2 INTRODUCTION The Arab American community has grown significantly in the past ten years, both in size and in political prominence. With a total population of well over three million, Arab Americans are represented at all levels of government, and have played a pivotal role in a number of recent elections. As the world changes drastically around us, it is more important than ever to make our voices heard. The past two years have witnessed inspiring revolutions across the Arab world, and changes and geopolitical dynamic that require an evolving U.S. foreign policy. The Israeli-Palestinian conflict appears further away from a solution than it has been in decades, and civil war continues to tear Syria apart. At home, the government has attempted to balance between our national security and our civil liberties, and has yet to decide on the proper way to reform our immigration system. The coming election will have to address all these questions and more, and your vote may shape the direction of this country for decades to come. We have therefore compiled this Voter Guide to help you to educate yourself before going to the polls. It contains a brief overview of many of the key issues of concern to Arab Americans, detailed descriptions of key races in your state, and important candidate information as well. 3 THE ISSUES Though not comprehensive, this voter guide covers issues of concern to Arab Americans in both domestic and foreign policy. We ve included short summaries of important campaign issues below, as well as profiles of congressional districts with sizable Arab American populations. In addition to voting records, the positions of candidates presented in this publication are also based on responses to AAI s candidate questionnaire, and a wide range of secondary sources. Civil Liberties In the weeks following the tragic events of 9/11, Congress passed the USA PATRIOT Act, an omnibus bill containing numerous provisions that have raised concerns among civil libertarians. AAI has documented the effect of these provisions on Arab Americans and American Muslims, and despite assertions that law enforcement agencies do not engage in racial and ethnic profiling, numerous instances of state and federal profiling have been unearthed in just the last 12 months. Islamophobia In the past decade, many Arab Americans and American Muslims have felt deliberately excluded from American civic, academic, and cultural life. An Islamophobic fringe in the media and even in the halls of government have focused on the fictitious threat of Sharia law overtaking our court system, and have used this to attack Arab American and American Muslim political organizing on issues wholly unrelated to religion or identity. Experts warn that this kind of social marginalization is far more dangerous than the Arab or Muslim community organizing that it aims to attack, because it further alienates, segregates, and excludes this community from political discourse, particularly as this organizing is often concerned with little more than local community issues and standard economic concerns. Immigration Comprehensive Immigration Reform (CIR) refers to the group of proposals for broad changes to current American immigration law, including proposals to increase legal immigration, decrease illegal immigration, and, in some cases, offer a pathway to citizenship for some of the nearly 11 million undocumented men and women in the country today. The Development, Relief, and Education for Alien Minors (or DREAM) Act would provide conditional permanent residency to certain undocumented students of good moral character who (a) arrived in the U.S. illegally as minors, (b) graduated from U.S. high schools, and (c) lived in the country continuously for at least 5 years prior to the bill s enactment. Racial Profiling In 2011, a series of reports published by the Associated Press documented the prevalence of false, biased, and discriminatory resources in law-enforcement training manuals and presentations. Prominent Republicans, Democrats, and senior administration officials were shocked to learn that federal agencies and local police relied on materials that blatantly distorted Arab culture and Islam, and engaged in unconstitutional racial profiling tactics. Investigations revealed that as early as 2002, the NYPD had been conducting secret surveillance of Arab American, American Muslim, Latino, and African-American neighborhoods to monitor community members simple day-to-day lives. To date, these programs have made no demonstrable contribution to national security, but may have undermined the trust that should exist between law enforcement and the communities they serve and protect. Arab Spring In the past year, we witnessed a remarkable and inspiring mobilization of millions of people across the Arab world to demand accountability, transparency, and representation from their governments. Uprisings in North Africa succeeded in toppling three regimes: Tunisia, Libya, and Egypt. In the Middle East, popular demonstrations continue in Syria, Yemen, Bahrain, among others. As this change swept through the region, American policymakers have had to rethink our conventional approach. Going forward, American foreign policy in the Middle East should ensure that we remain on the right side of history, support democracy and development, and ensure that our democratic ideals at home are not contradicted by our policies abroad. Israel/Palestine The past few years have been perilous for the Israeli-Palestinian peace process. Attempts to freeze illegal Israeli settlement construction have been put on hold after President Obama s 6-month moratorium, causing Palestinian leaders to abandon the peace talks entirely. In turn, Palestinian moves toward statehood based on a framework originally put forward by the United States were met with hostility from American officials, and resulted in a complete withdrawal of American funds from UNESCO simply for admitting Palestine as a member. In response to popular pressure, Palestinian officials in the West Bank and Gaza have been attempting to form a unified government and schedule the first elections in over 6 years. The Palestinian Authority has also indicated that it will renew its bid to be accepted as a non-member state at the United Nations, a move that some members of Congress have threatened to block by withholding U.S. aid. 2 Arab American Institute. 4 2012 PRESIDENTIAL CANDIDATE COMPARISON USA PATRIOT Act President Obama believes that the Patriot Act is necessary in dealing with an ongoing terrorist threat. In 2011 he requested a longer extention of the act s provisions to provide certainty and predictability for intelligence agencies. Romney has stated that the most important civil liberty I expect from my government is my right to be kept alive, and believes that surveillance and the Patriot Act are essential to keep America safe. He has also stated his support for enhanced interrogation techniques in a ticking time bomb scenario. Indefinite Detention Obama signed the 2012 National Defense Authorization Act (NDAA), which authorizes the indefinite detention of American citizens, though he initially expressed reservations about its excessive reach. Romney has stated that he would have signed the 2012 NDAA, and said I believe that it is appropriate to have in our nation the capacity to detain people who are threats to this country, who are members of al Qaeda. Immigration Reform Obama has been focusing immigration enforcement efforts on those who endanger our communities, and is de-emphasizing low-priority cases like students, veterans, seniors, and military families, and promised to make bipartisan immigration reform a priority in his second term. Romney believes in both preventing illegal border crossings and making it harder to illegally overstay a visa... We should field enough border patrol agents, complete a high-tech fence, and implement an improved exit-verification system. He has also promised to reallocate green cards to [keep] families under one roof. DREAM Act Islamophobia Racial Profiling Arab Spring Palestine Syria Obama believes that we need to move forward so that we can stop denying citizenship to responsible young people just because they re the children of undocumented immigrants...when we come together as one American family, and we re striving for the same dream. Romney promised that his administration will not revoke 2-year temporary visas for young immigrants who might be covered by the DREAM Act. He has softened his position since December 2011, when he stated that, as president, he would veto the DREAM Act if it came across his desk. All of us have an interest in standing up to [Islamophobia]. Let us remember that Muslims have suffered the most at the hands of extremism. Romney has dismissed the notion that the U.S. is coming under the influence of Shariah, and has said I think people should have the common courtesy and judgment... not to offend other peoples faiths. It s a very bad thing. The Obama administration has chosen not to repeal provisions in the Justice Department that permit racial profiling, and has chosen not to investigate the NYPD s racial profiling program. Romney argues that we must focus on preventing an attack, and preventing an attack means good intelligence work and if it means we have to go to a mosque to wiretap that s where we re gonna go. Obama has said that the United States has supported the forces of change in the Arab World. He described the values of the Arab Spring as not simply American values or Western values they are universal values. Romney believes that the protests that have broken out across the Arab world bespeak a generational yearning for a better life and for human dignity but the ongoing revolution is double edged. He has argued that the United States cannot be neutral about the outcome. Obama believes in a secure, Jewish state of Israel; and an independent, prosperous Palestine understanding that such a peace must come through a just agreement between the parties. He also asked that Jerusalem be reintroduced into the party platform as the designated capital of Israel. Romney has acknowledged the importance of Palestinian statehood and promised to restore our relationship with Israel and stand shoulder to shoulder with our close ally. He has stated that he believes that Jerusalem should be recognized as Israel s capital, and promised to move the U.S. embassy to Jerusalem. Obama agreed that we need to see a cessation of the violence, that a political process has to be created to prevent civil war, and has preferred an approach of support to the opposition and international diplomacy to force the Assad regime to capitulate. Romney recently said that the United States should work with partners to organize and arm Syrian opposition groups, and said he would be ready to take whatever action is necessary [in Syria] to ensure that we do not have any kind of weapon of mass destruction falling into the hands of terrorists. U.S.-Arab Bilateral Relations Obama has advocated fostering stronger diplomatic relations with emerging democracies, and strengthening alliances with key U.S. allies such as Saudi Arabia, Bahrain, Jordan, and others. Romney has expressed concern that, in the Arab World, we are at the mercy of events, rather than shaping events and has argued that to change communities and nations in the Middle East, foreign aid must also play a role. visit for a detailed account of presidential statements on these issues 4 Arab American Institute. 5 KEY SENATE RACE KEY HOUSE RACE Scott Brown (R) vs Elizabeth Warren (D) Race Snapshot The race between Senator Scott Brown and Elizabeth Warren is arguably the highest-profile and most hotly contested Senate race in the country. No Republican seat in the heavily Democratic state of Massachusetts is ever safe, but Senator Scott Brown is popular as a moderate Republican with substantial appeal across the aisle. The seat currently held by Scott Brown holds special symbolic significance for Massachusetts Democrats, as it is the seat of the late Senator Ted Kennedy. Republicans view the seat as central to their ambition of gaining control of the Senate. As is typical of close races, the attacks from both sides have been numerous and negative. Both candidates have led at varying points in the campaign, but never by more than a few points. The race is likely to remain too close to call up until Election Day. Scott Brown (R): Republican Scott Brown ran successfully for the Massachusetts House in Six years later, he won a special election for a state Senate seat vacated by Democrat Cheryl Jacques. Brown s opposition to same-sex marriage helped establish him as one of the most conservative lawmakers in the Massachusetts Senate, where he was one of only five Republicans out of 40 senators. When he launched his bid for the U.S. Senate, Brown was universally viewed as a long shot in a state where Democrats outnumber Republicans 3-to-1 and where a Republican had not been elected to the U.S. Senate since He ultimately won 52%-47%, ending the Democrats 60-vote supermajority in the Senate. Brown became a key Senator in the remaining months of the 111th Congress. He voted with Republicans on most issues, but also voted to repeal the ban on gays in the military. In 2010, Brown voted for the financial industry regulation bill after securing a provision exempting Massachusetts mutual funds and insurance companies from a rule barring financial institutions from owning private equity funds. Brown came out against a recess appointment for Elizabeth Warren, who is now his opponent, as the new head of the independent Bureau of Consumer Financial Protection. Brown also opposed the DREAM Act, which would have provided a path to citizenship for undocumented children after completion of a college degree or military service. Elizabeth Warren (D): Harvard professor Elizabeth Warren rose to prominence as an advocate for consumer financial protection in the wake of the financial crisis. TIME magazine has called her a New Sheriff of Wall Street and has twice included her among America s 100 most influential people. In the aftermath of the 2008 financial crisis, Warren served as Chair of the Congressional Oversight Panel for the Troubled Asset Relief Program (TARP). Her efforts to protect taxpayers, to hold Wall Street accountable, and to ensure tough oversight of both the Bush and Obama Administrations won praise from both sides of the aisle. She is widely credited for the creation of the Consumer Financial Protection Bureau. She led the establishment of the agency, building the structure and organization to hold accountable even trillion-dollar financial institutions and to protect consumers from financial tricks and traps often hidden in mortgages, credit cards, and other financial products. In an attempt to boost her candidacy, Warren was given a primetime speaking slot at the 2012 Democratic National Convention, immediately before Bill Clinton on the evening of September 5, Warren positioned herself as a champion of a beleaguered middle class that has been chipped, squeezed and hammered. 6th Congressional District: John Tierney (D) vs Richard Tisei (R) Race Snapshot Massachusetts s 6th congressional district is in northeastern Massachusetts, and contains most of Essex County, including the North Shore and Cape Ann. It is currently represented by John F. Tierney, who has represented the district since January Once thought to be a safe seat, Rep. John Tierney is scrambling after his wife and brother-in-law were embroiled in a gambling scandal that put them both in jail. Republicans have identified Tierney s seat as one of their top targets this election. Former state Sen. Richard Tisei has been polling close to Tierney despite low name recognition. Tisei stands a reasonably good chance of winning the formerly safe Democratic seat, as there are a large number of undecided voters and Democratic voters seem relatively uncommitted to Tierney s candidacy. John Tierney (D): John Tierney first ran for Congress in 1994 but was unsuccessful. In 1996, Tierney ran again and was elected in one of the year s closest races. This election will be the toughest challenge Tierney has faced since first being elected to Congress, against an embattled incumbent plagued by scandal. Now Rep. Tierney finds himself in the reverse position. In the House, Tierney has been an ally of labor unions on the Education and Labor Committee and a consistently liberal vote. His work on that panel has included support for alternative paths to teaching, gang- and drug-free schools, and vocational education. In the 2008 higher education bill, Tierney won an amendment to penalize states that fail to meet budget benchmarks for college aid. He has unsuccessfully sought for years to advance his sweeping Clean Money, Clean Elections legislation, which would require public financing of elections and free broadcast time for candidates. In the 111th Congress ( ), Tierney became the chairman of the National Security and Foreign Affairs Subcommittee of the Oversight and Government Reform Committee, where he has joined Senate Foreign Relations Chairman John Kerry in calling for tighter controls on U.S. aid to Pakistan. Tierney s panel issued a littlenoticed but scathing report in 2010 about the use of Afghan warlords to safeguard shipments of supplies to U.S. and NATO troops. While in this role, Tierney supported several pieces of legislation urging for humanitarian assistance to Gaza as well as support for the Palestinian economy. Tierney also voted against the extension of the key provisions of the Patriot Act. Richard Tisei (R): Richard Tisei was the youngest Republican ever elected to the Massachusetts House of Representatives. He has been recognized as a steadfast advocate for children, the disabled, and senior citizens. He s won Legislator of the Year awards from such groups as the National Alliance for the Mentally-Ill (Massachusetts), the Massachusetts Silver-Haired Legislature, the Massachusetts Council of Human Service Providers, the Mystic Valley Elder Services, and the YMCAs of Massachusetts among others. In 2009, he was awarded the Housing Families 2009 Community Hero Award for his advocacy on behalf of homeless families. In 2010, Republican gubernatorial candidate Charlie Baker named Richard as his running mate and he was confirmed unanimously by delegates at the 2010 Republican State Convention as the candidate for Lieutenant Governor. A self-described nontraditional Republican, Tisei is openly gay and takes a libertarian approach to social issues. On the civil liberties front, Tisei is perhaps best known for his support of protecting whistleblowers. He sponsored the 1993 Welfare Reform Law and the Whistleblower Protection Law, which was a landmark in the safeguarding workers from retaliation by employers for reporting abuse or unsafe working conditions. 6 Arab American Institute. 6 STATE ELECTION INFORMATION STATE ELECTION INFORMATION ELECTIONS General Election Tuesday, November 6, 2012 Polls OPEN at 7:00 AM and CLOSE at 8:00 PM. DEADLINES General Election The last day to register to vote is Wednesday, October 17, 2012 (20 days before the election). Make sure all applications mailed in will be postmarked before this day. Absentee Registration The ballot may be mailed or hand-delivered to the election station but it must arrive before the close of polls on Monday, November 6, 2012 at 8 PM. AT THE POLLS ID Requirements If an individual registered to vote by mail on or after January 1, 2003, they will be required to show identification when he or she votes for the first time in a federal election since registering by mail in 2003 if they did not send in a copy of their identification with their mail-in voter registration form. Acceptable identification must include a voter s name and the address at which they are registered to vote. For example, a voter may use a current and valid driver s license, photo identification, current utility bill, bank statement, paycheck, government check, or other government document showing their name and address. Registration for Groups with Special Needs Disabled Voters and Non-English Speaking Voters A voter who informs the warden that they are unable to prepare their ballot or register their vote due to blindness or other physical disability or inability to read or to read in the English language is entitled to receive assistance to do so. The voter may designate a person of their choice to assist them. Alternatively, the voter can request that two election officers, one from each major party, accompany them into the voting booth to assist them in completing their ballot. If a voter is permanently disabled the doctor must state that he or she is permanently unable to cast their ballot at the polling place due to a physical disability. The voter must apply to their local election office to vote from home and file a letter from his or her doctor with the town or city clerk or election commission. The local election official will automatically mail the voter an application for an absentee ballot for all elections in a calendar year. The voter must sign the application and send it back to his or her local election official. Campaigning and the Polls Massachusetts Law prohibits campaigning within 150 feet of a polling location. This includes but is not limited to: the posting, exhibition, circulation, or distribution of material--including posters, stickers, posters, cards, handbills, placards, pictures or circulars--intended to influence the action of the voter. A person standing within 150 feet of a polling location, including observers in the polling location, may not: hold any campaign sign; hand any person literature intended to influence the voter s action at the polls; wear any campaign buttons or identifying signage; solicit a person s vote for or against a candidate or question on the ballot; or, distribute stickers. Circulators of nomination papers, initiative and referenda petitions are also restricted from soliciting signatures within 150 feet of a building entrance door to a polling place. This is true even where the nomination papers, initiative petition or referendum have nothing to do with the current election. The law, however, does not limit the voter themselves from bringing material into the voting booth. They can bring preprinted brochures or pamphlets, or their own notes. The voter may also bring with them a sticker, handed to them on their way into the polls by one of the write-in candidates, to affix to the ballot. However, there are criminal penalties for exhibiting such materials. Accordingly, voters should not display campaign literature while in the polling location. Additionally, it is incumbent on the election officers to check the voting booths regularly to see that no one has left any materials behind. Representatives of the news media shall be allowed to enter, remain within and leave any polling place or restricted area surrounding any polling place to observe the election, provided any such representative who in any way interferes with the orderly process of voting shall be evicted by the moderator. Any person who violates any provision of this section or, while the polls are open for voting, removes or injures any such distance marker, shall be fined not more than fifty dollars or imprisoned not more than three months or both. Working at the Polls: Poll Watchers and Poll Workers Poll Watchers Any citizen may go to a polling place and observe. The poll watcher watches to see if any violations of the election laws occur. If such a violation occurs, the poll watcher is to inform the election board of the violation. The election board consists of the poll workers. Uniformed law enforcement officers are not allowed to be poll watchers. They cannot use the poll workers supplies. The poll watcher may not interfere with or impede the conduct of any election. He/she should come no closer to the official table or the voting booths than is reasonably necessary. Unless there is an observation of questionable nature, the poll watcher is not permitted to speak to the election board or voter. Individuals in Nursing Homes or Health Care Facilities Any patient in a nursing home must be a registered voter in order to vote by absentee ballot and must fill out an absentee ballot application. The individual must not be under a court ordered guardianship which specifically prohibits voting. If the clerk designates a health care facility in writing 28 days before the election, the ballot must be hand-delivered to such facility by a Registrar. If the patient states that he/she has entered a hospital after noon of the fifth day before the election, the ballot may be hand-delivered to the voter; otherwise, the ballot should be mailed to the voter at the facility. 7 STATE CONTACT INFORMATION What poll watchers may do: The first poll watcher of the Election Day has the right to see that the ballot box is empty before the first ballot is cast. A poll watcher may observe the distribution of the ballot to the voter and after the voter has voted the depositing of ballot into the ballot box. If the poll watcher observes what he thinks might be a violation, he/she may question a voter s privilege by stating his/her case to the election board. Remember, the election board consists of the poll workers at that precinct. The poll watcher may observe the closing procedures when the polls close. A poll watcher is not allowed to talk to any person in the polling place except when questioning a procedure. No poll watcher may wear anything advertising a candidacy or promoting for or against an issue. Poll watchers are official observers only. They may observe the conduct of the election before, during and after the polls close. The election board is the sole authority in the polling place on Election Day. No person, except the board, may handle or touch election supplies and materials. If the poll watcher feels that a violation has taken place during an election, the poll watcher must notify the election board. Electioneering, campaigning or solicitation within 100 feet of the entrance to the polling room is prohibited. Poll Workers The law requires that everyone who works in a polling place of Election Date receive training, including instruction on the rights of voters with disabilities. Also, a poll worker shall be a voter of the state and the poll worker may serve only in the precinct for which his or her appointment is received. Furthermore, a student may be appointed as a poll worker. However, an elections official may appoint not more than five students per precinct to serve under the direct supervision of precinct board members designated by the elections official Poll workers also learn about issues confronting voters who have disabilities, including access barriers and the need to make reasonable modification of policies and procedures to allow equals access to vote.
