5 5 Spreckels Memorial District From: Sent: To: Subject: Michele Mazzuca Thursday, May 11, :26 PM Trees on Second St. Hi, I live on Second St, in the new houses, and I am trying to figure out who I might talk to about the trees that line the street. Not sure if the tree that happens to sit in front of our house is the only one doing this, but it is dropping this sappy substance on my car and driving me insane, my car is this sticky mass of dust (thanks to the tree and the fields). The tree did this last year too, as they are finally big enough to reach onto the road, but figured it might have something to do with all the smoke from the fires. Anyhow I am trying to see if, I as a home owner am responsible for the tree and can remove and possibly replace as I see fit, or if some board/committe in Spreckels is responsible for these trees and if so, who I may talk to about possibly getting it replaced, as it is truly ruining my car. 16 16 RESOLUTION NO RESOLUTION CERTIFYING COMPLIANCE WITH STATE LAW WITH RESPECT TO THE LEVYING OF GENERAL AND SPECIAL TAXES, ASSESSMENTS, AND PROPERTY-RELATED FEES AND CHARGES WHEREAS, Spreckels Community Services District ("Public Agency") requests that the Monterey County Auditor-Controller enter those general or special taxes, assessments, or property-related Fees or charges identified in Exhibit "A" on the tax roll for collection and distribution by the Monterey County Treasurer-Tax Collector commencing with the property tax bills for fiscal year NOW, THEREFORE, BE IT RESOLVED as follows: 1. The Public Agency hereby certifies that it has, without limitation, complied with all legal procedures and requirements necessary for the levying and imposition of the general or special taxes, assessments, or property-related fees or charges identified in Exhibit "A", regardless of whether those procedures and requirements are set forth in the Constitution of the State of California, in State statutes, or in the applicable decisional law of the State of California. 2. Spreckels Community Services District User Fees consist of $15 per parcel in Zone 1 - Old Town. 18 Carmel Valley Recreation and Park District 18 Carmel Valley Recreation and Park District Board of Director's Public Hearing Thursday June 15, 2017 at 9:00 a.m. (Activity House) 29 Ford Road Carmel Valley, CA Board of Directors Steve Goodman Joseph Hertlein Alan Sokolow Karolyn Stone Michael Thatcher Notice of Public Hearing Concerning Your Vote on the Proposed Carmel Valley Recreation and Park District ( CVRPD) Park Maintenance Assessment District What is the Carmel Valley Recreation and Park District? Your parcel is located within the Carmel Valley Recreation and Park Distric ("Districf") boundaries. The District was formed in 1988 to provide local control over the Carmel Valley Community Park located at 29 Ford Road. Prior to 1985, the Monterey Peninsula Regional Park District owned and managed the park. In 1985, the property owners within the District also approved an annual assessment to fund the park maintenance. The assessment rate was set at $24 per residential unit and ranged from $12 to $48 per parcel for non/residential properties depending on their use (e.g. commercial, industrial, institutional, etc.). The CVRPD is managed by an elected unpaid Board of Directors of 5 people. All funds collected from property assessments and park event rentals is spent on park maintenance and related expenses. Currently, there are no funds available to replace existing improvements, when needed. For the past 32 years, the assessment rates have remained unchanged. During those 32 years, a 1.44 acre piece of land was donated by the Carmel Valley Village Improvement Committee (CVVIC), and due to generous property owner donations, the District has been able to acquire additional land and expand the park from 1.3 acres to 6.8 acres. Since 1985, the District has been generating approximately $50,000 annually from these assessments to fund the park. In addition, the District has also received a $25,000 grant which was matched with a $25,000 donation, for a total of $50,000. The District continues to receive some charitable donations from generous property owners. Why is an increase in the annual assessment needed? In the earlier years, the District was able to-build up reserves, out nowa ll reserve funds have been depleted. It has now come to a point where the District needs to ask property owners to approve additional funding. Therefore, the District is proposing to levy an annual assessment to cover the current park costs. The current budget projection for FY 2017/ 18 is $106,4 34, which is primarily used for maintenance. (If the assessment were to have been increased by inflation over the last 32 years, the annual assessment revenue would be $125,000 just to maintain the previous park size of 1.3 acres or about one fifth its present size.) The District is proposing to increase the assessment revenue to $106,4 34 in FY 2017/18. If the assessment is approved, the District can continue to maintain the improvements at the same level of service residents are accustomed to, and fund needed capital improvement projects such as; painting the gazebo, restrooms, and Activity House, install new toilets, maintain the irrigation system, replace picnic tables and trash cans, improve the stage area, slurry seal the parking lot, etc. Previous enhancements, such as the recent irrigation and drainage improvements were only made because of generous donations from a few supporters of the park. The District needs to be financially viable and can't rely on donations every time improvements need to be made to the park.

19 What are the "benefits" of the Maintenance Assessment District? H ow does maintaining park improvements affect public safety? Properly maintained parks enhance public safety. Well trimmed and groomed landscaping helps law enforcement easily monitor the park grounds for suspicious activity. How will this affect my property values? Property Appraisers routinely report that well maintained public landscapes increase property values within the respective community. Appraisers also hold that property values decrease when such services are significantly reduced. H ow will this affect my family's quality of life? Properly maintained parks enhance recreational opportunities for property owners and residents throughout the area. The approval of the assessment rate will enable the District to maintain a quality level of service to your park and provide needed funds to maintain existing facilities and for future improvements. W hat happens if the assessment vote 19 fails? Without this needed funding, future improvements could not be funded, existing improvements would be maintained less frequently, and reductions in current maintenance levels would occur. The District would also need to consider the possibility of conveying the Community Park to another governmental agency, for example the Monterey Peninsula Regional Park District or the County of Monterey. W hat are some other benefits of Park Maintenance? Aesthetics that result from properly maintained public landscapes (including trees, bushes and plants), as well as park amenities, result in a sense of pride and community. spirit. J, _ What types of improvements and services will be provided through the Park Maintenance Assessment District? The District maintains and services approximately 6.8 acres of park land. These improvements and services include; + Landscape maintenance, including grass mowing, tree trimming, shrubs pruning, weed control, litter pick/up, etc. + Irrigation system maintenance, including sprinkler repair, water usage monitoring, backflow, booster and well pump maintenance, etc. Recreation amenities, including a gazebo, barbecue pits, picnic tables, outdoor stage, volleyball court, horseshoe pits, Activity House, flag pole, restrooms, etc. Replacement of needed capital facilities such as; restroom toilets and urinals, painting of the Activity House, restrooms, and gazebo, parking lot repaving, upgrades to the horseshoe pits and stage area, etc. + New improvements, such as landscaping around the flag pole, adding electrical outlets to the gazebo, adding kitchen and bathroom improvements to the Activity House, etc.

20 How is the annual assessment to each parcel determined? 20 The Park Maintenance Assessment District includes all parcels located within a 3-miles radius of the park and located within the Carmel Valley Recreation and Park District boundary. The annual assessment rates are based upon the following: 0 The use of the parcel (e.g., single-family, condominium, apartment, commercial, industrial, office, public, etc.). 0 All residential parcels (single-family, condominium, apartment, mobile homes, etc.) are assessed on a per unit basis. 0 All non-residential parcels (commercial, industrial, institutional, public, etc.) are assessed on a Building - -squa-fe footage basis. _ 0 Public parcels that benefit from the park improvements will be assessed based upon their current use (e.g. a public building used as and office building will be assessed at the office rate. How much will my parcel be assessed? The proposed FY assessment for your parcel is shown on your enclosed ballot. The table below shows the proposed FY assessment rates for developed residential and non-residential parcels. For a detailed description of how your annual assessment was calculated, you may refer to the Engineer's Report on file with the Secretary of the Board. If supported by a majority of the property owners, weighted by assessment amount, the annual assessment shown on your ballot may be levied by the Carmel Valley Recreation and Park District beginning July 1, 2017.

21 Will there be an Automatic Annual Increase in my Assessment Rate? The District is proposing that the FY maximum annual assessment rates be increased each subsequent fiscal year by no more than the prior year's change in the Annual Consumer Price Index-All Urban Consumers (San Francisco-Oakland-San Jose, CA). This increase is needed each year to keep up with the increases in costs for goods and services. If an annual increase is not included, the District would need to incur the costs of conducting a property owner election each time assessments increases were needed. Are there measures of accountability? Assessment monies will be held in a separate account. The District will have a certified financial review conducted each fiscal year to ensure that assessment revenues were only expended on authorized park services and improvements. How do I vote? When will the ballots be counted? A Public Hearing will be held on June 15, 2017, at 9:00 am in the Carmel Valley Recreation and Park District Activity House. The Board will receive public testimony and formally accept the ballots. The ballots will be counted following the Board Meeting in the Activity House. What determines majority support vs.'majorit:y protest? Majority support occurs if the returned ballots supporting the proposed assessment are greater than the returned ballots opposing the proposed assessment. Whether in support for, or in opposition to the proposed assessment, the votes are weighted according to the amount of the assessment the respective property owner will be assessed. If the "No" votes number more than the "Yes" votes, weighted by assessment amount, the assessment cannot be imposed and the proceedings will be abandoned. When will we know the results?
