas County Regional Policy Plan, Greater East Wenatchee Area Comprehensive Plan, East Wenatchee Municipal Code, Douglas County Code and the Douglas County Regional Shoreline Master Program. 4. The proposed amendments are consistent with the requirements of Revised Code of Washington and the Washington Administrative Code. Planning Commission member Dan Beardslee seconded the motion. The motion passed unanimously. 5

7 c) CPRZ : A public hearing on an application submitted by Doreen Letts applied for a comprehensive plan designation change to redesignate the Farrington pit to an area mineral resource designation and to expand this designation to include 20 acres of an adjacent parcel. This proposal involves 2 parcels totaling 60 acres and is located at the northeast corner of the intersection of Turtle Rock Rd and US Hwy 2/97. Principle Planner Lillquist provided an overview of the project including the shift from a Point designation to an Area designation. Planning Commission Member Robert Knowles made a motion to recommend approval of the application. The following findings and conclusions were entered into record: Findings: 1. The applicant is Doreen Letts, 100 Turtle Rock Rd, East Wenatchee WA. 2. The subject property is located at the northwest corner of the intersection of Turtle Rock Rd and US Hwy 2/97 within Section 36, Township 24 N., Range 20 EWM, Douglas County, WA. The Douglas County Assessors Numbers are and (North of US 2/97). 3. The subject property (APN ) originally received approval for a mineral extraction operation via CLI P The subject property is designated Rural Resource 5 acres. 5. APN has a mineral resource point designation. 6. A wellhead protection area established to protect the Regional Wellfield is located on the western two thirds of APN The second parcel ( ) is not located within the wellhead protection area. 7. Douglas County has adopted a Countywide Comprehensive Plan pursuant to the Growth Management Act (GMA) and RCW Chapter 36.70A, and a series of subarea plans for each municipality in the county. These plans have been found to be consistent with each other. 8. CPRZ was submitted on June 29, 2018 in conformance with DCC Amendments to the comprehensive plan, SEPA threshold determination and supporting documentation were received at Washington State Department of Commerce on September 11, Douglas County issued a Determination of Nonsignificance on September 10, 2018 pursuant to WAC (2). 11. No comments were received during the comment period. 12. RCW A170 (c) authorizes the designation of mineral resource lands not already characterized by urban growth and that long term significance for the extraction of minerals, 6

8 13. The Douglas County Countywide Comprehensive Plan includes policies, identifying factors and criteria for designation Mineral Resource Lands. 14. The Notice of Public Hearing before the Planning Commission was published on November 1, 2018 in the Wenatchee World and Empire Press. 15. The Douglas County Planning Commission conducted an advertised public hearing on November 14, The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. Conclusions: 1. The procedural and substantive requirements of the State Environmental Policy Act have been complied with. 2. The procedural requirements of RCW 36.70A have been complied with. 3. The proposed amendment is consistent with the requirements of the Revised Code of Washington and the Washington Administrative Code. 4. The proposed amendment is consistent with the Douglas County Code, Douglas County Countywide Comprehensive Plan and the Growth Management Act. 5. The subject property meets the Identifying Factors and Designation Criteria for Mineral Resource Lands in the Douglas County Countywide Comprehensive Plan. The motion was seconded by Planning Commission member Michael Machado and unanimously passed. d) CPRZ : A public hearing on an application submitted by Selland Construction Inc. applied for a comprehensive plan designation change to expand an existing mineral resource designation by approximately 6 acres. The proposal is located on N Venture Rd., Section 10, Township 22N, Range 21 EWM, Douglas County WA. Associate Planner Tanner Ackley provided an overview of the project including relevant information referenced in the staff report. Planning Commission member Michael Machado made a motion to recommend approval of the application. The following findings and conclusions were entered into record: 7

The procedural and substantive requirements of the State Environmental Policy Act have been complied with. 2. The procedural and substantive requirements of RCW 36.70A have been complied with. 3. The proposed amendments are consistent with the Douglas County Countywide Comprehensive plan and the Growth Management Act. 4. The proposed amendments are consistent with the requirements of Revised Code of Washington and Washington Administrative Code. The motion was seconded by Planning Commission member Tanya Davis and passed unanimously. e) Capital Facilities A public hearing to consider amendments to the Douglas County Capital Facilities Plan as part of the annual budget process. Planner Curtis Lillquist gave a brief overview of the updates Planning Commission Member Robert Knowles made a motion to recommend approval of the Capital Facilities Plan. The motion was seconded by Planning Commission Member Michael Machado and passed unanimously. VI. Adjournment The meeting adjourned at 5:54 P.M. 8
