The Public Works Director recommends the addition of a divisional hourly rate for Maintenance & Fleet Services. The Assessor recommends a reduction in fees collected for map copies. The Agriculture Commissioner recommends clarifying that the fee for direct marketing certificates includes livestock/poultry. Staff from the Animal Control division of Public Health recommends the transfer of fees for Dangerous Animal permits from Butte County Code to the Master Fee Schedule. The Public Works Director recommends the addition of a divisional hourly rate for Maintenance & Fleet Services. The Assessor recommends a reduction in fees collected for map copies. The Agriculture Commissioner recommends clarifying that the fee for direct marketing certificates includes livestock/poultry. The Animal Control division of Public Health recommends the transfer of fees for Dangerous Animal permits from Butte County Code to the Master Fee Schedule. The Finance Office is responsible for coordinating the proposed fee adjustments and has reviewed the cost of service calculations used to develop any department recommendations. DEPARTMENT RECOMMENDATIONS Library As outlined in Attachment I, the Library Director is recommending a reduction in the number of free inter-library loan requests from twelve (12) to three (3) per year. A nominal fee of $6 is recommended for the 4 th through 12 th requests, and full cost recovery of $28 for each request over 12.
3 Fee language is also being adjusted to clarify that all requests are subject to lending library charges. The Butte County fee of $6 or $28 is collected in addition to the other costs once the thresholds of four and thirteen requests are reached. Public Works The Director recommends inclusion of the hourly rate for Maintenance/Fleet Services in the Master Fee Schedule. Although the hourly rate was calculated as part of the countywide cost of service study performed by NBS Consulting in 2008, it was never added to the fee schedule. Due to recent changes in Chapter 10 of Butte County Code affecting Encroachment Permits, the Maintenance Services hourly rate should be added to recover the cost of services that may be provided by the Department. Public Health No fee adjustments are recommended at this time, but there are two administrative "clean up" items related to Animal Control fees. Wild and Exotic Animal permits appear in both the Master Fee Schedule and Chapter 4-45 of Butte County Code. The draft ordinance would remove specific fee references and direct users to the Butte County Master Fee Schedule. Staff recommends relocating the fee for Dangerous Animal permits from Butte County Code to the Master Fee Schedule as well. Assessor Department staff recommend a reduction in the fee collected for map copies to reflect Counsel's determination that the copies are considered part of a Public Record request. Department staff also recommend a reduction in the fee collected for a complete set of maps to reflect one hour of labor and materials. Agriculture The Agriculture Commissioner recommends adding livestock and poultry certification letters to the direct marketing certificate fee. This service results in either a direct marketing certificate for produce or a livestock/poultry certification letter. ACTIONS REQUESTED 1. Adopt the Resolution amending the Butte County Master Fee Schedule with the proposed fee adjustments effective November 1, Adopt ordinance amending Chapter 4 of the Butte County Code. 2

5 Resolution No. RESOLUTION AMENDING THE MASTER FEE SCHEDULE FOR SERVICES PROVIDED BY THE COUNTY OF BUTTE WHEREAS, the Board of Supervisors established the Butte County Master Fee Schedule by Resolution on March 24, 2009; and WHEREAS, the County of Butte is authorized to adopt and implement fees for services; provided, however, that such fees do not exceed the estimated reasonable cost of providing such services; and WHEREAS, maintenance of a Master Fee Schedule serves the convenience of the County and all persons affected by said charges; and WHEREAS, an ordinance amending Chapter 10 of Butte County Code was recently adopted; and WHEREAS, persons applying for Encroachment Permits under Chapter 10 of Butte County Code may be required to pay the full County cost of services provided relative to the permit; and WHEREAS, the cost of Maintenance and Fleet Services by Public Works was calculated as part of a cost of service study performed in 2008/2009; and WHEREAS, Dangerous Animal permit fee amounts were removed from Butte County Code for the purpose of transferring said fees, without increase, to the Butte County Master Fee Schedule; and WHEREAS, the Library initiates a large number of inter-library loans for a small number of patrons; and WHEREAS, the Board of Supervisors desires to increase the cost recovery of inter-library loan requests; and WHEREAS, the Board of Supervisors desires to clarify that Farmers Market certifications may include Producer's Certificates or Livestock/Poultry Certification letters; and WHEREAS, the Board of Supervisors desires a reduction in fees for map copies provided by the Assessor's Office; and WHEREAS, a public hearing was noticed and duly conducted to allow consideration of the proposed fee adjustments prior to adoption of this Resolution; and WHEREAS, the Board of Supervisors desires to adjust fees and to implement new fees for various government services provided by the County of Butte as set forth in the above mentioned actions. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Butte adopts the adjusted fees as delineated in the attached Exhibit A and amends the Butte County Master Fee Schedule to reflect the changes. Fee adjustments shall become effective November 1, 2012.

12 Ordinance No. An Ordinance Amending Chapter 4 - Animals of the Butte County Code The Board of Supervisors of the County of Butte ordains as follows: Section 1. Purpose. This proposed ordinance amends Chapter 4, Animals to omit specific fee references. Fees are adopted by resolution of the Board of Supervisors as part of the Butte County Master Fee Schedule. Section 2. amended to read as follows: Application and fee. (a) Butte County Code Section 4-31, regarding Wild or Exotic Animals, is The application for a permit shall contain the name of the applicant, his address, the address of the proposed location of the animal if different from applicant's and a brief description of the applicant's plan for keeping the animal which shall include the species of animal, the number of individuals of each species and a description of the housing facilities for the animal. Permit fees are adopted by Resolution of the Board of Supervisors as part of the Butte County Master Fee Schedule (b) The initial fee for the issuance of each permit shall be fifty dollars ($50.00), and the permit shall be valid for a period of one (1) year from the date of its issuance unless revoked or suspended. The fee permit shall cover either one (1) animal or a collection, and the maximum number of specimens permitted to be kept shall be specified in the permit. Whenever a new animal or collection is added so as to exceed the maximum number permitted, a new permit must be secured and a new fee must be paid, to the exceptions in subsection (c) of this section. The fee shall be due and payable at the time of issuance of the permit and shall be a prerequisite of such issuance c) Whenever, in any given permit year, there are new animals in a collection due to the reproduction of members of the collection or due to trade, exchange or replacement in the same number and of the same zoological order as the members of the collection traded, exchanged or replaced, the new animals do not require an additional permit during that year, provided the animal control officer is notified in writing of the new animals within thirty (30) days of acquisition. 1

The application shall be accompanied by a fee, as adopted by Resolution of the Board of Supervisors as part of the Butte County Master Fee Schedule, of one hundred dollars ($100.00) and shall contain the name of the applicant, the applicant's address, the applicant's home and business phone numbers, the address and description of the proposed location where the animal will be kept, and a complete description and a color photograph of the animal. Section 4. Authority. This ordinance is enacted pursuant to Government Code Sections 66017(a) and 66016(b), Article I, Section 1 of the Butte County Charter, and Article XI Section 7 of the California Constitution. Section 5. Severability. If any provision of this Ordinance or the application thereof to any person or circumstances is for any reason held to be invalid by a court of competent jurisdiction, such provision shall be deemed severable, and the invalidity thereof shall not affect the remaining provisions or other applications of the Ordinance which can be given effect without the invalid provision or application thereof. Section 6. Effective Date and Publication. This Ordinance shall take effect thirty (30) days after the date of its passage. The Clerk of the Board of Supervisors is authorized and directed to publish this ordinance before the expiration of fifteen (15) days after its passage. This Ordinance shall be published once, with the names of the members of the Board of Supervisors voting for and against it, in the, a newspaper of general circulation published in the County of Butte, State of California.
