The information in this note is subject to change and will be updated as necessary. 2

4 1. PURPOSE This information note provides general (administration and logistics) information about APEC Capacity Building Workshop on Trade Remedies: Rules and Practices under the WTO and FTAs/RTAs to be held in Seoul, Korea from June 22 to 23, BACKGROUND One of the biggest challenges for the realization of the Free Trade Area of the Asia-Pacific (FTAAP) is the widening gap among the APEC member economies in terms of FTA capabilities. To fill this gap, since the inception of the CBNI in 2012, eight economies have organized twenty-one workshops until now and another five workshops are scheduled this year. In 2014, to maintain and utilize the momentum created in the first phase of the initiative, the APEC Leaders endorsed the Action Plan Framework for the second CBNI. The proposed workshop is designed as a part of the programs being pursued under the 2nd CBNI in the areas of trade remedies such as anti-dumping, safeguards and countervailing measures. With the rapid increase in newly adopted anti-dumping measures and other trade remedies around the world (119 cases in 2011 to 209 in 2015, WTO Statistics), trade remedies are becoming one of the key areas which require today s FTA/RTA negotiators to be wellequipped with a high level of knowledge and experience. 3. OBJECTIVES This workshop will help the capacity building of government officials who are directly involved in FTA/RTA negotiations as well as trade policy makers. The participants will also have the opportunity to share their hands-on experiences and difficulties they have encountered during negotiations and consultations with their respective stakeholders, private and/or governmental. In addition, experts from international organizations, government agencies and academia will be invited to share their knowledge and expertise in this field. The one-and-a-half-day workshop may cover such topics as trade remedy-related rules already set in the WTO and major issues in dispute settlement cases of the WTO as well as trade remedy chapters of FTAs/RTAs. Also, more detailed presentations and discussions on trade remedy measures and rules will be conducted. For more interactive discussions, participants will be encouraged to share their own experiences. 4. PARTICIPANTS FTA negotiators and trade policy makers of APEC member economies are invited to 3

5 participate. Financial support will be offered to two participant(s) from the 11 travel-eligible economies. Participants from other APEC economies are also welcome on a self-funded basis. Participants from non-member economies are restricted on this meeting. 5. MEETING DATES AND VENUE The workshop will be held in Seoul and will start on June 22 and will conclude on June 23. The venue is the Novotel Seoul Ambassador Gangnam.. 6. PROGRAM AND LANGUATE The program is included in Annex I. English is the working language of the workshop. No interpretation will be provided. 7. 6 9. VISA REQUIREMENTS All participants are required to possess valid passports to enter the Republic of Korea. Participants are responsible for arranging their visas, if required. Please contact your local Embassy or Consulate General of the Republic of Korea for more information regarding Korea visas. 10. You may take airport limousine bus, subway, and taxi. 1) Airport Limousine Bus You may get information on limousine buses and purchase tickets at the Transportation Information Counter (near the exit No. 2, 4, 9, and 13) on the arrival floor (1fl.) of passenger terminal at Incheon Int l Airport. All limousine buses operate between the hours 05:15 and 21:00 to major hotels. KAL Limousine (recommended) - Get on the bus at exit 4B, 11A on the 1st floor of Incheon International Airport - Board KAL Limousine 3A Line(#6703) and get off in front of the Novotel Ambassador Gangnam - Travel Time: 70 min. / Interval: 30~40 min. / Fare: KRW16,000(USD15) 2) AREX / Subway - Travel time: 1hr - Get on the AREX at Incheon airport, transfer at Gimpo airport station to Line 9, get off at Shinnonhyun station (exit4) which is 5 minute away from the hotel. 5

7 3) Taxi Taxi stands are easily found outside the airport. There are 3 types : General taxis, Deluxe taxis, and Van taxis. The basic fare for general is KRW 3,000. (From Inchon airport to Novotel hotel with general taxis : approx.. KRW 70,000~90,000 / The other two are more expensive.) 4) Hotel Pick-up Service You are required to make a reservation in advance for the hotel pick-up service. The price is KRW 130,000 for one-way from Airport to the Hotel and 130,000 KRW from Hotel to Airport. Reservation inquiries directly to the hotel: / novogres@ambatel.com 12. EXPENSES AND ALLOWANCE Financial support will be offered to two participants from the 11 travel-eligible economies for the round trip economy class airfare and per diem including accommodation for 3 nights in accordance with the APEC guidelines. (The 11 travel-eligible APEC economies are Chile, China, Indonesia, Malaysia, Mexico, Papua New Guinea, the Philippines, Peru, Russia, Thailand, and Viet Nam.) If a travel-eligible economy wishes to send more than two participants, the expenses for additional participants will be borne by the participants economy. Participants from other APEC economies are welcome on a self-funded basis. MOFA will offer the economy class round-trip airfare for the most direct and economical to the participant(s) from travel-eligible economies who wish to seek financial support for their travel expenses (airfare and per diem including accommodation for 3 nights). MOFA funded participants and speakers assume responsibility for other expenses and shall make their own arrangements for any other financial matters of private nature. At the same time, these participants are required to strictly follow the entire schedule and guidelines of APEC. Please note that all speakers and travelers need to sign a per diem form at the end of the workshop. The form will be one of the supporting documents for the attendance of speakers and participants. Per diem will be wire transferred after the workshop. The organizer will NOT be indemnified or liable for any medical expenses, accidents, disabilities or loss of life. Participants are advised to make their own insurance arrangements. 13. EVALUATION Participants are required to complete and return the satisfaction questionnaire form at the end of the workshop. In the evaluation form, each participant is encouraged to discuss the benefits of the seminar and provide suggestions for future CBNI programs. 6

We cordially invite all of you to this dinner. Weather The climate of Seoul, Korea in June is hot and humid with the average temperatures ranging from 18 C to 28 C over the course of the month. For more information on weather, please visit below website. Credit Card & ATMs Visa, American Express, Diners Club, Master Card and other major credit cards are accepted in Korea. Cash withdrawal is also available at select bank machines. Cards with the Plus and Cirrus logos are the easiest to use and most widely accepted in Korea. Some ATMs accept most major international bank cards, such as Maestro, Citibank, Citicard, Electron, JCB and others. Most ATM/bank machines operate 24 hours a day, while others are open from 8am to midnight. Public Transportation (in Seoul) Seoul has an extensive network of public transportation and taxis. Consistently voted as one of the best in the world for its ease of use, cleanliness, and frequency of service, the Seoul subway system is one of the most efficient ways to travel around the city. Trains run nonstop from approximately 5:30 am until midnight. All subway lines are color coded and stations display signs in Korean, English, and Chinese. 7

9 - Subway: KRW 1,350 basic fare(discounts are given only to those residing in Korea who use T-money) - Taxi: KRW 3,000 basic fare(taxi is charged by the meter and the drivers do not expect to receive a tip.) - Public Bus: KRW 1,150 basic fare(local), KRW 1,950 basic fare(express) * Additional charges apply by car mileage and running time. Electricity and Voltage The standard voltage in Korea is 220 volts. The outlet has two round holes If you do not have a multi-voltage travel adapter, you can borrow one from your hotel s front desk. If you want to buy one in Korea, you can do so at a duty-free shop or convenience stores at Incheon International Airport. The speaker(s) will touch upon the importance of trade remedy rules in international trade law and also highlight the distinctive features and the limitations of trade remedy provisions in FTAs/RTAs. 11 11:15 am 12:30 pm (1 hour 15 mins) Session II: Trade Remedies under the WTO Agreement Speaker - Mr. Johann Human, Director of the Rules Division, the WTO Secretariat - Prof. Jae-Hyoung LEE, Korea University Law School The overall relation between relevant provisions on trade remedy in GATT 1994 and WTO Agreements on trade remedy will be presented in the second session. Subsequently, unlike the following three deep-dive sessions, a comparative analysis of the aforementioned WTO rules on trade remedy and trade remedy chapters in FTAs/RTAs will be discussed as well. Various aspects of trade remedy in the context of WTO discussions will also be explored. Stiefel Center for Trade Policy Studies, CATO Institute The third session will focus on the structure of the Anti-dumping Agreement, details of investigation procedures stipulated in the Agreement, contentious issues related to the Agreement which comes out from the dispute settlement cases in the WTO etc. In addition, various aspects of the anti-dumping provisions in FTAs/RTAs will be presented as well. Presenter will illuminate on the Agreement s structure, investigation procedures in it, debates and controversies over the issues related to the Agreement, and dispute settlement cases of the SCM Agreement. The speaker will also touch upon variations of the SCM provisions in FTAs/RTAs, such as a sequential analysis of SCMs before and after the global financial crisis. The special characteristics of Safeguard as a provisional measure to prevent or remedy injury to domestic industry by foreign products legitimately imported without violation of any trade rules will also be emphasized. Discussions will deal with the following areas concerning the Agreement: overall structure, investigation procedures under the Agreement, controversies over issues related to safeguard measures, and dispute settlement cases of the Safeguard Agreement. The speaker will also present several distinctive features of the safeguard provisions in FTAs/RTAs by country/region.
