8 POLICY PROPOSED REVISED Rochester Community Schools Rochester, Michigan STUDENTS 5566/Page 1 of 1 Professional Staff/3366 Support Staff/4366 ANTI-BULLYING The Rochester Community Schools Board of Education prohibits acts of harassment or bullying. The Board of Education believes that a safe and civil environment is necessary for students to learn and achieve high academic standards. Demonstration of appropriate behavior, treating others with civility and respect, and refusing to tolerate harassment or bullying is expected of administrators, faculty, staff, students and school visitors. Bullying conduct that is reasonably perceived as being motivated by, but not limited to, any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression; or a mental, physical, or sensory disability or impairment; or by any other distinguishing characteristic is considered harassment or bullying. The Board of Education defines harassment or bullying as the intimidation or emotional abuse of others by infliction of harm of any kind to the person or property of others whether real or threatened, and whether transmitted physically, verbally, in writing, or electronically. Students who engage in any act of bullying while at school, at any school function, in connection with any District sponsored activity or event, while enroute to or from school, are subject to disciplinary action as outlined in the Code of Conduct. Bullying that occurs outside of school hours that causes a significant disruption to the school environment will also be subject to disciplinary action as outlined in the Student Code of Conduct. Law enforcement officials shall be notified of bullying incidents where required by law. IF A STUDENT, STAFF MEMBER, OR OTHER INDIVIDUAL BELIEVES THERE HAS BEEN AN INCIDENT OF BULLYING IN VIOLATION OF THIS POLICY, S/HE SHALL PROMPTLY REPORT SUCH INCIDENT TO THE APPROPRIATE PRINCIPAL OR DESIGNEE, OR THE RESPONSIBLE SCHOOL OFFICIAL(S), AS DEFINED BELOW. RETALIATION OR FALSE ACCUSATION AGAINST A TARGET OF BULLYING, ANYONE REPORTING BULLYING, A WITNESS, OR ANOTHER

9 POLICY Rochester Community Schools Rochester, Michigan PERSON WITH RELIABLE INFORMATION ABOUT AN ACT OF BULLYING IS STRICTLY PROHIBITED. ALL REPORTED ALLEGATIONS OF A POLICY VIOLATION OR RELATED COMPLAINT ABOUT BULLYING SHALL BE PROMPTLY AND THOROUGHLY INVESTIGATED BY THE BUILDING PRINCIPAL OR DESIGNEE. A DESCRIPTION OF EACH REPORTED INCIDENT, ALONG WITH ALL INVESTIGATION MATERIALS AND CONCLUSIONS REACHED BY THE PRINCIPAL OR DESIGNEE SHALL BE DOCUMENTED AND FILED SEPARATELY WITH SIMILAR MATERIALS IN THE DISTRICT'S CENTRAL ADMINISTRATIVE OFFICE. IF THE PRINCIPAL OR DESIGNEE DETERMINES THAT AN INCIDENT OF BULLYING HAS OCCURRED, S/HE SHALL PROMPTLY PROVIDE WRITTEN NOTIFICATION OF SAME TO THE PARENT/GUARDIAN OF THE VICTIM OF THE BULLYING AND THE PARENT/GUARDIAN OF THE PERPETRATOR OF THE BULLYING. AT LEAST ANNUALLY, THE BUILDING PRINCIPAL OR DESIGNEE, OR THE RESPONSIBLE SCHOOL OFFICIAL SHALL REPORT ALL VERIFIED INCIDENTS OF BULLYING AND THE RESULTING CONSEQUENCES, INCLUDING ANY DISCIPLINARY ACTION OR REFERRALS, TO THE BOARD OF EDUCATION. THE ANNUAL BOARD REPORT MAY BE GIVEN IN WRITING, IN PERSON AT A REGULAR BOARD MEETING, OR AS OTHERWISE REQUESTED BY THE BOARD OF EDUCATION. THE SUPERINTENDENT ("RESPONSIBLE SCHOOL OFFICIAL") SHALL BE RESPONSIBLE FOR ENSURING THE PROPER IMPLEMENTATION OF THIS POLICY THROUGHOUT THE DISTRICT. THE FOREGOING APPOINTMENT SHALL NOT REDUCE OR ELIMINATE THE DUTIES AND RESPONSIBILITIES OF A PRINCIPAL OR DESIGNEE AS DESCRIBED IN THIS POLICY. NOTICE OF THIS POLICY WILL BE: (A) ANNUALLY CIRCULATED TO ALL STUDENTS AND STAFF, (B) POSTED IN CONSPICUOUS LOCATIONS IN ALL SCHOOL BUILDINGS AND DEPARTMENTS WITHIN THE DISTRICT, (C) ANNUALLY DISCUSSED WITH STUDENTS, AND (D) INCORPORATED INTO THE TEACHER, STUDENT, AND PARENT/GUARDIAN HANDBOOKS. DEFINITIONS 1. "AT SCHOOL" MEANS IN A CLASSROOM, ELSEWHERE ON SCHOOL PREMISES, ON A SCHOOL BUS OR OTHER SCHOOL- RELATED VEHICLE, OR AT A SCHOOL-SPONSORED ACTIVITY OR EVENT WHETHER OR NOT IT IS HELD ON SCHOOL PREMISES. "AT SCHOOL" ALSO INCLUDES ANY CONDUCT USING A TELECOMMUNICATIONS ACCESS DEVICE OR

"TELECOMMUNICATIONS ACCESS DEVICE" MEANS THAT TERM AS DEFINED IN SECTION 219A OF THE MICHIGAN PENAL CODE, 1931 PA 328, MCL A, AS MAY BE AMENDED FROM TIME TO TIME. 3. "TELECOMMUNICATIONS SERVICE PROVIDER" MEANS THAT TERM AS DEFINED IN SECTION 219A OF THE MICHIGAN PENAL CODE, SUPRA, AS MAY BE AMENDED FROM TIME TO TIME. The Superintendent/designee will develop and implement regulations and procedures that ensure both the appropriate consequences and remedial responses to a student who commits one or more acts of harassment or bullying, and that outline reporting procedures for those who are victims of bullying. 14 Board Resolution on Superintendent Evaluation WHEREAS, the Board did an evaluation of the Superintendent s performance in November 2011, which evaluation found that the Superintendent s performance was satisfactory, which would merit a rating of effective ; WHEREAS, applicable law requires that a significant factor in the Superintendent s annual job performance evaluation is relevant data on student growth and achievement; WHEREAS, because most of the District-wide student achievement data currently available is based upon the previous year s academic performance, for which the Superintendent cannot be held accountable, there is inadequate data on student growth and achievement at this time upon which to base a substantive evaluation with respect to the Superintendent; THEREFORE, BE IT RESOLVED, that the Superintendent s performance shall be reported to be effective based upon the November evaluation until such time that additional data on student growth and achievement is received and the Superintendent s evaluation for his performance thereafter can be finalized.
