1 JOINT PROGRAMMING INITIATIVE ON CULTURAL HERITAGE WORKSHOP: FUNDED RESEARCH PROJECTS PARADE Project HEURIGHT14 Presentation BRUSSELS, FEBRUARY 2017
2 Main themes of the project The Project aims to map how human rights guarantees in relation to cultural heritage are being understood and implemented in the European Union (EU) and in its neighbouring countries. Acknowledging the changing and often contested nature of the right to (access or enjoyment of) cultural heritage it intends to assess how this right s evolving content affects the forms access to, protection and governance of cultural heritage, within the institutional, operational and legal structures of the EU. In particular, it deals with the complex organizational and regulatory frameworks concerned with cultural heritage and human rights in place in the EU Members States, as well as their interaction, cross-fertilization, and possible overlaps.
3 Project participants (and other organizations involved such as government, NGO s) The transnational consortium of the Project comprises three research teams (Poland, the United Kingdom, Italy), associate partners and experts. The consortium is chaired by Dr. Andrzej Jakubowski, the Project Leader (PL), based in Poland, and managed by two other Principal Investigators (PIs): Kristin Hausler (United Kingdom) and Prof. Francesca Fiorentini (Italy). The Project proposal was submitted by the University of Fine Arts in Poznan (Poland), a public (state) Academy of Fine Arts. Associate Partner: Dr. Cynthia Scott, History Department, Claremont Graduate University, California (USA)
4 Project participants (and other organizations involved such as government, NGO s) The Polish research team involves the participation of three different institutions forming a consortium. These comprise the University of Fine Arts in Poznan (institutional PL) and two research centres of the Polish Academy of Sciences in Warsaw: the Institute of Law Studies and the Institute of Art. The British research team is based at the British Institute of International and Comparative Law (BIICL) in London. The Italian research team is established at the Department of Legal Studies, Language, Interpreting and Translation Studies of the University of Trieste.

6 Main goals of the Project The Project s envisaged outcomes will be twofold: 1. a path breaking contribution to an interdisciplinary scholarship in this area, disseminated through various publications (articles, reports, workshops and a monograph); 2. the elaboration of recommendations and guidelines openly accessible via a new online platform concerning best practices on the use of cultural heritage for the benefit of states and communities which all have an intrinsic interest in its protection and enjoyment.

Trieste July 2016; BIICL London Oct. 2016; UAP Poznań Dec. 2016; Guest lectures by the Projects Participants (Rijeka, Piran, Trieste, Istanbul); Participation in international research and intergovernmental conferences by the Projects Participants; Consultation with stakeholders, including UNIDROIT, UNESCO; Development of a new Digitalised Heritage platform comprising photographs of wooden Orthodox and Catholic churches and synagogues, items of rural architecture in Central and Eastern Europe (Institute of Art of the Polish Academy of Sciences in Warsaw).

13 Future activities International Conference: Cultural Heritage in the European Union: Legal Perspectives and Contemporary Challenges, April 2017, Warsaw aimed at debating the research already conducted and preparing the Project s final peer-reviewed monograph. Use of digitalisation online galleries, exhibition, questionnaires and workshop to be held in Autumn 2017, in London. Data-gathering and research. Publication of the EU Law Project Working Papers. Analysis of the implementation of the right to cultural heritage through access and cooperation (including with a workshop on this issue within the UK which will be held in London in Summer 2017). Open call: Intangible Cultural Heritage Successes, Problems and Challenges 10 Years After the Entry into Force of the 2003 UNESCO Convention a joint initiative of the Project s members and Santander Art and Culture Law Review. Final conference to be held in Trieste in Outreach and dissemination of knowledge gathered in the Project. Internal and external networking.
14 How can the results of the project by used by the private sector (SMEs and civil society)? Benefits to the civil society: sharing of knowledge about cultural heritage protection, meaning and access for local communities spread among the borders of a plurality of States, within and without the EU; reconciliation of difficult pasts and alleviation of restitution disputes (especially those difficult to resolve merely on legal terms and procedures) through cooperation and shared access to cultural heritage, including digitalization and photography; Benefits to SMEs: possible collaboration with governments, NGOs, academic community and civil society in the setting up of cultural initiatives aiming at the sharing of, and accessing to the cultural heritage; these initiatives may create jobs and income, and may be beneficial for tourism.
15 How can the results of the project by used by the Policy Makers and Influencers and by the Cultural Heritage Research Community? The publications and the guidelines for policy makers that will be the ultimate results of the project will be useful material for the drafting of new legislation both at the EU and national level, as well as for the design of other policy actions aiming at increasing cultural diversity, cultural heritage protection and access to cultural heritage in the European region and beyond. We believe that such cultural actions will be relevant in the geopolitical relationships of the EU with its neighbouring countries, especially in times of political instability and international terrorism aimed also at the desctruction of cultrual identities throughout the world.
16 Does the project contribute to JPICH Strategic Research Agenda? 1. Developing a reflective society: the world is changing and that research questions, approaches, methods and reporting need to reflect this change. This is also true in the legal analysis of cultural heritage matters and disputes and this Project, by stressing the importance of cooperation and alternative means of addressing restitution disputes goes in this way. 2. Connecting people with heritage. This Project explores the enforcement level of the right to cultural heritage in the EU andf its neighbouring countries as well as new forms of access by addressing themes and issues that enable people and communities to connect with heritage. 3. Creating knowledge. The academic research and discussion in connection with civil society and stakeholders that finds place in this project produces a deepening of our understanding of the context in which cultural heritage exists and is formed, and helps developing innovative approaches, applications and tools that will create added value for culture in society. 4. Safeguarding our cultural heritage resources. This projects adds to this objective by exploring new forms of legal protection of cultural heritage and suggesting policy actions to enhance such protection at EU and national level.
17 Does the project contribute to JPICH Strategic Research Agenda? Enabling framework: 1. The project contributes to the training of joung researchers and researchers at different stages of their carreer, and with different legal area of expertise, so as to reinforce the cultrual heritage legal research in Europe. 2. The project adds to the management strategies involving the adequacy of the institutional and legal infrastructures dealing with cultural heritage protection at EU and national level. 3. The project adds to the knowledge sharing through an organized collaboation among academic communities, NGOs, governments and other stakeholders, the media and local communities about matters related to protection of, and access to cultural heritage. 4. The project contributes to an improving of the legal research infrastructure by linking traditional legal research approaches to digitalization and photography as new and different ways to address participation and access issues, as well as the alternative resolution of restitution disputes. 5. Finally, the projects offrers a substantial controbution to policies, laws and regulations in matters of cultural heritage by resulting in a series of peer reviewed publications, including a mapping out of meaning(s) and forms of protection of cultural heritage in the EU and in the EU's external relations, as well as guidelines for policy makers.
