OUTLINE Background: This document is submitted in accordance with 175 EX/Decision 52 in which the Executive Board recommended that the General Conference at its 34th session approve the establishment of a UNESCO observatory on women, sport and physical education. The abovementioned decision also authorized the Director-General to enter into a cooperation agreement with the observatory, as appropriate. Purpose: This document contains in Annex I, II and III respectively document 175 EX/47, 175 EX/Decision 52 and the draft agreement between UNESCO and the Greek Government and it is submitted to the General Conference for consideration at its 34th session, in accordance with the principles and guidelines regarding the establishment and operation of institutes and centres under the auspices of UNESCO (33 C/Resolution 90). Decision required: paragraph The proposal to establish the observatory on women, sport and physical education is submitted to the General Conference at its 34th session for approval pursuant to 175 EX/Decision 52, in which the Board recommended that the General Conference at its 34th session: approve the establishment of the UNESCO Observatory on Women, Sport and Physical Education; authorize the Director-General to appoint one staff member to the Steering Group of the Observatory;

The observatory had been recommended by MINEPS IV held in Athens in Its primary aim is to study the interest and concern of the international leaders in dealing with the position of women in sport. 3. The nature, role and objectives of the proposed observatory are highlighted in the draft agreement annexed hereto, which has been drafted in accordance with the principles and guidelines regarding the establishment and operation of institutes and centres under the auspices of UNESCO (category 2) approved by the General Conference in 33 C/Resolution 90. The budgetary implications and the operations of the observatory are also set out therein. The scope of the observatory is consistent with UNESCO s goals, particularly in regard to the principles on which the Organization bases its action to promote and develop sport and physical education, as set out in its 1978 International Charter of Physical Education and Sport. 4. The purpose of this document is to comply with the principles and guidelines regarding the establishment and operation of UNESCO institutes and centres (category 1) and institutes and centres under the auspices of UNESCO (category 2), in accordance with 33 C/Resolution 90. In that connection, arrangements for the establishment of the observatory are set out in Annex III hereto. 5. As the proposal to establish the observatory states that the observatory should bear UNESCO s name and as this will have legal implications for the Organization, it is desirable that the General Conference approve the Executive Board s recommendation that the observatory be established under the following name: Observatory on Women, Sport and Physical Education. This would make it possible to place the observatory in the most appropriate legal framework, namely, that of institutes and centres under the auspices of UNESCO (category 2). 6. In the light of the foregoing, the General Conference may wish to consider the following draft resolution: The General Conference, 1. Recalling 33 C/Resolution 90 and 175 EX/Decision 52, 2. Having examined document 34 C/18 and the Annexes thereto, 3. Welcomes the proposal of the Government of the Hellenic Republic to establish an observatory on women, sport and physical education under the auspices of UNESCO, which is in conformity with 33 C/Resolution 90 relating to the principles and guidelines for the establishment and functioning of institutes and centres under the auspices of UNESCO (category 2); 4. Approves the establishment of an observatory on women, sport and physical education under the auspices of UNESCO, as recommended by the Executive Board at its 175th session (175 EX/Decision 52); 5. Authorizes the Director-General to sign the corresponding agreement between UNESCO and the Greek Government annexed hereto (Annex III).

3 34 C/18 Annex I ex ANNEX I United Nations Educational, Scientific and Cultural Organization Executive Board Hundred and seventy-fifth session 175 EX/47 PARIS, 25 August 2006 Original: English Item 52 of the provisional agenda PROPOSAL FOR THE ESTABLISHMENT OF A UNESCO OBSERVATORY ON WOMEN, SPORT AND PHYSICAL EDUCATION SUMMARY This item has been included in the provisional agenda of the 175th session of the Executive Board at the request of the Government of Greece. Following the initial proposal by the Government of Greece to establish a UNESCO Observatory on Women, Sport and Physical Education at the Greek Secretariat General of Sport, Ministry of Culture, the Fourth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport (MINEPS IV) held in Athens, in 2004, adopted a recommendation (Rec.1 of Commission III) welcoming the establishment of the Observatory. It further requested that a concrete project be prepared for submission to UNESCO. The Observatory will be financed by the Greek Government, and thus there are no financial implications for UNESCO. An explanatory note, together with a proposed decision, is attached. Decision proposed: paragraph 30.

4 175 EX/47 EXPLANATORY NOTE I. INTRODUCTION 1. It has been widely recognized and emphasized in many international conferences and meetings that sport and physical education play a crucial role in the lives and the development of women and girls, in particular building health, self-esteem and self-confidence, encouraging participation and achievement in education and promoting social cohesion and inclusion in social and community life. 2. Commission III of the Fourth International Conference of Ministers and Senior Officials Responsible for Physical Education and Sport (MINEPS IV) held in Athens, in 2004, discussed the interest and concern of the international leaders in dealing with the position of women in sport and, namely, the lack of a central depositary for documentation relating to women and sport. It also emphasized the need for clear evidence and data to support strategies to increase investment in programmes to promote opportunities for women and girls in sport and physical education. MINEPS IV (Commission III) in its recommendations welcomed the generous offer of the Greek Ministry of Sport to provide the financial and human resources to support the development and maintenance of a web-based observatory on women, sport and physical education, to be established under the aegis of UNESCO and requested that a Steering Group comprised of officials from the Greek Government, UNESCO and representatives of key international bodies with a mandate in women and sport, meet with a view to preparing a concrete project description for presentation to UNESCO. 3. The present document addresses new developments since the recommendation made by MINEPS IV, historic decisive moments for the international movement on women and sport issues that have led to this proposal. Moreover, it includes a summary description of the project proposal. 4. In 1994, an International Conference on Women and Sport was held in Brighton, United Kingdom, which in its declaration, the Brighton Declaration on Women and Sport of 1994, stated that The conference agreed to establish and develop an international women and sport strategy that encompasses all continents. This should be endorsed and supported by governmental and nongovernmental organizations involved in sport development. Such an international strategic approach will enable model programmes and successful developments to be shared among nations and sporting federations, so accelerating the change towards a more equitable sporting culture worldwide. 5. At its 2nd International Conference in Windhoek, Namibia, in 1998, the International Working Group, formed at the Brighton Conference to monitor the implementation of its declaration, emphasized in its Call for Action the necessity to promote and share information about the positive contribution that girls and women s involvement in sport makes, inter alia, to social, health and economic issues. 6. The Greek Government, namely the Secretariat General of Sport, Ministry of Culture, organized under the auspices of UNESCO, in Athens, Greece (August 2001) an international conference entitled The position of Women in the Administration of Sport. This international conference adopted a declaration, the Declaration of Athens, which recommended in collaboration with UNESCO, the setting up of an Observatory whose role will be to track and evaluate the progress made at national and international level on the promotion of women in all areas of sport, and thus marked the beginning of the recognition by UNESCO Member States that

5 175 EX/47 page 2 an Observatory on Women and Sport would address issues raised in a number of other declarations and calls for action. 7. In pursuance of the recommendation of MINEPS IV, the Greek Government organized a Steering Group meeting, from 29 to 31 March 2006, formed by officials of the Greek Government, CIGEPS, UNESCO and representatives of key international bodies in order to develop a concrete project description for submission to UNESCO. 8. In May 2006, the 4th International Working Group World Conference on Women and Sport was held in Kumamoto, Japan. The representative of the Greek Government, member of the CIGEPS, and President of the CIGEPS Working Group on Women and Sport, presented the project concerning the establishment of the UNESCO Observatory on Women, Sport and Physical Education. The international conference, in its final conclusions, supported the establishment of the UNESCO Observatory on Women, Sport and Physical Education. 9. The project drawn up by the Steering Group and the annual budget estimate were officially submitted to the Director-General of UNESCO in June 2006, before being submitted to the Executive Board at its 175th session. 10. In July 2006, the Greek Government, in its answer to the questionnaire relating to the preparation of the Medium-Term Strategy for (34 C/4) and the Draft Programme and Budget for (34 C/5), recommended that the project be made one of UNESCO s flagship projects. The Observatory will contribute greatly to the organization and systematization of existing information and data and will increase progress towards the achievement of the UNESCO goals in this area. The Observatory s innovative character could serve as an exemplary contribution by a Member State to one of UNESCO s aims, namely to raise awareness of the significant benefits of the educational, social and moral values of sport and physical education and their crucial role in achieving the goals of Education for All (EFA) and the Millennium Development Goals (MDGs). II. OVERVIEW OF THE PROPOSAL A. Objectives 11. The general objectives of the Observatory on Women, Sport and Physical Education are: (c) to facilitate the follow-up and concrete implementation of the recommendations of the various international conferences on women and sport; to achieve better synergies with regard to competencies and experiences in this area; to capitalize on common efforts of all actors in sport and physical education in order to harmonize the development of policies and programmes in these areas. 12. The specific objectives are the following: (c) to contribute to greater knowledge and sound decision-making with respect to policies and programmes for women, sport and physical education; to gather, organize, analyse and disseminate worldwide information on women, sport and physical education; to stimulate research in areas where gaps exist;

6 175 EX/47 page 3 (d) to engage those interested in women, sport and physical education in dialogue and debate on current issues. 13. In general, the Observatory on Women, Sport and Physical Education will significantly contribute to the achievement of the United Nations Millennium Development Goals relating to gender equality and the empowerment of women. Its establishment will also mark the European Year of Equal Opportunities for All, in B. Functions and structure 14. Functions: the functions of the UNESCO Observatory on Women, Sport and Physical Education include the gathering, analysis, organization and dissemination of information worldwide on issues relating to women, sport and physical education. The data and information will be collected from both governmental and non-governmental bodies, and from research and university institutions. A database will also be established in this regard and the Observatory will function, among others, as a centre of information exchange. It will therefore ensure more systematic collection of data and support advocacy in these areas. 15. Structure and legal status: The UNESCO Observatory involves governmental and non-governmental stakeholders in the international sport movement interested in the promotion of women in all fields of sport, as well as the National Commissions for UNESCO through the selection of focal points. As mentioned above, it will be developed and maintained with the support of the Secretariat General of Sport of the Hellenic Ministry of Culture. The official seat of the UNESCO Observatory on Women, Sport and Physical Education will be the Secretariat General of Sport of the Hellenic Ministry of Culture, in Athens, Greece (7, Kifissias Avenue, , Athens, Greece). 16. Its structure would comprise: (i) the Head of the Observatory, a senior public servant nominated by the Greek Government who will chair the steering committee; (ii) a Steering Group composed of representatives of the International Working Group (IWG) (one person), European Women and Sport Group (EWS) (one person), UNESCO (two persons: one expert from the Secretariat dealing with women and sport, one representative from CIGEPS) and the Head of the Observatory. The Steering Group should decide on the Observatory policy and develop the best possible ways to receive and disseminate the information with regard to women, sport and physical education. The Steering Group should hold one ordinary meeting in Greece every year. Costs for accommodation, food and travel will be borne by the Secretariat General of Sport of the Greek Government. Extraordinary meetings may take place on the proposal of the Steering Group when deemed necessary in other parts of the world following an invitation of a Member State of UNESCO or an organization contributing to the observatory. In this case the country, or organization, that hosts the extraordinary Steering Group meeting shall cover all accommodation, food and travel expenses for this meeting;

7 175 EX/47 page 4 (iii) the Network of focal points, selected by the National Commissions for UNESCO of each Member State, which will inform on a regular basis the Observatory about the situation and the promotion of women, sport and physical education in the countries; (iv) expert advisers to the Observatory, individuals or organizations such as the International Olympic Committee (IOC), International Council of Sport Science and Physical Education (ICSSPE), International Association of Physical Education and Sport for Girls and Women (IAPESGW), International Council for Health, Physical Education, Recreation, Sport and Dance (ICHPER-SD), Women Sport International (WSI), International Federation of Sport Medicine (IFSM) who would assist the Observatory on various aspects relating to women, sport and physical education; (v) other forms of cooperation and information: scientists or organizations that wish to cooperate with the UNESCO Observatory on Women, Sport and Physical Education in order to exchange their experience, available study results and other valuable knowledge, thus contributing to the aims of the UNESCO Observatory, can contact for this purpose the focal points, the members of the Steering Group or the relevant UNESCO Observatory office in the Secretariat General of Sport, in Greece; (vi) the office staff. 17. Website structure The website and organization of materials will be structured on several levels: (c) (d) by region; by stakeholder; by topic (women in administration, women coaches, research, etc.); by age. C. Results to be achieved 18. The following results would be achieved: - development of policies and programmes on women and sport harmonized; - information on relevant areas gathered, organized, analysed and disseminated worldwide; - research stimulated; - public awareness increased and public opinion engaged; - network of interested stakeholders and partners established; - website established; - information bulletin published; - best practices shared.

The Observatory will work in the following areas: - sport as a tool for women s development; - girls and women and physical education (curricula, teacher training, practising); - women in sport administration; - women as coaches; - women as physical education teachers at school and university levels; - women in research (physical education and sport); - access to and quality of physical education for women, in formal and informal settings; - women and physical education and sport in documents of United Nations agencies; - publications on women and sport; - women in elite sport; - women and health and physical activity. E. Activities 20. Activities will include: (c) (d) (e) (f) (g) (h) online newsletter; development of a database; online forum for discussion on specific topics; announcement of events; production of articles; elaboration of reports; development of brochures promoting the objectives of the Observatory; other activities to be determined. F. Working languages 21. The Observatory s official working languages will be English and French. The website and all electronic and printed information will be available in these two languages. G. Funding 22. The Secretariat General of Sport of the Hellenic Government will ensure the permanent funding of the maintenance and operation (technical costs as well as the human resources cost required for the running of the Observatory), and the cost of hosting the ordinary annual executive steering groups meetings in Greece of the UNESCO Observatory.

The evaluation is planned on three levels, namely the annual reports to be presented to the governing bodies of UNESCO submitted by the Head of the Observatory, the annual internal evaluation undertaken by the Steering Group and the external evaluation. 24. UNESCO may, at any time, and upon due notification to the Observatory, carry out an evaluation of its activities in order to determine: whether the Observatory makes an important contribution to the strategic goals of UNESCO; whether the activities set forth in the plan of the Observatory have been effectively pursued. III. FEASIBILITY OF THE PROJECT SUBMITTED 25. From the previous paragraphs it is clear that the establishment of the Observatory is fully in line with UNESCO s objectives and programmes and will contribute to the improvement of the position of women in all fields of sport and at all levels, as well as to the effective promotion of gender equality and women empowerment. 26. The strong support on a permanent basis of the Greek Government for the establishment of the Observatory is a favourable precondition of sustainability, as is the Government s commitment permanently to support the maintenance and operation of the Observatory, both financially and logistically. 27. The gathering, organization, coordination and dissemination of all information at a common Observatory will contribute concretely to finding the most appropriate solutions to issues of concern to the international movement of women and sport, especially owing to the fact that the information will be derived from all possible governmental, non-governmental, academic and other sources. 28. The risks that UNESCO would incur in the establishment of the Observatory would be quasi inexistent, owing to the full support of the Greek Government in providing an appropriate state-ofthe-art infrastructure and permanent funding for the Observatory. 29. The points mentioned above indicate that the viability of the proposed UNESCO Observatory on Women, Sport and Physical Education is ensured and that UNESCO s governing bodies should give it due consideration. IV. DRAFT DECISION 30. In the light of the above, the Executive Board may wish to adopt a decision along the following lines: The Executive Board, 1. Recalling the importance of dealing with gender equity issues, adequate information and policy in women, sport and physical education matters, as well as the research required for the finding and advancement of solutions relating to those matters in all fields of sport and physical education of UNESCO, 2. Further recalling the recommendations of MINEPS IV,

Welcomes the proposal of the Greek Government to establish a UNESCO Observatory on Women, Sport and Physical Education at the Secretariat General of Sport, Ministry of Culture, in Athens, Greece; 5. 13 34 C/18 Annex III ANNEX III AGREEMENT BETWEEN UNESCO AND THE GOVERNMENT OF THE HELLENIC REPUBLIC on the Observatory on Women, Sport and Physical Education under the auspices of UNESCO The Government of the Hellenic Republic on the one hand, and the Director-General of the United Nations Educational, Scientific and Cultural Organization on the other hand, Having regard to the resolution whereby the General Conference of UNESCO seeks to favour international cooperation in respect of the development and promotion of physical education and sport in conformity with its fields of competence, Considering that the Director-General has been authorized by the General Conference to conclude with the Government of the Hellenic Republic an agreement in conformity with the draft that was submitted to the General Conference concerning the establishment of an Observatory on Women, Sport and Physical Education under the auspices of UNESCO, Desirous of defining the terms and conditions governing the contribution that shall be granted to the said Observatory in this Agreement, Have agreed as follows: ARTICLE I Interpretation 1. In this Agreement, unless the context requires a different meaning, UNESCO means the United Nations Educational, Scientific and Cultural Organization. 2. The Government means the Government of the Hellenic Republic. ARTICLE II Establishment The Government shall agree to take, in the course of the year 2008, any measures that may be required for the setting up and effective and functional establishment, as provided for under this Agreement, of an Observatory on Women, Sport and Physical Education, hereinafter called the Observatory. ARTICLE III Participation 1. The Observatory shall be an autonomous institution at the service of Member States and Associate Members of UNESCO which, by their common interest in the objectives of the Observatory, desire to cooperate with it. 2. Member States of UNESCO wishing to participate in the Observatory s activities, as provided for under this Agreement, shall send the Director-General of UNESCO notification to this effect. The Director-General shall inform the Observatory and the Member States and Associate Members mentioned above of the receipt of such notifications.

14 34 C/18 Annex III page 2 ARTICLE IV Purpose of the Agreement The purpose of this Agreement is to define the terms and conditions governing collaboration between UNESCO and the Government concerned and also the rights and obligations deriving therefrom for the parties. ARTICLE V Juridical personality The Observatory shall enjoy, on the territory of the Hellenic Republic, the personality and legal capacity necessary for the exercise of its functions, in particular the capacity: - to contract; - to institute legal proceedings; - to acquire and dispose of movable and immovable property. ARTICLE VI Constitution The Constitution of the Observatory must include provisions concerning: a legal status granting to the Observatory, under national legislation, the autonomous legal capacity necessary to exercise its functions and to receive subventions, obtain payments for services rendered and carry out the acquisition of all means required; a governing structure for the Observatory allowing UNESCO representation within its governing bodies. ARTICLE VII Functions/objectives 1. The functions/objectives of the Observatory are set out below: The Observatory s general objectives shall be to: (i) (ii) (iii) facilitate the follow-up and concrete implementation of the recommendations of the various international conferences on women and sport; achieve better synergies with regard to competencies and experiences in this area; capitalize on common efforts of all actors in sport and physical education in order to harmonize the development of policies and programmes in these areas. The specific objectives shall be to: (i) (ii) (iii) contribute to greater knowledge and sound decision-making with respect to policies and programmes for women in sport and physical education; gather, organize, analyse and disseminate information worldwide on women, sport and physical education; stimulate research in areas where gaps exist;

In general, the Observatory will contribute significantly to the achievement of the United Nations Millennium Development Goals relating to gender equality and the empowerment of women. 2. The functions of the Observatory include the gathering, analysis, organization and dissemination of information worldwide on issues relating to women, sport and physical education. The data and information will be collected from both governmental and non-governmental bodies and from research and university institutions. A database will also be established and the Observatory will function inter alia as a clearing house. It will therefore ensure more systematic collection of data and will support advocacy in these areas. ARTICLE VIII Operation 1. The Observatory shall call on governmental and non-governmental stakeholders in the international sport movement interested in the promotion of women in all fields of sport, as well as the National Commissions for UNESCO, which will be involved in its activities through focal points selected for that purpose. 2. The Observatory will be established and shall operate with the support of the Secretariat General of Sport of the Hellenic Ministry of Culture where it will have its official headquarters. 3. Its structure shall comprise: the Director of the Observatory, a senior civil servant appointed by the Government; the Steering Committee, as provided for in Article IX below. 4. The network of focal points selected by the National Commissions for UNESCO of each Member State, which will inform the Observatory regularly about the situation and the promotion of women in sport and physical education in various countries. 5. Expert advisers to the Observatory, including organizations such as the International Olympic Committee (IOC), the International Council of Sport Science and Physical Education (ICSSPE), the International Association of Physical Education and Sport for Girls and Women (IAPESGW), the International Council for Health, Physical Education, Recreation, Sport and Dance (ICHPER SD), Women Sport International (WSI) and the International Federation of Sports Medicine (FIMS) will assist it in various issues relating to women, sport and physical education. 6. Other forms of cooperation and information will include cooperation with scientists or organizations that wish to cooperate with the Observatory in order to communicate their experience, available research findings and other valuable knowledge, thus contributing to the achievement of the aims of the Observatory. ARTICLE IX Steering Committee 1. The Observatory s activities will be guided and supervised by a Steering Committee that shall be renewed every two years and shall comprise: a Director appointed by the Government; a representative of the International Working Group (GTI) and of the European Women and Sport Group (GEFS);

16 34 C/18 Annex III page 4 (c) (d) a representative of the Director-General of UNESCO; a representative of the Intergovernmental Committee for Physical Education and Sport (CIGEPS). 2. The Steering Committee shall: (c) adopt the Observatory s medium- and long-term programmes; adopt the Observatory s annual work plan and budget, including the staffing table; examine the annual reports submitted by the Director of the Observatory; (d) issue the rules and regulations and determine the financial, administrative and personnel management procedures of the Observatory; (e) decide on the participation of regional intergovernmental organizations and international organizations in the work of the Observatory. 3. The Steering Committee shall meet in ordinary session at regular intervals, at least once every calendar year; it shall meet in extraordinary session if summoned by the Director of the Observatory, either on his/her own initiative or on that of the Director-General of UNESCO or at the request of two thirds of its members. 4. The Steering Committee shall draw up its own Rules of Procedure. For its first meeting the procedure shall be established by the Government and UNESCO. ARTICLE X Secretariat 1. The Secretariat of the Observatory shall consist of a Director and such staff as is necessary for the proper functioning of the Observatory. 2. The Director shall be appointed by the Government, after consultation with the Director- General of UNESCO. 3. The other members of the Secretariat may comprise: (c) members of UNESCO s staff who are temporarily seconded and made available to the Observatory, as provided for by UNESCO s regulations and by the decisions of its governing bodies; any person appointed by the Director, in accordance with the procedures laid down by the Steering Committee; Government officials who are made available to the Observatory, as provided by Government regulations. The Director shall discharge the following duties: ARTICLE XI Duties of the Director direct the work of the international Observatory in conformity with the programmes and directives established by the Steering Committee;

17 34 C/18 Annex III page 5 (c) (d) (e) propose the draft work plan and budget to be submitted to the Steering Committee for approval; prepare the provisional agenda for the sessions of the Steering Committee and submit to it any proposals that he/she may deem useful for the administration of the Observatory; draw up and submit to the Steering Committee reports on the Observatory s activities; represent the Observatory in law and in all civil acts. ARTICLE XII Contribution of UNESCO 1. UNESCO shall provide assistance in the form of technical and intellectual contribution to the Observatory s activities, in accordance with the strategic goals and objectives of UNESCO. 2. UNESCO shall agree to: - provide the assistance of its experts in the specialized fields of the Observatory; - second members of its staff temporarily. Such secondment may be decided by the Director-General on an exceptional basis if justified by the implementation of a joint activity/project within a priority area as approved by UNESCO s governing bodies; - include the Observatory in various programmes which it implements and in which the Observatory s participation seems necessary to it. 3. In all the cases listed above, this contribution shall be provided for in UNESCO s Programme and Budget. ARTICLE XIII Contribution of the Government 1. The Government shall agree to provide all the resources, either financial or in kind, needed for the administration and proper functioning of the Observatory. 2. The Government shall provide the Observatory with the necessary budget and material resources for its long-term operations. 3. The Government shall bear full responsibility for the maintenance of the premises, the staff s salaries, the operational costs, the activity budget; and the material, human and logistical resources as required under this Agreement. 4. The total annual cost (including all categories of expenditure) for the proper functioning of the Observatory to be borne by the Government will amount to 222,000 in its first year of operation (2008) and to 191,000 in all years thereafter. 5. The Government shall make available to the Observatory the administrative staff necessary for the performance of its functions, as set out in the above provisions. 6. The Observatory s official working languages shall be English and French. The website and all electronic and printed information will be available in these two languages.

18 34 C/18 Annex III page 6 ARTICLE XIV Responsibility As the Observatory is legally separate from UNESCO, the latter shall not be legally responsible for it and shall bear no liabilities of any kind, be they financial or otherwise, with the exception of the provisions expressly laid down in this Agreement. ARTICLE XV Evaluation 1. UNESCO may, at any time, carry out an evaluation of the activities of the Observatory in order to ascertain: - whether the Observatory makes a significant contribution to the strategic goals of UNESCO; - whether the activities effectively pursued by the Observatory are in conformity with those set out in this Agreement. 2. UNESCO undertakes to submit to the Government, at the earliest opportunity, a report on any evaluation. 3. Each of the contracting parties shall reserve the option to denounce this Agreement or to request the amendment of its content, following the results of an evaluation. ARTICLE XVI Use of UNESCO name and logo 1. The Observatory may mention its affiliation with UNESCO. It may therefore use after its title the phrase under the auspices of UNESCO. 2. The Observatory is authorized to use the UNESCO logo or a version thereof on its letterheaded paper and documents in accordance with the conditions established by the governing bodies of UNESCO. ARTICLE XVII Entry into force This Agreement shall enter into force, following its signature by the contracting parties, when they have informed each other in writing that all the formalities required to that effect by the domestic law of the Hellenic Republic and by UNESCO s internal regulations have been completed. The date of receipt of the last notification shall be deemed to be the date of entry into force of this Agreement. ARTICLE XVIII Duration This Agreement is concluded for a period of 10 years as from its entry into force, and may be tacitly renewed. ARTICLE XIX Denunciation 1. Each of the contracting parties shall be entitled to denounce this Agreement unilaterally.

19 34 C/18 Annex III page 7 2. The denunciation shall take effect within 30 days following the date of receipt of the notification sent by one of the contracting parties to the other. ARTICLE XX Revision This Agreement may be revised by written consent between the parties and the revision shall enter into force in accordance with the procedure set forth in Article XVII. ARTICLE XXI Settlement of disputes 1. Any dispute between UNESCO and the Government concerning the interpretation or application of this Agreement, if it is not settled by negotiation or any other appropriate method agreed to by the parties, shall be submitted for final decision to an arbitration tribunal composed of three members, one of whom shall be appointed by a representative of the Government, another by the Director-General of UNESCO, and the third, who shall preside over the tribunal, chosen by these two. If, within a time limit of three months after the date of notification of the arbitration request, the required appointments have not been made, each of the parties may invite the President of the International Court of Justice to make the necessary appointments. 2.
