Call to Order: Roll Call: Scott McNeil, Greg Stanton, Gerald Lillpop, Roseann Livingston, Robert Dalton 2. Agenda Approval: Agenda for June 3, 2014 Recommended Action: Approve agenda. 3. CC&R Conformed Agenda: Conformed Agenda for May 6, 2014 Recommended Action: Approve Conformed agenda. 4. Public Comment: Time For the Audience to Address the Committee On Non-Agenda Items Public testimony will be received on each agenda item as it is called. Principal party on each side of an issue (where applicable) is allocated 10 minutes to speak, individual comments are limited to 3 minutes, and individuals representing a group are allocated 5 minutes. Matters not on the agenda may be addressed by the public during the Open Forum. Public comments during Open Forum are limited to three minutes per person. The Committee reserves the right to waive said rules by a majority vote. 5. Communications Requiring Committee Review/Action: A. Appeal: Homeowner of 3837 Los Santos Drive, Cameron Park North Unit #1 CC&Rs Following a telephone call complaint the homeowner was sent an Initial violation notice on February 11, 2014 for constructing a building on his property without prior approval. Clause #3 of the Cameron Park North Unit #1 CC&Rs reads, in part, as follows: No building or other structure shall be erected or the erection thereof begun on said premises, until the plans and specifications thereof have been first approved in writing by the established architectural committee, an a copy of such plans and specifications filed with said committee. On March 14, 2014 the homeowner submitted the required application for review by the Architectural Review Committee and paid the fine for the Initial violation. The application was reviewed and denied by the ARC on March 25, 2014 and the homeowner was notified by letter on the same date. The application was denied because the location of the shed which was constructed was in violation of Clause 4(d) which requires a side setback of a minimum of 10 feet and El Dorado County Zoning Ordinance (d) which requires a rear setback of a minimum of 15 feet. The completed shed is located 5 feet from the side property line and 11 feet from the rear property line. The homeowner was also notified in the denial letter that the shed would have to be removed or relocated from its current location. Consistent with earlier discussions, the homeowner decided to proceed with having a survey conducted to determine if the existing property lines related to his parcel were correctly defined. Subsequently, further enforcement action has been held in abeyance until the survey was completed. The survey has now been completed and the homeowner is exercising his right of appeal related to the Architectural Review Committee s denial of his original application. Recommended Action: Deny the Appeal B. Appeal: Homeowner of 3801 Los Santos Drive, Cameron Park North Unit #1 CC&Rs At the May 6, 2014 regular scheduled CC&R Committee Meeting the homeowner appealed the Architectural Review Committee s denial of his application for having a shed constructed in his rear yard. The application was denied because the location of the shed was in violation of the required setback regulations. Cameron Park North Unit #1 CC&Rs require a side setback of 10 feet and the shed has a side setback of only 6 feet. After a lengthy discussion Member Dalton made a motion that the CC&R Enforcement Officer should gather additional information related to (1) easements data, (2) feasibility of trimming the existing oak tree to allow space for moving the shed, (3) surveyor s office boundary data and that the

2 appeal would be subject to further review at the regular scheduled June CC&R Committee Meeting. The motion was seconded by Member Stanton. The motion was approved by a vote of 5-0. Legal Cases: Notice Sent Unit Complaint A. # Sombra Court 07/01/11 Bar J Ranch Unit #1 Barking Dogs/Neglected Landscaping & Property Maintenance Status: Legal counsel filed a lawsuit on November 1, 2011 and the homeowner was personally served with the lawsuit on the same date. The home owner was required to file a response to the lawsuit with the court by December Legal counsel sent another letter to the home owner requesting that he file a response by December 19, The home owner failed to file a response to the lawsuit with the court and legal counsel took the necessary steps to have the court order a judgment against the home owner. Legal counsel submitted a proposed judgment to the court and legal counsel is awaiting the court to sign, file and return the judgment. As of February 1, 2013 the court has been delayed in signing, filing and returning the judgment. The court has stated that it will rule on whether to award the judgment on March 28, The court has ruled that it will award the judgment granting to the District its request for (a) permanent injunction directing the owner to comply with the CC&Rs, including but not limited to causing their dogs to stop barking, completing the deck in the backyard, and properly maintaining the landscaping, (b) $2, in attorney s fees,

3 and (c) $ in costs. The court has awarded the District a judgment and legal counsel is taking the steps to enforce the judgment against the owner, including recording the judgment against the owner s home. Legal counsel has filed the judgment against the home and is also taking additional steps to request that the court grant a contempt order against the owner for failure to comply. Counsel has obtained and is proceeding with a court order requiring the owner to appear at the courthouse on January 8, 2014 regarding enforcement of the judgment against the owner. The homeowner has vacated the property and counsel was not able to have a subpoena served. Homeowners living adjacent to 3506 Sombra Court are concerned about the condition of the property and potential fire hazard. The issue was presented to the Board of Directors at the regular meeting held on April 16, 2014 and the board directed staff to implement the following: (1) Submit the Cal Fire letter to legal counsel for review; (2) Once approved, send letter by registered mail to homeowner; (3) If the letter is returned because property is vacant, authorize staff to hire contractor to remove all rubbish, weeds, dead trees, bushes/shrubs, leaves, etc. from the property and apply weed killer and pre-emergent chemicals where appropriate. The Cal Fire letter was reviewed and approved by District legal counsel and Cal Fire staff sent the letter to the homeowner of 3506 Sombra Court on April 28, 2014 and a copy of the letter was posted on the front door of the property on the same date. B. # Crazy Horse Road 04/10/14 Cambridge Oaks #3 Improper Parking on Street Status: Following an complaint the homeowner at 4304 Crazy Horse Drive was initially cited on January 22, 2014 for being in violation of Cambridge Oaks Unit #3 CC&Rs, Clause 16 which prohibits overnight parking of vehicles on any street within the subdivision. A Final Notice letter sent on February 11, 2014 and a Pre-Legal Notice letter was sent on March 10, The vehicle, a tan Chevrolet Astro Van, license #3TIF442, had been consistently parked in the same location, both day and night and the homeowner has never responded to any of the violation notices. On April 1, 2014 at the regular scheduled CC&R Committee Meeting, by a vote of 4-0, the Committee approved forwarding this issue to the Board of Directors for legal action. On April 16, 2014 the Board of Directors, by a vote of 4-0, approved forwarding this issue to legal counsel for legal action and the appropriate documents were forwarded accordingly. Legal counsel is sending to the homeowner a letter requesting that the homeowner comply and if the homeowner fails to comply, then Legal counsel will file a lawsuit on behalf of the District against the homeowner. C. # Fairway Drive 04/24/14 Air Park Estates R/V Trailer Not Properly Screened Status: Following a phone call complaint the homeowner at 3201 Fairway Drive was initially cited on March 12, 2014 for being in violation of Air Park Estates CC&Rs, Amendment #3. Recreational vehicles which are located upon Air Park Estates parcels for more than 10 consecutive days must be screened from view so as to ensure at least 50% of the RV is not visible to passing motorists because of landscaping, fences, topography or other structure.. A Final Notice was sent on April 4, 2014 and a Pre-Legal Notice was sent on April 24, The homeowner did not respond to any of the violation notices. On May 6, 2014, at the regular scheduled CC&R Committee Meeting, by a vote of 5-0, the Committee approved forwarding this issue to the Board of Directors for legal action. On May 21, 2014, the Board of Directors, by a vote of 4-0 approved forwarding this issue to legal counsel and the appropriate documents were forwarded accordingly. Legal counsel is sending to the homeowner a letter requesting that the homeowner comply and if the homeowner fails to comply, then Legal counsel will file a lawsuit on behalf of the District against the homeowner. D. # Hampton Lane 04/18/14 Cameron Park N. #3 Miscellaneous Debris/Materials Status: Following an complaint the homeowner at 3714 Hampton Lane was initially cited on March 20,2014 for being in violation of Cameron Park North Unit #3 CC&Rs, Clauses #5 & #7. In addition to the front and side yard portions of the property being littered with miscellaneous debris/materials, equipment and other paraphernalia, the front lawn portion is also covered with a heavy growth of tall weeds. A Final Notice was sent on April 4, 2014 and a Pre-Legal Notice was sent on April 18, The homeowner did not respond to any of the violation notices. On May 6, 2014, at the regular scheduled CC&R Committee Meeting, by a vote of 5-0, the Committee approved forwarding this issue to the Board of Directors for legal action. On May 21, 2014, the Board of Directors, by a vote of 4-0, approved forwarding this issue to legal counsel and the appropriate documents were forwarded accordingly. Legal counsel is sending to the homeowner a letter requesting that the homeowner comply and if the homeowner fails to comply, then Legal counsel will file a lawsuit on behalf of the District against the homeowner.

Pre-Legal Notice to Owner s: In the event the property owner/resident fails to comply to the Final Notice of CC&R violation, the CC&R Compliance Officer shall issue a Pre-Legal Notice informing the property owner of the date, time and place of the meeting and the District s intent to forward said CC&R violation to District s legal counsel. Recommended Action: Amend ARTICLE III by adding the following sentence and forwarding the amendment to the Board of Directors for approval: All Pre-Legal Notices are to be sent by Registered Mail. 14.
