1 LOCAL MEMORANDUM OF UNDERSTANDING LABORERS' INTERNATIONAL UNION OF NORTH AMERICA, AFL-CIO MAIL HANDLERS DIVISION MAIL HANDLER LOCAL NATIONAL AGREEMENT This Memorandum of Understanding is entered into on November 1, 1996 at , between the representatives of the United States Postal Service, and the designated agent of the Laborers' International Union of North America, Mail Handlers Division, pursuant to the Local Implementation Provisions of the 1994 National Agreement. 2 A. ADDITIONAL OR LONGER WASH-UP PERIODS. Mailhandlers shall be granted a reasonable amount of wash-up time prior to lunch and at the end of the tour. B. GUIDELINE FOR THE CURTAILMENT OR TERMINATION OF POSTAL OPERATIONS TO CONFORM TO ORDERS OF LOCAL AUTHORITIES OR AS LOCAL CONDITIONS WARRANT BECAUSE OF EMERGENCY CONDITIONS. The decision for the curtailment or termination of postal operations to conform to the order of local authorities, or as local conditions warrant because of emergency conditions, shall be made by the installation head. When a decision has been reached to curtail postal operations, to the greatest extent possible, management will notify and seek the cooperation of local radio and television stations to inform employees. Depending upon the severity of the emergency situation and what is allowed by local authorities, under such a situation, Postal Service telephones will be open for employees to call for information. C. FORMULATION OF LOCAL LEAVE PROGRAM. The formulation of the local leave program is contained in Sections 30.2C through 30.2R. D. THE DURATION OF THE CHOICE VACATION PERIOD. The vacation period will begin on the second Saturday in May and end on the second Friday in October, for the duration of this contract. All requests of choice vacation must be in bv April 15th. The supervisor must approve or disapprove by May 1st. E. THE DETERMINATION OF THE BEGINNING DAY OF AN EMPLOYEE'S VACATION PERIOD. The vacation period shall start on the first day of the service week.
3 F. WHETHER EMPLOYEES AT THEIR OPTTON MAY REQUEST TWO SELECTIONS DURING THE CHOICE VACATION PERIOD, IN UNITS OF FIVE (5) OR TEN (10) DAYS. Mailhandler craft employees may request two selections during choice vacation period. The combination of the two selections must not exceed fifteen (15) working days for those Mailhandlers who earn twenty (20) or twenty-six (26) days annual leave per year and ten (10) working days for those Mailhandlers who earn thirteen (13) days of annual leave per year. Where two selections are made, both choices must be submitted by the cut-off date. Approval of these requests shall be by seniority within the operation. Seniority during the preferred leave period may be used only once on each cycle. G. WHETHER JURY DUTY AND ATTENDANCE AT NATIONAL OR STATE CONVENTIONS SHALL BE CHARGED TO THE CHOICE VACATION PERIOD. 1) Employees on Jury Duty during the choice vacation period shall not have their absences charged to the choice vacation period. 2) Attendance at National conventions shall not be charged to the choice vacation period. 3) Relative to _ and 2 above, employees shall be eligible for another available period provided this does not deprive any other employee of first choice for scheduled vacation. H. DETERMINATION OF THE MAXIMUM PERCENTAGE OF EMPLOYEES WHO SHALL RECEIVE LEAVE EACH WEEK DURING THE CHOICE VACATION PERIOD. A minimum of 10% will receive leave each week during the choice vacation period. In computing the 10%, the advantage of all fractions of 1/2 or more goes to the employee/union. I. THE ISSUANCE OF OFFICIAL NOTICES TO EACH EMPLOYEE OF THE VACATION SCHEDULE APPROVED FOR SUCH EMPLOYEE. Request for choice vacation must be submitted in duplicate on PS Form 3971 to the employee's immediate supervisor by April 15. The supervisor must act upon these requests by_ May 1, and return the duplicate copy to the employee.
4 J. DETERMINATION OF THE DATE AND MEANS OF NOTIFYING EMPLOYEES OF THE BEGINNING OF THE NEW LEAVE YEAR. A notice will be posted on all bulletin boards to - info---all Mailhandlers of the beginning of the new leave year, no later than January 1. K. THE PROCEDURES FOR SUBMISSION OF APPLICATIONS FOR ANNUAL LEAVE DURING OTHER THAN THE CHOICE VACATION PERIOD. Applications for leave, other than vacation selections, as provided in Items 30.2F and 30.2G, may be submitted at any time of the year, the granting of which will be on a first come, first served basis, and supervisor must approve or disapprove within three (3) working days or the leave is automatically approved. If leave requests are submitted prior to 30 or more days before the requested period and if leave is disapproved, the employee must resubmit a request for leave within 21 days prior to the requested leave period. L. WHETHER "OVERTIME DESIRED" LISTS IN ARTICLE 8 SHALL BE BY SECTION AND/OR TOUR. Overtime Desired Lists shall be by Tours. M. THE NUMBER OF LIGHT DUTY ASSIGNMENTS TO BE RESERVED FOR TEMPORARY OR PERMANENT LIGHT DUTY ASSIGNMENT. The parties agree that when the need of reassignment to light duty presents itself, management will inform the representative of the Union or Unions concerned, and management will determine the type and duration cf lright duty assignment to be granted based on disability of the employee as certified by his physician. N. THE METHOD TO BE USED IN RESERVING LIGHT DUTY ASSIGNMENTS SO THAT NO REGULARLY ASSIGNED MEMBER OF THE REGULAR WORK FORCE WILL BE ADVERSELY AFFECTED. Management shall reassign an ill or injured employee to the extent possible within his craft to a light duty work. Such light duty and length of assignment shall be determined by management on the basis of the physician's report, and the ability to perform the duties involved. Mailhandlers will"not be assigned temporary or permanent light duty to the detriment of any fulltime regular Mailhandler.
5 O. THE IDENTIFICATION OF ASSIGNMENTS THAT ARE TO BE CONSIDERED LIGHT DUTY. Light duty is defined as that portion of an employee's duty assignment that can be performed by an employee who through illness or injury is unable to perform his full regular assigned duties. Mailhandler light duty work may include any of all of the following, but not limited to: 1. Obtaining empty equipment. 2. Obtaining mail,from outside boxes and drop units 3. Tray metered mail 4. Cull mail 5. Face by-passed mail on Mark II 6. Tray cancelled mail for distribution 7. Loading ledges 8. Sweeping 9. Operating typing machines 10. Loose pack 11. Hanging sacks 12. Examine sacks for mail content 13. Obtaining unprocessed flats 14. Simple distribution without requirements of a scheme 15. Inserting labels into sacks and pouches P. THE IDENTIFICATION OF ASSIGNMENTS COMPRISING A SECTION, WHEN IT IS PROPOSED TO REASSIGN WITHIN AN INSTALLATION, EMPLOYEES EXCESS TO THE NEEDS OF A SECTION For the purpose of this Local Memorandum of Understanding, a Section shall be defined as a Tour pursuant to Article 12, 12.?. Q. THE ASSIGNMENT OF EMPLOYEE PARKING SPACES Parking spaces which the installation head determines are available in excess of the needs of official Postal vehicles shall be used on a first come, first served basis, for postal employees only. R. THE DETERMINATION AS TO WHETHER ANNUAL LEAVE TO ATTEND UNION ACTIVITIES REQUESTED PRIOR TO DETERMINATION OF THE CHOICE VACATION SCHEDULE IS TO BE PART OF THE TOTAL CHOICE VACATION PLAN Annual leave to attend union activities shall not be charged against choice vacation period.

THOSE OTHER ITEMS WHICH ARE SUBJECT TO LOCAL NEGOTIATIONS AS PROVIDED IN THE FOLLOWING ARTICLES: Article 12, Section.3B5 / Article 12, Section.3C / Article 12, Section.3E3e ;' Article 12, Section.4 / Article 12, Section 6C4a / Article 13, Section.3. 1) Article 12, Section.3B5: Refer to the provisions of Article 12, Section.3B7. 2) Article 12, Section.3G: Unless otherwise specified, bidding for duty assignments will be on an installation-wide basis. 3) Article 12, Section.3E3e: Refer to Item 30.2T, Reassignments, herein. 4) Article 12, Section.4: Refer to Item 30.2P herein. 5) Article 12, Section.6C4a: :refer to Item 30.2P herein. 6) Article 13, Section.3: Refer to Item 30.2M through O herein. T. LOCAL IMPLEMENTATION OF THIS AGREEMENT RELATING TO SENIORITY, REASSIGNMENTS AND POSTING Reassignments For all full-time regular Mail Handlers having bid assignments, reassignment out of bid assignment shall be by volunteers or juniority. Reassignment back into bid assignment shall be by seniority. Seniority 1) Relative to Article 11, Section.6B, full and 'cart-time regular employees, in order c= seniority, shall be selected to work on a holiday within each category by sections. Sections are defined in Item 30.2P of this Memorandum. 2) An updated seniority roster shall be provided to the Local Union on a quarterly basis. Posting 1) Relative to Article 11, Section.6B, management shall post an invitation for volunteers by Tuesday, two weeks preceding the service week in which the holiday falls. Such invitations for volunteers shall be posted by section/tour. Sections are defined in Items 30.2P of this Memorandum. 2) Relative to Article 12, Section.3B, the Administrative Vice President or other designated union representative shall be notified and given an opportunity to review all newly established craft positions prior to posting.
7 3) Pursuant to Article 12, Section.3D4 of the National Agreement, PS Form 1716's will reflect the location of work activity, e.g., Originating Mail Preparation, Platform, Pouch Rack, etc
