1 MINUTES OF THE BOARD OF COUNTY COMMISSIONERS MEETING November 1, 2011 The Board of County Commissioners for Cecil County met in regular session at the County Administration Building, 200 Chesapeake Blvd., Suite 1009, Elkton, MD. The following members of the Board were present: James T. Mullin, President Diana Broomell, Vice President Tari Moore, Commissioner Michael W. Dunn, Commissioner Robert J. Hodge, Commissioner Constituting a full Board. The meeting of the Board of County Commissioners for Cecil County, November 1, 2011 was called to order by Commissioner Mullin at 7:00 p.m. and opened with the Pledge of Allegiance. The following minutes were presented for the Board s consideration: October 18, 2011 Commissioner Meeting Minutes Commissioner Moore made a motion to approve the minutes, seconded by Commissioner Broomell and unanimously carried to approve. - INFORMATIONAL ITEMS - COMMISSIONER COMMENTS Commissioner Moore commented about the Cecil County United Way Kick-Off. She also commented about meetings she will be attending and representing the County this week, the Local Government Insurance Trust and Maryland Association of Counties. Comment was also made relating to the Methadone Clinic and of some of the misconceptions circulating about her position relating to this matter. Commissioner Broomell commented about the Community Meeting that will be held on November 9 th, relating to the Methadone Clinic and the Drug Awareness Workshop on November 10 th at the Perryville library. She also commented on the recent news program featuring Cecil County and it s prescription drug epidemic. Commissioner Hodge welcomed everyone to the meeting. Commissioner Dunn welcomed everyone as well. - CECIL COUNTY BOARD OF HEALTH
2 Stephanie Garrity, Health Officer presented the statistical data for the annual Rabies Vaccination Program for the year and she noted a decline in the number of animals vaccinated. The decline is attributed to pet centers now offering low cost vaccines. Health Officer Garrity encouraged all citizens to receive the Seasonal Flu Immunization and advised of the upcoming clinics on Thursday, November 3, 2011 and Monday, November 14, 2011 at the Cecil County Health Department. The quarterly report for the period of July-September, 2011 was also presented to the Board. - CECIL COUNTY BICYCLE PLAN Tigist Zegeye, Wilmapco Executive Director, and staff presented the Cecil County Bicycle Plan that will be developed in coordination with Cecil County staff, State Highway, the Cecil County Health Department, as well as municipalities within the county to establish safe bicycle routes throughout the county and municipalities. - BREAST CANCER AWARENESS CHECK PRESENTATION Commissioner Mullin commented on the success of the Breast Cancer Awareness fundraiser. Vicky Rinkerman, Office Executive Administrator acknowledged all who made the fundraiser a success. - PUBLIC HEARING AMENDMENT TO CHAPTER 258 TAXATION OF THE CODE OF CECIL COUNTY ADDITION OF ARTICLE VII PROPERTY TAX CREDIT FOR HABITAT FOR HUMANITY- Alfred C. Wein, Jr., County Administrator presented a proposed amendment to the Cecil County Code that if adopted will provide for a 100% tax credit for real property owned by the Cecil County Habitat for Humanity and will remain in effect until such property is transferred, but in no event for more than five years. If adopted, the credit shall apply to the tax year beginning, July 1, 2012 and will be voted on at the Board of County Commissioners meeting on November 15, COMMENTS IN SUPPORT/OPPOSITION: Joanne Blewitt, Executive Director, Habitat for Humanity - commented in support of the amendment. - PUBLIC INPUT SESSION WATER SHED IMPLEMENTATION PLAN W. Scott Flanigan, Director of Public Works presented the plan mandated by the U.S. Environmental Protection Agency requiring the six states and the District of Columbia within the Chesapeake Bay Watershed to develop a plan for the reduction of total maximum daily load allocations of nitrogen and phosphorous into the bay. The deadline for the draft plan submission to the Maryland Department of the Environment is November 18, The Cecil County Watershed Implementation Plan (WIP) deals with septic systems, wastewater treatment plants and stormwater management practices. The draft WIP developed by county staff and the Commissioner appointed Watershed Implementation Committee was presented to the Board of County Commissioners for consideration at the November 15, 2011 regular meeting.
3 Rob Peoples, Project Manager provided a brief presentation of the Cecil County WIP developed by staff and the committee that includes upgrades to wastewater treatment facilities, best management practices for stormwater run- off and voluntary septic pumping. The following citizens expressed their comments and concerns about the proposed draft of the WIP: Al Reasin, 330 Conowingo Road, Conowingo, MD, Tom Backus no address provided George Kaplan, Colora, MD Joe Carabetta, 1611 Carpenter s Point Road, Perryville, MD Rupert Rossetti, Port Deposit, MD Matt Watkins, Elkton, MD Commissioner Moore commented about the MAST Model modifications mentioned by the Maryland Department of the Environment and about the requirements by the State for the WIP as well as the financial impacts to the counties and state. Commissioner Hodge also commented about the WIP and explained to the public about the inception of the plan as a result of a federal lawsuit filed by the Chesapeake Bay Foundation against the Environmental Protection Agency. Commissioner Mullin commented that the Board is working with the delegation on several initiatives relating to the WIP. - PUBLIC COMMENT Frank Vari, 100 Third Street, Chesapeake City, MD presented a Certificate of Appreciation for participation in the Conquer the Bridge Event in October. Joe Carabetta, Carpenter s Point Rd., Perryville, MD - commented in appreciation of the recognition for Mr. Wein and Ms. Nusic, and thanked the Board for the open communication with regard to the WIP. Ann Connor, 45 Enfield Road, Elkton, MD commented in opposition to the location of the Methadone Clinic in a residential area and the lack of notification the area residents. Al Reasin, Conowingo Road, Conowingo, MD thanked Mr. Flanigan and his staff for their work on the WIP. He also commented about accusations of county staff and the issuance of road code waivers that are not supported by facts. Linda Kleiner, North East, MD commented in reference to the appointments to the Bainbridge Development Corporation and urged the appointments as recommended. Kelly Frost, 6 Lavelle Court, Elkton, MD commented in reference to the criminal activity at or near the proposed Methadone Clinic. Nicholas Guns, 75 Alda Drive, Elkton, MD commented in opposition to the proposed Methadone Clinic and the effects this clinic will have on the area residents in reference to safety and property values. Michael Guns, 75 Alda Drive, Elkton commented in opposition to the proposed Methadone Clinic and the current criminal activity the residents of that area are currently experiencing as a result of the Elkton Motel.
4 Mary Rodgers - commented in reference to the conflict of the Republic Central Committee and the scheduled Town Hall meeting scheduled for November 10 th. Donna Caudell, Long Drive, Elkton announced two upcoming events, November 3 rd Town Hall on Plan Maryland at the Cecil County Senior Services with regard to property rights and November 10 th Town Hall Meeting with the County Commissioners at the Cecil County Senior Services Center and encouraged the Board s participation at the Town Hall Meeting. Ron Lobos commented about government transparency and the upcoming Town Hall Meeting and encouraged all Commissioners to attend. - ACTION ITEMS The appointments to the Susquehanna Workforce Network will be deferred until the Board s November 15, 2011 meeting. - APPOINTMENTS TO THE CECIL COUNTY ELECTRICAL BOARD & ADULT GUARDIANSHIP BOARD Motion to approve the following re-appointments to the Cecil County Electrical Board and the Cecil County Adult Guardianship Board was made by Commissioner Dunn, seconded by Commissioner Hodge and unanimously carried: Joe Johnson and Steve Moon Cecil County Electrical Board Brenda Sexton, Robert Churnside & Patricia Dana - AMENDMENTTO THE CECIL COUNTY ZONING ORDINANCE, SECTION 196 & SECTION 215 MITIGATION FOR FOREST INTERIOR DWELLING BIRDS IMPACT, BUFFER IMPACT & FOREST IMPACT Eric Sennstrom, Director of Planning & Zoning presented the text amendment to the Cecil County Zoning Ordinance for the Board s consideration as presented during a public hearing at the Board of County Commissioners meeting on October 18, Motion to approve the text amendment was made by Commissioner Moore, seconded by Commissioner Hodge and unanimously carried. A copy of this text amendment is attached hereto and incorporated into these minutes. - Department of Public Works W. Scott Flanigan, Director of Public Works presented the following action items: - DEED BETWEEN MONTGOMERY BROTHERS, INC., GRANTEE AND THE CECIL COUNTY BOARD OF COUNTY COMMISSIONERS FOR ACCEPTANCE OF A ROAD IDENTIFIED AS VAN WEAVER DRIVE. Motion to approve the Deed between Montgomery Brothers, Inc., and the Cecil County Board of County Commissioners for Van Weaver Drive was made by Commissioner Moore, seconded by Commissioner Hodge and unanimously carried. - RECOMMENDATION FOR BID NO SUPERSTRUCTURE PAINTING BRIDGES CE-0007 & CE-0087
5 Motion to award Bid No Superstructure Painting of Bridges CE-0007 New Bridge & CE 0087 New Valley to SAFFO Contracting in the amount of $377, was made by Commissioner Dunn, seconded by Commissioner Hodge and unanimously carried. - RECOMMENDATION FOR BID NO PAINTING OF VARIOUS BRIDGES IN CECIL COUNTY- Motion to award Bid No Painting of Various Bridges throughout Cecil County to Symmetric Painting in the amount of $205, was made by Commissioner Moore, seconded by Commissioner Hodge and unanimously carried. - RECOMMENDATION FOR BID NO FLYGT SEWAGE PUMP Motion to award Bid No Flygt Sewage Pump to Sherwood Logan & Associates in the amount of $13, was made by Commissioner Broomell, seconded by Commissioner Moore and unanimously carried. - BID AWARDS - RECOMMENDATION FOR BID NO FUELS Motion to award Bid No pursuant to the recommendation of the Purchasing Agent to Mid Atlantic Cooperation Solutions, D.B.A. Aero Fuels as specified in the bid document was made by Commissioner Moore, seconded by Commissioner Dunn and unanimously carried. - BUDGET AMENDMENTS NOS Motion to approve Budget Amendments No was made by Commissioner Moore, seconded by Commissioner Dunn and unanimously carried. A copy of the amendments are attached hereto and incorporated into these minutes.
