2 History of OSG P.L Title I, Indian Self-Determination and Education Assistance Act of 1975 Fall 1987, Arizona Republic newspaper publishes a series of articles, entitled: "Fraud in Indian Country Title III, Tribal Self Governance Demonstration Project - A Tribally Driven Initiative 2
3 OSG Statutory Mandates Title IV - October 25th, Leads to the creation the Office of Self-Governance (OSG) within DOI with the responsibility for administering Tribal Self-Governance as it relates to Bureau of Indian Affairs (BIA) and non- BIA programs. Title V- Authorized the Secretary of Health and dhuman Services to establish an Office of Self-Governance in the Indian Health Service. Title VI - Enacted to study the feasibility of applying Self-Governance to other Health and Human Services (HHS) programs. 3

5 Purpose of OSG To select tribes to participate in tribal self-governance and award planning and negotiation grants within established time frames. To complete annual funding agreement negotiations with fiscal year tribes by June 30 and calendar year tib tribes by August t31 of each year. To maintain the financial integrity and timely and accurate delivery and reporting of all funds negotiated in the Self-Governance annual funding agreements. 5
6 Purpose of OSG To facilitate negotiations for non-bia programs, services, functions or activities that are otherwise available to be operated under self-governance agreements, or that have a special geographic, historical or cultural connection to a self-governance tribe. To work with Tribes and the Inspector General to close all outstanding A-128 audits for Self-Governance tribes and to process requests for waiver of BIA regulations within 60 day time frame. To work with Tribes to submit an annual report to Congress by January 1 of each year. 6
7 Purpose of OSG To provide information to Tribes, Tribal members, other Federal agencies and the public regarding Self-Governance and other Self-Determination issues. To work with tribes and BIA area offices to resolve problems related to implementation of annual funding agreements. 7
8 Funding Agreements Funding Agreements are legally binding and mutually enforceable written agreements negotiated and entered into between a Self-Governance Tribe and BIA. Any provision that the parties mutually agree upon may be included in a Funding Agreement. A Tribe has the option to negotiate a Multi-Year Funding Agreement with a term that exceeds one year. A Tribe may include in its Funding Agreement programs administered by BIA. 8

10 Money through OSG to Tribal Accounts Program Office prepares sub-allotment document (Angela Salazar and Leroy Gishi) ATO signed by Director, Office of Self-Governance (Sharee M. Freeman) and returned to OSG-F Document goes to Budget Execution (BE) BE sub-allots into OSG account (Evelyn Nicholas) Information entered into SGDB by OSG-F and ATO Created Budget Execution notifies OSG Finance (OSG-F) about $ through K800 account folder (Paige Wagner) OSG-F verifies and reconciles the information received through backup information (spreadsheets) ATO scanned to Accounting Staff in Reston, VA (Karen Frejo) Accounting opens line in FFS and informs OSG-F when complete OSG-F prints out P638 screen from FFS Signatures are verified by OSG-F and P638 is faxed to BIA Accounting (Delinda Fisher) Tribe signs P638 and faxes P638 back to OSG-F P638 with ATO attached is faxed to Tribe 10
11 Money through OSG to Tribe Account BIA Accounting verifies P638 to ensure there is no duplication. (Vendor/Bank information is correct) Accounting downloads all transactions to be processed. Reports are sent to the Treasury daily. The Treasury deposits $ in the Tribes account usually within two days. 11
