1 Christopher Newport University Office of Recreational Services Volleyball Club Constitution Article I Name The name of this Organization shall be the Men s Volleyball Club at Christopher Newport University. Article II Purpose The purpose of this club shall be to (a) allow students to compete in a higher level of athletics in Men s volleyball and (b) to promote intercollegiate competition at Christopher Newport University, with the goal of possibly becoming an actual varsity sport at CNU. Article III Membership Section 1. Any student regularly enrolled in Christopher Newport University may become a member of the Men s Volleyball Club with voting and office-holding privileges. The standards of qualification and the amount of dues to be paid shall be determined by the club. Section 2. Dues, having been decided on by the organization as $65 dollars for the fall semester of 2008, which will be paid by members only, and the spring dues are to be determined. Section 3. The Men s Volleyball Club shall not haze any prospective member for the purpose of admission into or affiliation with the organization. Members of the Men s Volleyball are free to leave or dissociate without fear of retribution or harassment. The Men s Volleyball Club shall not discriminate based on race, creed, color, sex, age, national origin, disability and sexual orientation. Article IV Executive Officers The executive offices of the Men s Volleyball Club shall be as follows: Chairman, Vice- Chairman, Secretary, and Treasurer. The aforementioned officers shall constitute the Executive Committee. Article V Duties of the Executive Officers Section 1. The Chairman is to preside at the Executive Committee membership meetings, appoint special committees with approval of the Executive committee, maintain player information and forms, select individuals to attend Monday meetings with advisors, follow the constitution and maintain it, plan practices and decide the consequences for bad behavior. Section 2. The Vice Chairman is to preside in the Chairman s absence, schedule gym times, fundraising and publicity, plan practices and help with the decisions for the bad behavior. He will also perform such duties as may be required by the by-laws or resolutions of the Executive Committee. Section 3. The Secretary is to attend all general correspondence of the organization and to keep minutes of all Executive Committee and membership meetings and to preserve the records of the organization. He will perform other such duties as may be required of the Executive Committee
2 like contracts and research with other schools, disperse information to team members and be the main contact, and coordinate away match rides. Section 4. The Treasurer is to supervise the financial administration of all revenue periodically to the Executive Committee and membership on the financial condition of the organization, and perform other such duties as may be required by the by laws or resolutions of the Executive Committee including collecting dues, creating a budget, maintaining all receipts, creating business plans (deciding due amounts each semester and need of the club). Article VI Meetings Section 1. The regular meetings of the Men s Volleyball Club shall be on Wednesdays at 6:30 pm before practice. Executive Committee members will attend as well as advisors. Section 2. Special meetings may be called by the Chairman at his discretion. Section 3. Sixty percent of the membership shall constitute a quorum. Article VII Elections Section 1. Election of officers shall take place yearly during the first week of September. Club members will vote who they feel is best qualified for the positions. Section 2. Any student eligible for nomination as an officer of the Executive Committee who (a) meets Christopher Newport University s eligibility for student office holding, which consists of a 2.5 grade point average and (b) fulfills the qualification as set up by the Executive Committee. Section 3. A vacancy in any office, except the Presidency, shall be filled only by an election held among the members of the Men s Volleyball Club. Article VIII Recall of Officers Officers of the organization may be dismissed for cause if due process is followed. Grounds for dismissal include dereliction of duties, extreme absence, or unsportsmanlike conduct. A motion for recall of an officer requires a 2/3 vote. Article IX Amendments Amendments to this Constitution may be proposed to the voting membership by majority vote of the Executive Committee or by petition signed by 1/10 of the voting membership. Amendments shall be declared adopted which are presented at two general meetings and receive a majority favorable vote at both meetings by the voting members present. Article X By-laws By-laws, not inconsistent with the constitution, may be adopted or amended by 2/3 vote of the regular or special meetings, providing the by-laws are submitted in writing at least one week previously at either a regular or special meeting or the general membership. Article XI Role of the Advisor
3 The advisor of the organization shall provide support, counseling, and guidance in all situations. The advisor is expected to attend most meetings and give officers advice. Article XII Responsibilities The Men s Volleyball Club shall adhere to University policies and all city, state, and federal laws. Article XIII Ratification This constitution shall become effective upon ratification by a majority of the organization s membership and Office of Student Activities. Sport Club President Signature:. 4 Amendments These amendments shall serve to modify and update the Constitution to allow it to maintain its functionality for both the present and the future of the organization. Amendments to this Constitution shall in no form be used for the benefit of an individual or small group within the Men s Volleyball Club. They will be adopted and enforced as stated in Article IX of the Constitution. Amendment I Eligibility of General Student Population This amendment shall modify Article III, Section 1. Any student regularly enrolled in Christopher Newport University may become a member of the Men s Volleyball Club with voting and office-holding privileges. The standards of qualification and the amount of dues to be paid shall be determined by majority decision of the Executive Officers, not by the club. Amendment II Dues and Active Membership This amendment shall modify Article III, Section 2. Dues shall be decided by a majority vote of the Executive Officers on a yearly or semesterly basis. The amount due must be paid in full by the fourth practice or the end of the second week of the season, whichever comes first. To be considered an active member of the Men s Volleyball Club, Dues must be paid in full on time, all necessary forms completed to the satisfaction of the Executive Officers and of Recreation Services and attend ALL Sunday practices. Excuses will be taken into consideration by the Executive Officers on a case-by-case basis. Amendment III Formation of Safety Officer This amendment shall modify Article IV. This update shall create a new Executive Officer position, the Safety Officer, whose duties and powers are to be enumerated later. Amendment IV Duties of Safety Officer This amendment shall modify Article V. The Safety Officer shall serve as the team s primary contact for basic medical needs. He shall maintain his Red Cross CPR/AED and First Aid Certifications, along with any other necessary certifications as determined by the Recreation Services of Christopher Newport University. His duties shall be to maintain the First Aid Kit provided by CNU, carry it with the team to away matches, and document all uses of equipment. He shall constitute the deciding vote on a decision should the other Executive Officers be deadlocked. The Executive Officers, here named, thus consist of the President, Vice President, Secretary, Treasurer and Safety Officer. It is recommended that all Executive Officers by CPR/AED and First Aid Certified. Amendment V - Practices This amendment shall modify Article VI, Section 1. Practices shall be decided by the Executive Officers at the beginning of the season. They can be changed during the course of the season by a majority decision of the Executive Officers. Amendment VI Election of Executive Officers This amendment shall modify Article VII, Section 1. Election of the Executive Officers shall take place in during the first week of practices in the Spring season. Only Active members
5 shall be eligible to vote and hold office. The old officers shall assist the new officers to become adjusted to their responsibilities such as those stipulated in this Constitution and attendance of the Monthly Meeting with Recreation Services. Amendment VII Structure The Men s Volleyball Club at Christopher Newport University shall carry twenty to twenty five (20 25) players in the form of two teams. The composition of the Club Membership and of its subset teams shall be determined by the majority of the Executive Officers in accordance with this constitution. The teams shall be divided on the basis of skill level, attitude and dedication by the Executive Officers with advisement from the Club Advisor(s). The higher level team shall serve as the primary representative of the Men s Volleyball Club at Christopher Newport University at all Away matches. All active members will have the opportunity to play in at least one tournament. The number of players carried by the Men s Volleyball Club and the number of its subset teams may be modified at a later date by further amendments to this constitution. Amendment VIII - Punishments The punishment for TWO unexcused missed practices shall be the forfeit of member s playing spot at the next tournament, regardless of semester or seasonal breaks. Removal from Active Membership can be achieved by a Majority Decision of the Executive Officers. Amendment IX League Play Once the Men s Volleyball Club is thoroughly established, as determined by the Executive Officers, league play is to be pursued. When membership in an appropriate competition league is established, a team representative shall be chosen from the Active Membership to serve as the representative of the Men s Volleyball Club at Christopher Newport University to the league governance. The team representative shall serve as the medium between the Club and the League. All information shall be passed along on a timely basis between the two ends. Once league membership is achieved, this constitution is to be amended to facilitate league play. Amendment X Formation of the Marketing Officer This amendment shall modify Article IV. This update shall create a new Executive Officer position, the Marketing Officer, whose duties and powers are to be enumerated later. Amendment XI Duties of the Marketing Officer This amendment shall amend Article V. It shall be the charge of the Marketing Officer to coordinate advertisements for the Club in any medium the Executive Officers deem reasonable and responsible. This can include, but is not limited to posters, flyers, s and use of the plasma screen televisions. They shall bear the majority publicity role, but will coordinate with the Vice President. The Marketing Officer shall be the sixth member of the Executive Committee with full voting rights. In the case of a deadlock within the Executive Committee regarding ANY decision, it shall fall upon the President to decide the appropriate course of action for the club. Amendment XII Amendment to Team Structure This shall amend Amendment VII. The team structure shall continue to exist in a two team format. Team 1 (also known as the Competition Team) shall constitute the competition team. It
6 will consist of no more than 12 players. Its members will be decided by the Executive Committee no more than 2 weeks prior to the upcoming match. After the match, this team will be dissolved and its members reselected before the next match. Participation in Team 1 at any event does not equate to a permanent selection. All members will have an equal opportunity to make the Competition Team. It will be this team that represents CNU at matches. Team 2 (also known as the Training Team) will consist of as many members as the Executive Committee sees fit. There is no minimum or maximum. It is highly recommended that no less than 12 members be placed on this team, assuming there is adequate interest. This team s purpose is to improve the skill level of its members through concentrated attention by the Executive Committee as a coaching body. This team shall not be used as a form of punishment. Members of both teams will be selected by skill level, and skill level alone. Members of the Training Team will have an equal opportunity to make the Competition Team.
