2 Elizabeth II, April 17 Friday, April 17, o clock a.m. Prayers. Mr. Harrison, Member for Hampton-Kings, laid upon the table of the House a petition on behalf of residents of the Kingston Peninsula urging the Legislative Assembly to ensure that the development of a subdivision in Moss Glen is not approved. (Petition 37) Mr. Alward gave Notice of Motion 54, that on Thursday, April 23, 2009, he would move the following resolution, seconded by Mr. Fitch: WHEREAS economies across Canada have been in a state of decline during recent months and local, provincial and federal governments have been searching for tools to infuse money into regions to generate more stable financial markets; and WHEREAS the province of New Brunswick is currently facing an extremely difficult financial position with yearly deficits increasing and the provincial net debt growing at an unsustainable rate that will have negative impacts on the province s finances for decades and generations to come; and WHEREAS research and development funds must be a key component to revitalizing the New Brunswick economy by investing money in education, technology, infrastructure, and industry; and WHEREAS New Brunswick currently ranks as one of the lowest amongst all Canadian Provinces for investments in research and development from federal, provincial, business, nonprofit organizations, higher education, and foreign investment sectors; therefore BE IT RESOLVED that this Legislative Assembly urge the government to seek out every available resource for increased funding including new federal, provincial, and private industry funds so that this vital component of our economy can help New Brunswickers and our businesses revitalize our provincial economy in order to return this province to one of job creation, prosperity, and a leader in technology, research and development of world class products and services. Hon. Mr. Murphy, Government House Leader, announced that it was the intention of government that Bills 47 and 48 be called for second reading; following which, the House would consider

3 April 17 Journal of Assembly 203 a motion with respect to the Official Languages Act; following which, the House would resolve itself into a Committee of Supply to consider the estimates of the Department of Post-Secondary Education Training and Labour. With leave of the House to dispense with notice, Bills 47 and 48 were ordered for second reading. The Order being read for second reading of Bill 47, An Act to Amend the Smoke-free Places Act, a debate arose thereon. And the debate being ended, and the question being put that Bill 47 be now read a second time, it was resolved in the affirmative. Accordingly, Bill 47, An Act to Amend the Smoke-free Places Act, was read a second time and ordered referred to the Committee of the Whole House. The Order being read for second reading of Bill 48, An Act to Amend the Tobacco Sales Act, a debate arose thereon. And the debate being ended, and the question being put that Bill 48 be now read a second time, it was resolved in the affirmative. Accordingly, Bill 48, An Act to Amend the Tobacco Sales Act, was read a second time and ordered referred to the Committee of the Whole House. At o clock a.m., Mr. Speaker declared a recess and left the chair o clock p.m. Mr. Speaker resumed the chair. With the unanimous consent of the House, Mr. Speaker reverted to the order of Introduction of Guests. The Honourable the Premier welcomed to the House: Jacqueline Robichaud, wife of the late Premier Louis J. Robichaud; Lewis Ayles (Progressive Conservative, City of Campbellton, ); Robert Higgins (Liberal, Saint John Centre, ; and Saint John Park, ), a former Leader of the Opposition; Wendell Meldrum (Liberal, Westmorland County, ); Robert Pichette, administrative assistant to Premier Louis J. Robichaud; Michel Carrier, Commissioner of Official Languages; and Bernard Poirier, the Consul General of France.

4 Elizabeth II, April 17 With leave of the House to dispense with notice, Hon. S. Graham, seconded by Mr. Alward, moved the following resolution: (Motion 55) WHEREAS on April 18, 1969, the Legislative Assembly of New Brunswick adopted unanimously the Official Languages Act of New Brunswick; AND WHEREAS this Act has been amended and enhanced several times, and it has been entrenched in the Constitution of Canada; AND WHEREAS it is fit and proper to recall on this fortieth anniversary of the adoption of the original Act that New Brunswick has greatly benefited, and continues to draw important economic, social and cultural advantages from this Act, thanks to the vision and the generosity of our predecessors in 1969; NOW THEREFORE the Legislative Assembly once again unanimously resolves to reiterate and reaffirm its support and advocacy for and of the principles of linguistic equality, which have characterized New Brunswick since And the question being put, a debate ensued. And the debate being ended and the question being put, Motion 55 was carried. At o clock p.m., Mr. Speaker declared a recess and left the chair o clock p.m. Mr. Speaker resumed the chair. The House, according to order, resolved itself into a Committee of Supply with Mr. Fraser in the chair. And after some further time spent in Committee of Supply, Mr. Speaker resumed the chair, and Mr. Fraser, the Chairman, after requesting that Mr. Speaker revert to Presentations of Committee Reports, reported that the Committee had had under consideration the matters referred to them, had made some progress therein, had passed several items, and asked leave to sit again. Pursuant to Standing Rule 78.1, Mr. Speaker then put the question on the motion deemed to be before the House, that the report be concurred in, and it was resolved in the affirmative.
